60This cause came on for consideration upon Respondent's
68M otion for Summary Final Order, filed on April 28, 2014.
79STATEMENT OF THE CASE
83On February 12, 2014, Petitioner, Shakeitriy i a Edwards on
93behalf of and as parent and natural guardian of Desmond Govan
104(Desmond), a minor, filed a Petition for Benefits Pursuan t to
115Florida Statute Section 766.301 et seq. (Petition) with the
124Division of Administrative Hearings (DOAH) for compensation under
132the Florida Birth - Related Neurological Injury Compensation Plan
141(Plan). The Petition named Dennis Szurkus, M.D., as the
150phys ician who provided obstetric services at the birth of Desmond
161at Winnie Palmer Hospital located in Orlando, Florida, on
170February 14, 2009.
173DOAH served the Florida Birth - Related Neurological Injury
182Compensation Association (NICA) with a copy of the Petition on
192February 19, 2014. Winnie Palmer Hospital and Dr. Szurkus were
202served with copies of the Petition on February 20, 2014.
212On March 10, 2014, Orlando Health, Inc. , d/b/a Winnie Palmer
222Hospital for Women and Babies filed a Petition for Leave to
233Interven e, which was granted by Order dated March 27, 2014. As
245of the date of this Summary Final Order of Dismissal, Dr. Szurkus
257has not petitioned to intervene in this proceeding.
265On April 28, 2014, NICA filed a Motion for Summary Final
276Order, stating that, at t he time of DesmondÓs birth, Dr. Szurkus
288was not a "participating physician" as that term is defined by
299section 766.302(7), Florida Statutes (2012). Neither Petitioner
306nor Intervenor ha s filed a response to the Motion for Summary
318Final Order.
320FINDINGS OF F ACT
3241. The Petition named Dr. Szurkus as the physician
333providing obstetric services at DesmondÓs birth on February 14,
3422009.
3432. Attached to the Motion for Summary Final Order is an
354affidavit of NICA's custodian of records, Tim Daughtry, attesting
363to the following, which has not been refuted:
371One of my official duties as Custodian of
379Records is to maintain NICAÓs official
385records relative to the status of physicians
392as participating physicians in the Florida
398Birth - Related Neurological Compensation Plan
404wh o have timely paid the Five Thousand Dollar
413($5,000.00) assessment prescribed in Section
419766.314(4)(c), Florida Statutes, and the
424status of physicians who may be exempt from
432payment of the Five Thousand Dollar
438($5,000.00) assessment pursuant to Section
444766 .314(4)(c), Florida Statutes. Further, I
450maintain NICA's official records with respect
456to the payment of the Two Hundred Fifty
464Dollar ($250.00) assessment required by
469Section 766.314(4)(b)1., Florida Statutes, by
474all non - participating, non - exempt physicia ns.
483* * *
486As payments of the requisite assessments are
493received, NICA compiles data in the ÐNICA
500CARESÑ database for each physician. The
506ÐNICA CARES physician payment history/reportÑ
511attached hereto for Dr. Dennis Szurkus
517indicates that on Febru ary 14, 2009, the date
526in which Dr. Szurkus participated in the
533delivery of Desmond Govan, as indicated in
540the PetitionerÓs Petition for Benefits,
545Dr. Szurkus did not pay the Five Thousand
553Dollar ($5,000) assessment required for
559participation in the Florid a Birth - Related
567Neurological Injury Compensation Plan until
572September 21, 2009.
575Further, it is NICAÓs policy that if a
583physician falls within the exemption from
589payment of the Five Thousand Dollar ($5,000)
597assessment due to their status as a resident
605phys ician, assistant resident physician or
611intern as provided in Section 766.314(4)(c),
617Florida Statutes, annual documentation as to
623such exempt status is required to be provided
631to NICA. NICA has no records with respect to
640Dr. Szurkus in relation to an exemp t status
649for the year 2009.
6533. The physician payment history/report for Dr. Szurkus
661supports Mr. DaughtryÓs affidavit.
6654. Petitioner ha s not offered any exhibits, affidavits or
675any other evidence refuting the affidavit of Mr. Daughtry, which
685shows that on February 14, 2009, Dr. Szurkus had not paid his
697$5,000 assessment for 2009.
7025. At the time of the birth of Desmond, Dr. Szurkus was not
715a participating physician in the Plan.
721CONCLUSIONS OF LAW
7246. The Division of Administrative Hearings has jurisdic tion
733over the parties to, and the subject matter of, these
743proceedings. §§ 766.301 - 766.316, Fla. Stat.
7507. The Plan was established by the Legislature "for the
760purpose of providing compensation, irrespective of fault, for
768birth - related neurological injury claims" relating to births
777occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
7888. The injured infant, her or his personal representative,
797parents, dependents, and next of kin may seek compensation under
807the Plan by filing a claim for compen sation with the Division of
820Administrative Hearings. §§ 766.302(3), 766.303(2), and
826766.305(1), Fla. Stat. The Florida Birth - Related Neurological
835Injury Compensation Association, which administers the Plan, has
"84345 days from the date of service of a comp lete claim . . . in
859which to file a response to the petition and to submit relevant
871written information relating to the issue of whether the injury
881is a birth - related neurological injury." § 766.305(4), Fla.
891Stat.
8929. If NICA determines that the injury al leged in a claim is
905a compensable birth - related neurological injury, it may award
915compensation to the claimant, provided that the award is approved
925by the administrative law judge to whom the claim has been
936assigned. § 766.305(7), Fla. Stat. If, on the o ther hand, NICA
948disputes the claim, as it has in the instant case, the dispute
960must be resolved by the assigned administrative law judge in
970accordance with the provisions of chapter 120, Florida Statutes.
979§§ 766.304, 766.309, and 766.31, Fla. Stat.
98610. In discharging this responsibility, the administrative
993law judge must make the following determination based upon the
1003available evidence:
1005(a) Whether the injury claimed is a birth -
1014related neurological injury. If the claimant
1020has demonstrated, to the sat isfaction of the
1028administrative law judge, that the infant has
1035sustained a brain or spinal cord injury
1042caused by oxygen deprivation or mechanical
1048injury and that the infant was thereby
1055rendered permanently and substantially
1059mentally and physically impaired , a
1064rebuttable presumption shall arise that the
1070injury is a birth - related neurological injury
1078as defined in s. 766.303(2).
1083(b) Whether obstetrical services were
1088delivered by a participating physician in the
1095course of labor, delivery, or resuscitation
1101in the immediate postdelivery period in a
1108hospital; or by a certified nurse midwife in
1116a teaching hospital supervised by a
1122participating physician in the course of
1128labor, delivery, or resuscitation in the
1134immediate postdelivery period in a hospital.
1140§ 766. 309(1), Fla. Stat. An award may be sustained only if the
1153administrative law judge concludes that the "infant has sustained
1162a birth - related neurological injury and that obstetrical services
1172were delivered by a participating physician at birth."
1180§ 766.31(1 ), Fla. Stat.
118511. Pertinent to this case, "participating physician" is
1193defined by section 766.302(7), to mean:
1199[A] physician licensed in Florida to practice
1206medicine who practices obstetrics or performs
1212obstetrical services either full - time or
1219part - time and who had paid or was exempt from
1230payment at the time of the injury the
1238assessment required for participation in the
1244birth - related neurological injury
1249compensation plan for the year in which the
1257injury occurred.
125912. Dr. Szurkus had not paid his assessm ent of $5,000 at
1272the time Desmond was born; therefore, he was not a participating
1283physician at the time of DesmondÓs birth. No evidence was
1293submitted that, at the time of DesmondÓs birth, Dr. Szurkus was
1304excluded from paying the $5,000 assessment required for
1313participating physicians.
131513. The obstetrical services provided during DesmondÓs
1322birth were not provided by a participating physician. Thus, the
1332claim of Desmond is not compensable under the Plan.
1341CONCLUSION
1342Based on the Findings of Fact and Conclu sions of Law, it is
1355ORDERED that Respondent's Motion for Summary Final Order is
1364granted, and the Petition is dismissed with prejudice.
