110STATEMENT OF THE CASE

114On July 18, 2013, Petitioner, Sylvie Simon, individually and

123on behalf of Elijah S. Smith (Elijah), a minor, filed a Petition

135Under Protest Pursuant to Florida Statute Section 766.301 et seq.

145(Petition) with the Division of Administrative Hearings (DOAH)

153for a determination of compensability under the Florida Birth -

163Related Neurological Injury Compensation Plan (Plan). The

170Petition named Cherise Chambers, M.D., and Amanpreet Bhull e r,

180M.D., as the physicians providing obstetrical services at the

189birth of El ijah on May 27, 2011, at Orlando Health, Inc. , d/b/a

202Winnie Palmer Hospital for Women & Babies located in Orlando ,

212Florida.

213DOAH served NICA with a copy of the Petition on July 22,

2252013. DOAH served a copy of the Petition on Winnie Palmer

236Hospital for Wom en & Babies on July 23, 2013.

246On August 12, 2013, Orlando Health, Inc. , d/b/a Winnie

255Palmer Hospital for Women & Babies, Dr. Bhuller, and Dr. Chambers

266filed a Petition to Intervene, which was granted by Order dated

277September 3, 2013.

280On May 1, 2014, NICA filed a Motion for Summary Final Order,

292asserting that Elijah did not sustain a "birth - related

302neurological injury" as that term is defined in section

311766.302(2), Florida Statutes. On May 27, 2014, NICA filed a

321Renewed Motion for Summary Final Order, rep resenting that

330Petitioner and Intervenors had agreed to an order being entered

340granting the Renewed Motion for Summary Final Order.

348FINDINGS OF FACT

3511. Elijah S. Smith was born on May 27, 2011, at Orlando

363Health, Inc. , d/b/a Winnie Palmer Hospital for W omen & Babies in

375Orlando, Florida. Elijah weighed 3,266 grams at birth.

3842. Donald Willis, M.D. (Dr. Willis) , was requested by NICA

394to review the medical records for Elijah, to determine whether an

405injury occurred in the course of labor, delivery, or

414resu scitation in the immediate post - delivery period in the

425hospital due to oxygen deprivation or mechanical injury occurring

434in the course of labor, delivery, or resuscitation in the

444immediate post delivery period. Dr. Willis described his

452findings as follows :

456In summary, labor was complicated by an

463abnormal FHR pattern and a prolonged second

470stage of labor. Cesarean section delivery

476was required. The baby was depressed with

483low Apgar scores at one and five minutes.

491Bag and mask ventilation was required for

498over 5 minutes. Seizure activity developed

504at about 36 hours after birth. EEG and MRI

513were consistent with brain injury.

518The cord pH was just above 7.0. However, no

527base excess was recorded and there was no

535clear identification as to the blood being

542a rterial or venous. Overall, the clinical

549findings are consistent a [sic] birth related

556oxygen deprivation and brain injury. The

562cord blood pH of 7.1 does not alter this

571opinion.

572There was an apparent obstetrical event that

579resulted in loss of oxygen to the babyÓs

587brain during labor, delivery, and continuing

593into the immediate post delivery period. The

600oxygen deprivation resulted in brain injury.

606I am unable to comment about the severity of

615the brain injury.

6183. NICA retained Raymond J. Fernandez, M.D. , a pediatric

627neurologist, to examine Elijah and to review his medical records.

637Dr. Fernandez examined Elijah on April 8, 2014, and gave the

648following opinion:

650There is evidence in the medical record for

658hypoxic ischemic perinatal brain injury, but

664no evi dence at this time for substantial

672motor or mental impairment. ElijahÓs motor

678examination is normal. There is evidence of

685speech delay, but he is improving and I

693expect this trend to continue. Learning

699difficulty in the future is a possibility

706that is i ndeterminate at this time.

7134. A review of the file in this case reveals that there

725have been no expert opinions filed that are contrary to the

736opinions of Dr. Willis and Dr. Fernandez that there was an

747obstetrical event that resulted in loss of oxygen to the brain.

758Their opinions are credited. There are no contrary expert

767opinions filed that are contrary to Dr. FernandezÓs opinion that

777there is no evidence for a substantial motor or mental

787impairment. Dr. FernandezÓs opinion is credited.

793CONCLUSIONS OF LAW

7965. The Division of Administrative Hearings has jurisdiction

804over the parties to and the subject matter of these proceedings.

815§§ 766.301 - 766.316, Fla. Stat.

8216. The Plan was established by the Legislature "for the

831purpose of providing compensation, irrespective of fault, for

839birth - related neurological injury claims" relating to births

848occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8597. The injured infant, her or his personal representative,

868parents, dependents, and next of kin may s eek compensation under

879the Plan by filing a claim for compensation with DOAH.

889§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

897which administers the Plan, has "45 days from the date of service

909of a complete claim . . . in which to file a response to the

924petition and to submit relevant written information relating to

933the issue of whether the injury is a birth - related neurological

945injury." § 766.305(4), Fla. Stat.

9508. If NICA determines that the injury alleged in a claim is

962a compensable birth - related neurological injury, it may award

972compensation to the claimant, provided that the award is approved

982by the administrative law judge to whom the claim has been

993assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1004disputes the clai m, as it has in the instant case, the dispute

1017must be resolved by the assigned administrative law judge in

1027accordance with the provisions of chapter 120, Florida Statutes.

1036§§ 766.304, 766.309, and 766.31, Fla. Stat.

10439. In discharging this responsibility , the Administrative

1050Law Judge must make the following determination based upon the

1060available evidence:

1062(a) Whether the injury claimed is a birth -

1071related neurological injury. If the claimant

1077has demonstrated, to the satisfaction of the

1084administrative law judge, that the infant has

1091sustained a brain or spinal cord injury

1098caused by oxygen deprivation or mechanical

1104injury and that the infant was thereby

1111rendered permanently and substantially

1115mentally and physically impaired, a

1120rebuttable presumption shall ar ise that the

1127injury is a birth - related neurological injury

1135as defined in s. 766.303(2).

1140(b) Whether obstetrical services were

1145delivered by a participating physician in the

1152course of labor, delivery, or resuscitation

1158in the immediate postdelivery period in a

1165hospital; or by a certified nurse midwife in

1173a teaching hospital supervised by a

1179participating physician in the course of

1185labor, delivery, or resuscitation in the

1191immediate postdelivery period in a hospital.

1197§ 766.309(1), Fla. Stat. An award may be sustained only if the

1209administrative law judge concludes that the "infant has sustained

1218a birth - related neurological injury and that obstetrical services

1228were delivered by a participating physician at birth."

1236§ 766.31(1), Fla. Stat.

124010. The term "birth - related neurological injury" is defined

1250in section 766.302(2) as follows:

"1255Birth - related neurological injury" means

1261injury to the brain or spinal cord of a live

1271infant weighing at least 2,500 grams for a

1280single gestation or, in the case of a

1288multiple ges tation, a live infant weighing at

1296least 2,000 grams at birth caused by oxygen

1305deprivation or mechanical injury occurring in

1311the course of labor, delivery, or

1317resuscitation in the immediate postdelivery

1322period in a hospital, which renders the

1329infant permane ntly and substantially mentally

1335and physically impaired.

133811. The evidence, which is not refuted, established that

1347Elijah did sustain an injury to the brain caused by oxygen

1358deprivation occurring in the course of labor, delivery, and

1367resuscitation in the immediate post - delivery period in a

1377hospital. The evidence does not establish that the brain injury

1387resulted in permanent and substantial mental and physical

1395impairments. Therefore, Elijah is not eligible for benefits

1403under the Plan.

1406CONCLUSION

1407Based u pon the foregoing Findings of Fact and Conclusions of

1418Law, it is ORDERED that the Petition filed by Sylvie Simon,

1429individually and on behalf of Elijah S. Smith, is dismissed with

1440prejudice.
