73STATEMENT OF THE CASE

77On October 23, 2013, Petitioner, Ginelle Thomas, as mother

86and natural guardian of Tristan N . Thomas (Tristan), a minor,

97filed a Petition for Benefits Pursuant to Florida Statutes

106Section 766.301 et se q . (Petition) with the Division of

117Administrative Hearings (DOAH) for a determination of

124compensability under the Florida Birth - Related Neurological

132Injury Compensation Plan (Plan). The Petition named Felicia Fox,

141M.D., as the physician providing obstetric s ervices at the birth

152of Tristan at Baptist Medical Center in Jacksonville, Florida.

161DOAH served NICA with a copy of the Petition on October 28,

1732013. DOAH served Dr. Fox with a copy of the Petition on

185October 29, 2013. On December 23, 2013, DOAH received a receipt

196from the United States Postal Service showing that Baptist

205Medical Center had been served with a copy of the Petition. As

217of the date of th is Summary Final Order of Dismissal, neither

229Baptist Medical Center nor Dr. Fox has petitioned to interve ne in

241this proceeding.

243On February 25, 2014, NICA filed a Motion for Summary Final

254Order, asserting that Tristan did not sustain a "birth - related

265neurological injury" as that term is defined in section

274766.302(2), Florida Statutes. On February 26, 2014, P etitioner

283filed PetitionerÓs Unopposed Motion for Extension of Time to

292Respond to RespondentÓs Motion for Summary Final Order, which was

302granted by Order dated February 26, 2014, extending the time for

313responding to the Motion for Summary Final Order to Ap ril 18,

3252014.

326On April 17, 2014, the parties filed a Joint Response to

337Order of February 7, 2014, in which they stated:

3461. The parties have conferred and they do

354not believe that a hearing is needed at this

363time.

3642. The parties will await the Administ rative

372Law JudgeÓs ruling on the pending Motion for

380Summary Final Order filed by the Respondent,

387as well as the ALJÓs review of the underlying

396records filed by the Petitioner in

402conjunction with the Petition for Benefits.

408Other than the joint response fil ed on April 17, 2014, Petitioner

420has made no response to the Motion for Summary Final Order. Any

432underlying medical records filed by Petitioner with her Petition

441would have been forwarded to Respondent, and would not be

451retained by DOAH. Thus, the unders igned has no medical records

462to review other than those filed by Respondent in support of it s

475Motion for Summary Final Order.

480FINDINGS OF FACT

483istan N . Thomas was born on August 12, 2009, at

494Baptist Medical Center in Jacksonville, Florida. Trist an weighed

503in excess of 2,500 grams.

5092. Donald Willis, M.D., was requested by NICA to review the

520medical records of Tristan. Based on his review of the medical

531records, Dr. Willis opined as follows:

537In summary, labor was complicated by

543hypertension and a placental abruption. This

549resulted in a depressed baby at birth. Full

557resuscitation was required. The initial

562blood gas after birth was consistent with

569severe acidosis with a pH of 6.6. Seizures

577developed shortly after birth. EEG and MRI

584were consis tent with HIE.

589There was an apparent obstetrical event that

596resulted in loss of oxygen to the babyÓs

604brain during labor, delivery, and continuing

610into the immediate post delivery period.

616This oxygen deprivation resulted in brain

622injury. I am not able to comment about the

631severity of the brain injury.

6363. Michael S. Duchowny, M.D., was requested by NICA to

646perform an independent medical evaluation of Tristan. The

654evaluation was done on January 22, 2014. Based on his

664evaluation, Dr. Duchowny opined as f ollows:

671In summary, TristanÓs neurologic examination

676reveals evidence of multiple developmental

681delays in the social, communication and

687behavioral domains. His findings are

692consistent with a clinical diagnosis of

698autism spectrum disorder and there are no

705specific focal or lateralizing findings to

711suggest structural brain damage.

715I had an opportunity to review medical

722records supplied to me which confirmed the

729history obtained from TristanÓs mother.

734Tristan was delivered at term a t Baptist

742Medical Center. His mother suffered from

748preeclampsia and was treated with magnesium

754sulfateistan was delivered by emergency

759cesarean section due to placental abruption,

765required resuscitation at birth and had Apgar

772scores of 0, 3, and 7 at 1, 5, and 10

783minutes. H is cord blood gases revealed

790severe acidosis and he was placed in a head

799cooling protocol for 72 hours following

805stabilization. However, an ultrasound of the

811brain on August 17, 2009 was negative as was

820an MRI scan performed on August 18, 2009.

828In summar y, the findings on examination today

836together with the medical history did not

843provide evidence of significant brain damage

849and Tristan does not suffer from a

856substantial motor impairment. Furthermore,

860his neurological problems did not, in my

867opinion resu lt from either mechanical injury

874or oxygen deprivation acquired in the course

881of labor and delivery. His autism spectrum

888disorder is a primary developmental

893disability of prenatal origin. I, therefore,

899believe that Tristan should not be considered

906for ad mission into the NICA program.

9134 . A review of the file does not show any contrary opinion

926to Dr. WillisÓ opinion that Tristan did sustain oxygen

935deprivation during labor, delivery, and resuscitation in the

943immediate post - delivery period Plan. Dr. Willis could not

953comment on the extent of any brain injury that resulted from the

965oxygen deprivation. Dr. Duchowny opines that Tristan does not

974suffer from significant brain damage and that Tristan does not

984have a substantial motor impairment. These opinions a re not

994disputed and are credited.

998CONCLUSIONS OF LAW

10015 . The Division of Administrative Hearings has jurisdiction

1010over the parties to and the subject matter of these proceedings.

1021§§ 766.301 - 766.316, Fla. Stat.

10276 . The Plan was established by the Legis lature "for the

1039purpose of providing compensation, irrespective of fault, for

1047birth - related neurological injury claims" relating to births

1056occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10677 . The injured infant, her or his personal represen tative,

1078parents, dependents, and next of kin may seek compensation under

1088the Plan by filing a claim for compensation with DOAH.

1098§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1106which administers the Plan, has "45 days from the date of s ervice

1119of a complete claim . . . in which to file a response to the

1134petition and to submit relevant written information relating to

1143the issue of whether the injury is a birth - related neurological

1155injury." § 766.305(4), Fla. Stat.

11608 . If NICA determines t hat the injury alleged in a claim is

1174a compensable birth - related neurological injury, it may award

1184compensation to the claimant, provided that the award is approved

1194by the administrative law judge to whom the claim has been

1205assigned. § 766.305(7), Fla. St at. If, on the other hand, NICA

1217disputes the claim, as it has in the instant case, the dispute

1229must be resolved by the assigned administrative law judge in

1239accordance with the provisions of chapter 120, Florida Statutes.

1248§§ 766.304, 766.309, and 766.31, Fla. Stat.

12559 . In discharging this responsibility, the a dministrative

1264l aw j udge must make the following determination based upon the

1276available evidence:

1278(a) Whether the injury claimed is a birth -

1287related neurological injury. If the claimant

1293has demonstra ted, to the satisfaction of the

1301administrative law judge, that the infant has

1308sustained a brain or spinal cord injury

1315caused by oxygen deprivation or mechanical

1321injury and that the infant was thereby

1328rendered permanently and substantially

1332mentally and phys ically impaired, a

1338rebuttable presumption shall arise that the

1344injury is a birth - related neurological injury

1352as defined in s. 766.303(2).

1357(b) Whether obstetrical services were

1362delivered by a participating physician in the

1369course of labor, delivery, or r esuscitation

1376in the immediate postdelivery period in a

1383hospital; or by a certified nurse midwife in

1391a teaching hospital supervised by a

1397participating physician in the course of

1403labor, delivery, or resuscitation in the

1409immediate postdelivery period in a hos pital.

1416§ 766.309(1), Fla. Stat. An award may be sustained only if the

1428administrative law judge concludes that the "infant has sustained

1437a birth - related neurological injury and that obstetrical services

1447were delivered by a participating physician at birt h."

1456§ 766.31(1), Fla. Stat.

146010 . The term "birth - related neurological injury" is defined

1471in section 766.302(2) as follows:

"1476Birth - related neurological injury" means

1482injury to the brain or spinal cord of a live

1492infant weighing at least 2,500 grams for a

1501single gestation or, in the case of a

1509multiple gestation, a live infant weighing at

1516least 2,000 grams at birth caused by oxygen

1525deprivation or mechanical injury occurring in

1531the course of labor, delivery, or

1537resuscitation in the immediate postdelivery

1542peri od in a hospital, which renders the

1550infant permanently and substantially mentally

1555and physically impaired.

155811. The evidence, which is not refuted, established that

1567while Tristan may have sustained oxygen deprivation during labor,

1576delivery, and resuscita tion in the immediate post - delivery

1586period , such oxygen deprivation has not resulted in an injury

1596which renders Tristan permanently and substantially mentally and

1604physically impaired. Thus, Tristan has not sustained a birth -

1614related neurological injury and is not eligible for benefits

1623under the Plan.

1626CONCLUSION

1627Based upon the foregoing Findings of Fact and Conclusions of

1637Law, it is ORDERED that the Petition filed by Ginelle Thomas, as

1649mother and natural guardian of Tristan N. Thomas, is dismissed

1659with prej udice.
