67The issue in the case is whether Pacific Rim International

77West, Inc. (Pacific Rim) , may establish a new franchise motor

87vehicle dealership at Tropical Scooters, LLC (Tropical) , for the

96sale and service of motorcycles manufactured by Huzhou Daixi

105Zhenh ua Technology Trade Co., Ltd. (DAIX).

112PRELIMINARY STATEMENT

114By letter to Pinellas Powersports, LLC (Powersports) , dated

122November 15, 2013, the Department of Highway Safety and Motor

132Vehicles (Department) gave notice that Pacific Rim was seeking to

142establis h a new franchise motor vehicle dealership in Largo,

152Florida, for the sale of motorcycles manufactured by DAIX.

161Powersports filed a challenge to the establishment of the

170new dealership. By letter dated December 23, 2013, the

179Department forwarded the cha llenge to the Division of

188Administrative Hearings (DOAH). On December 26, 2013, DOAH

196issued an Initial Order directing the parties to identify the

206anticipated length of the hearing, dates upon which the parties

216were available for hearing, and suggested he aring locations. The

226Initial Order stated that the failure to respond would result in

237the hearing being scheduled in Tallahassee, Florida. No

245responses to the Initial Order were filed, and the hearing was

256scheduled accordingly.

258Prior to the hearing, a pre - hearing conference was held on

270July 9, 2014, to determine the status of the dispute. Although

281it appeared at that time that Pacific Rim believed the dispute

292had been resolved, Powersports and Tropical disagreed. The

300Administrative Law Judge directed the parties to advise DOAH if

310the dispute was resolved so that the hearing could be cancelled,

321but that otherwise the hearing would proceed as scheduled. There

331was no further communication from the parties prior to the

341hearing.

342No party appeared at the time scheduled for commencement of

352the hearing. There were no witnesses or exhibits admitted into

362evidence. Subsequent to the scheduled hearing time, Powersports

370filed a letter stating that the dispute was resolved and it was

382withdrawing the protest.

385F INDING S OF FACT

3901. There was no evidence presented at the hearing to

400establish that Powersports has a franchise agreement to sell or

410service DAIX motor vehicles. There was no evidence presented at

420the hearing that the Powersports dealership is physically located

429so as to meet the statutory requirements for standing to protest

440the establishment of the new franchise motor vehicle dealership.

449CONCLUSIONS OF LAW

4522. The Division of Administrative Hearings has

459jurisdiction over the parties to and subject m atter of this

470proceeding. §§ 120.569 and 120.57, Fla . Stat . (2013).

4803. Section 320.642, Florida Statutes (2009) , provides in

488relevant part as follows:

492Dealer licenses in areas previously served;

498procedure. --

500(1) Any licensee who proposes to establish

507an additional motor vehicle dealership or

513permit the relocation of an existing dealer

520to a location within a community or

527territory where the same line - make vehicle

535is presently represented by a franchised

541motor vehicle dealer or dealers shall give

548written notice of its intention to the

555department.

559(2)(a) An application for a motor vehicle

566dealer license in any community or territory

573shall be denied when:

5771. A timely protest is filed by a presently

586existing franchised motor vehicle dealer

591w ith standing to protest as defined in

599subsection (3); and

6022. The licensee fails to show that the

610existing franchised dealer or dealers who

616register new motor vehicle retail sales or

623retail leases of the same line - make in the

633community or territory of th e proposed

640dealership are not providing adequate

645representation of such line - make motor

652vehicles in such community or territory.

658The burden of proof in establishing

664inadequate representation shall be on the

670licensee.

674(3) An existing franchis ed motor vehicle

681dealer or dealers shall have standing to

688protest a proposed additional or relocated

694motor vehicle dealer when the existing motor

701vehicle dealer or dealers have a franchise

708agreement for the same line - make vehicle to

717be sold or serviced by the proposed

724additional or relocated motor vehicle dealer

730and are physically located so as to meet or

739satisfy any of the following requirements or

746conditions:

750(b) If the proposed additional or relocated

757motor vehicle dealer is to be located i n a

767county with a population of more than

774300,000 according to the most recent data of

783the United States Census Bureau or the data

791of the Bureau of Economic and Business

798Research of the University of Florida:

8041. Any existing motor vehicle dealer or

811deal ers of the same line - make have a

821licensed franchise location within a radius

827of 12.5 miles of the location of the

835proposed additional or relocated motor

840vehicle dealer; or

8432. Any existing motor vehicle dealer or

850dealers of the same line - make can establi sh

860that during any 12 - month period of the

86936 - month period preceding the filing of the

878licensee Ó s application for the proposed

885dealership, such dealer or its predecessor

891made 25 percent of its retail sales of new

900motor vehicles to persons whose registered

906h ousehold addresses were located within a

913radius of 12.5 miles of the location of the

922proposed additional or relocated motor

927vehicle dealer; provided such existing

932dealer is located in the same county or any

941county contiguous to the county where the

948additio nal or relocated dealer is proposed

955to be located.

9584. The licensee in this case is Pacific Rim. See

968§§ 320.60(8) and 320.61, Fla . Stat . (20 09 ).

9795. Powersports is the alleged existing franchised motor

987vehicle dealer. Powersports failed to present any evidence at

996the hearing to establish that it meets the statutory requirements

1006to establish standing, by location or sales volume, to protest

1016the establishment of the new franchise motor vehicle dealership

1025at issue in this case.

1030RECOMMENDATION

1031Based on the foregoing Findings of Fact and Conclusions of

1041Law and upon the post - hearing notice filed by Powersports that

1053the protest was withdrawn, it is RECOMMENDED that the Department

1063enter a f inal o rder dismissing the protest filed in this case.
