104STATEMENT OF THE ISSUE
108Whether the Pinellas County Sheriff ' s Office (PCSO or
118Petitioner) properly terminated Respondent, Richard Stotts, from
125his employment as a deputy sheriff for engaging in conduct that
136violated Petitioner ' s General Order 3 - 1.1, Rule and Regulation
1485.15, regarding the Custody of Arrestees/Prisoners.
154PRELIMINARY STATEMENT
156O n July 29, 2013, Petitioner terminated Respondent ' s
166employment as a dep uty sheriff. On August 1, Respondent timely
177requested " relief/appeal as set in [sic] forth in General Order
18710 - 3. " Petitioner forwarded the matter to the Division to
198conduct the hearing. The final hearing was noticed for Tuesday,
208October 1, 2013. 1/ On September 25, Respondent filed a Motion to
220Continue, which was denied.
224O n Friday, September 27, Respondent filed an Amended Exhibit
234and Witness List, which prompted Petitioner to file a Motion to
245Strike and Exclude Respondent ' s Amended Witness List and Am ended
257Proposed Exhibit List, and Emergency Motion for a Protective
266Order Regarding Sheriff Gualtieri (motion). Thereafter
272Respondent filed a Renewed Motion for a Continuance and
281Opposition to Petitioner ' s Motion to Strike and Exclude and for a
294Protective Order Regarding Sheriff Gualtieri. Following a
301telephonic hearing, the renewed motion for continuance was
309denied, the motion regarding the protective order was granted,
318and the ruling on the Amended Exhibit L ist was reserved for the
331hearing.
332A t the heari ng on October 1, 2013, Joint Exhibits 1 through
34513 were admitted into evidence. Petitioner presented the
353testimony of Respondent, Captain David Danzig and Sergeant Deanna
362Carey . 2/ Respondent testified on his own behalf . Captain Danzig
374was called in rebu ttal. Respondent offered Exhibits 1 through
3843 , 3/ which were admitted. 4/
390The T ranscript of the proceedings was filed on October 15,
4012013. Petitioner timely filed its Proposed Recommended Order
409(PRO) on October 25. Respondent ' s PRO was filed on October 2 8. 5/
424On October 29, Petitioner filed a Motion to S trike Respondent ' s
437P roposed R ecommended O rder (Strike Motion) , citing Respondent ' s
449failure to comply with Florida Administrative Code Rule 28 -
459106.104(1) and (3). The Strike Motion is denied . E ach PRO has
472been considered in the preparation of this Recommended Order.
481FINDING S OF FACT
4851 . Bob Gualtieri is the duly - appointed s heriff of Pinellas
498County, Florida.
5002 . Sheriff Gualtieri is in command of the operations of
511PCSO.
5123 . Sheriff Gualtieri ' s responsi bilities include providing
522law enforcement services within Pinellas County, Florida.
5294 . Sheriff Gualtieri is authorized to impose discipline, in
539accord ance with the Civil Service Act, on PCSO members and
550employees who are found to have violated PCSO rule s or
561regulations.
5625 . At all times pertinent to this case, Respondent was
573employed by PCSO as a deputy sheriff.
5806 . At the time of his termination, Respondent had been
591employed by PCSO for approximately 12 years.
5987 . As a deputy sheriff , Respondent was charged with the
609responsibility of complying with all PCSO rules, regulations,
617general orders, and standard operating procedures.
6238 . PCSO General Order 13 - 3 require s that PCSO members shall
637use only that degree of force necessary to perform official
647duti es. The member shall not strike or use physical force
658against a person except when necessary in self - defense, in
669defense of another, to overcome physical resistance to arrest, to
679take an individual into protective custody, or to prevent escape
689of an arres ted person.
6949 . At the time of the events in issue in this case, Captain
708David Danzig (then a Lieutenant) was assigned to the PCSO
718Administrative Investigations Division.
7211 0 . Sergeant Deanna Carey is assigned to the PCSO
732Administrative Investigations Di vision.
7361 1 . Sergeant Christina Cuttitta is assigned to the PCSO
747Administrative Investigations Division.
7501 2 . Sergeants Carey and Cuttitta investigated the complaint
760of misconduct that was filed against Respondent on or about
770June 11, 2013.
7731 3 . The co mplaint of misconduct alleged that on May 8,
7862013, Respondent violated General Order 3 - 1.1, Rule and
796Regulation 5.15 , pertaining to the custody of
803a rrestees/prisoners.
8051 4 . At the Administrative Review Board (ARB) hearing,
815Respondent admitted that his use of force on the inmate was not
827justified because it did not meet the criteria for use of force.
8391 5 . PCSO General Order 10 - 2 covers discipline and ranks
852certain offenses. This General Order ranks offenses from Level 1
862to Level 5. A Level 5 offense is t he most severe. A L evel 1
878offense is the least sever e . Further, this General Order sets
890forth a procedure for assigning points for each sustained
899violation. According to the number of points, there is a
909corresponding table that indicates the range of pu nishment. The
919point total for the violation admitted before the ARB in
929Respondent ' s case was 50.
9351 6 . Respondent had five carryover points from prior
945discipline.
9461 7 . U nder PCSO General Order 10 - 2, 55 points reverts to 50
962points.
9631 8 . U nder PCSO Genera l Order 10 - 2, the range of discipline
979for a 50 - point violation is a minimum five - day suspension to
993termination.
99419 . Sheriff Gualtieri terminated Respondent from his
1002employment with PCSO effective 1200 hours on July 29, 2013.
10122 0 . Exhibit 13 is a series of six video clips taken from
1026various angles in the intake and booking section of the Pinellas
1037County Jail. T he six video clips document Respondent ' s actions.
1049Respondent was not involved in bringing the inmate into the
1059intake/booking area. The inmate, w ho was yelling obscenities and
1069racial slurs, was standing on the mat to have his picture taken
1081when Respondent left his station, approached the inmate , and
1090proceeded to strike the inmate and take him to the floor.
1101Respondent admitted that he used force on the inmate. Respondent
1111admitted that the use of force on this inmate was not justified .
112421. In the past three years, two (former) deput y sheriff
1135were terminated for Level 5 offenses. While the exact offenses
1145involved other Level 5 offenses, the consis tency in discipline is
1156constant : termination. There was no justification for
1164Respondent ' s action.
1168CONCLUSIONS OF LAW
11712 2 . The Division of Administrative Hearings has
1180jurisdiction over the parties and subject matter of this
1189proceeding. § 120. 65(7 ), Fl a. Stat . (201 3 ).
12012 3 . Petitioner is asserting that Respondent violated PCSO
1211General Order 3 - 1.1, Rules and Regulations 5.15 . Petitioner, as
1223the party asserting the affirmative, has the burden of proving by
1234a preponderance of the evidence that Respondent com mitted the
1244alleged violation. " The burden of proof, apart from statute, is
1254on the party asserting the affirmative of an issue before an
1265administrative tribunal. " Balino v. Dep ' t of HRS , 348 So. 2d
1277348, 350 (Fla. 1 st DCA 1977).
12842 4 . A preponderance of th e evidence is defined as " the
1297greater weight of the evidence " or evidence that " more likely
1307than not " tends to prove a certain proposition. Gross v. Lyons ,
1318763 So. 2d 276, 289 n.1 (Fla. 2000).
13262 5 . Chapter 89 - 404, Laws of Florida, as amended by Chapter
134090 - 395, Laws of Florida, authorizes the sheriff to take certain
1352disciplinary action against classified employees. Chapter 89 - 404
1361also authorizes the PCSO to adopt rules and regulations as are
1372necessary to carry out the sheriff ' s functions. Pursuant to th is
1385authority, the PCSO has adopted policies, rules, and regulations
1394which establish a standard of conduct which must be followed by
1405employees of the sheriff ' s office.
14122 6 . General Order 3 - 1 provides that its purpose " is to
1426establish a standard of conduct, which must be followed by
1436members of the agency " (the PCSO). This General Order also
1446provides the PCSO disciplinary system. The disciplinary system
1454has five levels with L evel 5 applying to the most serious
1466infractions.
14672 7 . General Order 3 - 1.1 includes Rule and Regulation 5.15,
1480which addresses the " Custody of Arrestees/Prisoners. " This rule
1488provides:
1489Arrestees/prisoners shall be kept secured and
1495treated humanely and shall not be subjected
1502to physical abuse. The use of physical force
1510shall be restrict ed to circumstances
1516specified by law when necessary to accomplish
1523a police task.
15262 8 . Petitioner has met its burden of proving that
1537Respondent subjected an inmate to physical abuse that was not
1547warranted , and termination of employment is a reasonable
1555di scipline .
1558RECOMMENDATION
1559Based on the foregoing Findings of Fact and Conclusions of
1569Law, it is r ecommended that Petitioner, Pinellas County Sheriff ' s
1581Office, enter a final order finding that Respondent, Richard
1590Stotts , violated General Order 3 - 1.1, Rules and Regulations 5.15,
1601and terminating his employment.
