28On February 3, 2015 , the Appellate Division of the Circuit
38Court for the Sixth Judicial Circuit , in and for Pinellas County,
49Florida , entered an Opinion on Rehearing 1/ in this case. The
60Opinion directed the following:
64The Petition for Writ of Certiorari is
71granted to the ex tent this matter is remanded
80to the Administrative Law Judge to review the
88evidence and testimony presented at the
94November 19, 2013, hearing. The ALJ shall
101determine whether "a reasonable employee"
106would have found the December 21, 2012 letter
"114materiall y adverse" so that it would
121discourage a reasonable employee from making
127or supporting a charge of discrimination.
133See Donovan , 974 So. 2d at 460. On remand
142the ALJ shall enter a Final Order announcing
150his or her determination and reviewing the
157sufficien cy of the evidence. In all other
165respects the petition is denied.
170On February 19, the undersigned issued an Order Reopening
179File and directing the parties to submit any written argument in
190support of their position s . Each party timely submitted
200argument , which has been considered .
206The review of the evidence and testimony presented at the
216November 19, 2013 , hearing has been completed.
223FINDING S OF FACT
2271. The findings of fact set forth in the Recommended Order
238are approved, adopted and incorporated herein by reference and
247supplemented by the following :
2522. The letter, found in paragraph 6 of the Recommended
262Order, contains language that is materially adverse, and would
271deter a reasonable person from purs u ing a complaint with the
283Pinellas County Office of Human Rights. After receiving the
292letter, Mr. Tuzlak conferred with his counsel and decided to
302continue t his discrimination action. That continuation of the
311action does not negate the reasonable person standard.
3193. In reviewing the evidence provided du ring the hearing,
329there is competent substantial evidence to support the findings
338of fact as amended.
342CONCLUSIONS OF LAW
3454. The conclusions of law set forth in the Recommended
355Order are approved, adopted and incorporated herein by reference.
364ORDER
365Based o n the foregoing amended Findings of F act and
376Conclusions of Law, it is
381ORDERED that :
384A. Respondent violated section 70 - 54(1) Pinellas County
