289PRELIMINARY STATEMENT

291On October 2, 2013, Petitioner, Ashley Lamendola,

298individually and as parent and legal guardian of Hunter Lamendola

308(Hunter), a minor, f iled a Petition for Benefits Pursuant to

319Section 766.301 et seq., of the Florida Statutes (Petition) with

329the Division of Administrative Hearings (DOAH) for a

337determination of compensability under the Florida Birth - Related

346Neurological Injury Compensation Plan (Plan). The Petition named

354Christina Shamas, M.D., as the physician who provided obstetric

363services at the birth of Hunter on June 27, 2012, at St.

375Petersburg General Hospital in St. Petersburg, Florida. The

383Petition also named Guillermo Calderon, M .D., as

391Ashley LamendolaÓs treating obstetrician.

395DOAH served NICA with a copy of the Petition on October 8,

4072013. DOAH served St. Petersburg General Hospital with a copy of

418the Petition on October 11, 2013. On October 15, 2013, DOAH

429received a return re ceipt from the United States Postal Service

440showing that Dr. Shamas had been served with a copy of the

452Petition. On October 11, 2013, DOAH received a return receipt

462from the United States Postal Service showing that Dr. Calderon

472had been served with a cop y of the Petition.

482On October 21, 2013, St. Petersburg General Hospital filed a

492Petition to Intervene, which was granted by Order dated

501November 7, 2013. On October 23, 2013, Dr. Calderon filed a

512Petition to Intervene, which was granted by Order dated

521No vember 7, 2013. On November 1, 2013, Dr. Shamas and Gulf Coast

534Institute of OB/GYN, LLC, filed a Petition to Intervene, which

544was granted by Order dated November 20, 2013.

552On April 24, 2014, NICA filed RespondentÓs Motion for

561Summary Final Order on the Is sue of Birth - Related Neurological

573Injury, contending that Hunter Lamendola suffered a birth - related

583neurological injury. On May 29, 2014, the parties filed a Pre -

595Hearing Stipulation in which the parties agreed to the following:

605Hunter Lamendola suffered a birth - related

612neurological injury and obstetrical services

617were delivered by a participating physician

623in the course of labor, delivery, or

630resuscitation in the immediate post - delivery

637period in the hospital.

641On May 30, 2014, a Partial Summary Final Ord er was entered

653finding that Hunter Lamendola suffered a birth - related

662neurological injury. Jurisdiction was retain ed to determine the

671issue of an award and whether the notice requirements of section

682766.316 were satisfied.

685The Pre - Hearing Stipulation file d by the Parties stipulated

696to certain facts contained in Paragraph (e) of the Pre - Hearing

708Stipulation. Those facts have been incorporated into this Final

717Order on Notice.

720At the final hearing, PetitionerÓs Exhibits P1, P3, P4, P5,

730P6, P7, and P15 were ad mitted in evidence. Petitioner testified

741in her own behalf and called the following witnesses:

750Myra Deering, Violet Lamendola, and Tara Yan. At the final

760hearing, Respondent did not call any witnesses and did not have

771any exhibits which were admitted in evidence. Intervenor, St.

780Petersburg General HospitalÓs, Exhibits H1 and H2 were admitted

789in evidence. St. Petersburg General Hospital did not call any

799witnesses. Intervenors, Christina Shamas, M.D., and Gulf Coast

807Institute of OB/GYN , presented Exhibi ts G1, G2, G3, G4, G5, G10,

819G11, and G12, which were admitted in evidence. Elba Acosta

829testified on behalf of Dr. Shamas and Gulf Coast Institute of

840OB/GYN. Intervernor, Guillermo Calderon, M.D., did not call any

849witnesses or present any exhibits.

854The tw o - volume Transcript of the final hearing was filed on

867June 17, 2014. The parties timely filed their proposed final

877orders, which have been considered in the drafting of this

887Summary Final Order on Notice.

892FINDINGS OF FACT

8951. Ashley Lamendola first prese nted to Gulf Coast OB/GYN on

906the morning of December 16, 2011, for a prenatal visit. This

917visit constituted the beginning of her professional relationship

925with the physicians who were part of the Gulf Coast OB/GYN group,

937which included Dr. Calderon and Dr . Shamas. 1/ Violet Lamendola,

948Ms. LamendolaÓs mother, accompanied Ms. Lamendola to that visit.

957When she arrived at Gulf Coast OB/GYN, Ms. Lamendola was given

968information and forms to fill out by the receptionist. According

978to both Ms. Lamendola and her mother, the materials included a

989NICA brochure in Spanish and an acknowledgment of receipt of the

1000NICA form.

10022. While reviewing the materials, Ms. Lamendola, who does

1011not speak Spanish, noted that the NICA brochure given to her was

1023in Spanish. She asked her mother to take the brochure back to

1035the receptionist. When Ms. LamendolaÓs mother asked the

1043receptionist about the Spanish brochure, the receptionist told

1051her that the office had run out of NICA brochures printed in

1063English, but that she would obtain one from another office and

1074give it to Ms. Lamendola at the end of her appointment.

1085Ms. Lamendola was instructed to sign and did sign the

1095acknowledgment form so that she could see the physician. The

1105acknowledgment form advised that all physicians in the Gulf C oast

1116OB/GYN, P.A. , were participating physicians in the NICA program.

11253. Ms. Lamendola received a black - and - white facsimile copy

1137of the NICA brochure on her way out of the office along with

1150other materials relating to prenatal and infant care. The

1159brochure, received by Ms. Lamendola from Gulf Coast OB/GYN, bears

1169a facsimile transmission header dated December 16, 2011, at

11789:47 a.m.

11804. The brochure prepared by NICA is a color brochure which

1191contains the following text in white letters on a light - to - medium

1205green background on the back of the brochure:

1213Section 766.301 - 766.316, Florida Statutes,

1219(ÐNICA LawÑ) provides rights and remedies for

1226certain birth - related neurological injuries

1232and is an exclusive remedy. This brochure is

1240prepared in accordance with the mandate of

1247Section 766.316, Florida Statutes. A copy of

1254the complete statute is available free of

1261charge to completely inform patients of their

1268rights and limitations under the application

1274provision of Florida law. Since 1989,

1280numerous court cas es have interpreted the

1287NICA law, clarifying legislative intent.

1292The above - quoted language is absent from the facsimile copy of

1304the brochure that Ms. Lamendola received from Gulf Coast OB/GYN.

1314Apparently because the letters in the original brochure were

1323white, the letters did not transmit. It is noted that on the

1335front of the brochure, white lettering that appears on the green

1346background of the color brochure did not transmit on the copy

1357that Ms. Lamendola received.

13615. The majority of the information co ntained in

1370Ms. LamendolaÓs facsimile copy of the brochure is contained in

1380the color copy of the brochure. The facsimile copy informed

1390Ms. Lamendola that the statutes provide an exclusive remedy and a

1401copy of the statutes may be obtained from NICA. The fa csimile

1413outlined the rights and limitations provided in the statutes.

1422The only things that are not contained in the original brochure

1433are that a copy of the statutes is available free of charge, the

1446preparation of the brochure was mandated by section 766. 316, and

1457court cases have interpreted the statutes.

14636. St. Petersburg General Hospital offers a tour of its

1473obstetrical department to expectant mothers and their families.

1481Ms. LamendolaÓs mother called St. Petersburg General Hospital to

1490register for a tour. The hospital employee who was scheduling

1500the tour asked to speak to Ms. Lamendola to obtain pertinent

1511biographical information. Ms. Lamendola provided the information

1518to the hospital employee.

15227. The tour is an informational tour and attendance at the

1533tour does not constitute pre - registration at St. Petersburg

1543General Hospital for the delivery of a baby.

15518. Ms. Lamendola and her mother, along with 12 other

1561couples, attended the tour on March 22, 2012. During the tour,

1572Ms. Lamendola received a tou r packet, which contained a document

1583titled Preadmission and Financial Information. This document

1590instructed Ms. Lamendola to fill out the pre - admission form and

1602return it to the hospital. Ms. Lamendola filled out the pre -

1614admission form, but did not retu rn it to St. Petersburg General

1626Hospital. Ms. Lamendola did not pre - register for admission to

1637the hospital.

16399. On April 3, 2012, Ms. Lamendola presented to St.

1649Petersburg General Hospital with complaints of vaginal bleeding.

1657M s. Lamendola was told by a h ospital employee that she was

1670already in the system and that additional information would not

1680be necessary. Ms. Lamendola signed a ÐConsent to TreatÑ form and

1691was treated in the labor and delivery unit of the hospital. A

1703short time later, she was given i nformational materials relating

1713to prenatal and infant care and released. She was not given a

1725NICA brochure during the visit on April 3, 2012. It was the

1737hospitalÓs policy to give a NICA brochure to a patient only when

1749the patient was being admitted as a n inpatient for delivery of

1761her baby. Ms. LamendolaÓs professional relationship with St.

1769Petersburg General Hospital relating to her pregnancy began with

1778her visit on April 3, 2012.

178410. At 20:19 on June 26, 2012, Ms. Lamendola presented to

1795St. Petersburg General Hospital. She had been experiencing

1803contractions for six hours prior to her arrival at the hospital.

1814She had been placed on bed rest for gestational hypertension five

1825days prior to coming to the hospital. When she arrived at the

1837hospital, she h ad hypertension.

184211. Normally when a patient is 37 to 39 weeks gestation,

1853her physician will bring the prenatal records to the hospital or

1864the physicianÓs office will send the records to the hospital by

1875facsimile transmission. When Ms. Lamendola arrived at St.

1883Petersburg General Hospital, her prenatal records from her

1891physiciansÓ office were not on file. Megan Muse, R.N., was on

1902duty when Ms. Lamendola presented at St. Petersburg General

1911Hospital. Because Ms. LamendolaÓs records were not on file,

1920Ms. Mu se requested that Bayfront Hospital send Ms. LamendolaÓs

1930records to St. Petersburg General Hospital. The evidence did not

1940establish how Ms. Muse knew that the prenatal records were at

1951Bayfront Hospital. Ms. LamendolaÓs prenatal records, consisting

1958of 11 pages, were sent by facsimile transmission to St.

1968Petersburg General Hospital beginning at 21:35 on June 26, 2012.

1978Ms. Muse recorded in her notes that Ms. LamendolaÓs prenatal

1988records were received from Bayfront Hospital at 21:45 on June 26,

19992012.

200012. A lthough Ms. LamendolaÓs prenatal records may have been

2010sent to Bayfront Hospital, it was never Ms. LamendolaÓs intention

2020to deliver her baby at Bayfront Hospital. She took the

2030informational tour offered by St. Petersburg General Hospital and

2039went to St. P etersburg General Hospital in April 2012 when she

2051had a problem related to her pregnancy.

205813. At 20:33, Dr. Javate admitted Ms. Lamendola to St.

2068Petersburg General Hospital for the delivery of her infant.

2077Ms. Lamendola was examined by Emanuel Javate, M. D. , at

2087approximately 21:35. At 22:02, Ms. Lamendola signed the

2095hospitalÓs Condition of Admission form. At 22:10 the hospital

2104gave Ms. Lamendola the brochure prepared by NICA, and

2113Ms. Lamendola signed the acknowledgment form, acknowledging that

2121she had re ceived the brochure.

212714. Ms. Lamendola gave birth to Hunter Lamendola (Hunter)

2136on June 27, 2012, at St. Petersburg General Hospital, which is a

2148licensed Florida Hospital. At birth, Hunter weighed in excess of

21582,500 grams and was a single gestation.

216615. Ashley Lamendola received obstetrical care from

2173Guillermo Calderon, M.D. Dr. Calderon was a Ðparticipating

2181physicianÑ as defined in section 766.302(7).

218716. Christina Shamas, M.D., provided obstetrical services

2194in the course of labor, delivery, and resusc itation in the

2205immediate post - delivery period. Dr. Shamas was a Ðparticipating

2215physicianÑ as defined in section 766.302(7).

2221CONCLUSIONS OF LAW

222417. The Division of Administrative Hearings has

2231jurisdiction over the parties to and the subject matter of th is

2243proceeding. §§ 766.301 - 766.316, Fla. Stat. (2012).

225118. The only issue to be determined in the final hearing is

2263whether notice was provided pursuant to section 766.316, which

2272provides:

2273Each hospital with a participating physician

2279on its staff and each participating

2285physician, other than residents, assistant

2290residents, and interns deemed to be

2296participating physicians under s.

2300766.314(4)(c), under the Florida Birth -

2306Related Neurological Injury Compensation Plan

2311shall provide notice to the obstetrical

2317pat ients as to the limited no - fault

2326alternative for birth - related neurological

2332injuries. Such notice shall be provided on

2339forms furnished by the association and shall

2346include a clear and concise explanation of a

2354patientÓs rights and limitations under the

2360pla n. The hospital or the participating

2367physician may elect to have the patient sign

2375a form acknowledging receipt of the notice

2382form. Signature of the patient acknowledging

2388receipt of the notice form raises a

2395rebuttable presumption that the notice

2400requireme nts of this section have been met.

2408Notice need not be given to a patient when

2417the patient has an emergency medical

2423condition as defined in s. 395.002(8)(b) or

2430when notice is not practicable.

243519. Section 766.309(1)(d) provides:

2439(1) The administrative law judge shall make

2446the following determination based upon all

2452available evidence:

2454* * *

2457(d) Whether if raised by the claimant or

2465other party, the factual determinations

2470regarding the notice requirements in s.

2476766.316 are satisfied. The administ rative

2482law judge has the exclusive jurisdiction to

2489make these factual determinations.

249320. Ms. Lamendola signed an acknowledgment form that her

2502physicians had provided her with a brochure prepared by NICA, and

2513she signed an acknowledgment form that she ha d received a NICA

2525brochure form from St. Petersburg General Hospital. Her

2533signature on these forms raises a rebuttable presumption that the

2543notice requirements of section 766.316 have been met. Petitioner

2552contends that the notice provided by the physicia ns did not meet

2564the requirements of section 766.316 because part of the language

2574of the copy that she received was absent. Petitioner contends

2584that the notice provided by St. Petersburg General Hospital did

2594not meet the notice requirements of section 766. 316 because the

2605notice should have been provided either in March 2012 when

2615Ms. Lamendola toured the labor and delivery section of St.

2625Petersburg General Hospital or on April 3, 2012, when

2634Ms. Lamendola presented to St. Petersburg General Hospital for

2643medic al services related to her pregnancy.

265021. In Weeks v. Florida Birth - Related Neurological Injury

2660Compensation Association , 977 So. 2d 616, 618 - 620 (Fla. 5th DCA

26722008), the court stated:

2676[T]he formation of the provider - obstetrical

2683patient relationship is wh at triggers the

2690obligation to furnish the notice. The

2696determination of when this relationship

2701commences is a question of fact. Once the

2709relationship commences, because [section

2713766.316] is silent on the time period within

2721which notice must be furnished, under well -

2729established principles of statutory

2733construction, the law implies that notice

2739must be given within a reasonable time.

2746Burnsed v. Seaboard Coastline R. Co. , 290 So .

27552d 13, 19 (Fla. 1974); Concerned Citizens of

2763Putnam County v. St. Johns River Wa ter Mgmt.

2772Dist. , 622 So. 2d 520, 523 (Fla. 5th DCA

27811993). The determination depends on the

2787circumstances, but a central consideration

2792should be whether the patient received the

2799notice in sufficient time to make a

2806meaningful choice of whether to select

2812ano ther provider prior to delivery, which is

2820the primary purpose of the notice

2826requirement.

2827* * *

2830[T]he NICA notice must be given within a

2838reasonable time after the provider -

2844obstetrical patient relationship begins,

2848unless the occasion of the commenceme nt of

2856the relationship involves a patient who

2862presents in an "emergency medical condition,"

2868as defined by the statute, or unless the

2876provision of notice is otherwise "not

2882practicable." When the patient first becomes

2888an "obstetrical patient" of the provide r and

2896what constitutes a "reasonable time" are

2902issues of fact. As a result, conclusions

2909might vary, even where similar situations are

2916presented. For this reason, a prudent

2922provider should furnish the notice at the

2929first opportunity and err on the side of

2937caution.

293822. The physician - patient relationship between

2945Ms. Lamendola and Dr. Shamas and Dr. Calderon began when

2955Ms. Lamendola presented at Gulf Coast OB/GYN on December 16,

29652011. The notice provided by Gulf Coast OB/GYN covered all

2975physicians employed by Gulf Coast OB/GYN, including Dr. Shamas

2984and Dr. Calderon.

298723. Gulf Coast OB/GYN provided a copy of a NICA brochure,

2998which had been sent by facsimile transmission. Part of the text

3009of the brochure did not transmit, probably because that text on

3020the co lor brochure was printed in white. The copy of the

3032brochure that Ms. Lamendola received was sufficient to satisfy

3041the provisions of section 766.316 in that it included a clear and

3053concise explanation of Ms. LamendolaÓs rights and limitations

3061under the NIC A plan. Most of the missing text was a reiteration

3074of what was already contained in the copy of the brochure that

3086Ms. Lamendola received. Thus, Dr. Shamas and Dr. Calderon

3095provided sufficient notice pursuant to section 766.316.

310224. Ms. LamendolaÓs tour of St. Petersburg General Hospital

3111did not form a professional relationship between her and St.

3121Petersburg General Hospital. It was an informational tour and

3130did not constitute pre - registration at the hospital for delivery

3141of her baby. She was given a fo rm to use to pre - register, but

3157she did not avail herself of the opportunity to pre - register.

3169Even if Ms. Lamendola had pre - registered, the policy of St.

3181Petersburg General Hospital was to provide the NICA notice only

3191when the patient arrives at the hospit al and is admitted as an

3204inpatient for delivery of her baby.

32102 5 . The hospitalÓs professional relationship with

3218Ms. Lamendola, relating to her pregnancy, began when

3226Ms. Lamendola presented to St. Petersburg General Hospital on

3235April 3, 2012, with complaint s relating to her pregnancy. She

3246was treated at the hospital for those complaints. The hospital

3256did not provide notice at that time as required by section

3267766.316.

32682 6 . At 8:19 p.m. , on June 26, 2012, when Ms. Lamendola

3281arrived at St. Petersburg General Hospital, she was having

3290contractions and had hypertension. She had been placed on bed

3300rest for the hypertension five days prior to her coming to the

3312hospital. The hospital did not provide her with NICA notice

3322until 10:10 p.m. To contend that under thes e circumstances that

3333the notice provided by the hospital was reasonable when it had an

3345opportunity to do so almost three months prior to June 26, 2012,

3357misses the mark. A woman who has been on bed rest for

3369hypertension, has hypertension on arrival at the hospital, is

3378experiencing contractions, and is given NICA notice at ten

3387oÓclock at night does not have sufficient time to go and find a

3400non - participating physician to deliver her baby. The notice

3410provided by St. Petersburg General Hospital did not meet th e

3421requirements of section 766.316.

3425CONCLUSION

3426Based on the foregoing Findings of Fact and Conclusions of

3436Law, it is

3439ORDERED that St. Peter s burg General Hospital did not comply

3450with the notice provisions of section 766.316 ; that Dr. Calderon

3460did comply wit h the notice provisions of section 766.316 ; and

3471that Dr. Shamas did comply with the notice provisions of section

3482766.316.

3483It is further ORDERED that the parties are accorded 30 days

3494from the date of this Order to resolve, subject to approval of

3506the Adminis trative Law Judge, the amount and manner of payment of

3518an award to Ms. Lamendola ; the reasonable expenses incurred in

3528connection with the filing of the claim, including reasonable

3537attorney's fees and costs; and the amount owing for expenses

3547previously incu rred. If not resolved within such period, the

3557parties shall so advise the Administrative Law Judge, and a

3567hearing will be scheduled to resolve such issues. Once resolved,

3577an award will be made consistent with section 766.31.

3586It is further ORDERED that in the event Petitioner files an

3597election of remedies declining or rejecting NICA benefits , this

3606case will be dismissed and DOAHÓs file will be closed.

3616DONE AND ORDERED this 1 3 th day of August , 2014 , in

4016Review of a final order of an administrative law judge shall be
