155By the terms of their stipulation, Petitioners, Jaime Barnes

164and Jonathan Talley, as parents and natural guardians of Sophia

174Talley , a minor, deceased, and Respondent, the Florida Birth -

184Related Neurological Injury Compensation Association (NICA) , have

191agreed that Jaime Barnes and Jonathan Talley are the parents and

202legal guardians of Sophia Talley ( Sophia ), deceased; that Sophia

213was born a live infant on or about June 14, 2011 , at Lakeland

226Regional Medical C enter , a ÐhospitalÑ as defined by section

236766.302(6) located in Lakeland , Florida; and that Sophia Ós birth

246weight exceeded 2,500 grams. The Parties have further agreed

256that Jeffrey Puretz , M.D., provided obstetrical services at

264Sophia Ós delivery and was a Ðparticipating physicianÑ in the

274Florida Birth - Related Neurological Injury Compensation Plan, as

283defined by section 766.302(7). The Parties have agreed that

292Sophia suffered a Ðbirth - related neurological injury,Ñ as that

303term is defined by section 766.302 (2), which was the sole and

315proximate cause of SophiaÓs injury.

320It is ORDERED:

3231. The Stipulation and Joint Petition filed on March 22,

3332016 , is hereby approved, and the Parties are directed to comply

344with the provisions of the Stipulation and Joint Petit ion.

3542. Petitioners, Jaime Barnes and Jonathan Talley , as the

363parents and legal guardians of Sophia Talley , deceased, are

372awarded one hundred thousand dollars ($100,000.00), pursuant to

381section 766.31(1)(b)1 . , to be paid as a lump sum; payment of

393benefits up to and including the effective date of the Stipulation

404and Joint Petition pursuant to section 766.31(1)(a), subject to

413the provisions of paragraph 19 of the Stipulation and Joint

423Petition; and payment of the $10,000.00 death benefit pursuant to

434section 766.31(1)(b) 2 .

4383. NICA will reimburse Maria Tejedor, Esquire, and Jack T.

448Cook, Esquire , attorney s for Petitioners, an agreed - upon

458attorneyÓs fee of $ 8,000.00 and expenses of $ 500.00 , totaling

470$ 8,500.00 in full for services rendered in the filing of this

483claim.

4844. Upon the payment of the award of $100,000.00, the death

496benefit of $10,000.00, past benefit/expenses, and $ 8,500.00 for

507attorneyÓs fees and costs, the claims of Petitioners shall be

517deemed fully satisfied and extinguished.

5225. The Division of A dministrative Hearings retains

530jurisdiction over this matter to resolve any disputes, should they

540arise, regarding the P artiesÓ compliance with the terms of this
