111Whether Petitioner, B elinda Traylor, complied with the

134PRELIMINARY STATEMENT
136On September 23, 20 1 3, the Florida Commission on Human
147Relations (FCHR) issued a Notice of Determination: No Cause, in
157response to a complaint Petitioner, Belinda Trayler , filed
165against Disney World/Walt Disney. 1/ On Oct ober 10, 2013,
175Petitioner executed an FCHR Petition for Hearing form (Petition) ,
184checking the statement that " This is a Petition for Relief from
195(check the applicable one): Unlawful Employment Practice . 2/
204On October 21, 2013, FCHR transmitted Petitioner ' s Petition
214for Relief 3 / to the Division. The matter was assigned to the
227undersigned.
228Based on filings that are explained in more detail below , it
239has been concluded by the undersigned that this case should be
250dismissed without a final hearing.
255FINDINGS OF FACT
2581. On or about March 30, 2013, Petitioner filed an
268employment complaint of discrimination with FCHR, alleging that
276Disney World/Walt Disney had discriminated against her on the
285basis of sex and religion.
2902. On September 13, 2013, FCHR entered a N otice of
301Determination: No Cause (Notice), concluding that there was no
310reasonable cause to believe that an unlawful employment practice
319had been committed against Petitioner.
3243. In the Notice Petitioner was informed of the following:

3624. In he r October Petition, Petitioner provided her name,
372the FCHR case number, her address and phone number, a c heck mark
385indicating " Respondent has violated the Florida Civil Rights Act
394of 1992, as Amended, " the date the form was signed, and her
406signature. Petitioner did not supply: Respondent ' s name,
415address, or telephone number; the " specifically described " mann er
424in which Respondent violated the Florida Civil Rights Act of
4341992; the disputed issue s of material fact, if any; or the
446ultimate facts alleged and entitlement to relief .
4545. On November 1, 2013, Respondent filed a Motion to
464Dismiss (Motion). The Motio n set forth that Petitioner had
474. . . f ailed to supply in her petition both
485a statement of all disputed issues of
492material fact and a concise statement of the
500ultimate facts alleged, including the
505specific facts that she contends warrant
511reversal or modi fication of the September 23,
5192013 [sic] No Cause determination by the
526Florida Commission on Human R elations (FCHR).
5336 . On November 5, 2013, an Order to Show Cause was entered
546by the undersigned. Therein Petitioner was afforded until
5545:00 p.m., Novemb er 18, 2013, to file a written statement setting
566forth the facts surrounding her claim of discrimination.
574Petitioner was told to include the information required by
583Florida Administrative Code Rule 28 - 106.201. Additionally,
591Petitioner was advised that a failure to file a written statement
602by the deadline " or a failure to set forth facts which, if proven
615at the hearing would show discrimination, may result in the entry
626of a recommended order of dismissal. "
6327 . On November 12, 2013, Petitioner filed the fo llowing: 4/

652the cause for this petition. That I was
660Harassed, and Abused ,also about my religious
667background from fellow employers. I was
673fired without a just cause. The days I was
682out were due to my legal gr andson emotion. I
692have the legal guardianship from the courts
699which I will bring with me also to court. He
709has adhd, bipolar, anger issues.
714Disney did not accept these paper words. As
722the results of all this we are currently on
731welfare and living day by day. I came down
740in 2006 for my internship. An they asked me
749to stay so I remained here. I am a 53 year
760old single woman trying to raised to kids.
768An for a 53 year old woman jobs are not easy

7848 . On November 13, 2013, Respondent ' s Re newed Motion to
797Dismiss was filed. Respondent set forth as its basis for
807dismissal that Petitioner ' s response fails to comply with r ule
81928 - 106.201 and the requirements of the FCHR ' s Petition for
832Relief.
8339 . Petitioner ' s November 12, 2013, response fails to
844provide the following: rule 28 - 106.201(2)(d) , a statement of all
855disputed issues of material fact; rule 28 - 106.201(2)(e) , a
865concise statement of the ultimate facts alleged, including the
874specific facts the petitioner contends warrant reversal or
882modifi cation of the agency ' s proposed action; rule 28 -
894106.201(2)(f) , an explanation of how the alleged facts relate to
904the specific rules or statutes [alleged to be violated]; and rule
91528 - 106.201(2)(g) , a statement of the relief sought, stating
925precisely the act ion petitioner wishes the agency to take with
936respect to the agency ' s proposed action.
944CONCLUSIONS OF LAW
94710 . The Division of Administrative Hearings has
955jurisdiction of the parties and the subject matter of this
965proceeding. §§ 120.569, 120.57(1), Fla . Stat . (201 3 ).
9761 1 . Petitioner has the burden to state " the ultimate facts ,
988to identify the facts that are in dispute, and to allege the
1000facts that warrant, in the petitioner ' s opinion , reversal. "
1010Brookwood Extended Care Ctr. o f Homestead, L.L.P. v. AHCA , 870
1021So. 2d 834 , 840 (Fla . 3d DCA 2003). Petitioner was afforded the
1034opportunity to provide the requisite information to enable
1042Respondent to know the specific allegations of discrimination.
1050Petitioner did not do so.
10551 2 . The hearing scheduled for January 3, 2014 , is canceled.
1067RECOMMENDATION
1068Based on foregoing Findings of Fact and Conclusions of Law,
1078it is r ecommended that a final order be entered by the Florida
1091Commission on Human Relations dismissing the Petition for Relief.
