44This cause came on for consideration upon a Motion for

74STATEMENT OF THE CASE

78On October 3, 201 3 , Petitioner, Lu r crecia Alavez,

88individually and on behalf of Bryan Alavez (Bryan), a minor,

98filed a Petition Under Protest Pursuant to Florida Statute

107Section 766.301 et seq. (Petition) with the Divisio n of

117Administrative Hearings (DOAH) for a determination of

124compensability under the Florida Birth - Related Neurological

132Injury Compensation Plan (Plan). The Petition named

139Jerome Yan k owitz, M.D., and Kiran Rao, M.D., as the physicians

151providing obstetrical services at the birth of Bryan on August 7,

1622011, at Tampa General Hospital located in Tampa, Florida.

171DOAH served NICA with a copy of the Petition on October 10,

1832013. On October 15, 2013, DOAH received a return receipt from

194the United States Postal Ser vice showing that Tampa General

204Hospital had been served with a copy of the Petition. On

215October 15, 2013, DOAH received return receipt s from the United

226States Postal Service showing that Dr. Rao and Dr. Yankowitz had

237been served with a copy of the Petiti on.

246On November 3, 2014, NICA filed a Motion for Summary Final

257Order, asserting that Bryan did not sustain a "birth - related

268neurological injury" as that term is defined in section

277766.302(2), Florida Statutes. NICA represents in its Motion for

286Summary F inal Order that Petitioner has no objection to the

297granting of the motion. As of the date of this Summary Final

309Order of Dismissal, no petitions to intervene have been filed by

320Dr. Rao, Dr. Yankowitz, or Tampa General Hospital.

328FINDINGS OF FACT

3311. B ryan Alavez was born on August 7, 2011, at Tampa

343General Hospital located in Tampa, Florida. Bryan weighed 4,590

353grams at birth.

3562. Donald Willis, M.D. (Dr. Willis), was requested by NICA

366to review the medical records for Bryan. In a medical report

377date d July 14, 2014, Dr. Willis opined as follows:

387In summary, the mother had poorly controlled

394Gestational Diabetes, which most likely

399resulted in the large for gestational age

406(macrosomic) newborn and resulting shoulder

411dystocia. Umbilical cord blood gas wa s

418within normal limits, suggesting the baby did

425not have hypoxia during labor. However,

431newborn depression occurred, most likely

436related to shoulder dystocia. The Apgar was

4430 at one minute. Chest compressions and bag

451and mask ventilation were required a t birth.

459The baby improved and was taken to the NICU

468with respiratory depression requiring nasal

473canula oxygen. A fractured humerus occurred

479at time of shoulder dystocia delivery. The

486baby did not have seizures. Encephalopathy

492was not suspected. Imagin g studies of the

500brain were not done.

504The fetus did not suffer oxygen deprivation

511or mechanical trauma to the brain during

518labor. Some oxygen deprivation may have

524occurred as a result of the shoulder

531dystocia, as indicated by an Apgar score of 0

540at one m inute. However, there is no

548documentation that any significant brain

553injury resulted from this possible oxygen

559deprivation.

560There was an apparent obstetrical event,

566shoulder dystocia, but this does not appear

573to have resulted in any significant loss of

581o xygen or mechanical trauma to the babyÓs

589brain during labor, delivery, or the

595immediate post delivery period.

5993. NICA retained Raymond J. Fernandez, M.D.

606(Dr. Fernandez) , a pediatric neurologist, to examine Bryan and to

616review his medical records. Dr. Fernandez examined Bryan on

625September 15, 2014. In a medical report regarding his

634independent medical examination of Bryan, Dr. Fernandez opined as

643follows:

644IMPRESSION:

645Despite transient neurological depression

649immediately after birth, there is no eviden ce

657for substantial mental and motor impairment

663due to oxygen deprivation or mechanical

669injury of brain or spinal cord during labor,

677delivery, or within the immediate

682postdelivery period of resuscitation. This

687opinion is based on record review and

694clinical history and physical and

699neurodevelopmental examination. There was no

704suspicion o f perinatal encephalopathy while

710in the NICU or after discharge. Imaging of

718the brain and spinal cord has not been

726necessary.

727Bryan sustained a fracture of his left

734hume rus as a complication of shoulder

741dystocia and there was question of left

748brachial plexus injury causing left arm

754weakness. He appears to have subtle residual

761left upper extremity proximal weakness. This

767is due to mechanical injury of peripheral

774nerves ( brachial plexus). It is not due to

783oxygen deprivation or mechanical injury of

789brain or spinal cord.

7934. A review of the file in this case reveals that there

805have been no expert opinions filed that are contrary to the

816opinion of Dr. Willis that there was an apparent obstetrical

826event, shoulder dystocia, but this event does not appear to have

837resulted in any significant loss of oxygen or mechanical trauma

847to the baby's brain during labor, delivery, or the immediate post

858delivery period. Dr. WillisÓ opinion is credited. There are no

868contrary expert opinions filed that are contrary to

876Dr. FernandezÓs opinion that although Bryan appears to have

885subtle residual left upper extremity proximal weakness, this is

894due to mechanical injury to peripheral nerves, and i s not due to

907oxygen deprivation or mechanical injury of the brain or spinal

917cord. Dr. FernandezÓs opinion is credited.

923CONCLUSIONS OF LAW

9265. The Division of Administrative Hearings has jurisdiction

934over the parties to and the subject matter of these pro ceedings.

946§§ 766.301 - 766.316, Fla. Stat.

9526. The Plan was established by the Legislature "for the

962purpose of providing compensation, irrespective of fault, for

970birth - related neurological injury claims" relating to births

979occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

9907. The injured infant, her or his personal representative,

999parents, dependents, and next of kin may seek compensation under

1009the Plan by filing a claim for compensation with DOAH.

1019§§ 766.302(3), 766.303(2), and 766.3 05(1), Fla. Stat. NICA,

1028which administers the Plan, has "45 days from the date of service

1040of a complete claim . . . in which to file a response to the

1055petition and to submit relevant written information relating to

1064the issue of whether the injury is a bir th - related neurological

1077injury." § 766.305(4), Fla. Stat.

10828. If NICA determines that the injury alleged in a claim is

1094a compensable birth - related neurological injury, it may award

1104compensation to the claimant, provided that the award is approved

1114by the administrative law judge to whom the claim has been

1125assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1136disputes the claim, as it has in the instant case, the dispute

1148must be resolved by the assigned administrative law judge in

1158accordance with the provisions of chapter 120, Florida Statutes.

1167§§ 766.304, 766.309, and 766.31, Fla. Stat.

11749. In discharging this responsibility, the administrative

1181law judge must make the following determination based upon the

1191available evidence:

1193(a) Whether the i njury claimed is a birth -

1203related neurological injury. If the claimant

1209has demonstrated, to the satisfaction of the

1216administrative law judge, that the infant has

1223sustained a brain or spinal cord injury

1230caused by oxygen deprivation or mechanical

1236injury and that the infant was thereby

1243rendered permanently and substantially

1247mentally and physically impaired, a

1252rebuttable presumption shall arise that the

1258injury is a birth - related neurological injury

1266as defined in s. 766.303(2).

1271(b) Whether obstetrical service s were

1277delivered by a participating physician in the

1284course of labor, delivery, or resuscitation

1290in the immediate postdelivery period in a

1297hospital; or by a certified nurse midwife in

1305a teaching hospital supervised by a

1311participating physician in the cours e of

1318labor, delivery, or resuscitation in the

1324immediate postdelivery period in a hospital.

1330§ 766.309(1), Fla. Stat. An award may be sustained only if the

1342administrative law judge concludes that the "infant has sustained

1351a birth - related neurological inju ry and that obstetrical services

1362were delivered by a participating physician at birth."

1370§ 766.31(1), Fla. Stat.

137410. The term "birth - related neurological injury" is defined

1384in section 766.302(2) as follows:

"1389Birth - related neurological injury" means

1395inju ry to the brain or spinal cord of a live

1406infant weighing at least 2,500 grams for a

1415single gestation or, in the case of a

1423multiple gestation, a live infant weighing at

1430least 2,000 grams at birth caused by oxygen

1439deprivation or mechanical injury occurring i n

1446the course of labor, delivery, or

1452resuscitation in the immediate postdelivery

1457period in a hospital, which renders the

1464infant permanently and substantially mentally

1469and physically impaired.

147211. The evidence, which is not refuted, established that

1481Bryan did not sustain an injury to the brain or spinal cord

1493caused by oxygen deprivation or mechanical injury in the course

1503of labor, delivery, or resuscitation in the immediate post -

1513delivery period in a hospital. Therefore, Bryan is not eligible

1523for benefits under the Plan.

1528CONCLUSION

1529Based upon the foregoing Findings of Fact and Conclusions of

1539Law, it is ORDERED that the Petition filed by Lu r crecia Alavez,

1552on behalf of Bryan Al a vez, is dismissed with prejudice.
