111STATEMENT OF THE ISSUE
115The issue in th is case is whether the Application to
126Participate in Educational Scholarship Programs submitted by the
134Petitioner, Hodge Pavilion Stem Academy (6402), should be
142appro ved.
144PRELIMINARY STATEMENT
146On October 30, 2013, the Petitioner, through its
154administrator Arthur Jenkins, filed an Application to Participate
162in Educational Scholarship Programs for the 2013 - 14 school year.
173By letter dated January 8, 2014, Commission er of Education Pam
184Stewart (Respondent) notified Mr. Jenkins that the application
192was denied.
194The Petitioner challenged the decision through a Petition
202for Administrative Hearing filed with the Respondent. On
210March 5, 2014, the Respondent forwarded the Peti tion to the
221Division of Administrative Hearings. The hearing was initially
229scheduled to commence on April 3, 2014, and, based on the
240unopposed motion of the Respondent, was rescheduled for May 13,
2502014.
251At the hearing, the Petitioner presented the testi mony of
261four witnesses and had Exhibits 1 through 10 admitted into
271evidence. The Respondent presented the testimony of five
279witnesses and had Exhibits 1 through 13 admitted into evidence.
289A T ranscript of the hearing was filed on May 20, 2014. Both
302part ies filed pro posed r ecommended o rder s that ha ve been reviewed
317in the preparation of this Recommended O rder.
325FINDING S OF FACT
3291. The John M. McKay Scholarships for Students with
338Disabilities Program (McKay) and the Florida Tax Credit
346Scholarship Program (FT C) provide state funds to pay private
356school tuition to qualified students.
3612. Private schools must apply to, and obtain approval from,
371the Respondent to participate in the scholarship programs.
379Approval of an application authorizes the private school to
388receive the scholarship funds. Individual scholarship checks are
396made payable to the parent of each qualified student and the name
408of the studentÓs private school. The parent endorses the check
418and provides it to the school.
4243. In the spring of 201 3, Mr. Jenkins and an associate,
436Ayesha Hackman, founded a private school identified as the
445ÐHarmon - Hodge STEM School.Ñ
4504. The Harmon - Hodge STEM School submitted an application to
461participate in the McKay and FTC programs. The Respondent
470approved the a pplication.
4745. Not long after the Harmon - Hodge STEM School was founded,
486Mr. Jenkins and Ms. Hackman began to disagree about the direction
497of the school. When Ms. Hackman sought to obtain control over
508the school, Mr. Jenkins announced to her that he was severing his
520ties with the school. At Ms. HackmanÓs request, Mr. Jenkins
530agreed to continue his employment with the school.
5386. During the summer of 2013, Mr. Jenkins and an associate,
549Tami Robinson, began to organize another private school, the
558Petiti oner in this proceeding.
5637. By August of 2013, Ms. Hackman consolidated her control
573of the Harmon - Hodge STEM School. She amended the corporate
584documents to designate herself as the chief executive officer , to
594identify Mr. Jenkins as the school principa l, and to delete the
606hyphen from the school name (now identified as the ÐHarmon Hodge
617STEM School.Ñ)
6198. Students began attending the Harmon Hodge STEM School in
629August of 2013.
6329. One month later, the school started accepting
640scholarship checks payab le to the ÐHarmon - Hodge STEM School.Ñ
65110. Mr. Jenkins came into possession of an FTC scholarship
661check for $1,183.40 , made payable to the parent of an enrolled
673student and to the Harmon - Hodge STEM School.
68211. In early October of 2013, Mr. Jenkins opene d an account
694at a Wells Fargo bank in the name of Harmon Hodge STEM School and
708deposited the check into the account. Mr. Jenkins designated
717only himself as the authorized signatory on the account and did
728not advise Ms. Hackman that he had opened the accou nt.
73912. Very shortly after the account was opened, Wells Fargo
749notified Mr. Jenkins that the account was being closed.
75813. At the hearing, Mr. Jenkins testified that the account
768closure was related to a previous incident of identity theft
778involving his personal bank account.
78314. Wells Fargo returned the deposited funds to Mr. Jenkins
793in the form of cash.
79815. At the hearing, Mr. Jenkins testified that he used some
809of the cash to pay Harmon Hodge STEM School vendors who , he said,
822had not been paid by the school. No documentation was offered to
834support the testimony. Mr. Jenkins testified that the vendors
843did not present bills for services , and no receipts for payment
854were obtained from the vendors. Mr. Jenkins Ó testimony is not
865credible.
86616. Mr. J enkins testified that he retained the remainder of
877the cash because he believed it was owed to him. There was no
890credible evidence that the Harmon Hodge STEM School owed
899Mr. Jenkins any funds or that he was entitled or authorized to
911retain any state schol arship funds for his personal use.
92117. After the Wells Fargo account was closed, Mr. Jenkins
931came into possession of two FTC scholarship checks totaling
940$2,400 that were payable to the parents of enrolled students and
952to the Harmon - Hodge STEM School.
9591 8. Mr. Jenkins then opened a bank account at Bank of
971America in October of 2013, again in the name of Harmon Hodge
983STEM School.
98519. Mr. Jenkins again designated only himself as the
994authorized signatory on the account and did not advise
1003Ms. Hackman of the account.
100820. As was the case with the Wells Fargo account, Bank of
1020America notified Mr. Jenkins shortly after the account was opened
1030that the account was being closed.
103621. Mr. Jenkins testified that this account closure was
1045also related to a previous incident of identity theft involving
1055his personal bank account.
105922. Bank of America returned the deposited funds to
1068Mr. Jenkins in the form of a bank check made payable to Harmon
1081Hodge STEM School.
108423. Using the Bank of America bank check, Mr. Jenkins
1094opened a third account, still in October of 2013, in the name of
1107Harmon Hodge STEM School, this time at Chase Bank.
111624. Mr. Jenkins again designated only himself as the
1125authorized signatory on the account and did not advise
1134Ms. Hackman of the account.
113925. Mr. Jenkins used a debit card issued on the Chase
1150account to withdraw cash from the account and to spend the funds
1162in the account.
116526. Mr. Jenkins again testified that he used some of the
1176cash withdrawn from the Chase account to pay Harmon Hodge STE M
1188School vendors. No documentation was offered to support the
1197testimony. Mr. Jenkins Ó testimony is not credible.
120527. Mr. Jenkins testified that he retained the remaining
1214Chase deposit because he believed it was owed to him. There was
1226no credible evide nce that the Harmon Hodge STEM School owed
1237Mr. Jenkins any funds or that he was entitled or authorized to
1249retain any state scholarship funds for his personal use.
125828. Towards the end of October, Ms. Hackman became aware of
1269the unauthorized banking activi ty and filed a report with local
1280law enforcement. Criminal charges were filed against Mr. Jenkins
1289related to some of the banking activities referenced herein. The
1299charges were pending at the time of the hearing.
130829. On October 30, 2013, Mr. Jenkins sub mitted an
1318application on behalf of the Petitioner seeking approval to
1327participate in the McKay and FTC scholarship programs.
133530. By letter dated January 8, 2014, the Respondent, aware
1345of the banking activities referenced herein, notified Mr. Jenkins
1354that the application was denied.
1359CONCLUSIONS OF LAW
136231. The Division of Administrative Hearings has
1369jurisdiction over the parties and subject matter of this
1378proceeding. §§ 120.56 and 120.57, Fla. Stat. (2013). 1/
138732. The Petitioner has the burden of establis hing by a
1398preponderance of the evidence that it is entitled to approval of
1409the application. Fl a. D ep Ó t of Transp . v. J.W.C. Co . , Inc. ,
1425396 So. 2d 778 (Fla. 1st DCA 1981) ; Balino v. Dep Ó t of HRS ,
1440348 So. 2d 349 (Fla. 1st DCA 1977). The evidence fails to
1452e stablish that the Application to Participate in Educational
1461Scholarship Programs, filed by Mr. Jenkins on behalf of the
1471Petitioner, should be approved.
147533. Section 1002.39 , Florida Statutes, establishes the
1482McKay P rogram . Section 1002.39(7) provides tha t the C ommissioner
1494of E ducation may deny a private schoolÓs participation in the
1505McKay program if the C ommissioner determines that the owner or
1516operator of the school has operated an educational institution
1525Ðin a manner contrary to the health, safety, or w elfare of the
1538public.Ñ
153934. Section 1002.395 establishes the FTC P rogram. Section
15481002.395(11) provides that the C ommissioner of E ducation may deny
1559a private schoolÓs participation in the FTC program if the
1569C ommissioner determines that the school has fai led to comply with
1581the requirements set forth therein. Section 1002.395(11)(a)2.
1588provides that the C ommissioner may deny participation if the
1598owner or operator of the school has operated an educational
1608institution Ðin a manner contrary to the health, safe ty, or
1619welfare of the public.Ñ
162335. The evidence establishes that without authorization by
1631the Harmon Hodge STEM School or by any person acting in an
1643official capacity with the school, Mr. Jenkins opened bank
1652accounts in the name of the school. He obtain ed scholarship
1663checks of students enrolled in the Harmon Hodge STEM School and
1674deposited them into the accounts he had opened. The evidence
1684fails to establish that Mr. Jenkins was authorized to deposit the
1695scholarship funds into the accounts he created or entitled to use
1706the funds for any purpose.
171136. The banking activities referenced herein were contrary
1719to the welfare of the public and are sufficient to warrant denial
1731of the application filed by Mr. Jenkins on behalf of the
1742Petitioner to participate in the McKay and FTC scholarship
1751programs.
1752RECOMMENDATION
1753Based on the foregoing Findings of Fact and Conclusions of
1763Law, it is RECOMMENDED that the Commissioner of Education enter a
1774final order denying the Petitioner's Application to Participate
1782in Educat ional Scholarship Programs.
