88On April 22 , 201 4 , Petitioners, La kysha Engram and

130766.301 et seq. (Petition) with the Division of Administrative

156(Plan ).

158The Petition named Joan McCarthy , M.D., as the physician

167providing obstetric services at the birth of Marco at Tampa

177General Hospital in Tampa , Florida.

182DOAH served NICA with a copy of the Petition on May 1 , 201 4 .

197DOAH served Dr. McCarthy with a copy of the Petition on April 30,

210201 4 . DOAH served a copy of the Petition on Tampa General

223Hospital on April 3 0 , 201 4 .

231On October 13 , 201 4 , NICA filed a Motion for Summary Final

243Order, asserting that Marco did not sustain a "birth - related

254neurological inju ry" as that term is defined in section

264766.302(2), Florida Statutes. NICA represented in the motion

272that Petitioners ha ve no objection to the granting of the motion.

284FINDINGS OF FACT

2871. Marco DeÓAndre Bryant was born on May 2 2 , 200 7 , at Tampa

301General H ospital in Tampa , Florida. Marco weighed 3 , 250 grams at

313birth.

3142. Donald Willis, M.D. (Dr. Willis), was requested by NICA

324to review the medical records for Marco . In a medical report

336dated May 12 , 201 4 , Dr. Willis opined:

344S ummary : T he baby was healthy at birth and

355had a normal newborn hospital course.

361Unfortunately, the child developed viral

366(HSV) encephalitis at 17 - days of age, which

375resulted in brain injury. The HSV or viral

383encephalitis was not present during labor,

389delivery or the immediate post - de livery

397period. Brain injury did not occur until the

405HSV infection at 17 - days of age.

413There was no apparent obstetrical event that

420resulted in loss of oxygen or mechanical

427trauma to the babyÓs brain during labor,

434delivery or the immediate post delivery

440pe riod. The childÓs brain injury resulted

447from viral encephalitis that occurred over

453two weeks after birth.

457Thank you for allowing me to review this

4753. A review of the file does not show any co ntrary

487opinions, and Petitioners have no objection to the issuance of a

498summary final order finding that the injury is not compensable

508under the Plan. The opinion of Dr. Willis that Marco did not

520suffer a neurological injury due to oxygen deprivation or

529m echanical injury during labor, delivery, or the immediate post -

540delivery period is credited.

544CONCLUSIONS OF LAW

5474. The Division of Administrative Hearings has jurisdiction

555over the parties to and the subject matter of these proceedings.

566§§ 766.301 - 766.316 , Fla. Stat.

5725. The Plan was established by the Legislature "for the

582purpose of providing compensation, irrespective of fault, for

590birth - related neurological injury claims" relating to births

599occurring on or after January 1, 1989. § 766.303(1), Fla. Sta t.

6116. The injured infant, her or his personal representative,

620parents, dependents, and next of kin may seek compensation under

630the Plan by filing a claim for compensation with DOAH.

640§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA, whic h

650administers the Plan, has "45 days from the date of service of a

663complete claim . . . in which to file a response to the petition

677and to submit relevant written information relating to the issue

687of whether the injury is a birth - related neurological injur y."

699§ 766.305(4), Fla. Stat.

7037. If NICA determines that the injury alleged in a claim is

715a compensable birth - related neurological injury, it may award

725compensation to the claimant, provided that the award is approved

735by the administrative law judge to w hom the claim has been

747assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

758disputes the claim, as it has in the instant case, the dispute

770must be resolved by the assigned administrative law judge in

780accordance with the provisions of chapter 12 0, Florida Statutes.

790§§ 766.304, 766.309, and 766.31, Fla. Stat.

7978. In discharging this responsibility, the administrative

804law judge must make the following determination based upon the

814available evidence:

816(a) Whether the injury claimed is a birth -

825rela ted neurological injury. If the claimant

832has demonstrated, to the satisfaction of the

839administrative law judge, that the infant has

846sustained a brain or spinal cord injury caused

854by oxygen deprivation or mechanical injury and

861that the infant was thereby r endered

868permanently and substantially mentally and

873physically impaired, a rebuttable presumption

878shall arise that the injury is a birth - related

888neurological injury as defined in s.

894766.303(2).

895(b) Whether obstetrical services were

900delivered by a partici pating physician in the

908course of labor, delivery, or resuscitation in

915the immediate postdelivery period in a

921hospital; or by a certified nurse midwife in a

930teaching hospital supervised by a

935participating physician in the course of

941labor, delivery, or resu scitation in the

948immediate postdelivery period in a hospital.

954§ 766.309(1), Fla. Stat. An award may be sustained only if the

966administrative law judge concludes that the "infant has sustained

975a birth - related neurological injury and that obstetrical servi ces

986were delivered by a participating physician at birth."

994§ 766.31(1), Fla. Stat.

9989. The term "birth - related neurological injury" is defined

1008in section 766.302(2) as follows:

"1013Birth - related neurological injury" means

1019injury to the brain or spinal cord of a live

1029infant weighing at least 2,500 grams for a

1038single gestation or, in the case of a multiple

1047gestation, a live infant weighing at least

10542,000 grams at birth caused by oxygen

1062deprivation or mechanical injury occurring in

1068the course of labor, deliver y, or

1075resuscitation in the immediate postdelivery

1080period in a hospital, which renders the infant

1088permanently and substantially mentally and

1093physically impaired.

109510. The evidence, which is not refuted, established that

1104Marco did not sustain an injury to the brain or spinal cord caused

1117by oxygen deprivation or mechanical injury occurring in the course

1127of labor, delivery, or resuscitation in the immediate post -

1137delivery period in a hospital. Therefore, Marco is not eligible

1147for benefits under the Plan.

1152CONC LUSION

1154Based upon the foregoing Findings of Fact and Conclusions of

1164Law, it is ORDERED that the Petition filed by La kysha Engram and

1177Marco Andre Bryant on behalf of and as parents and natural

1188guardians of Marco DeÓAndre Bryant , is dismissed with prejudice.
