112STATEMENT OF THE ISSUE
116The issue in this case is whether the allegations set forth
127in the Amended Administrative Complaint filed by the Department
136of Health (Petitioner), against Santana Lashon da Williams, L.P.N.
145(Respondent) , are correct, and, if so, what penalty should be
155imposed.
156PRELIMINARY STATEMENT
158By an Administrative Complaint dated August 23, 2013, the
167Petitioner alleged that the Respondent violated sections 456.072
175and 464.018, Florida Statutes (2013). 1/ The Respondent disputed
184the allegations and requested an administrative hearing. The
192Petitioner forwarded the request to the Division of
200Administrative Hearings , which scheduled and conducted the
207hearing.
208On December 16, 2013, the P etitioner moved for leave to file
220an Amended Administrative Complaint, and the Motion was granted
229on that date.
232On January 7, 2014, the parties filed a Joint Pre - Hearing
244Stipulation containing a statement of admitted facts that have
253been incorporated her ein as necessary.
259The case was transferred to the undersigned Administrative
267Law Judge on January 8, 2014.
273At the hearing, the Petitioner presented the testimony of
282eight witnesses and had Exhibits 1 , 2, 4 , 5, 7, 9, 15 , and 16
296admitted into evidence. The Respondent presented no testimony or
305exhibits.
306A T ranscript of the hearing was filed on January 27, 2014.
318Both parties filed proposed recommended orders that have been
327considered in the preparation of this Recommended Order.
335FINDING S OF FACT
3391. T he Petitioner is the state agency charged by statute
350with regulating the practice of nursing.
3562. At all times material to this case, the Respondent was
367licensed as a practical nurse in the State of Florida, holding
378license n o. PN 5195962, with an addres s of record at 7255 Bucks
392Ford Drive, Riverview, Florida 33578.
3973. Between July 2012 and June 2013, the Respondent was
407employed as a licensed practical nurse by Armor Correctional
416Health Services, Inc. (Armor).
4204. At all times material to this case, pe rsons employed by
432Armor, including the Respondent, provided health services to
" 440patients " (inmates) incarcerated in detention facilities
446operated by the H illsborough County Sheriff's Office (H CSO ) ,
457including the Falkenburg Road Jail.
4625. The HCSO utilize s a computerized jail management system
472( " JAMS " ) that, in relevant part, stores personal and medical data
484for each inmate incarcerated in the HCSO detention facilities.
4936. Personal data stored in JAMS includes names, birthdates
502and social security numbers . The HCSO treats inmate social
512security numbers as confidential and private. The names and
521birthdates of inmates incarcerated in HCSO detention facilities
529are published online and are available to the public through the
540HCSO website.
5427. Medical data stored in JAMS is confidential and includes
552screening information obtained by a registered nurse upon an
561inmate ' s initial arrival to a detention facility, as well as
573information about inmate health issues that are presented during
582incarceration.
5838. Lice nsed practical nurses working at the Falkenburg Road
593Jail can access JAMS through computer terminals at nursing
602stations placed in various locations in the facility.
6109. At all times material to this case, the Respondent had
621access to JAMS and to the rel evant data contained therein.
63210. In May 2013, Anthony Collins, an undercover detective
641employed by the HCSO, engaged in an investigation of a tax fraud
653scheme based on information received from a confidential
661informant.
66211. Detective Collins testified persuasively at the
669hearing, and his testimony is fully credited.
67612. The scheme involved using the personal information
684(names, birthdates and social security numbers) of inmates
692incarcerated in HCSO detention facilities to file fraudulent
700federal tax returns and obtain refunds.
70613. On May 30, 2013, Detective Collins met with the
716Respondent ' s father. During the meeting, the Respondent ' s father
728showed Detective Collins a handwritten list of names, birthdates
737and apparent social security numbers ( List #1 ). The reverse side
749of the document was a blank form titled , " Armor Correctional
759Health Services, Inc., Infirmary Shift Report. "
76514. During the May 30 meeting, Detective Collins learned
774that the Respondent was employed at the Falkenburg Road Jail.
784Wi th Detective Collins present, the Respondent ' s father
794telephoned someone he represented as the Respondent to discuss
803List #1 and its delivery to Detective Collins. Detective Collins
813believed the Respondent to be the source of List #1 .
82415. HCSO Corporal Kristy Udugawa testified at the hearing
833that during the course of the undercover operation, she was
843directed to determine whether List #1 revealed personal data of
853inmates incarcerated in the Falkenburg Road Jail. Corporal
861Udugawa interviewed nine inmates and determined that List #1
870disclosed their names, birthdates and social security numbers.
878Corporal Udugawa ' s testimony is fully credited.
88616. At the hearing, a witness who had been incarcerated in
897the Falkenburg Road Jail during the relevant period te stified
907credibly that his name, birthdate , and social security number
916were on List #1 , and that he had not given consent for the data
930to be used in filing a fraudulent tax return.
93917. The May 30 meeting ended with an agreement between
949Detective Collins a nd the Respondent ' s father to proceed with the
962scheme.
96318. On May 31, 2013, Detective Collins met with the
973Respondent after a series of telephone calls between Detective
982Collins, the Respondent , and the Respondent ' s father. Detective
992Collins had been di rected to bring a computer and related
1003equipment to the meeting so as to begin filing tax returns , and
1015he complied with the instructions.
102019. During the May 31 meeting, the Respondent told
1029Detective Collins that on a weekly basis, she would provide
1039perso nal information for 20 to 30 individuals that could be used
1051to file tax returns and that the proceeds of the tax refunds
1063would be divided evenly between the Respondent and Detective
1072Collins. She directed him to obtain a prepaid cell phone for use
1084in arran ging the weekly meeting.
109020. During the May 31 meeting, the Respondent advised
1099Detective Collins that she had access to personal information for
1109about 3,400 people.
111321. The Falkenburg Road Jail houses about 3,400 inmates.
112322. During the May 31 meetin g, Detective Collins paid $500
1134to the Respondent, which she accepted. The Respondent provided
1143Detective Collins a list of six handwritten names ( List #2 ) , with
1156birthdates and apparent social security numbers.
116223. By deposition, a witness who had been in carcerated at
1173the Falkenburg Road Jail during the relevant period testified
1182that List #2 disclosed his name, birthdate , and social security
1192number , and that he had not given consent for the data to be used
1206in filing a fraudulent tax return. The testimony is credited.
121624. The interaction between the Respondent and Detective
1224Collins was recorded through the use of electronic audio and
1234video surveillance equipment.
123725. At the conclusion of the May 31 meeting, the Respondent
1248was arrested by HCSO officers w ho had been monitoring the
1259surveillance.
126026. Deputy Paul Baez, one of the officers participating in
1270the surveillance monitoring, testified at the hearing that after
1279having been advised of her " Miranda R ights, " the Respondent
1289admitted that she had obtaine d personal data of inmates at the
1301jail and had sold the data. Deputy Baez further testified that
1312the Respondent admitted " doing drops, " which Deputy Baez
1320explained involved obtaining the personal data of other people
1329and selling it for use in fraudulent t ax return filings. Deputy
1341Baez 's testimony was persuasive and is fully credited.
1350CONCLUSIONS OF LAW
135327. The Division of Administrative Hearings has
1360jurisdiction over the parties to and subject matter of this
1370proceeding. §§ 120.569 & 120.57(1), Fla . Sta t . (2013).
138128. In this case, the Petitioner is seeking to impose
1391discipline against the Respondent ' s license. In order to
1401prevail, the Petitioner must demonstrate the truthfulness of the
1410allegations in the Administrative Complaint by clear and
1418convincin g evidence. Dep 't of Banking & Fin . v. Osborne Stern &
1432Co . , 670 So. 2d 932 (Fla. 1996); Ferris v. Turlington , 510 So. 2d
1446292 (Fla. 1987). In order to be " clear and convincing, " the
1457evidence must be " of such weight that it produces in the mind of
1470the trie r of fact a firm belief or conviction, without hesitancy,
1482as to the truth of the allegations sought to be established. "
1493See Slomowitz v. Walker , 429 So. 2d 797, 800 (Fla. 4th DCA 1983).
1506In this case, the burden has been met.
151429. As set forth in Count I of the Amended Administrative
1525Complaint, section 464.018(1)(h) authorizes the Petitioner to
1532impose discipline against a licensee for " unprofessional conduct,
1540as defined by board rule. " Florida Administrative Code R ule
155064B9 - 8.005(4) provides that " stealin g from a patient " constitutes
1561unprofessional conduct. Rule 64B9 - 8.005(7) provides that
" 1569violating the confidentiality of information or knowledge
1576concerning a patient " constitutes unprofessional conduct.
158230. The evidence establishes that the Respondent, employed
1590as a nurse in a detention center, engaged in unprofessional
1600conduct in violation of section 464.018(1)(h), when she obtained
1609and sold confidential personal data of patients for the purpose
1619of filing fraudulent federal tax returns and receiving ta x
1629refunds to which she was not entitled.
163631. As set forth in Count II of the Amended Administrative
1647Complaint, section 464.018(1)(o) authorizes the Petitioner to
1654impose discipline against a licensee for violating any provision
1663of chapter 4 5 6 . Section 45 6.072(1)(m) provides that a licensee
1676may be disciplined for " employing a trick or scheme in or related
1688to the practice of a profession. "
169432. The Respondent had access to inmate personal data
1703contained in JAMS through her employment as a nurse at the
1714Falk enburg Road Jail. The evidence establishes that the
1723Respondent, through her employment, obtained personal data of
1731others and provided it for use in filing fraudulent federal tax
1742returns for personal gain, thereby violating sections
1749456.072(1)(m) and 464.0 18(1)(o).
175333. Guidelines for the imposition of discipline in this
1762case are set forth at rule 64B9 - 8.006.
177134. According to the guidelines, the minimum penalty for a
1781violation of section 464.018(1)(h) and rule 64B9 - 8.005(4) is
1791revocation of the Responden t ' s license.
179935. The guidelines provide that violation of section
1807464.018(1)(h) and rule 64B9 - 8.005(7) warrants a penalty ranging
1817from a minimum of reprimand, continuing education and a $250
1827fine , to a maximum of probation and a $500 fine.
183736. The guid elines provide that a violation of section
1847456.072(1)(m) warrants a penalty ranging from a minimum of
1856reprimand and a $250 fine , to a maximum of suspension and a
1868$10,000 fine.
187137. Rule 64B9 - 8.006(6) requires the imposition of a $10,000
1883fine for any offen se involving fraud.
1890RECOMMENDATION
1891Based on the foregoing Findings of Fact and Conclusions of
1901Law, it is RECOMMENDED that the Petitioner enter a final order
1912finding the Respondent guilty of the violations set forth herein,
1922revoking the Respondent ' s licen se as a practical nurse, and
1934imposing a fine of $10,000.
