110PRELIMINARY STATEMENT
112On July 19 , 201 3 , Ms. Demons filed an Employment Complaint
123of Discrimination alleging that she was subjected to unfair
132treatment , more strict terms and conditions , and ultimately
140discharged for allegedly violating certain employee rules and
148regulations . The Florida Commission on Human Relations
156(Commission) issued a No Cause Determination. Ms. Demons filed a
166P etition for Relief. On November 19 , 2013, the Commission
176referred the matter to the Division for co nduct of the requested
188hearing. The remainder of this case ' s procedural history is
199contained in the following Findings of Fact.
206FINDINGS OF FACT
2091 . By Notice dated December 3, 2013, the hearing was
220originally scheduled for January 14, 2014.
2262 . On January 8, 2014, Petitioner fil ed a request that the
239hearing be continued.
2423 . The undersigned continued the hearing until February 4,
2522014 .
2544 . On January 17, 2014, Respondent filed an Unopposed
264Motion for Continuance.
2675 . The undersigned continued the hearing until March 11,
2772014 .
2796 . On March 7, 2014, Respondent filed a Motion to Exclude
291PetitionerÓs Undisclosed Witnesses and (Proposed) Exhibits on the
299grounds that Petitioner had not disclosed her witnesses and
308exhibits to Respondent as required by the Order of Pre - Hearing
320Instruction s.
3227 . The hearing convened as scheduled at 9:00 a.m. , Central
333Time, on March 11 , 201 4 . Counsel for Emerald and Emerald ' s
347representative and witnesses appeared. Emerald had previo usly
355timely provided Petitioner with its witness and exhibit list s .
3668 . A s of 9:16 a.m., Ms. Demons had not appear ed or
380contact ed the office of the undersigned.
3879 . At 9:17 a.m., counsel for Respondent moved, ore tenus ,
398for an order of dismissal. The undersigned informed counsel for
408Respondent that a written recommended order would be entered
417granting RespondentÓs motion.
42010 . Ms. Demons presented no evidence. Emerald presented no
430evidence. The hearing was adjourned at 9:20 a.m . When the
441undersigned left the hearing room at 9:30 a.m., Petitioner had
451still not appeared or con tacted the office of the undersigned.
462CONCLUSIONS OF LAW
46511 . The Division of Administrative Hearings has
473jurisdiction over the subject matter of this proceeding and of
483the parties pursuant to sections 120.569 and 120.57(1), Florida

49312 . Section 760.11(7) permits a party who receives a no
504cause determination to request a formal administrative hearing
512before the Division. Ð If the administrative law judge finds that
523a violation of the Florida Civil Rights Act of 1992 has occurred,

547Commission prohibiting the practice and recommending affirmative
554relief from the effects of the practice, including back - pay. Ñ

56713 . Ms. Demons claims that E merald terminated her because
578of race . Section 760 .10(1)(a) prohibits discharging an employee
588on account of her race .
59414 . Ms. Demons must prove her claim by a preponderance of
606the evidence. Dep ' t of Banking & Fin. , Div. of Sec. and Inv.
620Prot. v. Osborne Stern & Co., Inc. , 670 So. 2d 932 (Fla. 1996).
63315 . An employee may prove a discrimination claim by direct
644evidence. Wilson v. B/E Aerospace, Inc. , 376 F.3d 1079, 1086
654(11th Cir. 2004). Direct evidence of discrimination is evidence
663that, if believed, proves the existence of a fact without
673inference or p resumption. Carter v. City of Miami , 870 F.2d 578,
685581 - 82 (11th Cir. 1989).
69116 . An employee may also prove a claim of discrimination by
703circumstantial evidence establishing that similarly - situated
710employees, who were not in her protected class, were tre ated more
722favorably than she was. Wilson v. B/E Aerospace, Inc. , supra ,
732at 1087.
73417 . Ms. Demons has not presented direct or circumstantial
744evidence tending to prove that she was discriminat ed against on
755account of her race . Consequently , she has not pr oven her claim
768by the preponderance of the evidence.
774RECOMMENDATION
775Based on the foregoing Findings of Fact and Conclusions of
785Law, it is RECOMMENDED that the Florida Commission on Human
795Relations deny the Petition for Relief of Shelia Demons .
