77STATEMENT OF THE CASE
81On October 21, 2013, Petitioner, Lauren Bury, on behalf of
91and as parent and natural guardian of Maurice Bury (Maurice), a
102minor, filed a Petition for Benefits Pursuant to Florida Statute
112Section 7 66.301 et se q . (Petition) with the Division of
124Administrative Hearings (DOAH) for a determination of
131compensability under the Florida Birth - Related Neurological
139Injury Compensation Plan (Plan). The Petition named
146Barbara Telan, CNM , as the midwife providi ng obstetric services
156at the birth of Maurice at St. MaryÓs Medical Center in West Palm
169Beach, Florida.
171DOAH served NICA with a copy of the Petition on October 31,
1832013. DOAH served a copy of the Petition on St. MaryÓs Medical
195Center on December 18, 2013. DOAH served a copy of the Petition
207on Barbara W. Flowers Telan, ARNP, on December 18, 2013. As of
219the date of th is Summary Final Order of Dismissal, neither
230Ms. Telan nor St. MaryÓs Medical Center has petitioned to
240intervene in this proceeding.
244On March 12, 2014, NICA filed a Motion for Summary Final
255Order, asserting that Maurice did not sustain a "birth - related
266neurological injury" as that term is defined in section
275766.302(2), Florida Statutes (2012) . On March 27, 2014, a n Order
287to Show Cause was ente red, requiring Petitioner to show cause why
299the motion should not be granted.
305On April 7, 2014, Petitioner filed PetitionerÓs Motion for
314Extension of Time to File Response to RespondentÓs Motion for
324Summary Final Order, which was granted by Order dated April 8,
3352014. On April 24, 2014, Petitioner filed PetitionerÓs Notice of
345No Objection to RespondentÓs Motion for Summary Final Order.
354FINDINGS OF FACT
3571. Maurice Bury was born on February 9, 2012, at St. MaryÓs
369Medical Center in West Palm Beach , Florid a. Maurice weighed
3793 , 230 grams at birth.
3842. NICA retained Donald Willis, M.D., an obstetrician
392specializing in maternal - fetal medicine, to examine the medical
402records for Maurice and his mother, Lauren Bury. After reviewing
412the records, Dr. Willis gave the following opinion in his
422Affidavit dated March 6, 2014:
427It is my opinion that there was no obvious
436fetal distress during labor. The baby was
443not depressed at birth. Apgar scores were
4509/9. The baby was described as vigorous
457after birth. The newborn hospital course was
464apparently normal for several hours after
470birth. Seizure activity was noted more than
47712 hours after birth. MRI studies one week
485apart, showed findings consistent with
490evolving hypoxic brain injury.
494This child suffered hypoxic brain injury.
500However, there are no findings suggesting the
507brain injury occurred during labor, delivery,
513or the immediate past [sic] delivery period.
520There was no apparent obstetrical event that
527resulted in loss of oxygen or mechanical
534trauma to the babyÓs br ain during labor,
542delivery, or the immediate post delivery
548period.
5493. Michael S. Duchowny, M.D., a pediatric neurologist, was
558requested by NICA to do an independent medical examination of
568Maurice. Dr. Duchowny examined Maurice on January 29, 2014.
577Base d on his examination, Dr. Duchowny opined the following:
587It is my opinion that Maurice Bury MauriceÓs
595[sic] general, physical and neurological
600examinations reveal evidence of hypotonic
605weakness of all four limbs and absence of
613expressive or receptive commu nication skills.
619Maurice manifests findings consistent with a
625cortical visual impairment, microcephaly, and
630oromotor incoordination. These findings are
635indicative of a substantial mental and motor
642impairment.
643I reviewed the medical records. Although th e
651records confirm the motherÓs history that
657Maurice was born with a true knot in the
666nuchal cord, his neonatal course did not show
674evidence of postnatal depression, abnormal
679Apgar scores, or old multi - organ system
687failure. These findings would be expected
693given his poor outcome and MRI findings.
700Furthermore, the medical records document a
706clear change in fetal movement that occurred
713prior to the onset of labor.
719As such, it is my opinion that Maurice BuryÓs
728neurologic impairment did not result from
734oxygen deprivation either in the course of
741labor or delivery. Although his substantial
747and mental impairments are permanent, I would
754not recommend that Maurice be considered for
761inclusion within the NICA program.
7664. A review of the file does not show any cont rary opinion
779that MauriceÓs injuries were not a result of oxygen deprivation
789or mechanical injury during labor, delivery, or resuscitation in
798the immediate post - delivery period. The opinions of Dr. Willis
809and Dr. Duchowny as stated above are credited.
817CON CLUSIONS OF LAW
8215. The Division of Administrative Hearings has jurisdiction
829over the parties to and the subject matter of these proceedings.
840§§ 766.301 - 766.316, Fla. Stat.
8466. The Plan was established by the Legislature "for the
856purpose of providing co mpensation, irrespective of fault, for
865birth - related neurological injury claims" relating to births
874occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
8857. The injured infant, her or his personal representative,
894parents, dependents, and next o f kin may seek compensation under
905the Plan by filing a claim for compensation with DOAH.
915§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
923which administers the Plan, has "45 days from the date of service
935of a complete claim . . . in whi ch to file a response to the
951petition and to submit relevant written information relating to
960the issue of whether the injury is a birth - related neurological
972injury." § 766.305(4), Fla. Stat.
9778. If NICA determines that the injury alleged in a claim is
989a compensable birth - related neurological injury, it may award
999compensation to the claimant, provided that the award is approved
1009by the administrative law judge to whom the claim has been
1020assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1031disput es the claim, as it has in the instant case, the dispute
1044must be resolved by the assigned administrative law judge in
1054accordance with the provisions of chapter 120, Florida Statutes.
1063§§ 766.304, 766.309, and 766.31, Fla. Stat.
10709. In discharging this res ponsibility, the a dministrative
1079l aw j udge must make the following determination based upon the
1091available evidence:
1093(a) Whether the injury claimed is a birth -
1102related neurological injury. If the claimant
1108has demonstrated, to the satisfaction of the
1115adminis trative law judge, that the infant has
1123sustained a brain or spinal cord injury
1130caused by oxygen deprivation or mechanical
1136injury and that the infant was thereby
1143rendered permanently and substantially
1147mentally and physically impaired, a
1152rebuttable presumpti on shall arise that the
1159injury is a birth - related neurological injury
1167as defined in s. 766.303(2).
1172(b) Whether obstetrical services were
1177delivered by a participating physician in the
1184course of labor, delivery, or resuscitation
1190in the immediate postdeli very period in a
1198hospital; or by a certified nurse midwife in
1206a teaching hospital supervised by a
1212participating physician in the course of
1218labor, delivery, or resuscitation in the
1224immediate postdelivery period in a hospital.
1230§ 766.309(1), Fla. Stat. An award may be sustained only if the
1242administrative law judge concludes that the "infant has sustained
1251a birth - related neurological injury and that obstetrical services
1261were delivered by a participating physician at birth."
1269§ 766.31(1), Fla. Stat.
127310. The term "birth - related neurological injury" is defined
1283in section 766.302(2) as follows:
"1288Birth - related neurological injury" means
1294injury to the brain or spinal cord of a live
1304infant weighing at least 2,500 grams for a
1313single gestation or, in the case of a
1321multiple gestation, a live infant weighing at
1328least 2,000 grams at birth caused by oxygen
1337deprivation or mechanical injury occurring in
1343the course of labor, delivery, or
1349resuscitation in the immediate postdelivery
1354period in a hospital, which renders the
1361in fant permanently and substantially mentally
1367and physically impaired.
13701 1 . The evidence, which is not refuted, established that
1381there was not an obstetrical event that resulted in loss of
1392oxygen or mechanical trauma to MauriceÓs brain during labor,
1401delive ry, or the immediate post - delivery period. Therefore,
1411Maurice is not eligible for benefits under the Plan.
1420CONCLUSION
1421Based upon the foregoing Findings of Fact and Conclusions of
1431Law, it is ORDERED that the Petition filed by Lauren Bury on
1443behalf of and as parent and natural guardian of Maurice Bury, is
1455dismissed with prejudice.
