89STATEMENT OF THE CASE

93On October 22, 2013, Petitioner, Mayum i Perez, individually

102and on behalf of Christopher Perez ( Christopher), a minor, filed

113a Petition Under Protest Pursuant to Florida Statute Section

122766.301 et seq. (Petition) with the Division of Administrative

131Hearings (DOAH) for a determination of compensability under the

140Florida Birth - Related Neurological Inju ry Compensation Plan

149(Plan). The Petition named Adam Scott Levine, M.D., and

158Urmila Patel, M.D. as the physicians providing obstetric services

167at the birth of Christopher on May 16, 2007, at St. JosephÓs

179Medical Center located in Tampa, Florida.

185DOAH se rved NICA with a copy of the Petition on October 28,

1982013. DOAH served copies of the Petition on Dr. Patel,

208Dr. Levine, and St. JosephÓs Medical Center by certified mail and

219received receipts from the United States Postal on October 30,

2292013, showing that the Petition had been received by Dr. Patel

240and St. JosephÓs Medical Center. On November 4 , 2013, DOAH

250received a receipt from the United States Postal Service showing

260that Dr. Levine had been served with a copy of the Petition.

272On November 13, 2013, Dr. Levine filed a Petition to

282Intervene, which was granted by Order dated On December 2, 2013.

293On November 14, 2013, Tampa Obstetrics, P.A., and Dr. Patel filed

304a Petition and Motion to Intervene, which was granted by Order

315dated December 3, 2013. On Decem ber 2, 2013, St. JosephÓs

326WomenÓs Hospital filed a Petition and Motion to Intervene, which

336was granted by Order dated December 17, 2013.

344On May 8, 2014, NICA filed a Motion for Summary Final Order,

356asserting that Christopher did not sustain a "birth - relat ed

367neurological injury" as that term is defined in section

376766.302(2), Florida Statutes, and that any claim for compensation

385under the Plan is barred by the statute of limitations.

395As of the date of this Summary Final Order of Dismissal, no

407response has been filed by the Petitioners or by Intervenors.

417FINDINGS OF FACT

4201. Christopher Perez was born on May 16, 2007, at St.

431JosephÓs Medical Center in Tampa, Florida. Christopher weighed

4393,470 grams at birth.

4442. Donald Willis, M.D. (Dr. Willis) , was reques ted by NICA

455to review the medical records for Christopher to determine

464whether an injury occurred in the course of labor, delivery, or

475resuscitation in the immediate post - delivery period in the

485hospital due to oxygen deprivation or mechanical injury occurr ing

495in the course of labor, delivery, or resuscitation in the

505immediate post - delivery period. In a report dated December 6,

5162013, Dr. Willis described his findings as follows:

524In summary, there was no fetal distress

531during labor. Cesarean section deliver y was

538uncomplicated. The baby was not distressed

544at birth and was taken from the delivery room

553in his motherÓs arms. The baby was

560transferred to the NICU at about seven hour s

569of life due to temperature instability and an

577elevated white blood count. Bloo d cultures

584were negative. Newborn hospital course was

590otherwise uncomplicated.

592There was no apparent obstetrical event that

599resulted in loss of oxygen or mechanical

606trauma to the baby's brain during labor,

613delivery, or in the immediate post delivery

620peri od .

6233. NICA retained Raymond J. Fernandez, M.D., a pediatric

632neurologist, to examine Christopher and to review the medical

641records of Christopher. On January 30, 2014, Dr. Fernandez

650examined Christopher. Dr. Fernandez made the following findings:

658There was no evidence on examination for

665substantial physical (motor) impairment.

669There is evidence for substantial mental

675(cognitive) impairment, characterized mainly

679by learning difficulty and difficulty with

685processing of speech and language. I suspect

692tha t Christopher will prove to continue to

700experience significant learning difficulty,

704especially as learning becomes more complex.

710There is no evidence in the record that would

719indicate ChristopherÓs substantial mental

723impairment to be due to neurological in jury

731to the brain or spinal cord caused by oxygen

740deprivation or mechanical injury during

745labor, delivery, or the immediate post

751delivery period.

7534. A review of the file in this case reveals that there

765have been no expert opinions filed that are contrary to the

776opinions of Dr. Willis and Dr. Fernandez. The opinions of

786Dr. Willis and Dr. Fernandez that Christopher did not suffer a

797neurological injury due to oxygen deprivation or mechanical

805injury during labor, delivery, or the immediate post - delivery

815peri od are credited. Dr. Fernandez 's opinion that Christopher

825does not have a substantial motor impairment is credited.

834CONCLUSIONS OF LAW

8375. The Division of Administrative Hearings has jurisdiction

845over the parties to and the subject matter of these proceedings.

856§§ 766.301 - 766.316, Fla. Stat.

8626. The Plan was established by the Legislature "for the

872purpose of providing compensation, irrespective of fault, for

880birth - related neurological injury claims" relating to births

889occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

9007. The injured infant, her or his personal representative,

909parents, dependents, and next of kin may seek compensation under

919the Plan by filing a claim for compensation with DOAH.

929§§ 766.302(3), 766.303(2), and 76 6.305(1), Fla. Stat. NICA,

938which administers the Plan, has "45 days from the date of service

950of a complete claim . . . in which to file a response to the

965petition and to submit relevant written information relating to

974the issue of whether the injury is a birth - related neurological

986injury." § 766.305(4), Fla. Stat.

9918. If NICA determines that the injury alleged in a claim is

1003a compensable birth - related neurological injury, it may award

1013compensation to the claimant, provided that the award is approved

1023by t he administrative law judge to whom the claim has been

1035assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1046disputes the claim, as it has in the instant case, the dispute

1058must be resolved by the assigned administrative law judge in

1068accordance w ith the provisions of chapter 120, Florida Statutes.

1078§§ 766.304, 766.309, and 766.31, Fla. Stat.

10859. In discharging this responsibility, the Administrative

1092Law Judge must make the following determination based upon the

1102available evidence:

1104(a) Whether th e injury claimed is a birth -

1114related neurological injury. If the claimant

1120has demonstrated, to the satisfaction of the

1127administrative law judge, that the infant has

1134sustained a brain or spinal cord injury

1141caused by oxygen deprivation or mechanical

1147injury a nd that the infant was thereby

1155rendered permanently and substantially

1159mentally and physically impaired, a

1164rebuttable presumption shall arise that the

1170injury is a birth - related neurological injury

1178as defined in s. 766.303(2).

1183(b) Whether obstetrical serv ices were

1189delivered by a participating physician in the

1196course of labor, delivery, or resuscitation

1202in the immediate postdelivery period in a

1209hospital; or by a certified nurse midwife in

1217a teaching hospital supervised by a

1223participating physician in the co urse of

1230labor, delivery, or resuscitation in the

1236immediate postdelivery period in a hospital.

1242§ 766.309(1), Fla. Stat. An award may be sustained only if the

1254administrative law judge concludes that the "infant has sustained

1263a birth - related neurological i njury and that obstetrical services

1274were delivered by a participating physician at birth."

1282§ 766.31(1), Fla. Stat.

128610. The term "birth - related neurological injury" is defined

1296in section 766.302(2) as follows:

"1301Birth - related neurological injury" means

1307i njury to the brain or spinal cord of a live

1318infant weighing at least 2,500 grams for a

1327single gestation or, in the case of a

1335multiple gestation, a live infant weighing at

1342least 2,000 grams at birth caused by oxygen

1351deprivation or mechanical injury occurrin g in

1358the course of labor, delivery, or

1364resuscitation in the immediate postdelivery

1369period in a hospital, which renders the

1376infant permanently and substantially mentally

1381and physically impaired.

138411. The evidence, which is not refuted, established that

1393Ch ristopher did not sustain an injury to the brain or spinal cord

1406caused by oxygen deprivation or mechanical injury occurring in

1415the course of labor, delivery, or resuscitation in the immediate

1425post - delivery period in a hospital and that Christopher does not

1437have a permanent and substantial physical impairment. Therefore,

1445Christopher is not eligible for benefits under the Plan.

145412. Section 766.313 provides: ÐAny claim for compensation

1462under ss. 766.301 - 766.316 that is filed more than 5 years after

1475the birt h of an infant alleged to have a birth - related

1488neurological injury shall be barred.Ñ Christopher was born on

1497May 16, 2007, and the Petition was filed on October 22, 2013,

1509more than five years after ChristopherÓs birth. Thus, any claim

1519for compensability under the Plan is barred by the statute of

1530limitations.

1531CONCLUSION

1532Based upon the foregoing Findings of Fact and Conclusions of

1542Law, it is ORDERED that the Petition filed by Mayum i Perez,

1554individually and on behalf of Christopher Perez, is dismissed

1563with prejudice.

1565The final hearing scheduled for June 9, 2014, is cancelled.
