626FINDINGS OF FACT

6291. Amy Nicole Alvarez was born on June 16 , 20 10 , at Jackson

642South Community Hospital in Miami , Florida.

6482. Michael S . Duchowny , M.D. (Dr. Duchown y ), was requested

660by NICA to do an independent medical examination of Amy and to

672review her medical records . Dr. Duchowny examined Amy on July 2,

6842014 . In an affidavit dated September 22, 2014, Dr. Duchowny

695reported his findings and gave the following op inion :

705In summary, AmyÓs neurological examination

710today reveals mild right spastic hemiparesis,

716speech dysarthria and a complex visual

722agnosia. She additionally evidences

726microcephaly. Although I am concerned about

732AmyÓs overall cognitive development due to

738her microcephaly, she appears to be

744progressing satisfactory and is making

749progress with respect to verbal communication

755both in the receptive and expressive domains.

762Her visual impairment is likely to be

769centrally - based.

772I had an opportunity to revie w AmyÓs med i cal

783records. It contained information that is

789consistent with AmyÓs overall history but I

796have not reviewed AmyÓs brain MRI scans.

803However, in view of AmyÓs relatively good

810mental development and only mild degree of

817motor impairment, I would n ot recommend

824inclusion within the NICA program.

829As such, it is my opinion that AMY NICOLE

838ALVAREZ is not permanently and substantially

844mentally impaired nor is she permanently and

851substantially physically impaired due to

856oxygen deprivation or mechanical injury

861occurring during the course of labor,

867delivery or the immediate post - delivery

874period in the hospital during the birth of

882AMY NICOLE ALVAREZ. ( E mphasis in original . )

8923. A review of the file does not show any contrary opinio n ,

905nor was any potential contrary expert disclosed during the

914telephone hearing on the Motions for Summary Final Order . The

925opinion of Dr. Duchowny that Amy does not have a permanent and

937substantial mental o r physical impairment is credited.

945CONCLUSIONS OF LAW

9484. The Division of Administrative Hearings has jurisdiction

956over the parties to and the subject matter of these proceedings.

967§§ 766.301 - 766.316, Fla. Stat.

9735. The Plan was established by the Legislature "for the

983purpose of providing compensation, irrespective of fault , for

991birth - related neurological injury claims" relating to births

1000occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

10116. The injured infant, her or his personal representative,

1020parents, dependents, and next of kin may seek compensation under

1030the Plan by filing a claim for compensation with DOAH.

1040§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1048which administers the Plan, has "45 days from the date of service

1060of a complete claim . . . in which to file a response to the

1075peti tion and to submit relevant written information relating to

1085the issue of whether the injury is a birth - related neurological

1097injury." § 766.305(4), Fla. Stat.

11027. If NICA determines that the injury alleged in a claim is

1114a compensable birth - related neurolo gical injury, it may award

1125compensation to the claimant, provided that the award is approved

1135by the administrative law judge to whom the claim has been

1146assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1157disputes the claim, as it has in the in stant case, the dispute

1170must be resolved by the assigned administrative law judge in

1180accordance with the provisions of chapter 120, Florida Statutes.

1189§§ 766.304, 766.309, and 766.31, Fla. Stat.

11968. In discharging this responsibility, the a dministrative

1204l aw j udge must make the following determination based upon the

1216available evidence:

1218(a) Whether the injury claimed is a birth -

1227related neurological injury. If the claimant

1233has demonstrated, to the satisfaction of the

1240administrative law judge, that the infan t has

1248sustained a brain or spinal cord injury

1255caused by oxygen deprivation or mechanical

1261injury and that the infant was thereby

1268rendered permanently and substantially

1272mentally and physically impaired, a

1277rebuttable presumption shall arise that the

1283injury is a birth - related neurological injury

1291as defined in s. 766.303(2).

1296(b) Whether obstetrical services were

1301delivered by a participating physician in the

1308course of labor, delivery, or resuscitation

1314in the immediate postdelivery period in a

1321hospital; or by a certified nurse midwife in

1329a teaching hospital supervised by a

1335participating physician in the course of

1341labor, delivery, or resuscitation in the

1347immediate postdelivery period in a hospital.

1353§ 766.309(1), Fla. Stat. An award may be sustained only if th e

1366administrative law judge concludes that the "infant has sustained

1375a birth - related neurological injury and that obstetrical services

1385were delivered by a participating physician at birth."

1393§ 766.31(1), Fla. Stat.

13979. The term "birth - related neurological injury" is defined

1407in section 766.302(2) as follows:

"1412Birth - related neurological injury" means

1418injury to the brain or spinal cord of a live

1428infant weighing at least 2,500 grams for a

1437single gestation or, in the case of a

1445multiple gestation, a live infant weighing at

1452least 2,000 grams at birth caused by oxygen

1461deprivation or mechanical injury occurring in

1467the course of labor, delivery, or

1473resuscitation in the immediate postdelivery

1478period in a hospital, which renders the

1485infant permanently and substantially mentally

1490and physically impaired.

14931 0 . The evidence, which is not refuted, established that

1504Amy does not have a permanent and substantial m ental or physical

1516impairment; thus, Amy has not sustained a birth - related

1526neurological injury because s he is not p ermanently and

1536substantially physically impaired. Therefore, Amy is not

1543eligible for benefits under the Plan.

1549CONCLUSION

1550Based upon the foregoing Findings of Fact and Conclusions of

1560Law, it is ORDERED :

15651. The Petition filed by Michelle and Thomas Alvare z,

1575individually and as natural persons and guardians of Amy Nicole

1585Alvarez , is dismissed with prejudice.

15902. The final hearing scheduled for January 8, 2015, is

1600cancelled.
