97STATEMENT OF THE CASE

101On December 9 , 201 3, Petitioner, Bethzaida Rodriguez , on

110behalf of and as parent and natural guardian of Arielle Rodriguez

121( Arielle ), a minor, filed a Petition for Benefits Pursuant to

133Florida Statute Section 766.301 et seq. (Petition) with the

142Division of Administrative Hearings (DOAH) for a determination of

151compensabil ity under the Florida Birth - Related Neurological

160Injury Compensation Plan (Plan). The Petition named

167ÐDr. McLaugfinÑ as the physician providing obstetrical services

175at the birth of Arielle on September 28 , 201 0 , at Wi nnie Palmer

189Hospital for Women and Bab ies (Winnie Palmer) in Orlando ,

199Florida. On December 18, 2013, Petitioner filed a letter with

209the ClerkÓs Office of DOAH referencing Samuel McLead, M.D. ;

218James Lawrence, M.D. ; Sekeyta Paul, M.D. ; Virginia Pagani, M.D. ;

329On January 21, 201 4 , Dennis C. Szurkus, M.D., and Orlando

340Health, d/b/a Winnie Palmer Hospital for Women and Babies, filed

350a Petition for Leave to Intervene naming Dr. Szurkus as having

361been involved with the labor and delivery process of A rielle.

372The Petition to Intervene w as granted by Order dated February 5 ,

3842014.

385On September 3 , 2014, NICA filed a Motion for Summary Final

396Order, asserting that Arielle did not sustain a "birth - related

407neurological injury" as that term is defined in sect ion

417766.302(2), Florida Statutes. The motion was served by United

426States mail on September 3 , 2014.

432An Order to Show Cause was entered on September 16, 2014,

443advising Petitioner to show cause in writing why RespondentÓs

452Motion for Summary Final Order sh ould not be granted. To date,

464no response has been filed.

469FINDINGS OF FACT

4721. Arielle Rodriguez was born on September 28, 201 0 , at

483Winnie Palmer Hospital for Women and Babies located in Orlando ,

493Florida. Arielle weighed 3, 394 grams at birth.

5012. Do nald Willis, M.D. (Dr. Willis), was requested by NICA

512to review the medical records for Arielle , to determine whether

522an injury occurred in the course of labor, delivery, or

532resuscitation in the immediate post - delivery period in the

542hospital due to oxygen deprivation or mechanical injury occurring

551in the course of labor, delivery, or resuscitation in the

561immediate post - delivery period. Dr. Willis described his

570findings in pertinent part as follows in an affidavit dated

580August 28, 2014 :

5845. I have reviewed the medical records for

592the above individual. The mother, Bethzaida

598[sic] Calderon was a 19 year old G 1 with no

609significant prenatal problems. She was

614admitted to the hospital at 37 weeks with

622spontaneous rupture of the membranes and

628active labor.

6306. T he fetus was noted to be in a breech

641presentation. Cesarean section was done

646without difficulty. Birth weight was 3,394

653grams. Apgar scores were 4/9. The umbilical

660cord blood gas was normal with pH of 7.24.

6697. Newborn evaluation stated the baby was

676Ð clinically well.Ñ The newborn hospital

682course was uncomplicated. Hospital discharge

687note on DOL 3 has a discharge diagnosis of

696healthy female.

6988. The baby was subsequently diagnose d with

706developmental delay at 5 to 6 months of age.

715MRI at about one ye ar of age was normal.

725Laboratory evaluation, including genetic

729studies (microarray) was negative. A note

735from 2 years of age states the child had

744spastic quadraparesis of unknown etiology.

7499. In summary, the baby was delivered by

757Cesarean section due t o breech presentation.

764The baby had a normal cord blood gas (pH

7737.24) and a normal and uncomplicated newborn

780hospital course. There was nothing to

786suggest a birth - related hypoxic injury.

793Developmental delay was noted at 5 to 6

801months of age. MRI at one y ear was normal.

81110. There was no apparent obstetrical event

818that resulted in loss of oxygen or mechanical

826trauma to the babyÓs brain or spinal cord

834during labor, delivery or the immediate post

841delivery period.

8433. NICA retained Michael S . Duchowny , M.D . (Dr. Duchowny) ,

854a pediatric neurologist, to examine Arielle and to review h er

865medical records. Dr. Duchowny examined Arielle on June 25 , 2014,

875and opined in pertinent part as follows in his affidavit dated

886August 28, 2014.

8895. Arielle is 3 years old and has a

898longstanding history of motor delay. Her

904parents indicated that she has a combination

911of both increased and decreased muscle tone

918and that she is spastic. Arielle cannot walk

926independently and did not sit until age 18

934months. She has never stood on her own and

943tends to move around by combat crawling. She

951did not roll over until age 8 months. Both

960arms and legs are affected equally and there

968is no later ality to her muscular disability.

976She is wheelchair - bound.

9816. Arielle participates in physica l and

988occupational therapy through her

992prekindergarten program at Lake Silver

997Elementary School in Orlando. She

1002participates in 2 sessions per week, each

1009lasting 30 minutes. She wears AFOs and wrist

1017splints and is under surveillance by

1023orthopedic surgery . She has never required

1030surgery and from an orthopedic standpoint,

1036has been stable.

10397. In contrast, ArielleÓs motor disability

1045and cognitive development have proceeded

1050quite well. Her mother indicated that

" 1056mentally, she is fineÑ. In fact, she tests

1064out above average and her language skills

1071have always been advanced. Her speech is

1078clear and she is very sociable. There have

1086been no behavioral problems, cognitive or

1092motor regression.

10948. Arielle is on no intercurrent

1100medications. She has never had seizures.

1106She has never been examined by an

1113op h thalmogist. Her vision and hearing are

1121both good and her appetite is stable. She

1129sleeps through the night.

11339. The physical examination revealed a well -

1141developed, well nourished, wheelchair bound,

1146socially appropriate 3 - year old girl.

1153ArielleÓs height and weight were not measured

1160due to her restriction of being in a

1168wheelchair. Her head circumference measured

117350.3 centimeters which is within standard

1179percentiles. There are no neurocutaneous

1184stigmata. She does not have a darkly

1191pigmented nevus on the right lower leg.

1198There are no other neurocutaneous features.

1204The spine is straight without dysraphism.

1210The anterior and posterior fontanels are

1216closed. There are no cranial or facial

1223anomalies or asymmetrie s. The neck is supple

1231without masses, thyromegaly or adenopathy.

1236There are no signs of peripheral dysmorphism.

1243The lung fields are clear. The heart sounds

1251are strong with out murmurs or rubs. The

1259abdomen is soft and nontender without

1265palpable liver, spl een or kidneys.

1271Peripheral pulses are 2 and symmetric.

127710. The neurologic examination revealed an

1283alert, pleasant and cooperative child who

1289initially was shy but ultimately warmed up

1296during the evaluation. Arielle is quite

1302engaging and she clearly und erstands

1308everything going on in her surround. She

1315interacts well with her parents and maintains

1322an age appropriate stream of thought and

1329attention. Her speech is fluent and well

1336articulated and she follows simple commands

1342without problems. She was not o verly

1349fearful.

135011. The motor examination reveals a complex

1357pattern of abnormality. Arielle demonstrates

1362static hypotonia but demonstrates prominent

1367hypertonicity with spasticity. She

1371additionally evidences truncal ataxia and has

1377a dyskinetic syndrome wi th involuntary

1383movements and intermittent tongue thrusting.

1388Drooling is noted intermittently. She is

1394unable to stand and bear weight and

1401demonstrates a plantigrade attitude. There

1406is prominent scissoring of the lower

1412extremities. No specific focal weakn ess or

1419atrophy is noted and there are no

1426fasciculations. Her head control is good.

1432She is unable to maintain a sitting or

1440standing balance. Placing and stepping

1445responses are elicited.

144812. In summary, ArielleÓs neurologic

1453examination reveals a prominen t motor

1459disability at a level of development

1465approximating 8 months. In contrast, her

1471mental development is fully on target without

1478evidence of a cognitive deficit. There are

1485no specific focal or lateralizing findings on

1492examination to suggest a lateraliz ed brain

1499lesion.

150013. I am familiar with the Florida Birth -

1509Related Neurological Injury Compensation Plan

1514(the ÐPlanÑ) and the standards imposed by the

1522Plan for compensability of potential claims.

1528Based upon my review of the medical records

1536as described he rein and in my report, and

1545further based upon my evaluation of ARIELLE

1552RODRIGUEZ, I have formed an opinion as to

1560whether ARIELLE RODRIGUEZ qualifies for

1565compensation under the plan.

156914. I had an opportunity to review medical

1577records which confirm the par entÓs history

1584and add little in the way of diagnostic

1592information. ArielleÓs healthcare providers

1596have not established a firm diagnosis of her

1604motor disability although further workup is

1610planned. There is no historical or physical

1617evidence of intrapartum hypoxia or mechanical

1623injury.

162415. I therefore do not believe that Arielle

1632should be considered for compensation within

1638the NICA Program. Her mental development is

1645normal and there is no indication of an

1653intrapartum event causing her neurological

1658disabi lity.

16604 . A review of the file in this case reveals that there

1673have been no expert opinions filed t hat are contrary to the

1685opinion of Dr. Willis that there was no apparent obstetrical

1695event that resulted in loss of oxygen or mechanical trauma to the

1707babyÓ s brain or spinal cord during labor, delivery or the

1718immediate post - delivery period. Dr. WillisÓ opinion is credited.

1728There are no expert opinions filed that are contrary to

1738Dr. Duchowny Ós opinion that Arielle does not show a significant

1749mental impairmen t and th a t there is no indication of an

1762intrapartum event causing her neurological injury .

1769Dr. Duchowny Ós opinion is credited.

1775CONCLUSIONS OF LAW

17785 . The Division of Administrative Hearings has jurisdiction

1787over the parties to and the subject matter of t hese proceedings.

1799§§ 766.301 - 766.316, Fla. Stat.

18056 . The Plan was established by the Legislature "for the

1816purpose of providing compensation, irrespective of fault, for

1824birth - related neurological injury claims" relating to births

1833occurring on or after Jan uary 1, 1989. § 766.303(1), Fla. Stat.

18457 . The injured infant, her or his personal representative,

1855parents, dependents, and next of kin may seek compensation under

1865the Plan by filing a claim for compensation with DOAH.

1875§§ 766.302(3), 766.303(2), a nd 766.305(1), Fla. Stat. NICA,

1884which administers the Plan, has "45 days from the date of service

1896of a complete claim . . . in which to file a response to the

1911petition and to submit relevant written information relating to

1920the issue of whether the injury is a birth - related neurological

1932injury." § 766.305(4), Fla. Stat.

19378 . If NICA determines that the injury alleged in a claim is

1950a compensable birth - related neurological injury, it may award

1960compensation to the claimant, provided that the award is approved

1970by the administrative law judge to whom the claim has been

1981assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1992disputes the claim, as it has in the instant case, the dispute

2004must be resolved by the assigned administrative law judge in

2014accorda nce with the provisions of chapter 120, Florida Statutes.

2024§§ 766.304, 766.309, and 766.31, Fla. Stat.

20319 . In discharging this responsibility, the a dministrative

2040l aw j udge must make the following determination based upon the

2052available evidence:

2054(a) Wheth er the injury claimed is a birth -

2064related neurological injury. If the claimant

2070has demonstrated, to the satisfaction of the

2077administrative law judge, that the infant has

2084sustained a brain or spinal cord injury

2091caused by oxygen deprivation or mechanical

2097inj ury and that the infant was thereby

2105rendered permanently and substantially

2109mentally and physically impaired, a

2114rebuttable presumption shall arise that the

2120injury is a birth - related neurological injury

2128as defined in s. 766.303(2).

2133(b) Whether obstetrical services were

2138delivered by a participating physician in the

2145course of labor, delivery, or resuscitation

2151in the immediate postdelivery period in a

2158hospital; or by a certified nurse midwife in

2166a teaching hospital supervised by a

2172participating physician in t he course of

2179labor, delivery, or resuscitation in the

2185immediate postdelivery period in a hospital.

2191§ 766.309(1), Fla. Stat. An award may be sustained only if the

2203administrative law judge concludes that the "infant has sustained

2212a birth - related neurologi cal injury and that obstetrical services

2223were delivered by a participating physician at birth."

2231§ 766.31(1), Fla. Stat.

22351 0 . The term "birth - related neurological injury" is defined

2247in section 766.302(2) as follows:

"2252Birth - related neurological injury" me ans

2259injury to the brain or spinal cord of a live

2269infant weighing at least 2,500 grams for a

2278single gestation or, in the case of a

2286multiple gestation, a live infant weighing at

2293least 2,000 grams at birth caused by oxygen

2302deprivation or mechanical injury occ urring in

2309the course of labor, delivery, or

2315resuscitation in the immediate postdelivery

2320period in a hospital, which renders the

2327infant permanently and substantially mentally

2332and physically impaired.

233511 . The evidence, which is not refuted, established th at

2346Arielle did not sustain an injury to the brain caused by oxygen

2358deprivation occurring during labor, delivery, or the immediate

2366post - delivery period, nor that she has a permanent and

2377substantial mental impairment. Therefore, Arielle is not

2384eligible for benefits under the Plan.

2390CONCLUSION

2391Based upon the foregoing Findings of Fact and Conclusions of

2401Law, it is ORDERED that the Petition filed by Bethzaida

2411Rodriguez , on behalf of and as parent and natural guardian of

2422Arielle Rodriguez , is dismissed with pre judice.

2429DONE AND ORDERED this 24th day of October , 2014 , in
