84STATEMENT OF THE CASE

88On September 23, 2013, Petitioner, Khai Nguyen, individually

96and a s Personal Representative of the Estate of Maituyet Nguyen,

107and on beha lf and as parent of Kaden Nguyen (Kaden), a minor,

120filed a Petition Under Protest Pursuant to Florida Statute

129Section 766.301 et seq. (Petition) with the Division of

138Administrative Hearings (DOAH) for a determination of

145compensability under the Florida Bir th - Related Neurological

154Injury Compensation Plan (Plan). The Petition named Alex Birman,

163M.D., and Georges Edouard, M.D., as the physicians providing

172obstetric services at the birth of Kaden at Plantation General

182Hospital in Plantation, Florida.

186DOAH serv ed NICA with a copy of the Petition on

197September 27, 2013. DOAH served a copy of the Petition on

208Plantation General Hospital on September 30, 2013. DOAH served a

218copy of the Petition on Dr. Edouard on October 7, 2013. On

230October 1, 2013, NICA served a c opy of the Petition on

242Dr. Birman. As of the date of the Summary Final Order of

254Dismissal, no petitions to intervene in this proceeding have been

264filed by Dr. Birman, Dr. Edouard, or Plantation General Hospital.

274On April 21, 2014, NICA filed a Motion for Summary Final

285Order, asserting that Kaden did not sustain a "birth - related

296neurological injury" as that term is defined in section

305766.302(2), Florida Statutes (2012) . Petitioner did not file a

315response to the motion for summary final order.

323FINDINGS OF F ACT

3271. Kaden Nguyen was born on July 26, 2012, at Plantation

338General Hospital and weighed 3,827 grams at birth.

3472. NICA retained Donald Willis, M.D., to review the medical

357records for Kaden. After reviewing the records, Dr. Willis

366opined as follows:

369In summary, the mother suffered a cardiac

376arrest during labor due to a suspected

383amniotic fluid embolism and could not be

390resuscitated. Fetal oxygen deprivation

394resulted from maternal cardiac arrest, as

400reflected by fetal bradycardia. Emergency

405Cesarean se ction was done while maternal CPR

413continued. The baby was depressed at birth

420and continued to develop worsening

425respiratory distress. Despite the obvious

430lack of oxygen, there was no seizure activity

438and the MRI on DOL 17 was normal.

446There was an obstet rical event that resulted

454in loss of oxygen to the babyÓs brain during

463labor, delivery, and continuing into the

469immediate post delivery period. However, the

475oxygen deprivation did not result in any

482significant brain injury. The lack of

488significant brain injury is based primarily

494on the normal MRI on DOL 17, absence of any

504seizure activity and age appropriate

509developmental milestones achieved at 9 months

515of age.

5173. Michael Duchowny, M.D. (Dr. Duchowny), was requested by

526NICA to do an independent medical evaluation of Kaden.

535Dr. Duchowny examined Kaden on February 12, 2014. Based on his

546examination, Dr. Duchowny opined the following:

552In summary, KadenÓs neurological examination

557reveals no specific focal or lateralizing

563findings. He does not evidence any motor or

571mental impairment and his growth and

577development are proceeding satisfactorily.

581I had an opportunity to review medical

588records which were sent to me on December 5,

5972013 which documented the catastrophic

602perinatal course. Of note, head ultrasoun d

609examinations performed on July 28 th and 30 th ,

6182012 were within normal limits. No further

625neuroimaging studies were undertaken.

629As KadenÓs neurological examination is normal

635today, I do not believe that he should be

644considered for acceptance into the NI CA

651program.

6524. A review of the file does not show any contrary opinions

664to the opinions of Dr. Willis and Dr. Duchowny that Kaden did not

677have a brain injury that resulted in permanent and substantial

687physical and mental impairments. The opinions of Dr. Willis and

697Dr. Duchowny are credited.

701CONCLUSIONS OF LAW

7045. The Division of Administrative Hearings has jurisdiction

712over the parties to and the subject matter of these proceedings.

723§§ 766.301 - 766.316, Fla. Stat.

7296. The Plan was established by the Legislature "for the

739purpose of providing compensation, irrespective of fault, for

747birth - related neurological injury claims" relating to births

756occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7677. The injured infant, her or his personal rep resentative,

777parents, dependents, and next of kin may seek compensation under

787the Plan by filing a claim for compensation with DOAH.

797§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

805which administers the Plan, has "45 days from the date of service

817of a complete claim . . . in which to file a response to the

832petition and to submit relevant written information relating to

841the issue of whether the injury is a birth - related neurological

853injury." § 766.305(4), Fla. Stat.

8588. If NICA determi nes that the injury alleged in a claim is

871a compensable birth - related neurological injury, it may award

881compensation to the claimant, provided that the award is approved

891by the administrative law judge to whom the claim has been

902assigned. § 766.305(7), Fl a. Stat. If, on the other hand, NICA

914disputes the claim, as it has in the instant case, the dispute

926must be resolved by the assigned administrative law judge in

936accordance with the provisions of chapter 120, Florida Statutes.

945§§ 766.304, 766.309, and 766 .31, Fla. Stat.

9539. In discharging this responsibility, the a dministrative

961l aw j udge must make the following determination based upon the

973available evidence:

975(a) Whether the injury claimed is a birth -

984related neurological injury. If the claimant

990has demo nstrated, to the satisfaction of the

998administrative law judge, that the infant has

1005sustained a brain or spinal cord injury

1012caused by oxygen deprivation or mechanical

1018injury and that the infant was thereby

1025rendered permanently and substantially

1029mentally and physically impaired, a

1034rebuttable presumption shall arise that the

1040injury is a birth - related neurological injury

1048as defined in s. 766.303(2).

1053(b) Whether obstetrical services were

1058delivered by a participating physician in the

1065course of labor, delivery , or resuscitation

1071in the immediate postdelivery period in a

1078hospital; or by a certified nurse midwife in

1086a teaching hospital supervised by a

1092participating physician in the course of

1098labor, delivery, or resuscitation in the

1104immediate postdelivery period in a hospital.

1110§ 766.309(1), Fla. Stat. An award may be sustained only if the

1122administrative law judge concludes that the "infant has sustained

1131a birth - related neurological injury and that obstetrical services

1141were delivered by a participating physician a t birth."

1150§ 766.31(1), Fla. Stat.

115410. The term "birth - related neurological injury" is defined

1164in section 766.302(2) as follows:

"1169Birth - related neurological injury" means

1175injury to the brain or spinal cord of a live

1185infant weighing at least 2,500 grams for a

1194single gestation or, in the case of a

1202multiple gestation, a live infant weighing at

1209least 2,000 grams at birth caused by oxygen

1218deprivation or mechanical injury occurring in

1224the course of labor, delivery, or

1230resuscitation in the immediate postdeliver y

1236period in a hospital, which renders the

1243infant permanently and substantially mentally

1248and physically impaired.

125111. The evidence, which is not refuted, established that

1260Kaden does not have a permanent and substantial motor or mental

1271impairment; thus, K aden has not sustained a birth - related

1282neurological injury because he is not permanently and

1290substantially physically impaired. Therefore, Kaden is not

1297eligible for benefits under the Plan.

1303CONCLUSION

1304Based upon the foregoing Findings of Fact and Con clusions of

1315Law, it is ORDERED that the Petition is dismissed with prejudice.
