86STATEMENT OF THE CASE

90On March 24, 2014, Petitioners, Lovetre Leach and Damien

99Lawrence, on behalf of and as parents and natural guardians of

110OÓuri Lawrence (OÓuri), a minor, filed a Petition for Benefits

120Pursuant to Florida Statute Section 766.301 et seq. (Petition)

129with the Division of Administrative Hearings (DOAH) for a

138determination of compensability under the Florida Birth - Related

147Neurological I njury Compensation Plan (Plan). The Petition named

156James Palmer, M.D., as the physician providing obstetrical

164services at the birth of OÓuri on February 18, 2012, at Tampa

176General Hospital located in Tampa, Florida.

182DOAH served NICA with a copy of the Pet ition on May 6, 2014.

196On May 9, 2014, DOAH received a return receipt from the United

208States Postal Service showing that Tampa General Hospital had

217been served with a copy of the Petition. On May 14, 2014, DOAH

230received a return receipt from the United St ates Postal Service

241showing that Dr. Palmer had been served with a copy of the

253Petition.

254On June 6, 2014, James Marshall Palmer, M.D. , filed a

264Petition to Intervene which was granted by Order dated June 19,

275201 4 .

278As of the date of this Summary Final Ord er of Dismissal,

290Tampa General Hospital has not petitioned to intervene in this

300proceeding.

301On April 28, 2015, NICA filed a Motion for Summary Final

312Order, asserting that OÓuri did not sustain a "birth - related

323neurological injury" as that term is defined in section

332766.302(2), Florida Statutes. The motion was served by e - mail on

344April 28, 2015. An Order to Show Cause was entered on May 6,

3572015, advising Petitioners and Intervenor to show cause in

366writing why RespondentÓs Motion for Summary Final Order sh ould

376not be granted. On May 15 and May 19, 2015, various medical

388records concerning OÓuri Lawrence were fax - filed with the

398Division of Administrative Hearings.

402FINDINGS OF FACT

4051. OÓuri Lawrence was born on February 18, 2012, at Tampa

416General Hospit al located in Tampa, Florida. OÓuri weighed 4,520

427grams at birth.

4302. Donald Willis, M.D. (Dr. Willis), was requested by NICA

440to review the medical records for OÓuri, to determine whether an

451injury occurred to the brain or spinal cord caused by oxygen

462dep rivation or mechanical injury occurring in the course of

472labor, delivery, or resuscitation in the immediate post - delivery

482period. In a medical report dated November 4, 2014 , Dr. Willis

493described his findings in part as follows:

500Vaginal delivery was compli cated by a

507shoulder dystocia. Birth weight was 4,520

514grams. Despite the shoulder dystocia, the

520baby was not depressed at birth. Apgar

527scores were 8/9. Cord blood gas had a normal

536pH of 7.26 and a normal base of 2.

545Evaluation in the nursery indicated t he baby

553was in no acute distress and was alert.

561Decreased movement of the left arm was noted.

569X - Ray did not identify any bone fractures.

578Other than the ErbÓs palsy, the baby had a

587relatively normal hospital course.

591In summary, delivery was complicated by a

598shoulder dystocia and resulting ErbÓs palsy.

604There was no fetal distress during labor.

611The newborn was not depressed at birth. The

619newborn hospital course did not suggest

625hypoxic ischemic injury.

628Follow - up care after hospital discharge

635primarily co ncerned evaluation and management

641of the ErbÓs palsy.

645There was no apparent obstetrical event that

652resulted in loss of oxygen or mechanical

659trauma to the babyÓs brain or spine during

667labor, delivery or the immediate post

673delivery period.

6753. Dr. Willis reaffirmed his opinion in an affidavit dated

685April 7, 2015.

6884 . NICA retained Michael S. Duchowny, M.D. (Dr. Duchowny) ,

698a pediatric neurologist, to examine OÓuri and to review his

708medical records. Dr. Duchowny examined OÓuri on January 28,

7172015. In an af fidavit dated April 7, 2015, Dr. Duchowny opined

729as follows:

731In summary, OÓuriÓs neurological examination

736today reveals findings consistent with a left

743ErbÓs palsy affecting the C5/C6 musculature.

749He has preserved fine motor coordination of

756his distal extr emity but supination is

763limited at the wrist and he does not

771consistently fully extend the left elbow. In

778contrast, there are no findings on todayÓs

785evaluation that indicate injury to either the

792brain or spinal cord. Mechanical injury was

799therefore susta ined outside the central

805nervous system and for this reason, I am not

814recommending OÓuri for compensation within

819the NICA program.

8225 . Various medical records of OÓuri were fax - filed with

834DOAH following the entry of the Order to Show Cause. However, as

846further addressed in the Conclusions of Law, whether or not these

857documents would be admissible in a formal hearing, they would not

868affect the ultimate conclusion reached in this case.

8766 . A review of the file in this case reveals that there

889have been no expert opinions filed that are contrary to the

900opinion of Dr. Willis that there was no apparent obstetrical

910event that resulted in loss of oxygen or mechanical trauma to the

922baby's brain or spine during labor, delivery or the immediate

932post - delivery perio d. Dr. WillisÓ opinion is credited. There

943are no contrary expert opinions filed that are contrary to

953Dr. DuchownyÓs opinion that there are no findings that indicate

963injury to the brain or spinal cord, and that mechanical injury

974was therefore sustained ou tside the central nervous system.

983Dr. DuchownyÓs opinion is credited.

988CONCLUSIONS OF LAW

9917 . The Division of Administrative Hearings has jurisdiction

1000over the parties to and the subject matter of these proceedings.

1011§§ 766.301 - 766.316, Fla. Stat.

10178 . Th e Plan was established by the Legislature "for the

1029purpose of providing compensation, irrespective of fault, for

1037birth - related neurological injury claims" relating to births

1046occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10579 . The injured i nfant, her or his personal representative,

1068parents, dependents, and next of kin may seek compensation under

1078the Plan by filing a claim for compensation with DOAH.

1088§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1096which administers the Pl an, has "45 days from the date of service

1109of a complete claim . . . in which to file a response to the

1124petition and to submit relevant written information relating to

1133the issue of whether the injury is a birth - related neurological

1145injury." § 766.305(4), F la. Stat.

115110 . If NICA determines that the injury alleged in a claim

1163is a compensable birth - related neurological injury, it may award

1174compensation to the claimant, provided that the award is approved

1184by the administrative law judge to whom the claim has b een

1196assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1207disputes the claim, as it has in the instant case, the dispute

1219must be resolved by the assigned administrative law judge in

1229accordance with the provisions of chapter 120, Florida Statutes .

1239§§ 766.304, 766.309, and 766.31, Fla. Stat.

12461 1 . In discharging this responsibility, the administrative

1255law judge must make the following determination based upon the

1265available evidence:

1267(a) Whether the injury claimed is a birth -

1276related neurological i njury. If the claimant

1283has demonstrated, to the satisfaction of the

1290administrative law judge, that the infant has

1297sustained a brain or spinal cord injury

1304caused by oxygen deprivation or mechanical

1310injury and that the infant was thereby

1317rendered permanentl y and substantially

1322mentally and physically impaired, a

1327rebuttable presumption shall arise that the

1333injury is a birth - related neurological injury

1341as defined in s. 766.303(2).

1346(b) Whether obstetrical services were

1351delivered by a participating physician i n the

1359course of labor, delivery, or resuscitation

1365in the immediate postdelivery period in a

1372hospital; or by a certified nurse midwife in

1380a teaching hospital supervised by a

1386participating physician in the course of

1392labor, delivery, or resuscitation in the

1398i mmediate postdelivery period in a hospital.

1405§ 766.309(1), Fla. Stat. An award may be sustained only if the

1417administrative law judge concludes that the "infant has sustained

1426a birth - related neurological injury and that obstetrical services

1436were delivered by a participating physician at birth."

1444§ 766.31(1), Fla. Stat.

14481 2 . The term "birth - related neurological injury" is defined

1460in section 766.302(2) as follows:

"1465Birth - related neurological injury" means

1471injury to the brain or spinal cord of a live

1481infant weighing at least 2,500 grams for a

1490single gestation or, in the case of a

1498multiple gestation, a live infant weighing at

1505least 2,000 grams at birth caused by oxygen

1514deprivation or mechanical injury occurring in

1520the course of labor, delivery, or

1526resuscitati on in the immediate postdelivery

1532period in a hospital, which renders the

1539infant permanently and substantially mentally

1544and physically impaired.

15471 3 . As referenced above, medical records of OÓuri were fax -

1560filed following the entry of the Order to Show Cau se. However,

1572whether or not these documents would be admissible in a formal

1583hearing, they would not affect the ultimate conclusion reached in

1593this case. That is, section 766.302(2), Florida Statutes,

1601specifically requires that the injury to the brain or spinal cord

1612be Ðcaused by oxygen deprivation or mechanical injury occurring

1621in the course of labor, delivery, or resuscitation in the

1631immediate postdelivery period which renders the infant

1638permanently and substantially mentally and physically impaired.Ñ

1645Th e evidence, which is not refuted by any contrary expert

1656opinions, established that OÓuri did not sustain an injury to the

1667brain or spinal cord caused by oxygen deprivation or mechanical

1677injury in the course of labor and delivery. Therefore, OÓuri is

1688not e ligible for benefits under the Plan. §§ 766.302(2) and

1699766.309(1), Fla. Stat.

1702CONCLUSION

1703Based upon the foregoing Findings of Fact and Conclusions of

1713Law, it is ORDERED that the Petition filed by Lovetre Leach and

1725Damien Lawrence, on behalf of and as p arents and natural

1736guardians of OÓuri L a wrence, is dismissed with prejudice, and the

1748final hearing scheduled for June 2, 2015, is canceled.
