83STATEMENT OF THE CASE

87On February 21, 2014, Petitioners, Linda and Russell Kerns,

96on behalf of and as parents and natural guardians of Christian

107Kerns (Christian ), a minor, filed a Petition for Benefits

117Pursuant to Florida Statute Section 766.301 et seq. (Petition)

126with the Division of Administrative Hearings (DOAH) for a

135determination of compensability under the Florida Birth - Related

144Neurological Injury Compensat ion Plan (Plan). The Petition named

153Wanda Torres, M.D., as the physician providing obstetrical

161services at the birth of Christian on February 24, 2009, at Mease

173Countryside Hospital located in Safety Harbor, Florida.

180DOAH served NICA with a copy of the Pe tition on February 26,

1932014. DOAH served Mease Countryside Hospital with a copy of the

204Petition on March 13, 2014. DOAH served Wanda Torres - Oyola,

215M.D., with a copy of the Petition on February 27, 2014.

226On March 27, 2014, Mease Countryside Hospital fil ed a

236Petition to Intervene which was granted by Order dated April 9,

2472014. As of the date of this Summary Final Order of Dismissal,

259no petition to intervene has been filed by Dr. Torres - Oyola.

271On May 5, 2015, NICA filed a Motion for Summary Final Orde r,

284asserting that Christian did not sustain a "birth - related

294neurological injury" as that term is defined in section

303766.302(2), Florida Statutes.

306FINDINGS OF FACT

3091. Christian was born on February 24, 2009, at Mease

319Countryside located in Safety Harbo r , Florida. Christian, who

328was born a twin, weighed in excess of 2,000 grams at birth.

3412. Donald Willis, M.D. (Dr. Willis), was requested by NICA

351to review the medical records for Christian. In a medical report

362dated August 7, 2014, Dr. Willis opined as follows:

371Christine [ sic ] was delivered by Cesarean

379section for twins. Christine was designated

385as fetus A in the hospital records. Birth

393weight was 2,395 grams. Apgar scores were

4019/9. The baby had mild respiratory distress

408and required nasal oxygen fo r < 24="" hours="">

414then weaned to room air. NICU admission exam

422noted the baby to be alert and active with

431normal muscle tone.

434After weaning off oxygen, the baby remained

441stable until about one week of age when fever

450and seizure activity developed. E. coli

456meningitis was diagnosed. The baby

461subsequently developed hydrocephalus as a

466result of the meningitis. The child was

473subsequently diagnosed with cerebral palsy

478and developmental delay.

481Based on limited medical records, there does

488not apparent [ sic ] to be any obstetrical

497event that resulted in loss of oxygen or

505mechanical trauma to the babyÓs brain during

512labor, delivery or the immediate post

518delivery period. The baby had mild

524respiratory distress for less than 24 hours.

531The baby was stable until seizur es developed

539at about one week age. Bacterial meningitis

546was diagnosed and resulted in hydrocephalus

552and brain injury.

5553. Dr. Willis reaffirmed his opinion in an affidavit dated

565April 27, 2014.

5684. NICA retained Michael S. Duchowny, M.D. (Dr. Duchowny),

577a pediatric neurologist, to examine Christian and to review his

587medical records. Dr. Duchowny examined Christian on January 14,

5962015. In an affidavit dated April 29, 2015, regarding his

606independent medical examination of Christian, Dr. Duchowny opined

614a s follows:

617In summary, ChristianÓs evaluation today

622reveals findings consistent with a

627substantial mental and physical impairment.

632Christian has a right hemiparesis with

638greater involvement of the upper extremity,

644absence of meaningful communication skill s,

650repetitive self - stimulatory behavior,

655cortical visual impairment, microcephaly, and

660static hydrocephalus with a functioning left

666ventriculoperitoneal shunt. His

669developmental level is between 9 - 12 months of

678age which is significantly delayed.

683A review of ChristianÓs medical records

689confirms his motherÓs impression of

694meningitis. Christian was diagnosed with

699Citrobacter meningitis in the N ewborn

705N ursery. The records indicate that Christian

712was born at 33 weeks gestation and weighed 5

721pounds 4 ounces a t birth and had Apgar scores

731of 9 & 9 at 1 and 5 minutes. He was

742delivered by non - emergent repeat elective

749cesarean section. Citrobacter meningitis was

754confirmed on cerebrospinal fluid examination

759on March 3, 2009. Gram negative rods were

767noted in the f luid which revealed a protein

776of 248 with 2830 white blood cells. He was

785treated aggressively with antibiotics but

790developed obstructive hydrocephalus

793necessitating his ventriculoperitoneal

796shunting.

797Although Christian has a permanent and

803substantial men tal and motor impairment, the

810etiology would appear to be postnatal -

817acquired Citrobacter meningitis and

821hydrocephalus. The medical records do not

827substantiate that ChristianÓs neurologic

831impairment resulted from either oxygen

836deprivation or mechanical inj ury in the

843course of labor or delivery. For this

850reason, I am not recommending Christian for

857inclusion within the NICA program.

8625. A review of the file in this case reveals that there

874have been no expert opinions filed that are contrary to the

885opinion of Dr. Willis that there was no apparent obstetrical

895event that resulted in loss of oxygen or mechanical trauma to the

907baby's brain during labor, delivery, or the immediate post -

917delivery period. Dr. WillisÓ opinion is credited. There are no

927expert opini ons filed that are contrary to Dr. DuchownyÓs opinion

938that although ChristianÓs examination reveals findings consistent

945with a substantial mental and motor impairment, his neurological

954problems did not result from either oxygen deprivation or

963mechanical in jury acquired in the course of labor or delivery.

974Dr. DuchownyÓs opinion is credited.

979CONCLUSIONS OF LAW

9826. The Division of Administrative Hearings has jurisdiction

990over the parties to and the subject matter of these proceedings.

1001§§ 766.301 - 766.316, Fl a. Stat.

10087. The Plan was established by the Legislature "for the

1018purpose of providing compensation, irrespective of fault, for

1026birth - related neurological injury claims" relating to births

1035occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10468 . The injured infant, her or his personal representative,

1056parents, dependents, and next of kin may seek compensation under

1066the Plan by filing a claim for compensation with DOAH.

1076§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1084which ad ministers the Plan, has "45 days from the date of service

1097of a complete claim . . . in which to file a response to the

1112petition and to submit relevant written information relating to

1121the issue of whether the injury is a birth - related neurological

1133injury." § 766.305(4), Fla. Stat.

11389. If NICA determines that the injury alleged in a claim is

1150a compensable birth - related neurological injury, it may award

1160compensation to the claimant, provided that the award is approved

1170by the administrative law judge to whom the claim has been

1181assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1192disputes the claim, as it has in the instant case, the dispute

1204must be resolved by the assigned administrative law judge in

1214accordance with the provisions of chapter 120, F lorida Statutes.

1224§§ 766.304, 766.309, and 766.31, Fla. Stat.

123110. In discharging this responsibility, the administrative

1238law judge must make the following determination based upon the

1248available evidence:

1250(a) Whether the injury claimed is a birth -

1259related neurological injury. If the claimant

1265has demonstrated, to the satisfaction of the

1272administrative law judge, that the infant has

1279sustained a brain or spinal cord injury

1286caused by oxygen deprivation or mechanical

1292injury and that the infant was thereby

1299rend ered permanently and substantially

1304mentally and physically impaired, a

1309rebuttable presumption shall arise that the

1315injury is a birth - related neurological injury

1323as defined in s. 766.303(2).

1328(b) Whether obstetrical services were

1333delivered by a participat ing physician in the

1341course of labor, delivery, or resuscitation

1347in the immediate postdelivery period in a

1354hospital; or by a certified nurse midwife in

1362a teaching hospital supervised by a

1368participating physician in the course of

1374labor, delivery, or resusci tation in the

1381immediate postdelivery period in a hospital.

1387§ 766.309(1), Fla. Stat. An award may be sustained only if the

1399administrative law judge concludes that the "infant has sustained

1408a birth - related neurological injury and that obstetrical services

1418were delivered by a participating physician at birth."

1426§ 766.31(1), Fla. Stat.

143011. The term "birth - related neurological injury" is defined

1440in section 766.302(2) as follows:

"1445Birth - related neurological injury" means

1451injury to the brain or spinal cord o f a live

1462infant weighing at least 2,500 grams for a

1471single gestation or, in the case of a

1479multiple gestation, a live infant weighing at

1486least 2,000 grams at birth caused by oxygen

1495deprivation or mechanical injury occurring in

1501the course of labor, delivery, or

1507resuscitation in the immediate postdelivery

1512period in a hospital, which renders the

1519infant permanently and substantially mentally

1524and physically impaired.

152712. The evidence, which is not refuted, established that

1536Christian did not sustain an injury t o the brain or spinal cord

1549caused by oxygen deprivation or mechanical injury in the course

1559of labor, delivery, or resuscitation in the immediate post -

1569delivery period in a hospital. Therefore, Christian is not

1578eligible for benefits under the Plan.

1584CONCLUSI ON

1586Based upon the foregoing Findings of Fact and Conclusions of

1596Law, it is ORDERED that:

16011. The Petition filed by Linda and Russell Kerns, on behalf

1612of Christian Kerns, is dismissed with prejudice.

16192. The final hearing scheduled for June 16, 2015, is

1629ca ncelled.
