71STATEMENT OF THE CASE

75On October 3, 2013, Petitioner, Ofelia Santiago,

82individually and on behalf of April Santiago (April), a minor,

92filed a Petition Under Protest Pursuant to Florida Statute

101Section 766.301 et se q . (Petition) with th e Division of

113Administrative Hearings (DOAH) for a determination of

120compensability under the Florida Birth - Related Neurological

128Injury Compensation Plan (Plan). The Petition named Dr. Sharon

137Young Byun and Dr. Lindsey Malloch as the physicians providing

147o bstetric services at the birth of April at Shands Teaching

158Hospital in Gainesville, Florida.

162DOAH served NICA with a copy of the Petition on October 10,

1742013. DOAH served a copy of the Petition on Shands Hospital on

186October 14, 2013. On October 15, 2013, DOAH received a receipt

197from the United States Postal Service showing that Dr. Byun had

208been served with a copy of the Petition. On October 30, 2013,

220DOAH received a receipt from the United States Postal Service

230showing that Dr. Malloch had been served w ith a copy of the

243Petition. As of the date of the Summary Final Order of

254Dismissal, Shands Teaching Hospital, Dr. Byun, and Dr. Malloch

263have not petitioned to intervene in this proceeding.

271On March 17, 2014, NICA filed a Motion for Summary Final

282Order, as serting that April did not sustain a "birth - related

294neurological injury" as that term is defined in section

303766.302(2), Florida Statutes. The motion was heard by telephonic

312conference call on April 2, 2014, and counsel for Petitioner

322advised that Petition er had no objection to the granting of the

334motion.

335FINDINGS OF FACT

3381. April Santiago was born on November 23, 2011, at Shands

349Teaching Hospital in Gainesville, Florida. April weighed in

357excess of 2,500 grams at the time of her birth .

3692. Donald Willis, M.D. (Dr. Willis), was requested by NICA

379to review the medical records of April. Based on his review of

391the medical records, Dr. Willis opined as follows:

399In summary, the mother presented to the

406hospital with an imminent delivery, which was

413complicated b y a shoulder dystocia. The baby

421was depressed at birth, but recovered

427quickly. The umbilical cord blood pH of 7.19

435was within normal limits and consistent with

442no significant hypoxia during labor or

448delivery. By DOL 2 the respiratory

454depression had reso lved and the child was on

463room air and taking oral feedings. The baby

471was stable and would consider the post -

479delivery resuscitation period to be over.

485On DOL 5 the baby had a renal artery

494thrombosis, which caused a hypertensive

499crisis and resulted in cer ebral hemorrhage

506and brain damage.

509There was no apparent obstetrical event that

516resulted in loss of oxygen or mechanical

523trauma to the babyÓs brain or spinal cord

531during labor, delivery or the immediate post

538delivery period. The baby did have trauma at

546t ime of delivery, which included a fractured

554humerus and clavicle, but no trauma to the

562spine or brain. The baby was stable and

570would be considered out of the post - delivery

579resuscitation period when a renal artery

585thrombosis, hypertensive crisis and result ing

591cerebral hemorrhage occurred.

5943. A review of the file does not show any contrary opinion

606to Dr. WillisÓ opinion that the claim is not compensable under

617the Plan. The opinion of Dr. Willis that April did not sustain a

630birth - related neurological injur y is credited.

638CONCLUSIONS OF LAW

6414. The Division of Administrative Hearings has jurisdiction

649over the parties to and the subject matter of these proceedings.

660§§ 766.301 - 766.316, Fla. Stat.

6665. The Plan was established by the Legislature "for the

676p urpose of providing compensation, irrespective of fault, for

685birth - related neurological injury claims" relating to births

694occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

7056. The injured infant, her or his personal representative,

714parents, dependents, and next of kin may seek compensation under

724the Plan by filing a claim for compensation with DOAH.

734§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

742which administers the Plan, has "45 days from the date of service

754of a compl ete claim . . . in which to file a response to the

770petition and to submit relevant written information relating to

779the issue of whether the injury is a birth - related neurological

791injury." § 766.305(4), Fla. Stat.

7967. If NICA determines that the injury al leged in a claim is

809a compensable birth - related neurological injury, it may award

819compensation to the claimant, provided that the award is approved

829by the administrative law judge to whom the claim has been

840assigned. § 766.305(7), Fla. Stat. If, on the o ther hand, NICA

852disputes the claim, as it has in the instant case, the dispute

864must be resolved by the assigned administrative law judge in

874accordance with the provisions of chapter 120, Florida Statutes.

883§§ 766.304, 766.309, and 766.31, Fla. Stat.

8908. I n discharging this responsibility, the a dministrative

899l aw j udge must make the following determination based upon the

911available evidence:

913(a) Whether the injury claimed is a birth -

922related neurological injury. If the claimant

928has demonstrated, to the satis faction of the

936administrative law judge, that the infant has

943sustained a brain or spinal cord injury

950caused by oxygen deprivation or mechanical

956injury and that the infant was thereby

963rendered permanently and substantially

967mentally and physically impaired, a

972rebuttable presumption shall arise that the

978injury is a birth - related neurological injury

986as defined in s. 766.303(2).

991(b) Whether obstetrical services were

996delivered by a participating physician in the

1003course of labor, delivery, or resuscitation

1009in the immediate postdelivery period in a

1016hospital; or by a certified nurse midwife in

1024a teaching hospital supervised by a

1030participating physician in the course of

1036labor, delivery, or resuscitation in the

1042immediate postdelivery period in a hospital.

1048§ 766.3 09(1), Fla. Stat. An award may be sustained only if the

1061administrative law judge concludes that the "infant has sustained

1070a birth - related neurological injury and that obstetrical services

1080were delivered by a participating physician at birth."

1088§ 766.31(1) , Fla. Stat.

10929. The term "birth - related neurological injury" is defined

1102in section 766.302(2) as follows:

"1107Birth - related neurological injury" means

1113injury to the brain or spinal cord of a live

1123infant weighing at least 2,500 grams for a

1132single gestation or, in the case of a

1140multiple gestation, a live infant weighing at

1147least 2,000 grams at birth caused by oxygen

1156deprivation or mechanical injury occurring in

1162the course of labor, delivery, or

1168resuscitation in the immediate postdelivery

1173period in a hospital, which renders the

1180infant permanently and substantially mentally

1185and physically impaired.

11881 0 . The evidence, which is not refuted, established that

1199April did not sustain an injury to the brain or spinal cord

1211caused by oxygen deprivation or mechanical inj ury during labor,

1221delivery, or resuscitation in the immediate post - delivery period;

1231thus, April has not sustained a birth - related neurological

1241injury. Therefore, April is not eligible for benefits under the

1251Plan.

1252CONCLUSION

1253Based upon the foregoing Findi ngs of Fact and Conclusions of

1264Law, it is ORDERED that the Petition filed by Ofelia Santiago,

1275individually, and on behalf of April Santiago, is dismissed with

1285prejudice.
