100Whether Petitioner is entitled to licensure as a certified
109contractor pursuant to the " grandfathering " provisions of s ection

121PRELIMINARY STATEMENT
123On or abou t July 23, 2013, Petitioner, Terre nce A. Davis, a
136locally - licensed electrical contractor doing business in Broward
145County, Florida, applied to Respondent, Electrical C ontractor ' s
155Licensing Board ( " Board " ), which is a board under the
166jurisdiction of the Dep artment of Business an d Professional
176Regulation ( " Department " ), for licensure as a certified
185electrical contractor. By a Notice of Intent to Deny, dated
195October 18, 2013, the Board denied Petitioner ' s app lication for
207two reasons: (1) within the previous five years, Petitioner ' s
218contracting license was suspended for failure to pay child
227support; and (2) Petitioner ' s application failed to demonstrate
237that he had the requisite financial stability as required by
247Florida Administrative Code Rule 61G6 - 5.005(3) a nd requisite net
258worth as required by Florida Administrative Code
265Rule 61G6 - 5.004.
269Petitioner timely requested a formal hearing, and the matter
278was referred to the Division of Administrative Hearings on
287December 4, 2013. The case was assigned to t he undersigned, who
299set the final hearing for January 13, 2014. On January 6, 2014,
311the parties requested and were granted a continuance of the final
322hearing. The final hearing was rescheduled to March 26, 2014.
332The final hearing took place as sch eduled. Petitioner
341appeared pro se and the Board was represented by counsel. The
352final hearing Transcript was filed on April 10, 2014. The
362identity of the witnesses and exhibits and the rulings regarding
372each are as set forth in the Transcript. Petitio ner and the
384Board timely filed proposed recommended orders, which were
392considered in preparing this Recommended Order. Unless otherwise
400indicated, all rule and statutory references are to the versions
410in effect at the time of the application process.
419FIN DING S OF FACT
4241. At all times material hereto, Petitioner held a
433R eg istered E lectrical C ontractors license, No. 13012890, and a
445R eg istered A larm S ystem C ontractors I license, No. 12000229, that
459authorized him to engage in the same in Broward County, Flori da.
4712. Petitioner ' s license s are active and in good standing;
483he has not been the subject of any complaints filed with, or
495discipline imposed by, the local licensing authority. Petitioner
503operates a business named " D " Electrician Technical Services,
511In c. , in Pompano Beach, Florida.
5173. In the case styled State v. Terrance Davis , Case
527No. 082026CCFICA, in the Circuit Court of the Seventeenth
536Judicial Circuit, in and for Broward County, Florida, Petitioner
545was charged with burglary of a structure with a ssault or battery
557and felony battery. Petitioner ' s unrefuted testimony was that
567after his arrest in October 2008, he was detained without bond
578pending his trial. 1 /
5834. On November 17, 2009, the Florida Department of Revenue
593( " DOR " ) issued to Petitioner a Notice of Non - Compliance with
606Support Order and Intent to Suspend License for the nonpayment of
617a previously existing child support order . The notice was sent
628to 7906 Southwest Seven th Place, North Lauderdale, Florida 33068.
638At the time the notice was se nt, Petitioner claims to have been
651detained in the Broward County jail.
6575. The criminal charge of felony battery was nol prossed on
668December 14, 2009. On December 15, 2009, Petitioner proceeded to
678trial on the remaining charge and was acquitted by a ju ry.
6906. On December 27, 2009, DOR issued a Notice to Suspend
701License for Nonpayment of Support to the Division of Professions.
711Said notice provided that, " [w]e gave [Petitioner] notice of
720nonpayment and intent to suspend license(s) more than 30 days
730ago . [He has] not complied with the support order, a written
742agreement if there is one, or timely contested the action. " The
753notice further directed that, " [u]nder section 409.2598(5)(b),
760Florida Statutes, you must suspend the license, permit or
769certificate that allows the person to engage in an occupation,
779business or recreation. "
7827. In January 2010, during the course of a traffic stop,
793Petitioner was advised by a law enforcement officer that his
803Florida driver ' s license was suspended. On February 8, 20 10,
815Petitioner entered into a Written Agreement for Past Due Support
825with DOR w herein he agreed to make a lump - sum payment and
839additional monthly payments. DOR agreed that it would not
848suspend or deny his driver ' s license as long as Petitioner
860complied wi th the terms of the agreement.
8688. Petitioner credibly testified that thereafter, when he
" 876resumed his Articles of Incorporation, " he realized his
884professional licenses had also been suspended.
8909. On February 25, 2010, DOR issued a Request to Reinstat e
902License to the Division of Professions. Said request provided as
912follows:
913The license(s) of the parent named below, was
921suspended for nonpayment of support. Please
927reinstate the license(s). The parent is
933paying as agreed or ordered, the circuit
940court has ordered reinstatement, or the
946parent is otherwise entitled to have the
953license(s) reinstated under section
957409.2598(4)(b), Florida Statutes.

100510. On or about July 23, 2013, Petitioner applied for
1015certification as an electrical contractor pu rsuant to the
" 1024grandfathering " provisions of s ection 484.514, Florida
1031Statutes. 2 / Included with Petitioner ' s application, was a
1042personal financial statement wherein Petitioner itemized his
1049assets and liabilities. Petitioner ' s personal financial
1057statement concluded that his personal net worth was $56,400.00.
1067Also included in Petitioner ' s application was a business
1077financial statement for " D " Electrician Technical Services, Inc.,
1085that similarly itemized Petitioner ' s business assets and
1094liabilities. Petiti oner ' s business financial statement concluded
1103that the business ' s net worth was $35,945.
111311. By a Notice of Intent to Deny, dated October 18, 2013,
1125the Board denied Petitioner ' s application for two reasons:
1135(1) within the previous five years, Pet itioner ' s contracting
1146license was suspended for failure to pay child support; and
1156(2) Petitioner ' s application failed to demonstrate that he had
1167the requisite fina ncial stability as required by r ule 61G6 -
11795.005(3) and requi site net worth as required by r ul e 61G6 - 5.004.
119412. Petitioner credibly testified as to the figures
1202supporting the itemization of both his personal and business
1211assets and liabilities and respective net worth contained in the
1221application. Petitioner conceded that a credit report, d ated
1230July 8, 2013, documents that he had a late mortgage payment in
1242April 2010; that in 1997, his child support arrearage was placed
1253in collection; and that an account, with a current balance of
1264$3110.00, was placed for collection. Petitioner contends sai d
1273account concerned a one - year lease that he was unable to satisfy
1286at the time due to his detainment for the above - noted criminal
1299charges.
130013. Respondent presented the testimony of Clarence Kelly
1308Tibbs . Mr. Tibbs is a state - certified electrical co ntractor who
1321served on the Board for approximately 13 years. Mr. Tibbs was not
1333on the Board at the time the Board considered and rejected
1344Petitioner ' s application.
134814. The undersigned deemed Mr. Tibbs as an expert in
1358electrical contracting. Mr. Tibbs did not testify concerning the
1367areas of his expertise (electrical contracting), but rather,
1375offered opinions on the propriety of the Board ' s denial of
1387Petitioner ' s application.
139115. Mr. Tibbs testified that, " as an ex - Board member , "
1402looking at Petitioner ' s personal and business financials, there
1412were several problems. After itemizing his concerns, Mr. Tibbs
1421concluded that, " [h]owever, looking at the financials that you ' ve
1432got in front of me, although I have some problems with them, I
1445could probably go ah ead and approve them. "
1453CONCLUSIONS OF LAW
145616 . The Division of Administrative Hearings has personal
1465and subject matter jurisdiction in this proceeding pursuant to
1474s ections 120.569 and 120.57(1), Florida Statutes.
148117. As an applicant for licensure, Peti tioner bore the
1491burden at hearing of going forward initially with proof of his
1502fitness for certification; he also was required to should er the
1513ultimate burden of persuasion. See Dep ' t of Banking & Fin., Div.
1526of Sec. & Investor Pro t. v. Osborne Stern & Co. , 670 S o. 2d 932,
15429 34 (Fla. 1st DCA 1996).
154818. The " grandfathering " provision under which Pet itioner
1556seeks certification is s ection 489.514, Florida Statutes, which
1565provides as follows:
1568489.514 Certification for registered
1572contract ors; grandfathering p rovisions. --
1578(1) The board shall, upon receipt of a
1586completed application, appropriate fee, and
1591proof of compliance with the provisions of
1598this section, issue:
1601(a) To an applying registered electrical
1607contractor, a certificate as an electrical
1613contractor , as defined in s. 489.505 (12);
1620(b) To an applying registered alarm system
1627contractor, a certificate in the mat ching
1634alarm system contractor category, as defined
1640in s. 489.505 (2)(a) or (b); or
1647(c) To an applying registered electrical
1653specialty contractor, a certificate in the
1659matching electrical specialty contractor
1663category, as defined in s. 489.505 (19).
1670(2) Any contractor registered under this part
1677who makes application under this section to
1684the board shall meet each of the following
1692requirements for certification:
1695(a) Currently holds a valid registered local
1702license in the categ ory of electrical
1709contractor, alarm system contractor, or
1714electrical specialty contractor.
1717(b) Has, for that category, passed a written,
1725proctored examination that the board finds to
1732be substantially similar to the examination
1738required to be licensed as a certified
1745contractor under this part. For purposes of
1752this subsection, a written, proctored
1757examination such as that produced by the
1764National Assessment Institute, Block and
1769Associates, NAI/Block, Experior Assessments,
1773Professional Testing, Inc., or Asse ssment
1779Systems, Inc., shall be considered to be
1786substantially similar to the examination
1791required to be licensed as a certified
1798contractor. The board may not impose or make
1806any requirements regarding the nature or
1812content of these cited examinations.
1817(c) Has at least 5 years of experience as a
1827contractor in that contracting category, or
1833as an inspector or building administrator
1839with oversight over that category, at the
1846time of application. For contractors, only
1852time periods in which the contractor licens e
1860is active and the contractor is not on
1868probation shall count toward the 5 years
1875required under this subsection.
1879(d) Has not had his or her contractor ' s
1889license revoked at any time, had his or her
1898contractor ' s license suspended in the last 5
1907years, or be en assessed a fine in excess of
1917$500 in the last 5 years.
1923(e) Is in compliance with the insurance and
1931financial responsibility requirements in s.
1936489.515 (1)(b).
1938(3) An applicant must make application by
1945November 1, 2015, to be licensed pursuant to
1953this section.
195519. Section 489.515(1)(b), Florida Statutes, provides as
1962follows:
1963The board shall certify as qualifie d for
1971certification any person who satisfies the
1977requirements of s. 489.511 and who submits
1984satisfactory evidenc e that he or she has
1992obtained both workers ' compensation insurance
1998or an acceptable exemption certificate issued
2004by the department and public liability and
2011property damage insurance for the health,
2017safety, and welfare of the public in amounts
2025determined by rule of the board, and
2032furnishes evidence of financial
2036responsibility, credit, and business
2040reputation of either himself or herself or
2047the business organization he or she desires
2054to qualify.
205620. Subsection 489.507(3), Florida Statutes, grants to th e
2065Board rulemaking authority to implemen t the provisions of Part II
2076of c hapter 489, Florida Statutes. Pursuant to its rulemaking
2086author ity, the Board has promulgated Florida Administrative Code
2095R ule 61G6 - 5.004, which provides, in pertinent part:
2105In order that the Board may carry out its
2114statutory duty to investigate the financial
2120responsibility, credit, and business
2124reputation of an applicant proposing to
2130engage in contracting as a partnership,
2136corporation, business trust, or other legal
2142entity other than a sole proprietorship, an
2149applicant shall be required to forward the
2156following to the Department for review by the
2164Board:
2165(1) A comprehensive financial statement
2170reflecting the financial condition of the
2176business organization in its previous fiscal
2182year; provided, however, that the statement
2188be prepared within 12 months of the date of
2197filing of the application. The financial
2203statement shall be prepared in accordance
2209with generally accepted accounting
2213principles, as defined by Rule 61H1 - 20.007,
2221F.A.C. (Fe bruary, 2004). The financial
2227statement must indicate a minimum net worth
2234as indicated below for the following
2240categories:
2241(a) Unlimited electrical and alarm contractor
2247$10,000.00
2249(b) Specialty Contractor $5,000.00
2254(2) A report on the business organ ization
2262from any recognized credit bureau which
2268includes but is not limited to credit
2275history, ability to be bonded, liens,
2281judgments, suits, bankruptcy, and assignment
2286of receivers obtained from county, state and
2293federal records. The credit report must b e
2301dated within twelve (12) months of the date
2309of filing the application.
231321. The Board has also promulgated Florida Administrative
2321Code R ule 61G6 - 5.005 , which provides as follows:
2331(1) For purposes of this rule, the phrase
" 2339financial responsibilit y " is defined as the
2346ability to insure that the public, the
2353laborers, the materialmen, the supplier and
2359other parties with whom the applicant will do
2367business as an contractor, will not sustain
2374economic losses resulting from the
2379contractor ' s inability to p ay his obligations
2388to them.
2390(2) The following factors will be reviewed
2397when examining the financial responsibility
2402of the applicant:
2405(a) Evidence that the applicant or any of its
2414corporate officers, or any of its
2420shareholders holding 10% or more of the
2427c orporate stock has filed or been a party to
2437voluntary or involuntary bankruptcy within
2442the past five years preceding its
2448application, arising out of the electrical
2454contracting operations of said applicant,
2459corporate officer or 10% shareholder.
2464(b) The ex istence, within the past five years
2473preceding the application, of a court
2479judgment rendered against the applicant or
2485any of its corporate officers, or any of its
2494shareholders holding 10% or more of its
2501corporate stock, based upon the failure of
2508the applica nt or any of its corporate
2516officers or 10% shareholders to pay their
2523obligations to materialmen, laborers,
2527suppliers or any other parties with whom the
2535applicant or corporate officer or 10%
2541shareholder conducted business as a
2546contractor.
2547(c) The existence of any liens of record by
2556the United States Internal Revenue Service or
2563the State of Florida Corporation Tax Division
2570against the applicant or any of its corporate
2578officers or any of its 10% shareholders.
2585(d) An unfavorable credit history as
2591indicated by any of the documents submitted
2598pursuant to Rule 61G6 - 5.004, F.A.C.
2605(3) A determination by the Board that the
2613applicant lacks the financial stability
2618necessary to assure compliance with the
2624standards set forth in subsection (1) of this
2632rule. As guideline s for the determination of
2640financial stability the Board shall consider
2646the responses to the questions set forth in
2654subsection 61G6 - 5.004(3), F.A.C., and the
2661documents submitted pursuant to Rule 61G6 -
26685.004, F.A.C.
267022. Section 489.514, Florida Statut es, makes clear that to
2680become certified under the " grandfathering " provisions, an
2687applicant shall meet each of the requirement s of section
2697489.514(2), including subsection (2) (d) ÏÏ that the contractor has
2707not had his contractor ' s license suspended in the l ast five
2720years. It is undisputed that Petitioner ' s registered electrical
2730contractor ' s license was suspended within the five years
2740preceding his application for the failure to pay child support.
2750Accordingly, Petitioner has failed to meet his burden of fit ness
2761for certification , as set f orth in section 489.514(2) . 3 /
277323. The undersigned concludes that Petitioner met his
2781burden concerning his compliance with the financial
2788responsibility requirements, as set forth in the above - referenced
2798Florida Sta tutes a nd Florida Administrative Code R ules.
2808RECOMMENDATION
2809Based on the foregoing Findings of Fact and Conclusions of
2819Law, it is RECOMMENDED that
2824The Department of Business and Professional Regulation,
2831Electrical Contractor ' s Licensing Board , enter a fi nal order
2842denying Petitioner ' s application for licensure as a certified
2852electrical contractor.
