90STATEMENT OF THE CASE

94On March 3 , 201 4 , Petitioner, Erica Jackson , on behalf of

105and as parent and natural guar dian of ShÓmyia Mc Bean ( ShÓmyia ), a

120minor, filed a Petition for Benefits Pursuant to Florida Statute

130Section 766.301 et seq. (Petition) with the Division of

139Administrative Hearings (DOAH) for a determination of

146compensability under the Florida Birth - Relate d Neurological

155Injury Compensation Plan (Plan). The Petition named Thomas G.

164Stavoy , M.D., as the physician providing obstetrical services at

173the birth of ShÓmyia on February 1 1 , 201 1 , at Halifax Medical

186Center located in Daytona Beach , Florida.

192DOAH serv ed NICA with a copy of the Petition on March 6 ,

205201 4 . DOAH served a copy of the Petition on Halifax Hospital

218Center , d/b/a Halifax Medical Center on March 7, 2014. On

228March 1 0 , 201 4 , DOAH received a return receipt from the United

241States Postal Service sh owing that Dr. Stavoy had been served

252with a copy of the Petition.

258On March 21, 201 4 , Thomas Stavoy, M.D. , filed a Motion to

270Intervene , and on March 24, 2014, Halifax Hospital Medical

279Center, d/b/a Halifax Medical Center filed a Motion to Intervene,

289whic h w ere granted by Order dated April 3 , 2014.

300On August 20 , 2014, NICA filed a Motion for Summary Final

311Order, asserting that ShÓmyia did not sustain a "birth - related

322neurological injury" as that term is defined in section

331766.302(2), Florida Statutes. Th e motion was served by

340electronic mail on August 20 , 2014. Respondent represented in

349its motion that Petitioner and Intervenor s had no objection to

360the granting of the motion.

365FINDINGS OF FACT

3681. ShÓmyia Mc Bean was born on February 1 1 201 1 , at Hali fax

383Medical Center located in Daytona Beach , Florida. ShÓmyia

391weighed 3, 288 grams at birth.

3972. Donald Willis, M.D. (Dr. Willis), was requested by NICA

407to review the medical records for ShÓmyia , to determine whether

417an injury occurred in the course of lab or, delivery, or

428resuscitation in the immediate post - delivery period in the

438hospital due to oxygen deprivation or mechanical injury occurring

447in the course of labor, delivery, or resuscitation in the

457immediate post - delivery period. Dr. Willis described hi s

467findings as follows in his medical report :

475In summary , there was no significant fetal

482distress during labor. However, delivery was

488complicated by several failed attempts for

494vaginal delivery by vacuum and some delay in

502starting the Cesarean delivery due to

508problems with inadequate levels with a labor

515epidural. The baby was severely depressed at

522birth due to the difficult delivery. Full

529resuscitation was required. Cord blood gas

535was consistent with acidosis (pH 6.78).

541Seizure activity developed within 24 hours of

548birth and MRI on the day of birth confirmed

557cerebral ischemia.

559There was an apparent obstetrical event that

566resulted in loss of oxygen to the babyÓs

574brain during delivery and continuing into the

581immediate postdelivery period. The o xygen

587depr ivation resulted in brain injury. I am

595unable to comment about the severity of the

603brain injury .

6063. NICA retained Michael S . Duchowny , M.D., a pediatric

616ne u rologist, to examine ShÓmyia and to review h er medical

628records. Dr. Duchowny examined ShÓmyia o n July 16 , 2014, and

639opined as follows in his medical report :

647In SUMMARY, Sh ÓmyiaÓs neurological

652examination is significant for a left lower

659extremity monoparesis. In contrast, her

664other three limbs are well preserved and her

672overall mental functioning is clearly at or

679above age level.

682A review of Sh'myia's medical records

688confirms the family's impression that she had

695difficulties at birth. Of note, her mother

702was febrile to 101 degrees at time of

710delivery and Sh'myia was delivered by urgent

717cesarean s ection after four failed attempts

724at vaginal delivery with vacuum assistance.

730Sh'myia was born cyanotic, floppy, and apneic

737and required intubation in the delivery room.

744However, she was weaned from mechanical

750ventilation at 12 hours of age. Seizures

757we re noted at 20 hours of age. Her Apgar

767scores were 0, 0, 3, and 4 at 1, 5, 10, and

77920 minutes respectively. The cord pH was

7866.78. Her white blood cell count showed a

794left shift and she was treated aggressively

801with antibiotics for 4 days until blood

808cul tures came back normal. Hypocalcemia with

815a value of 6.7 was also treated immediately.

823Sh'myia weighed 7 pounds 4 ounces at birth

831and was 41 weeks gestation. An MRI scan the

840next day revealed edema consistent with

846diffuse changes and an EEG performed on

853February 15 revealed high voltage discharges

859but no evidence of birth suppression pattern.

866Although Sh'myia did have birth - related

873difficulties, she has done remarkedly well

879and she does not presently show a significant

887mental impairment. Her motor imp airment in

894the left lower extremity is significant but

901she is undergoing therapy and I suspect that

909she will ultimately regain a more normal

916range of motion through either her present

923therapies or possibly future surgery to

929lengthen her Achilles tendon.

933I n view of Sh'myia's good overall current

941neurologic status, I am not recommending her

948for compensation within the NICA program.

9544 . A review of the file in this case reveals that there

967have been no expert opinions filed t hat are contrary to the

979opinion of Dr. Willis that there was an obstetrical event that

990resulted in loss of oxygen to the brain. Dr. WillisÓ opinion is

1002credited. There are no contrary expert opinions filed that are

1012contrary to Dr. Duchowny Ós opinion that ShÓmyia does not

1022presently show a significant mental impairment or that any

1031physical impairment is permanent . Dr. Duchowny Ós opinion is

1041credited.

1042CONCLUSIONS OF LAW

10455 . The Division of Administrative Hearings has jurisdiction

1054over the parties to and the subject matter of these proceeding s.

1066§§ 766.301 - 766.316, Fla. Stat.

10726 . The Plan was established by the Legislature "for the

1083purpose of providing compensation, irrespective of fault, for

1091birth - related neurological injury claims" relating to births

1100occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

11117 . The injured infant, her or his personal representative,

1121parents, dependents, and next of kin may seek compensation under

1131the Plan by filing a claim for compensation with DOAH.

1141§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1149which administers the Plan, has "45 days from the date of service

1161of a complete claim . . . in which to file a response to the

1176petition and to submit relevant written information relating to

1185the issue of whether the injury is a birth - rela ted neurological

1198injury." § 766.305(4), Fla. Stat.

12038 . If NICA determines that the injury alleged in a claim is

1216a compensable birth - related neurological injury, it may award

1226compensation to the claimant, provided that the award is approved

1236by the adminis trative law judge to whom the claim has been

1248assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1259disputes the claim, as it has in the instant case, the dispute

1271must be resolved by the assigned administrative law judge in

1281accordance with the pr ovisions of chapter 120, Florida Statutes.

1291§§ 766.304, 766.309, and 766.31, Fla. Stat.

12989 . In discharging this responsibility, the a dministrative

1307l aw j udge must make the following determination based upon the

1319available evidence:

1321(a) Whether the injury c laimed is a birth -

1331related neurological injury. If the claimant

1337has demonstrated, to the satisfaction of the

1344administrative law judge, that the infant has

1351sustained a brain or spinal cord injury

1358caused by oxygen deprivation or mechanical

1364injury and that th e infant was thereby

1372rendered permanently and substantially

1376mentally and physically impaired, a

1381rebuttable presumption shall arise that the

1387injury is a birth - related neurological injury

1395as defined in s. 766.303(2).

1400(b) Whether obstetrical services were

1405delivered by a participating physician in the

1412course of labor, delivery, or resuscitation

1418in the immediate postdelivery period in a

1425hospital; or by a certified nurse midwife in

1433a teaching hospital supervised by a

1439participating physician in the course of

1445la bor, delivery, or resuscitation in the

1452immediate postdelivery period in a hospital.

1458§ 766.309(1), Fla. Stat. An award may be sustained only if the

1470administrative law judge concludes that the "infant has sustained

1479a birth - related neurological injury and that obstetrical services

1489were delivered by a participating physician at birth."

1497§ 766.31(1), Fla. Stat.

15011 0 . The term "birth - related neurological injury" is defined

1513in section 766.302(2) as follows:

"1518Birth - related neurological injury" means

1524injury to t he brain or spinal cord of a live

1535infant weighing at least 2,500 grams for a

1544single gestation or, in the case of a

1552multiple gestation, a live infant weighing at

1559least 2,000 grams at birth caused by oxygen

1568deprivation or mechanical injury occurring in

1574the c ourse of labor, delivery, or

1581resuscitation in the immediate postdelivery

1586period in a hospital, which renders the

1593infant permanently and substantially mentally

1598and physically impaired.

160111 . The evidence, which is not refuted, established that

1611most likely ShÓmyia did sustain an injury to the brain caused by

1623oxygen deprivation occurring in the course of delivery. The

1632evidence does not establish that the brain injury resulted in

1642permanent and substantial mental and physical impairments.

1649Therefore, ShÓmyia i s not eligible for benefits under the Plan.

1660CONCLUSION

1661Based upon the foregoing Findings of Fact and Conclusions of

1671Law, it is ORDERED that the Petition filed by Erica Jackson , on

1683behalf of and as parent and natural guardian of ShÓmyia Mc Bean ,

1695is dismisse d with prejudice.
