101Whether PetitionerÓs request for hearing was timely filed
109or should otherwise be accepted by the De partment of Management

129PRELIMINARY STATEMENT
131T his case was initiated after the Department of Management
141Services, Division of State Group Insurance (Department or
149Respondent) issued a notice (Notice) setting forth its
157[preliminary] determi nation to deny PetitionerÓs Level - II Appeal
167regarding PetitionerÓs request to cancel her dental plan and
176receive reimbursement for associated costs . Thereafter,
183Petitioner filed a p etition for a f ormal h earing (Petition) ,
195which was referred to the Divisi o n of Administrative Hearings
206(DOAH) on February 4, 201 4 . The undersigned issued an Initial
218Order in this case on February 4, 2014.
226On February 10, 2014 , Respondent filed a Motion to Dismiss
236(Motion) alleging that the Petition was untimely filed.
244Attached to the Motion were a copy of the Notice ; a copy of the
258certified mail receipt of the Notice that was date - stamped
269May 14, 2013 ; and a copy of the Petition bearing the
280DepartmentÓs June 5, 2013, date - stamped filing date .
290Petitioner Ós response (Response) t o the Motion does not dispute
301the alleged date that she received the Notice or the date that
313her Petition was filed with the Department. Rather,
321PetitionerÓs Response asserts that Petitioner mailed her
328Petition to the Department by certified mail on June 1, 2013,
339and the post office receipt reflects that June 3, 2013, was the
351Ðexpected date of delivery.Ñ PetitionerÓs Response further
358argues that if the Memorial Day of M ay 27th is excluded from the
37221 - day filing deadline period, her Petition was timely fil ed.
384T he Motion and Response, together with the attached
393exhibits of each, show that PetitionerÓs Petition request ing an
403administrative h earing was filed with the Department beyond the
41321 - day perio d required by the Notice and Florida Administrative
425Code Ru le 60P - 1.004.
431Having reviewed the matter fully, accepting all of
439PetitionerÓs allegations as true, and having considered the
447allegations in the manner most favorable to the Petitioner, for
457the reasons set forth below it is concluded that, as a matter of
470l aw, the request for formal hearing should be dismissed as
481untimely, and the Department of Management Services should enter
490a final order consistent with its notice of proposed agency
500action.
501FINDINGS OF FACT
5041. On May 14 , 2013 , Petitioner received the Not ice ,
514consisting of the DepartmentÓs le tter denying PetitionerÓs Level -
524II Appeal in which Petitioner had requested cancellation of her
534dental plan and reimbursement of associated costs.
5412. The N otice included a notice of rights advising
551Petitioner that s he could request an administrative hearing by
561filing a request for hearin g within 21 - calendar days of her
574receipt of the Notice .
5793. Memorial Day was observed as a national holiday in the
590United States on May 27, 2013. There are no facts or
601circumstances in this case, however, indicating that the 21 - day
612period for filing a request for administrative hearing was tolled
622or suspended because of Memorial Day.
6284 . Not counting the May 14 , 201 3 , date of receipt of the
642N otice, the 21 st day for filing a request fo r hearing fell on
657Tuesday, June 4, 201 3 .
6635 . Petitioner mailed her Petition request ing a hearing on
674June 1 , 201 3.
6786. PetitionerÓs receipt from the post office reflects an
687expected delivery date of June 3, 2013. PetitionerÓs Petition ,
696however, was not rec eived by the Department until June 5 , 201 3 .
7107 . There is no indication that Petitioner sought or was
721granted an extension of the 21 - day period within which to seek an
735administrative hearing from the date of her receipt of the
745Notice.
746CONCLUSIONS OF LAW
7498 . The Division of Administrative Hearings has jurisdiction
758over the parties to and subject matter of this proceeding
768pursuant to s ections 120.569 and 120.57(1), Fla. Stat. (201 3 ). 1/
7819 . Respondent cites to Florida Administrative Code Rule
79060P - 1.004 as suppo rt for the dismissal of the request for
803hearing. That rule provides that:
808Any party whose substantial interests have
814been or will be determined by a decision or
823intended decision of the Division of State
830Group Insurance and who desires to contest
837the age ncyÓs decision or intended decision
844shall submit a petition for an
850administrative hearing that complies with
855Rule 28 - 106.201, F.A.C., if there is a
864dispute of material fact, or Rule 28 -
872106.301, F.A.C., if there is no dispute of
880material fact. The petition must be
886received by the agency clerk of the
893Department within twenty - one (21) calendar
900days after notice of the decision or
907intended decision is received by the party.
914The clerkÓs address is Office of General

95410 . Florida Administrative Code Rules 28 - 106.111(2) - (4)
965provide:
966(2) Unless otherwise provided by law,
972persons seeking a hearing on an agency
979decision which does or may determine their
986substantial interests shall file a petition
992for hearing with the agency within 21 days
1000of receipt of written notice of the
1007decision.
1008(3) An agency may, fo r good cause shown,
1017grant a request for an extension of time for
1026filing an initial pleading. Requests for
1032extension of time must be filed with the
1040agency prior to the applicable deadline.
1046Such requests for extensions of time shall
1053contain a certificate t hat the moving party
1061has consulted with all other parties, if
1068any, concerning the extension and that the
1075agency and any other parties agree to or
1083oppose the extension. A timely request for
1090extension of time shall toll the running of
1098the time period for fi ling a petition until
1107the request is acted upon.
1112(4) Any person who receives written notice
1119of an agency decision and who fails to file
1128a written request for a hearing within 21
1136days waives the right to request a hearing
1144on such matters . This provision does not
1152eliminate the availability of equitable
1157tolling as a defense.
11611 1 . Florida Administrative Code Rule 28 - 106.104(1)
1171provides:
1172In construing these rules or any order of a
1181presiding officer, filing shall mean
1186received by the office of the agency cle rk
1195during normal business hours or by the
1202presiding officer during the course of a
1209hearing.
12101 2 . Section 120.569(2)(c), Fl orida Statutes , provides, in
1220pertinent part, that Ð[a] petition shall be dismissed if it . . .
1233has been untimely filed.Ñ
123713 . Dismiss al of an untimely request for hearing is
1248mandatory unless facts exist to support the application of the
1258doctrine of equitable tolling. Sect ion 120.569(2)(c), Fla.
1266Stat.; Fla. Admin. Code R. 28 - 106.111(4); Machules v. Dep Ó t of
1280Admin . , 523 So. 2d 1132 (Fla. 1988); Riverwood Nursing Ctr., LLC
1292v. Ag . for Health Care Admin. , 58 So. 3d 907 (Fla. 1 st DCA 2011);
1308Cann v. De p Ó t. of Child . & Fam . Servs . , 813 So. 2d 237 (Fla. 2d
1328DCA 2000). E quitable tolling may be applicable Ðwhen the
1338plaintiff has been misled or lul led into inaction, has in some
1350extraordinary way been prevented from asserting his rights, or
1359has timely asserted his rights mistakenly in the wrong forum.Ñ
1369Machules at 1134.
13721 4 . There has been no suggestion that Petitioner was misled
1384or lulled into inac tion as a result of any act or omission of the
1399Department or any other person. To the contrary, the documents
1409filed in this proceeding reflect that the Department clearly
1418advised Petitioner of the timeframe and procedure for requesting
1427a hearing as well a s the consequences for failure to timely
1439request a hearing. Likewise, Petitioner has not asserted that
1448s he timely asserted her rights in the wrong forum. Therefore ,
1459the sole issue for consideration is whether Petitioner was, in
1469some extraordinary way, pr e vented from timely asserting her
1479rights.
14801 5 . The facts alleged by Petitioner are not so
1491extraordinary as to have prevented Petitioner from asserting her
1500rights. The fact that the post office receipt reflects an
1510expected date of delivery of June 3, 2013, is not an
1521extraordinary occurrence as to require the application of
1529equitable tolling to excuse the late filing of PetitionerÓs
1538request for hearing. Likewise, a four - day delay from mailing
1549until delivery is not extraordinary. Cf . , _ e.g. , Fla. Admin. Code
1561R. 28 - 106.103 (where applicable, 5 days added for service by
1573mail). 2/
157516 . Petitioner could have requested additional time to file
1585which would have, without more, tolled the time for filing. Fl a .
1598Admin . Code R . 28 - 106.111(3). Petitioner, however, did no t
1611request additional time, but rather relied on an Ðexpected dateÑ
1621of delivery by the post office.
162717 . PetitionerÓs suggestion that the intervening Memorial
1635Day holiday should add another day to the 21 - day period is also
1649without merit. Florida Administr ative Code Rule 28 - 106.103,
1659Computation of Time, provides for additional time for
1667intermediate Saturdays, Sundays, and legal holidays only when the
1676period of time is less than 7 days, or when a Saturday, Sunday or
1690holiday falls on the last day of a given t ime period.
17021 8 . In sum, PetitionerÓs request for hearing should be
1713dismissed because it was filed with the Department more than 21
1724days after Petitioner receiv ed the letter denying her Level - II
1736appeal.
1737RECOMMENDATION
1738Based upon the foregoing Findings o f Fact and Conclusions
1748of Law, it is
1752RECOMMENDED that Respondent, Department of Management
1758Services, issue a final order dismissing PetitionerÓs request
1766for hearing.
