59This cause came on for consideration upon a Motion fo r
70Summary Final Order filed by Respondent, Florida Birth - Related
80Neurological Injury Compensation Association (NICA), on July 3,
882014.
89STATEMENT OF THE CASE
93On October 9, 2013, Petitioners, Julie E. Smith and Mark L.
104McMillan, individually and on behalf o f Coleman McMillan
113(Coleman), a minor, filed a Petition Under Protest Pursuant to
123Florida Statute Section 766.301 et seq. (Petition) with the
132Division of Administrative Hearings (DOAH) for a determination of
141compensability under the Florida Birth - Related N eurological
150Injury Compensation Plan (Plan). The Petition named Amy D.
159Greenwald, M.D., as the physician providing obstetrical services
167at the birth of Coleman on December 12, 2012, at Baptist Health
179System located in Jacksonville, Florida.
184DOAH served NI CA with a copy of the Petition on October 11,
1972013. On October 17, 2013, DOAH received a return receipt from
208the United States Postal Service showing that Dr. Greenwald had
218been served with a copy of the Petition. On October 23, 2013,
230DOAH received a ret urn receipt showing that Baptist Health System
241had been served with a copy of the Petition.
250On December 18, 2013, Southern Baptist Hospital of Florida,
259Inc. , d/b/a Baptist Medical Center South filed a Petition for
269Leave to Intervene, which was granted by O rder dated January 6,
2812014. As of the date of this Summary Final Order of Dismissal,
293Dr. Greenwald has not petitioned to intervene in this proceeding.
303On July 3, 2014, NICA filed a Motion for Summary Final
314Order, asserting that Coleman did not sustain a " birth - related
325neurological injury" as that term is defined in section
334766.302(2), Florida Statutes. The motion was served by
342electronic mail on July 3, 2014. Respondent represented in its
352motion that Intervenor had no objection to the granting of the
363mot ion, and that Petitioners had an objection because they wanted
374to take the depositions of RespondentÓs experts. As of the date
385of the Summary Final Order of Dismissal, Petitioners have filed
395no response to the Motion for Summary Final Order nor have they
407requested additional time to respond to the motion.
415FINDINGS OF FACT
4181. Coleman McMillan was born on December 12, 2012, at
428Baptist Medical Center South located in Jacksonville, Florida.
436Coleman weighed 3,690 grams at birth.
4432. Donald Willis, M.D. (Dr . Willis), was requested by NICA
454to review the medical records for Coleman, to determine whether
464an injury occurred in the course of labor, delivery, or
474resuscitation in the immediate post - delivery period in the
484hospital due to oxygen deprivation or mechan ical injury occurring
494in the course of labor, delivery, or resuscitation in the
504immediate post - delivery period. Dr. Willis described his
513findings as follows:
516In summary: The mother had well - controlled
524hypertension during pregnancy. She was
529followed twic e weekly for fetal testing.
536There was no documentation of fetal distress
543prior to labor. The baby was depressed at
551birth, requiring resuscitation. A cord blood
557gas was apparently not done. The initial
564blood gas in the NICU was consistent with
572acidosis. Abnormal fetal tone was noted
578shortly after delivery. MRI on DOL 2 was
586consistent with anoxic brain injury.
591There was an apparent obstetrical event that
598resulted in loss of oxygen to the babyÓs
606brain during delivery and continuing into the
613immediate po st delivery period. Oxygen
619deprivation was likely present during labor,
625but without reviewing the FHR tracing I am
633reluctant to make a statement concerning this
640issue.
641After a review of the fetal heart rate monitor tracing,
651Dr. Willis concluded that ther e was no significant oxygen
661deprivation during labor.
6643. NICA retained Raymond J. Fernandez, M.D., a pediatric
673neurologist, to examine Coleman and to review his medical
682records. Dr. Fernandez examined Coleman on May 29, 2014, and
692made the following findi ngs:
697Coleman was active and energetic during much
704of the examination. He usually turned when
711his name was called, and maintained good eye
719contact. Towards the end of the examination
726Coleman sat calmly on his fatherÓs lap and
734again maintained good eye con tact. He
741displayed appropriate stranger anxiety. He
746pointed and made grunting sounds. No words
753were spoken. He carried out age - appropriate
761verbal requests. He opened the door on
768request without visual cues, looked up at the
776light when I asked him wher e is the light,
786lifted his shirt when I asked him to show me
796his shirt and pointed to his fatherÓs nose
804when I asked him to touch his nose. He
813scribbled with pen and paper and pushed the
821button on the pen before he handed it back to
831me. He stacked four, one - inch cubes using
840either hand in well - coordinated fashion. He
848walked and ran well. He was able to squat,
857pick up objects and shift to stand without
865difficulty. He was able to throw a ball
873overhand. Muscle tone was normal. He
879reached accurately with either hand. There
885was no tremor, ataxia or involuntary
891movement. Deep tendon reflexes were 2
897throughout. There were no pathologic
902reflexes. Limited funduscopic examination
906was normal. Eye movement was normal and he
914was visually attentive. Face was symmetric.
920He swallowed well. Palate elevated at
926midline. Tongue was midline.
9304. Based on his review of the medical records and his
941examination of Coleman, Dr. Fernandez opined as follows:
949There is no evidence for substantial motor
956impairment. Colem anÓs motor examination is
962normal, both with regard to fine and gross
970motor control and muscle tone is normal.
977There is no evidence for substantial mental
984impairment at this time. Expressive speech
990is delayed, but he displays normal or age -
999appropriate pre verbal skills and he appears
1006to have age - appropriate comprehension of
1013language. Expressive speech will probably
1018improve within a reasonable period of time.
1025Coleman sustained an hypoxic brain injury,
1031probably during labor and delivery, but there
1038is no evi dence for substantial mental and
1046motor impairment that will be permanent.
10525. A review of the file in this case reveals that there
1064have been no expert opinions filed that are contrary to the
1075opinions of Dr. Willis and Dr. Fernandez that there was an
1086obste trical event that resulted in loss of oxygen to the brain.
1098Their opinions are credited. There are no contrary expert
1107opinions filed that are contrary to Dr. FernandezÓs opinion that
1117there is no evidence for a substantial motor or mental impairment
1128that w ill be permanent. Dr. FernandezÓs opinion is credited.
1138CONCLUSIONS OF LAW
11416. The Division of Administrative Hearings has jurisdiction
1149over the parties to and the subject matter of these proceedings.
1160§§ 766.301 - 766.316, Fla. Stat.
11667. The Plan was esta blished by the Legislature "for the
1177purpose of providing compensation, irrespective of fault, for
1185birth - related neurological injury claims" relating to births
1194occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
12058. The injured infant, her or h is personal representative,
1215parents, dependents, and next of kin may seek compensation under
1225the Plan by filing a claim for compensation with DOAH.
1235§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1243which administers the Plan, has "45 day s from the date of service
1256of a complete claim . . . in which to file a response to the
1271petition and to submit relevant written information relating to
1280the issue of whether the injury is a birth - related neurological
1292injury." § 766.305(4), Fla. Stat.
12979. If NICA determines that the injury alleged in a claim is
1309a compensable birth - related neurological injury, it may award
1319compensation to the claimant, provided that the award is approved
1329by the administrative law judge to whom the claim has been
1340assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1351disputes the claim, as it has in the instant case, the dispute
1363must be resolved by the assigned administrative law judge in
1373accordance with the provisions of chapter 120, Florida Statutes.
1382§§ 766.304, 7 66.309, and 766.31, Fla. Stat.
139010. In discharging this responsibility, the a dministrative
1398l aw j udge must make the following determination based upon the
1410available evidence:
1412(a) Whether the injury claimed is a birth -
1421related neurological injury. If the c laimant
1428has demonstrated, to the satisfaction of the
1435administrative law judge, that the infant has
1442sustained a brain or spinal cord injury
1449caused by oxygen deprivation or mechanical
1455injury and that the infant was thereby
1462rendered permanently and substantia lly
1467mentally and physically impaired, a
1472rebuttable presumption shall arise that the
1478injury is a birth - related neurological injury
1486as defined in s. 766.303(2).
1491(b) Whether obstetrical services were
1496delivered by a participating physician in the
1503course of labor, delivery, or resuscitation
1509in the immediate postdelivery period in a
1516hospital; or by a certified nurse midwife in
1524a teaching hospital supervised by a
1530participating physician in the course of
1536labor, delivery, or resuscitation in the
1542immediate postdel ivery period in a hospital.
1549§ 766.309(1), Fla. Stat. An award may be sustained only if the
1561administrative law judge concludes that the "infant has sustained
1570a birth - related neurological injury and that obstetrical services
1580were delivered by a participat ing physician at birth."
1589§ 766.31(1), Fla. Stat.
159311. The term "birth - related neurological injury" is defined
1603in section 766.302(2) as follows:
"1608Birth - related neurological injury" means
1614injury to the brain or spinal cord of a live
1624infant weighing at lea st 2,500 grams for a
1634single gestation or, in the case of a
1642multiple gestation, a live infant weighing at
1649least 2,000 grams at birth caused by oxygen
1658deprivation or mechanical injury occurring in
1664the course of labor, delivery, or
1670resuscitation in the immedi ate postdelivery
1676period in a hospital, which renders the
1683infant permanently and substantially mentally
1688and physically impaired.
169112. The evidence, which is not refuted, established that
1700most likely Coleman did sustain an injury to the brain caused by
1712oxy gen deprivation occurring in the course of delivery. The
1722evidence does not establish that the brain injury resulted in
1732permanent and substantial mental and physical impairments.
1739Therefore, Coleman is not eligible for benefits under the Plan.
1749CONCLUSION
1750Based upon the foregoing Findings of Fact and Conclusions of
1760Law, it is ORDERED that the Petition filed by Julie E. Smith and
1773Mark L. McMillan, individually and on behalf of Coleman McMillan,
1783is dismissed with prejudice.
