51This cause came on for consideration upon a Motion for

81STATEMENT OF THE CASE
85On January 6 , 201 4, Petitioner s , Rashad Sukhu and
95Anjani Ramoutar , on behalf of and as parents and natural
105guardians of Alina Karina Sukhu ( Alina ), a minor, filed a
117Petition f or Benefits Pursuant to Florida Statute Section 766.301
127et seq. (Petition) with the Division of Administrative Hearings
136(DOAH) for a determination of compensability under the Florida
145Birth - Related Neurological Injury Compensation Plan (Plan). The
154Petition named Juan Ravelo , M.D., as the physician providing
163obstetrical services at the birth of Alina on June 23 , 201 1 , at
176Florida Hospital located in Orlando , Florida.
182DOAH served NICA with a copy of the Petition on January 10 ,
194201 4 . On January 1 3 , 2014, DOAH received a return receipt from
208the United States Postal Service showing that Florida Hospital
217had been served with a copy of the Petition. On January 1 3 ,
230201 4 , DOAH received a return receipt from the United States
241Postal Service showing that Dr. Ravelo ha d been served with a
253copy of the Petition.
257Neither Juan Ravelo, M.D., nor Florida Hospital has
265petitioned to i ntervene in this proceeding.
272On August 28 , 2014, NICA filed a Motion for Summary Final
283Order, asserting that Alina did not sustain a "birth - rel ated
295neurological injury" as that term is defined in section
304766.302(2), Florida Statutes. The motion was served by United
313States Mail on August 28 , 2014. An Order to Show Cause was
325entered on September 11 , 2014, advising Petitioners to show cause
335in wri ting why Respondent Ós Motion for Summary Final Order should
347not be granted. On September 19, 2014, Petitioner
355Anjani Ramoutar filed a letter in opposition to the motion.
365FINDINGS OF FACT
3681. Alina Karina Sukhu was born on June 23, 201 1 , at Florida
381H ospital located in Orlando , Florida. Alina weighed 6 pounds 12
392ounces at birth.
3952. Donald Willis, M.D. (Dr. Willis), was requested by NICA
405to review the medical records for Alina , to determine whether an
416injury occurred in the course of labor, delivery, or
425resuscitation in the immediate post - delivery period in the
435hospital due to oxygen deprivation or mechanical injury occurring
444in the course of labor, delivery, or resuscitation in the
454immediate post - delivery period. In an affidavit dated August 14,
4652014 , Dr. Willis described his findings as follows:
473In summary , labor and delivery were
479apparently uncomplicated. Umbilical cord
483blood gas was not done. The newborn had
491decreased muscle tone and feeding difficulty.
497MRI of the brain showed some abnormalities
504that could represent hemorrhage or hypoxic
510injury. However, the FHR tracing did not
517suggest fetal distress during labor and
523delivery was uncomplicated. These findings
528suggest that the brain injury was most likely
536not birth related.
539There was no apparent obstetrical event that
546resulted in loss of oxygen or mechanical
553trauma to the babyÓs brain during labor or
561delivery.
5623. NICA retained Michael S . Duchowny , M.D., a pediatric
572neurologist, to examine Alina and to review h er medical records.
583Dr. Duchowny examined Alina on May 28 , 2014 . In an affidavit
595dated August 18, 2014, Dr. Duchowny opined as follows :
605In summary, AlinaÓs neurological examination
610reveals global developmental delay
614characterized by a complex 4 - limb motor
622disability with static hypotonia , truncal
627ataxia, and dynamic hypertoncity. She has
633ab sent language development, a cortical
639visual impairment, and severe oro - motor
646incoordination necessitating caloric intake
650via an indwelling gastrostomy tube.
655Although Alina has a substantial mental and
662motor impairment, the medical records do not
669provide evidence to suggest that her
675neurological injury was acquired due to
681oxygen deprivation or me chanical injury in
688the course of labor and delivery. I therefore
696am not recommending Alina to be considere d
704for compensation within the NICA program.
7104. Petitioner Anjani Ramoutar filed a letter in opposition
719to NICA's Motion for Summary Final Order. In the letter,
729Petitioner raises the issue of fault. However, as addressed in
739the Conclusions of Law, the F lorida Birth - Related Neurological
750Injury Compensation Plan was established for the purpose of
759providing compensation, irrespective of fault, for birth - related
768neurological injury that fits within specific statutory
775definitions to be eligible to receive ben efits under the Plan.
786§§ 766.302(2), 766.303(1), and 766.309(1), Fla. Stat.
7935 . A review of the file in this case reveals that there
806have been no expert opinions filed t hat are contrary to the
818opinion of Dr. Willis that there was no apparent obstetrical
828e vent that resulted in loss of oxygen or mechanical trauma to the
841baby's brain during labor or delivery . Dr. WillisÓ opinion is
852credited. There are no contrary expert opinions filed that are
862contrary to Dr. Duchowny Ós opinion that although Alina has a
873sub stantial mental and motor impairment, the medical records do
883not provide evidence to suggest that her neurological injury was
893acquired due to oxygen deprivation or mechanical injury in the
903course of labor and delivery. Dr. Duchowny Ós opinion is
913credited.
914CONCLUSIONS OF LAW
9176 . The Division of Administrative Hearings has jurisdiction
926over the parties to and the subject matter of these proceedings.
937§§ 766.301 - 766.316, Fla. Stat.
9437 . The Plan was established by the Legislature "for the
954purpose of providing compensation, irrespective of fault, for
962birth - related neurological injury claims" relating to births
971occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
9828 . The injured infant, her or his personal representative,
992parents, dependents, and nex t of kin may seek compensation under
1003the Plan by filing a claim for compensation with DOAH.
1013§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1021which administers the Plan, has "45 days from the date of service
1033of a complete claim . . . in which to file a response to the
1048petition and to submit relevant written information relating to
1057the issue of whether the injury is a birth - related neurological
1069injury." § 766.305(4), Fla. Stat.
10749 . If NICA determines that the injury alleged in a claim is
1087a compensable birth - related neurological injury, it may award
1097compensation to the claimant, provided that the award is approved
1107by the administrative law judge to whom the claim has been
1118assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1129dis putes the claim, as it has in the instant case, the dispute
1142must be resolved by the assigned administrative law judge in
1152accordance with the provisions of chapter 120, Florida Statutes.
1161§§ 766.304, 766.309, and 766.31, Fla. Stat.
116810 . In discharging this responsibility, the a dministrative
1177l aw j udge must make the following determination based upon the
1189available evidence:
1191(a) Whether the injury claimed is a birth -
1200related neurological injury. If the claimant
1206has demonstrated, to the satisfaction of the
1213adm inistrative law judge, that the infant has
1221sustained a brain or spinal cord injury
1228caused by oxygen deprivation or mechanical
1234injury and that the infant was thereby
1241rendered permanently and substantially
1245mentally and physically impaired, a
1250rebuttable presu mption shall arise that the
1257injury is a birth - related neurological injury
1265as defined in s. 766.303(2).
1270(b) Whether obstetrical services were
1275delivered by a participating physician in the
1282course of labor, delivery, or resuscitation
1288in the immediate postd elivery period in a
1296hospital; or by a certified nurse midwife in
1304a teaching hospital supervised by a
1310participating physician in the course of
1316labor, delivery, or resuscitation in the
1322immediate postdelivery period in a hospital.
1328§ 766.309(1), Fla. Stat. An award may be sustained only if the
1340administrative law judge concludes that the "infant has sustained
1349a birth - related neurological injury and that obstetrical services
1359were delivered by a participating physician at birth."
1367§ 766.31(1), Fla. Stat.
13711 1 . The term "birth - related neurological injury" is defined
1383in section 766.302(2) as follows:
"1388Birth - related neurological injury" means
1394injury to the brain or spinal cord of a live
1404infant weighing at least 2,500 grams for a
1413single gestation or, in the case of a
1421multiple gestation, a live infant weighing at
1428least 2,000 grams at birth caused by oxygen
1437deprivation or mechanical injury occurring in
1443the course of labor, delivery, or
1449resuscitation in the immediate postdelivery
1454period in a hospital, which renders the
1461infant permanently and substantially mentally
1466and physically impaired.
14691 2 . While PetitionerÓs letter is in disagreement with
1479Drs. Willis and DuchownyÓs conclusions, t he evidence, which is
1489not refuted by any contrary expert opinions , established that
1498Al ina did not sustain an injury to the brain caused by oxygen
1511deprivation or mechanical injury in the course of labor and
1521delivery. Therefore, Alina is not eligible for benefits under
1530the Plan.
1532CONCLUSION
1533Based upon the foregoing Findings of Fact and Con clusions of
1544Law, it is ORDERED that the Petition filed by Rashad Sukhu and
1556Anjani Ramoutar , on behalf of and as parents and natural
1566guardians of Alina Karina Sukhu , is dismissed with prejudice , and
1576the final hearing scheduled for November 14, 2014, is canc eled .
