61This cause came on for consideration upon a Motion for
71Summar y Final Order filed by Respondent, Florida Birth - Related
82Neurological Injury Compensation Association (NICA) on
88December 6, 2013.
91STATEMENT OF THE CASE
95On September 25, 2013, Petitioners, Gilbert Kouame and
103Selina Kouame Duku , on behalf of and as parents a nd natural
115guardians of Trinity Kouame (Trinity), a minor, filed a Petition
125for Determination of Compensability Pursuant to Section 766.309,
133Florida Statutes, and for Bifurcation of any Determination of
142Compensation (Petition) with the Division of Administ rative
150Hearings (DOAH) for a determination of compensability under the
159Florida Birth - Related Neurological Injury Compensation Plan
167(Plan). The Petition named the following physicians as providing
176obstetric services at the birth of Trinity at Tampa General
186Hospital at Tampa, Florida: Catherine Lynch, M.D.,
193Margaux Manuel, M.D., Jerome Yankowitz , M.D. , and
200Angela Gonzalez , M.D.
203DOAH served NICA with a copy of the Petition on October 2,
2152013. DOAH served Dr. Manuel with a copy of the Petition on
227October 4, 2013. On October 7, 2013, DOAH served Dr. Lynch with
239a copy of the Petition. On October 7, 2013, DOAH received a
251receipt from the United States Postal Service (USPS) showing that
261Tampa General Hospital had been served with a copy of the
272Petition. On Oct ober 9, 2013, DOAH received a receipt from USPS
284showing that Dr. Gonzalez had been served with a copy of the
296Petition. On October 11, 2013, DOAH received a receipt from USPS
307that Dr. Yan k owitz had been served with a copy of the Petition.
321On October 29, 20 13, Florida Health Services Center, Inc. ,
331d/b/a Tampa General Hospital filed an Amended Motion to
340Intervene, which was granted by Order dated November 8, 2013. As
351of the date of this Summary Final Order, Dr. Lynch, Dr. Manuel,
363Dr. Yankowitz, and Dr. Gonza lez have not petitioned to intervene
374in this proceeding.
377On December 6, 2013, NICA filed a Motion for Summary Final
388Order, asserting that Trinity did sustain a "birth - related
398neurological injury" as that term is defined in section
407766.302(2), Florida Statu tes. On January 9, 2014, Petitioners
416filed PetitionersÓ Response to Motion for Summary Final Order,
425stating that they had no objection to a summary final order
436finding that Trinity Ðsuffered a compensable birth - related
445neurological injury.Ñ
447On January 1 5, 2014, Intervenor filed Intervenor's Response
456to Motion for Summary Final Order, stating it had no position as
468to the relief requested by Respondent.
474FINDINGS OF FACT
477inity Kouame was born on January 31, 2012, at Tampa
487General Hospital in Tampa, F lorida. She weighed 2,955 grams at
499birth.
5002. Donald Willis, M.D. (Dr. Willis), was requested by NICA
510to review the medical records of Trinity . In a report dated
522November 18, 2013, Dr. Willis set forth his findings as follows:
533The fetal heart rate (FHR) monitor tracing on
541admission to the hospital showed a fetal
548tachycardia of 180 bpm and decreased FHR
555variability. Regular uterine contractions
559were present every 2 to 3 minutes, consistent
567with labor. A FHR deceleration occurred
573about one hour after hosp ital admission with
581FHR dropping to 95 bpm. A persistent
588irregular FHR pattern continued with the FHR
595remaining below 120 bpm until the monitor was
603removed, which was about 40 minutes after the
611FHR deceleration.
613Emergency Cesarean section was done for an
620abnormal FHR pattern. Birth weight was
6262,995 grams.
629The newborn was depressed at birth. Apgar
636scores were 0/3/5. Umbilical cord blood gas
643was abnormal and consistent with acidosis
649with a pH of 6.86 and a base excess of - 14.
661The baby was limp at bi rth with spontaneous
670respiratory effort. Bag and mask ventilation
676was started.
678No heart rate could be identified at 30
686seconds after birth. Chest compressions
691began at 60 seconds after birth. At 90
699seconds the baby was intubated. A heart rate
707of >100 bpm was noted at 3 minutes of life.
717Respiratory distress worsened. At 7 minutes
723after birth the oxygen saturation was only
73065%. The baby was transported to NICU.
737Hypoxic ischemic encephalopathy was
741clinically suspected. The baby was managed
747with cont rolled hypothermia. Seizure
752activity was present a <12 hours="" of="">12>
756EEG on DOL 2 confirmed seizure activity. The
764baby was not extubated until DOL 7.
771MRI on DOL 11 showed cerebral infarcts,
778consistent with global hypoxia.
7823. In an affidavit dated De cember 5, 2013, Dr. Willis
793opined as follows:
796It is my opinion that in summary, labor was
805complicated by an abnormal FHR pattern.
811Emergency Cesarean section delivery was done
817with a depressed newborn. Umbilical cord pH
824was only 6.86. Resuscitation was r equired,
831including intubation and chest compressions.
836Seizure activity was present by 12 hours of
844life. MRI on DOL 11 was consistent with
852global hypoxia.
854As such, it is my opinion that there was an
864apparent obstetrical event that resulted in
870loss of oxy gen to the babyÓs brain during
879labor, delivery and continued into the
885immediate post delivery period. The oxygen
891resulted in brain injury.
8954. NICA retained Michael S. Duchowny, a pediatric
903neurologist , to review TrinityÓs medical records and to examine
912her. He performed a neurological evaluation on Trinity on
921November 20, 2013. On December 5, 2013, Dr. Duchowny executed an
932affidavit which stated:
935It is my opinion that TRINITYÓs neurological
942examination reveals evidence of substantial
947mental and motor i mpairment consistent with
954global developmental delay. TrinityÓs
958examination demonstrates spastic
961quadriparesis, microcephaly, cortical visual
965impairment, and absence of communication or
971socialization skills. She additionally has a
977long standing history o f medical resistant
984seizures.
985A review of medical records sent on
992November 7, 2013 confirms her motherÓs recall
999of a with cerclage problem prenatally. The
1006cerclage was removed on January 26, but a
1014stitch was left in place and the pregnancy
1022was complica ted by significant hemorrhage.
1028Apgar scores were 0, 3, & 5 at 1, 5, and 10
1040minutes and a cord arterial pH was measured
1048at inity was delivered at Tampa
1054General Hospital and immediately placed in a
1061hypothermia protocol for 72 hours. Seizures
1067were noted after the day of birth. An
1075ultrasound of the brain performed on
1081February 3 rd was normal but an MRI scan on
1091February 12 th revealed multiple areas of
1098infarction involving the corpus callosum,
1103basal ganglia, internal capsule and
1108periventricular white m atter with widespread
1114diffusion abnormalities in the cerebral
1119hemispheres. These findings are consistent
1124with hypoxic ischemic damage.
1128As such, it is my opinion that based on the
1138neurological examination and record review, I
1144believe that TRINITY should b e considered for
1152compensation with the NICA program as she has
1160a substantial mental and motor impairment
1166resulting from a brain injury due to oxygen
1174deprivation in the course of labor and
1181delivery. Her findings are in all likelihood
1188permanent and her prog nosis is extremely
1195guarded. Should she be accepted into the
1202NICA program, I believe that her lifespan
1209prognosis includes another 20 years.
12145. A review of the file in this case reveals that there
1226have been no expert opinions filed that are contrary to th e
1238opinions of either Dr. Willis or Dr. Duchowny. The opinions of
1249Dr. Willis and Dr. Duchowny that Trinity did suffer a
1259neurological injury due to oxygen deprivation during labor and
1268delivery are credited. Additionally, Dr. DuchownyÓs opinion that
1276Trinity has both a substantial mental and motor impairment is
1286also credited.
1288CONCLUSIONS OF LAW
12916. The Division of Administrative Hearings has jurisdiction
1299over the parties to and the subject matter of these proceedings.
1310§§ 766.301 - 766.316, Fla. Stat.
13167. The Plan was established by the Legislature "for the
1326purpose of providing compensation, irrespective of fault, for
1334birth - related neurological injury claims" relating to births
1343occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
13548. The injured in fant, her or his personal representative,
1364parents, dependents, and next of kin may seek compensation under
1374the Plan by filing a claim for compensation with DOAH.
1384§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1392which administers the Pla n, has "45 days from the date of service
1405of a complete claim . . . in which to file a response to the
1420petition and to submit relevant written information relating to
1429the issue of whether the injury is a birth - related neurological
1441injury." § 766.305(4), Fl a. Stat.
14479. If NICA determines that the injury alleged in a claim is
1459a compensable birth - related neurological injury, it may award
1469compensation to the claimant, provided that the award is approved
1479by the administrative law judge to whom the claim has bee n
1491assigned. § 766.305(7), Fla. Stat. The administrative law judge
1500must make the following determination based upon the available
1509evidence:
1510(a) Whether the injury claimed is a birth -
1519related neurological injury. If the claimant
1525has demonstrated, to the s atisfaction of the
1533administrative law judge, that the infant has
1540sustained a brain or spinal cord injury
1547caused by oxygen deprivation or mechanical
1553injury and that the infant was thereby
1560rendered permanently and substantially
1564mentally and physically impair ed, a
1570rebuttable presumption shall arise that the
1576injury is a birth - related neurological injury
1584as defined in s. 766.303(2).
1589(b) Whether obstetrical services were
1594delivered by a participating physician in the
1601course of labor, delivery, or resuscitation
1607in the immediate postdelivery period in a
1614hospital; or by a certified nurse midwife in
1622a teaching hospital supervised by a
1628participating physician in the course of
1634labor, delivery, or resuscitation in the
1640immediate postdelivery period in a hospital.
1646§ 76 6.309(1), Fla. Stat. An award may be sustained only if the
1659administrative law judge concludes that the "infant has sustained
1668a birth - related neurological injury and that obstetrical services
1678were delivered by a participating physician at birth."
1686§ 766.31 (1), Fla. Stat.
169110. The term "birth - related neurological injury" is defined
1701in section 766.302(2) as follows:
"1706Birth - related neurological injury" means
1712injury to the brain or spinal cord of a live
1722infant weighing at least 2,500 grams for a
1731single gestat ion or, in the case of a
1740multiple gestation, a live infant weighing at
1747least 2,000 grams at birth caused by oxygen
1756deprivation or mechanical injury occurring in
1762the course of labor, delivery, or
1768resuscitation in the immediate postdelivery
1773period in a hospi tal, which renders the
1781infant permanently and substantially mentally
1786and physically impaired.
178911. The evidence, which is not refuted, established that
1798Trinity did sustain an injury to the brain caused by oxygen
1809deprivation occurring in the course of lab or and delivery in a
1821hospital, which renders her substantially and permanently
1828physically and mentally impaired. Therefore, Trinity is eligible
1836for benefits under the Plan.
1841CONCLUSION
1842Based upon the foregoing Findings of Fact and Conclusions of
1852Law, it is
1855ORDERED:
18561. Respondent's Motion for Summary Final Order is granted,
1865and Trinity Kouame sustained a birth - related neurological injury
1875which is compensable under the Plan.
18812. Jurisdiction is reserved to determine the issue of award
1891pursuant to section 766.31.
18953. It is further ORDERED that the parties are accorded 30
1906days from the date of this Order to resolve, subject to approval
1918of the administrative law judge, the amount and manner of payment
1929of an award to Petitioners; the reasonable expenses incurr ed in
1940connection with the filing of the claim, including reasonable
1949attorney's fees and costs; and the amount owing for expenses
1959previously incurred. If not resolved within such period, the
1968parties shall so advise the administrative law judge, and a
1978heari ng will be scheduled to resolve such issues. Once resolved,
1989an award will be made consistent with section 766.31.
1998DONE AND ORDERED this 22nd day of January , 2014 , in
