106STATEMENT OF THE ISSUE

110The issue to be determined in this case is whether

120PetitionerÓs proposed activities qualify for the seawall

127construction exemption from permitting in section 403 .813(1)(i),

135Florida Statutes (2014).

138PRELIMINARY STATEMENT

140On November 5, 2013, Petitioner submitted an exemption

148verification request to the District, requesting verification

155that his proposed activities qualify for five types of exemption

165from Environme ntal Resource Permit (ÐERPÑ) requirements. On

173December 5, 2013, the District issued exemption determination

181No. 131105 - 6, which determined that PetitionerÓs proposed

190activities qualified for the maintenance dredging exemption, but

198not the other four reque sted exemptions.

205On December 30, 2013, Petitioner filed a petition for

214administrative hearing challenging the DistrictÓs exemption

220determination. The District dismissed the initial petition and

228Petitioner filed an amended petition on January 10, 2014. T he

239amended petition was referred to DOAH to conduct an evidentiary

249hearing.

250On July 10, 2014, the DistrictÓs Governing Board adopted a

260resolution which delegated authority to the Executive Director

268to take final action on requests for verification of exem ptions.

279Petitioner moved to amend his petition again to include a claim

290of procedural error based on the after - the - fact delegation

302described above. Following a hearing on the motion, the

311Administrative Law Judge placed the case in abeyance and

320relinquish ed jurisdiction to the District to correct any

329procedural error. On September 24, 2014, the District issued a

339revised exemption determination, but it still concluded that

347Petitioner only qualified for the maintenance dredging

354exemption.

355Before the final hearing, Petitioner withdrew his challenge

363of the DistrictÓs denial of the requested exemptions except with

373respect to the seawall construction exemption. The case

381proceeded to hearing solely on PetitionerÓs challenge to the

390DistrictÓs determination that Petitioner did not qualify for the

399seawall construction exemption.

402At the final hearing, official recognition was taken of

411Florida Administrative Code Rules 40E - 4.051 and 62 - 312.050;

422chapters 40E - 4, 62 - 302, 62 - 330, and 62 - 340; and the ERP

439ApplicantÓs Hand book, Volume I and II. Joint Exhibit 1 was

450admitted into evidence.

453Petitioner testified on his own behalf. PetitionerÓs

460Exhibits 2, 3, 9 - 12, 15 - 16, 23, 26, 27, 28, and 29, were

476admitted into evidence. PetitionerÓs Exhibits 3, 27, 28, and 29

486were ruled h earsay and admitted only to supplement or explain

497non - hearsay evidence or evidence for which a hearsay exception

508applies. PetitionerÓs Exhibit 47 was placed in the record only

518as a proffer.

521The District presented the testimony of Rod Maddox, P.S.M.,

530who was accepted as an expert in surveying and mapping;

540Richard Barnes, P.S.M., who was accepted as an expert in

550surveying and mapping; Patrick Ganley; Dr. Jeffrey Eder;

558Robert Schaffer, who was accepted as an expert in mapping;

568Robert Hopper, R.L.A., P.W.S., who was accepted as an expert in

579wetland delineation, wetland mitigation and wetland ecology; and

587Robert Robbins, P.W.S., who was accepted as an expert in

597saltwater ecology, wetland ecology, and wetland mitigation.

604District Exhibits 1 - 3, 6 - 11, 13 - 32, 39 - 4 4, and 52 were admitted

623into evidence.

625The five - volume Transcript of the final hearing was filed

636with DOAH. The parties filed proposed recommended orders that

645were considered in the preparation of this Recommended Order.

654FINDINGS OF FACT

657The Parties

6591. The District is a multi - purpose water management district

670with its principal office at 3301 Gun Club Road, West Palm Beach,

682Florida. It has been granted powers and assigned duties under

692chapter 373 , Florida Statutes, to regulate construction activities

700in wetlands and other surface waters.

7062. Petitioner William B. Swaim is the contract purchaser of

716real property located at Section 22, Township 45 South, Range 43

727East, Palm Beach County Parcel Identification number

73446 - 43 - 45 - 22 - 00 - 005 - 0020 , in the Town of Ocean Ridge, Palm Beach

755County (Ðthe propertyÑ or ÐPetitionerÓs propertyÑ).

7613. The western side of the property contains a healthy

771stand of red mangroves. It is inundated on high tides.

7814. The eastern portion of the property is beneath the open

792waters of Spanish Creek. This submerged portion contains

800productive benthic habitat for a number of fish, invertebrates,

809oysters, conchs, clams, mussels, barnacles, and crabs.

8165 . The Department of Environmental Protection could not

825determine whether Spanish C reek was navigable at the date of

836statehood (1845) and, therefore, is subject to a claim of State

847ownership under chapter 253, Florida Statutes, as Ðsovereignty

855submerged lands.Ñ

8576 . Petitioner did not present competent evidence that all

867of the land upon which the proposed project would be constructed

878is contained within the property which he has contracted to

888purchase. Petitioner showed his title would extend to the

897centerline of Spanish Creek, but he did not establish where the

908centerline is located.

9117 . PetitionerÓs evidence was not sufficient to show that he

922has a colorable claim to all of the open water area that he

935proposes to wall off and fill.

941The Proposed Project

9448 . In his request for exemption verification, Petitioner

953identified the following proposed development activities:

959(1) construction of approximately 950 feet of batter pile

968concrete seawall around three sides of the approximate

976boundaries of the property; (2) filling within the seawalls to

986an approximate elevation of 8.0 feet above sea level with

996offsite fill; and (3) construction of an access road to the

1007south of the property.

10119 . Petitioner later modified his proposal to construct

10201,117 feet of batter pile concrete and steel sheet seawall and

1032to fill within the seawalls to an appro ximate elevation of 6.0

1044feet above sea level. At the final hearing, Petitioner withdrew

1054his plan to place riprap on the outside of the eastern seawall.

1066Petitioner still proposes to place 300 feet of riprap along the

1077western boundary of the property.

1082The Seawall Construction Exemption

10861 0 . Section 403.813(1)(i) provides an exemption from

1095permitting for the following activities:

1100The construction of private docks of 1,000

1108square feet or less of over - water surface

1117area and seawalls in artificially created

1123waterways where such construction will not

1129violate existing water quality standards,

1134impede navigation, or affect flood control.

1140This exemption does not apply to the

1147construction of vertical seawalls in

1152estuaries or lagoons unless the proposed

1158constructio n is within an existing manmade

1165canal where the shoreline is currently

1171occupied in whole or part by vertical

1178seawalls.

1179Whether Petitioner Proposes to Construct Seawalls

11851 1 . The term ÐseawallÑ is not defined in the statute. It

1198is defined in section 2 .0(a)91 of the ApplicantÓs Handbook as Ða

1210man - made wall or encroachment, except riprap, which is made to

1222break the force of waves and to protect the shore from erosion.Ñ

12341 2 . The DistrictÓs definition of ÐseawallÑ is similar to

1245its dictionary definition a s Ða wall or embankment to protect the

1257shore from erosion or to act as a breakwater.Ñ WebsterÓs New

1268Collegiate Dictionary at 1035 (1979).

12731 3 . PetitionerÓs proposed project is not intended to

1283protect a shore from erosion. The property has no shore.

1293Pet itionerÓs project is more accurately described as construction

1302of retaining walls to form a frame within which to place fill

1314dirt so that about three acres of wetlands and open water can be

1327transformed into uplands. PetitionerÓs purpose is to create a

1336bui ldable residential lot.

13401 4 . PetitionerÓs project is not the construction of

1350seawalls. Therefore, the proposed seawalls will be referred to

1359hereafter as walls.

1362Whether Spanish Creek is an Artificially Created Waterway

13701 5 . The term Ðartificially created waterwayÑ is not defined

1381in section 403.813(1)(i) or in the rules of the District.

1391However, the term Ðartificial watersÑ is defined in section

14002.0(a)10 of the ApplicantÓs Handbook as Ðbodies of water that

1410were totally excavated from uplands, do not overl ap historic

1420wetlands or other surface waters, and were not created as a part

1432of a mitigation plan.Ñ

14361 6 . The District interprets the term Ðartificially created

1446waterwayÑ in section 403.813(1)(i) as having the same meaning as

1456Ðartificial watersÑ; that is, it does not include natural

1465waterbodies that have been dredged.

14701 7 . The District conducted an extensive review of over 160

1482years of mapping data, including certified historic maps from the

14921800s, aerial photography, the National Wetlands Inventory

1499databa se, topographic and hydrographic data, soil surveys and

1508maps, and historic photographs. The evidence clearly establishes

1516that Spanish Creek is a naturally - occurring waterbody, having

1526appeared on historic documents since at least 1872.

15341 8 . Some dredging was conducted in Spanish Creek, probably

1545in the 1950s or 1960s. The western portion of PetitionerÓs

1555property where the red mangroves are located was not dredged.

1565The preponderance of the evidence indicates that the property

1574once included a larger area of shallow marsh or mangrove

1584vegetation and a smaller area of open water, but dredging

1594decreased the area of vegetated wetlands and increased the area

1604of open water.

160719 . Spanish Creek does not meet the DistrictÓs definition

1617of Ðartificial watersÑ because i t is not totally excavated from

1628uplands.

16292 0 . Spanish Creek meets the definition of ÐstreamÑ in

1640section 2.0(a)101 of the ApplicantÓs Handbook, which is Ðany

1649river, creek, slough, or natural watercourse in which water

1658usually flows in a defined bed or chan nel.Ñ The definition

1669includes a statement that Ð[t]he fact that some part of the bed

1681or channel shall have been dredged or improved does not prevent

1692the watercourse from being a stream.Ñ

16982 1 . PetitionerÓs reference to U.S. Army Corps of Engineers

1709charact erizations of waters in the area as Ðresidential canalsÑ

1719is not controlling, nor persuasive. Spanish Creek is not a

1729canal. Spanish Creek is a natural waterbody, which has been

1739artificially widened by dredging.

17432 2 . Petitioner argues that the plain meanin g of

1754Ðartificially created waterwayÑ applies to Spanish Creek, but

1762Ðartificially createdÑ does not have the plain meaning of being

1772artificially altered. Spanish Creek was altered by dredging .

1781It was not created by dredging . It was widened by the dredgin g

1795and probably deepened, at least initially, but no evidence was

1805presented to compare historical and current depths.

18122 3 . Petitioner suggests that Spanish Creek was not a

1823waterway before it was dredged based on his unproven ass umption

1834that Spanish Creek w as only navigable after it was dredged.

1845However, the first dictionary entry for ÐwaterwayÑ is Ða way or

1856channel for water.Ñ WebsterÓs New Collegiate Dictionary , at

18641314. Spanish Creek was a way or channel for water before it was

1877dredged.

18782 4 . Spanish C reek is not an artificially created waterway.

1890Whether the Project Would Violate Water Quality Standards

18982 5 . Other than submitting a turbidity control plan that

1909Petitioner adapted from a plan he found in the District files for

1921another project, Petitioner did not address water quality issues

1930in his request for exemption verification. At the final hearing,

1940Petitioner did not present competent evidence regarding the

1948potential water quality impacts associated with his proposed

1956project.

19572 6 . Petitioner is pr oposing to construct an access road

1969that will be located on properties owned by Palm Beach County and

1981Spanish Creek, LLC, which currently consist of mangrove wetlands,

1990but he has not obtained their permission for the construction.

20002 7 . The area contains m uck soils, which would have to be

2014removed to construct the road. Petitioner did not address with

2024competent evidence the potential water quality impacts associated

2032with th e muck removal.

20372 8 . Petitioner stated that if he is unable to transport the

2050muck an d fill material over the access road , he will use a barge

2064and tug boat. Because of the shallow depth of Spanish Creek,

2075these vessels would likely disturb the submerged soils and the

2085organisms that live in or use these soils.

209329 . PetitionerÓs proposed pr oject would extend a box -

2104shaped land form into the open waters of Spanish Creek that

2115would affect water currents and sediment movement. Tidal

2123flushing would be impeded. Erosion would likely be caused by

2133currents and waves reflecting off and flowing aroun d the

2143proposed walls. S hoaling would likely occur .

21513 0 . Petitioner did not present competent evidence that the

2162proposed construction activities can be conducted without

2169causing violations of state water quality standards. The

2177preponderance of the eviden ce indicates that PetitionerÓs

2185proposed activities would violate state water quality standards

2193for turbidity, dissolved oxygen, and species diversity in the

2202area.

2203Whether the Project Would Impede Navigation

22093 1 . The proposed project would cause a substan tial

2220narrowing of Spanish Creek , leaving about 75 feet of open water

2231between the eastern wall of PetitionerÓs p roperty and the

2241Wellington Arms Condominium seawall.

22453 2 . Wellington Arms has docks which extend out 34 feet from

2258its seawall. The docks are cu rrently being used for boats that

2270extend beyond the end of the docks. Less than 40 feet would

2282separate the vessels moored at Wellington Arms from PetitionerÓs

2291proposed eastern wall.

22943 3 . If PetitionerÓs proposed project were built,

2303m aneuvering a boat in and out of the docks at Wellington Arms or

2317between the docks and PetitionerÓs proposed eastern wall would be

2327difficult . It would be unsafe in windy conditions.

23363 4 . The proposed project would impede navigation.

2345Whether the Proposed Project Would Affect Flood Control

23533 5 . The District presented evidence to support its

2363contention that the proposed project would affect flood control,

2372but the evidence was not persuasive. The property is surrounded

2382by waters of the Intracoastal Waterway and Atlantic Ocean a nd the

2394DistrictÓs evidence did not adequately explain how the project

2403could have more than an insignificant effect on these dominant

2413forces which determine water levels in the area.

2421Whether Petitioner Proposes Only Backfilling

24263 6 . Rule 62 - 330, entitled ÐExempt Activities,Ñ is

2438applicable to all exemption requests. Rule 62 - 330.051(12)(a)

2447addresses the exemption for construction of seawalls and states

2456that the exemption includes Ðonly that backfilling needed to

2465level the land behind seawalls.Ñ

24703 7 . Petiti oner proposes to fill approximately three acres

2481behind the walls. Currently, there is no land (uplands) behind

2491the proposed walls to level. The purpose of the fill is not to

2504level land behind the walls. The purpose of the fill is to

2516create a buildable l ot.

25213 8 . Petitioner does not know how much fill is required to

2534stabilize the walls. Less than three acres of fill is required.

254539 . PetitionerÓs proposed project does not include only

2554that backfilling needed to level the land behind the walls.

2564CONCLUSIO NS OF LAW

25684 0 . An administrative hearing held pursuant to sections

2578120.569 and 120.57(1), Florida Statutes, is a de novo proceeding

2588designed to formulate final agency action. McDonald v. DepÓt of

2598Banking and Finance , 346 So. 2d 569, 584 (Fla. 1st DCA 197 7).

26114 1 . Because Petitioner is the party asserting the

2621affirmative of the issue of the proceeding -- that he qualifies for

2633the seawall construction exemption -- he has the burden of ultimate

2644persuasion . DepÓt of Transp. v . J.W.C. Co., Inc. , 396 So. 2d

2657778, 78 8 (Fla. 1st DCA 1981).

26644 2 . Petitioner must prove the material facts that establish

2675his entitlement to the exemption by a preponderance of the

2685evidence. See § 120.57(1)(j), Fla. Stat.

26914 3 . An agencyÓs interpretation of the statutes and rules

2702it adminis ters is entitled to deference and should be upheld

2713unless it is clearly erroneous. See Suddath Van Lines, Inc. v.

2724DepÓt of Envtl. Prot. , 668 So. 2d 209, 212 (Fla. 1st DCA 1996).

27374 4 . The DistrictÓs interpretation of the statutory term

2747Ðartificially creat ed waterwaysÑ to exclude natural waterbodies

2755that have been dredged is a reasonable one. It furthers the

2766legislative intent reflected in all of the exemptions created in

2776section 403.813 that the exemptions apply to activities which

2785will have little or no adverse effect on natural resources.

27954 5 . Whether Spanish Creek contains state sovereign

2804submerged lands is not a controlling factor in determining

2813whether a proposed seawall qualifies for an exemption under

2822section 403.813(1)(i).

28244 6 . Petitioner contend s that the seawall construction

2834exemption only requires him to provide turbidity controls. There

2843is no such limitation in the statute. All state water quality

2854standards are applicable.

28574 7 . PetitionerÓs proposed project does not qualify for the

2868exemptio n for seawall construction in section 403.813(1)(i)

2876because (1) it does not propose seawalls, but, rather, retaining

2886walls to hold fill material; (2) the project is not in an

2898artificially created waterway; (3) the project would violate

2906state water quality standards; (4) the project would impede

2915navigation; and (5) the project includes more backfilling than

2924needed to level the land behind the walls.

2932RECOMMENDATION

2933Based on the foregoing Findings of Fact and Conclusions of

2943Law, it is recommended that the Dist rict enter a Final Order

2955determining that PetitionerÓs proposed development activities do

2962not qualify for the seawall construction exemption from

2970permitting under section 403.813(1)(i), Florida Statutes.
