105STATEMENT OF THE CASE

109On Ju ly 16, 2013, Petitioners, Adriana Pillow and

118Cody Pillow, on behalf of and as parents and natural guardians of

130Landon Pillow (Landon), a minor, filed a Petition for Benefits

140Pursuant to Florida Statute Section 766.301 et seq. (Petition)

149with the Division o f Administrative Hearings (DOAH) for a

159determination of compensability under the Florida Birth - Related

168Neurological Injury Compensation Plan (Plan). The Petition named

176Michael B. Cotter, M.D., as the physician providing obstetrical

185services at the birth o f Landon on November 29, 2010, at North

198Florida Regional Medical Center located in Gainesville, Florida.

206DOAH served NICA with a copy of the Petition on August 6,

2182013. DOAH served a copy of the Petition on Dr. Cotter on

230August 8, 2013. DOAH served a cop y of the Petition on North

243Florida Regional Medical Center on August 8 , 2013.

251On October 7, 2013, Dr. Cotter and North Florida Woman Care ,

262d/b/a Gainesville OB/GYN filed a Petition for Leave to Intervene,

272which was granted by Order dated October 16, 2013. On

282October 29, 2013, North Florida Regional Medical Center filed an

292Amended Petition to Intervene, which was granted by Order dated

302November 7, 2013.

305On July 7, 2014, NICA filed a Motion for Summary Final

316Order, asserting that Landon did not sustain a "b irth - related

328neurological injury" as that term is defined in section

337766.302(2), Florida Statutes. On June 12, 2014, North Florida

346Regional Medical Center filed a Response to Order dated May 21,

3572014, and stated that it did not take a formal position with

369regard to NICAÓs position that the claim was not compensable. On

380June 4, 2014, Petitioners filed a Response to Order dated May 21,

3922014, stating that Petitioners did not see a need for a hearing

404to determine whether the claim was compensable and waived a

414hearing on whether the claim was compensable.

421The Motion for Summary Final Order was served by electronic

431mail on July 4 , 2014. Other than the responses to the Order

443dated May 21, 2014, requiring the parties to advise the

453undersigned of hearing dates f or a final hearing, none of the

465parties have filed a response to the Motion for Summary Final

476Order.

477FINDINGS OF FACT

4801. Landon Pillow was born on November 29, 2010, at North

491Florida Regional Medical Center in Gainesville, Florida. Landon

499weighed 3,500 grams at birth.

5052. Donald Willis, M.D. (Dr. Willis), was requested by NICA

515to review the medical records for Landon, to determine whether an

526injury occurred in the course of labor, delivery, or

535resuscitation in the immediate post - delivery period in the

545ho spital due to oxygen deprivation or mechanical injury occurring

555in the course of labor, delivery, or resuscitation in the

565immediate post - delivery period. Dr. Willis described his

574findings as follows:

577In summary, there was a non - reassuring FHR

586pattern duri ng labor. It is unlikely this

594resulted in any significant oxygen

599deprivation to the fetus, based on a cord

607blood gas pH > 7.0 and a normal newborn

616hospital course. Babies with birth related

622hypoxic brain injury will generally have

628multi - organ failures du ring the newborn

636period.

637There was no apparent obstetrical event that

644resulted in loss of oxygen or mechanical

651trauma to the babyÓs brain during labor,

658delivery or the immediate post delivery

664period.

6653. Dr. Willis reviewed additional medical records on

673January 16, 2014, and, based on his review of those records,

684opined as follows:

687The additional records do not change any of

695my opinions concerning this case. The child

702suffered a brain injury, but the etiology is

710still undetermined. Based on the cord b lood

718gas pH > 7 and a normal newborn hospital

727course after delivery, it does not seem

734reasonable to time the brain insult as birth

742related.

7434. NICA retained Michael S. Duchowny, M.D., to examine

752Landon and to review his medical records. Dr. Duchowny exa mined

763Landon on April 30, 2014, and gave the following opinion:

773In summary, LandonÓs neurological examination

778today was extremely limited because of his

785postictal state. However, there were no

791specific focal or lateralizing findings

796despite the history of a left hemisphere

803infarct and porencephalic cavity.

807A review of medical records sent on

814February 26, 2014 confirms the history

820obtained today which revealed no evidence of

827a neurological injury to the brain or spinal

835cord due to oxygen deprivation or mec hanical

843injury in the course of labor, delivery, or

851the immediate postnatal period. LandonÓs

856cord blood pH was 7.25 and the base excess

865was - 4. Both values are near - normal.

874Although the neurological examination was

879suboptimal, the history obtained today from

885the family and from medical records indicate

892that LandonÓs neurological impairment was

897acquired prenatally. I therefore believe

902that he should not be considered for

909compensation within the NICA program.

9145. A review of the file in this case revea ls that there

927have been no expert opinions filed that are contrary to the

938opinions of Dr. Willis and Dr. Duchowny that there was no

949obstetrical event that resulted in injury to the brain or spinal

960cord due to oxygen deprivation or mechanical injury during labor,

970delivery or the immediate post - delivery period. Their opinions

980are credited.

982CONCLUSIONS OF LAW

9856. The Division of Administrative Hearings has jurisdiction

993over the parties to and the subject matter of these proceedings.

1004§§ 766.301 - 766.316, Fl a. Stat.

10117. The Plan was established by the Legislature "for the

1021purpose of providing compensation, irrespective of fault, for

1029birth - related neurological injury claims" relating to births

1038occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10498 . The injured infant, her or his personal representative,

1059parents, dependents, and next of kin may seek compensation under

1069the Plan by filing a claim for compensation with DOAH.

1079§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1087which ad ministers the Plan, has "45 days from the date of service

1100of a complete claim . . . in which to file a response to the

1115petition and to submit relevant written information relating to

1124the issue of whether the injury is a birth - related neurological

1136injury." § 766.305(4), Fla. Stat.

11419. If NICA determines that the injury alleged in a claim is

1153a compensable birth - related neurological injury, it may award

1163compensation to the claimant, provided that the award is approved

1173by the administrative law judge to whom the claim has been

1184assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1195disputes the claim, as it has in the instant case, the dispute

1207must be resolved by the assigned administrative law judge in

1217accordance with the provisions of chapter 120, F lorida Statutes.

1227§§ 766.304, 766.309, and 766.31, Fla. Stat.

123410. In discharging this responsibility, the a dministrative

1242l aw j udge must make the following determination based upon the

1254available evidence:

1256(a) Whether the injury claimed is a birth -

1265related neurological injury. If the claimant

1271has demonstrated, to the satisfaction of the

1278administrative law judge, that the infant has

1285sustained a brain or spinal cord injury

1292caused by oxygen deprivation or mechanical

1298injury and that the infant was thereby

1305rend ered permanently and substantially

1310mentally and physically impaired, a

1315rebuttable presumption shall arise that the

1321injury is a birth - related neurological injury

1329as defined in s. 766.303(2).

1334(b) Whether obstetrical services were

1339delivered by a participat ing physician in the

1347course of labor, delivery, or resuscitation

1353in the immediate postdelivery period in a

1360hospital; or by a certified nurse midwife in

1368a teaching hospital supervised by a

1374participating physician in the course of

1380labor, delivery, or resusci tation in the

1387immediate postdelivery period in a hospital.

1393§ 766.309(1), Fla. Stat. An award may be sustained only if the

1405administrative law judge concludes that the "infant has sustained

1414a birth - related neurological injury and that obstetrical services

1424were delivered by a participating physician at birth."

1432§ 766.31(1), Fla. Stat.

143611. The term "birth - related neurological injury" is defined

1446in section 766.302(2) as follows:

"1451Birth - related neurological injury" means

1457injury to the brain or spinal cord o f a live

1468infant weighing at least 2,500 grams for a

1477single gestation or, in the case of a

1485multiple gestation, a live infant weighing at

1492least 2,000 grams at birth caused by oxygen

1501deprivation or mechanical injury occurring in

1507the course of labor, delivery, or

1513resuscitation in the immediate postdelivery

1518period in a hospital, which renders the

1525infant permanently and substantially mentally

1530and physically impaired.

153312. The evidence, which is not refuted, established that

1542Landon did not sustain an injury to t he brain or spinal cord

1555caused by oxygen deprivation or mechanical injury occurring in

1564the course of labor, delivery, and resuscitation in the immediate

1574post - delivery period in a hospital. Therefore, Landon is not

1585eligible for benefits under the Plan.

1591CON CLUSION

1593Based upon the foregoing Findings of Fact and Conclusions of

1603Law, it is ORDERED that the Petition filed by Adriana Pillow and

1615Cody Pillow, on behalf of and as parents and natural guardians of

1627Landon Pillow, is dismissed with prejudice.
