90STATEMENT OF THE CASE

94On July 15, 2013, Petitioner, Nathalie Jorge, on behalf of

104and as parent and natural guardian of Yancel Peraza (Yancel), a

115minor, filed a Petition for Benefits Pursuant to Florida Statute

125Section 766.301 et se q . (Petition) with the Division of

136Administrative Hearings (DOAH) for compensation under the Florida

144Birth - Related Neurological Injury Compensa tion Plan (Plan). The

154Petition named Jorge Londoño, M.D., as the physician providing

163obstetric services at the birth of Yancel at Winnie Palmer

173Hospital in Orlando, Florida.

177DOAH served NICA with a copy of the Petition on July 30,

1892013. DOAH served a cop y of the Petition on Winnie Palmer

201Hospital on July 31, 2013. DOAH served a copy of the Petition on

214Dr. Londoño on August 7, 2013.

220On August 23, 2013, Dr. Londoño and Orlando Health, Inc. ,

230d/b/a Winnie Palmer Hospital filed a petition for leave to

240interve ne, which was granted by Order dated September 10, 2013.

251On February 3, 2014, NICA filed a Motion for Summary Final

262Order, asserting that Yancel did not sustain a "birth - related

273neurological injury" as that term is defined in section

282766.302(2), Florida St atutes. NICA represented in the motion

291that counsel for Petitioner and counsel for Intervenors were

300contacted and had no objection to the granting of the motion.

311FINDINGS OF FACT

3141. Yancel Peraza was born on April 1, 2009, at Winnie

325Palmer Hospital in O rlando, Florida. Yancel weighed 3,525 grams

336at birth.

3382. Donald Willis, M.D. (Dr. Willis), was requested by NICA

348to review the medical records for Yancel. In a medical report

359dated November 27, 2013, Dr. Willis opined the following:

368The newborn was not depressed. Apgar scores

375were 8/9. No cord blood gas was done. No

384resuscitation was required after birth. The

390baby had a weak right arm and some mild

399respiratory distress with grunting and

404flaring. The respiratory distress resolved

409shortly after birth.

412Neurology consultation was obtained at one

418day of age for evaluation of a weak right

427arm. ErbÓs palsy was suspected. New born

434hospital course was otherwise uncomplicated.

439The baby was discharged home two days after

447birth with Neurology follow - up sched uled for

456reevaluation of the weak right arm.

462There was no apparent obstetrical event that

469resulted in loss of oxygen or mechanical

476trauma to the babyÓs brain or spinal cord

484during labor, delivery, or the immediate post

491delivery period. The baby did have a

498brachial plexus injury, but no damage to the

506spinal cord.

5083. NICA retained Michael S. Duchowny, M.D. , to perform an

518independent medical examination of Yancel. Dr. Duchowny examined

526Yancel on September 25, 2013. In a medical report dated

536September 25, 2013, Dr. Duchowny reported his findings and gave

546the following opinion:

549In summary, YancelÓs neurologic examination

554is significant for a right ErbÓs (upper

561brachial plexus) palsy involving the C5 and

568C6 dermatomes. He has a preserved individual

575finger d exterity and fine motor coordination

582but is mechanically limited by a fixed elbow

590contracture on the right. In contrast, there

597are no other significant findings on the

604neurologic examination.

606Despite the absence of supplementary medical

612records, YancelÓs neurological examination

616today that is consistent with an ErbÓs palsy

624of the upper cervical nerve roots

630anatomically places his deficit outside the

636central nervous system (brain and spinal

642cord). For this reason, I do not believe

650that Yancel should be co nsidered for

657compensation within the NICA program.

6624. A review of the file does not show any contrary opinion,

674and Petitioner and Intervenors have no objection to the issuance

684of a summary final order finding that the injury is not

695compensable under Plan . The opinion of Dr. Willis that Yancel

706did not suffer a neurological injury due to oxygen deprivation or

717mechanical injury during labor, delivery, or resuscitation in the

726immediate postdelivery period is credited. The opinion of Dr.

735Duchowny that Yancel has ErbÓs palsy, which is outside the

745central nervous system, meaning that the injury does not involve

755the brain or spinal cord, is credited.

762CONCLUSIONS OF LAW

7655. The Division of Administrative Hearings has jurisdiction

773over the parties to and the subj ect matter of these proceedings.

785§§ 766.301 - 766.316, Fla. Stat.

7916. The Plan was established by the Legislature "for the

801purpose of providing compensation, irrespective of fault, for

809birth - related neurological injury claims" relating to births

818occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8297. The injured infant, her or his personal representative,

838parents, dependents, and next of kin may seek compensation under

848the Plan by filing a claim for compensation with DOAH.

858§§ 766.302(3) , 766.303(2), and 766.305(1), Fla. Stat. NICA,

866which administers the Plan, has "45 days from the date of service

878of a complete claim . . . in which to file a response to the

893petition and to submit relevant written information relating to

902the issue of whet her the injury is a birth - related neurological

915injury." § 766.305(4), Fla. Stat.

9208. If NICA determines that the injury alleged in a claim is

932a compensable birth - related neurological injury, it may award

942compensation to the claimant, provided that the aw ard is approved

953by the administrative law judge to whom the claim has been

964assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

975disputes the claim, as it has in the instant case, the dispute

987must be resolved by the assigned administrative law j udge in

998accordance with the provisions of chapter 120, Florida Statutes.

1007§§ 766.304, 766.309, and 766.31, Fla. Stat.

10149. In discharging this responsibility, the Administrative

1021Law Judge must make the following determination based upon the

1031available evide nce:

1034(a) Whether the injury claimed is a birth -

1043related neurological injury. If the claimant

1049has demonstrated, to the satisfaction of the

1056administrative law judge, that the infant has

1063sustained a brain or spinal cord injury

1070caused by oxygen deprivation or mechanical

1076injury and that the infant was thereby

1083rendered permanently and substantially

1087mentally and physically impaired, a

1092rebuttable presumption shall arise that the

1098injury is a birth - related neurological injury

1106as defined in s. 766.303(2).

1111(b) Whe ther obstetrical services were

1117delivered by a participating physician in the

1124course of labor, delivery, or resuscitation

1130in the immediate postdelivery period in a

1137hospital; or by a certified nurse midwife in

1145a teaching hospital supervised by a

1151participatin g physician in the course of

1158labor, delivery, or resuscitation in the

1164immediate postdelivery period in a hospital.

1170§ 766.309(1), Fla. Stat. An award may be sustained only if the

1182administrative law judge concludes that the "infant has sustained

1191a birth - r elated neurological injury and that obstetrical services

1202were delivered by a participating physician at birth."

1210§ 766.31(1), Fla. Stat.

121410. The term "birth - related neurological injury" is defined

1224in section 766.302(2) as follows:

"1229Birth - related neurolo gical injury" means

1236injury to the brain or spinal cord of a live

1246infant weighing at least 2,500 grams for a

1255single gestation or, in the case of a

1263multiple gestation, a live infant weighing at

1270least 2,000 grams at birth caused by oxygen

1279deprivation or mecha nical injury occurring in

1286the course of labor, delivery, or

1292resuscitation in the immediate postdelivery

1297period in a hospital, which renders the

1304infant permanently and substantially mentally

1309and physically impaired.

131211. The evidence, which is not refuted , established that

1321Yancel did not sustain an injury to the brain or spinal cord

1333caused by oxygen deprivation or mechanical injury occurring in

1342the course of labor, delivery, or resuscitation in the immediate

1352postdelivery period in a hospital. Therefore, Y ancel is not

1362eligible for benefits under the Plan.

1368CONCLUSION

1369Based upon the foregoing Findings of Fact and Conclusions of

1379Law, it is ORDERED that the Petition filed by Nathalie Jorge, on

1391behalf of and as parent and natural guardian of Yancel Peraz, is

1403di smissed with prejudice.
