90STATEMENT OF THE CASE
94On June 13 , 2014, Petitioner, Melissa D'Angelo, individually
102and as natural parent of Ale x DeBlasio (Alex) , a minor, filed a
115Petition under Protest to Florida Statute Section 766.301 et seq.
125( Petition) with the Division of Administrative Hearings (DOAH)
134for a determination of compensability under the Florida Birth -
144Related Neurological Injury C ompensation Plan (Plan). The
152Petition named Rose Mary Sobel , M.D., as the physician providing
162obstetrical services at the birth of Alex on February 7, 2011, at
174Citrus HMA, LLC, d/b/a Seven Rivers Regional Medical Center
183located in Crystal River, Florida.
188DOAH served NICA with a copy of the Petition on June 19 ,
2002014. DOAH served Dr. Sobel and Seven Rivers Regional Medical
210Center with copies of the Petition on June 20 , 2014.
220On July 14, 2014, Rose Mary Sobel, M.D., filed a Petition
231and Motion to Intervene. On July 17, 2014, Citrus HMA, LLC,
242d/b/a Seven Rivers Regional Medical Center filed a Petition and
252Motion to Intervene. The Petitions to Intervene were granted by
262Order dated July 31, 2014.
267On November 13, 2014, NICA filed a Motion for Summary Final
278Orde r, asserting that Alex did not sustain a "birth - related
290neurological injury" as that term is defined in section
299766.302(2), Florida Statutes. On December 2, 2014, Petitioner
307filed a response to NICA's Motion for Summary Final Order stating
318that Petitioner takes no position on the Motion and does not have
330any objection to the Motion. As of today's date, neither
340Dr. Sobel nor Seven Rivers Regional Medical Center has responded
350to NICA's Motion for Summary Final Order .
358FINDINGS OF FACT
3611. A lex DeBlasio was born on February 7, 2011, at Seven
373Rivers Regional Medical Center located in Crystal River, Florida.
382Alex weighed 3,640 grams at birth.
3892. Donald Willis, M.D. (Dr. Willis), was requested by NICA
399to review the medical records for Alex . In the report of his
412review of medical records, Dr. Willis described his findings and
422stated his opinion as follows:
427In summary labor was induced for post - dates.
436There was no fetal distress during labor and
444delivery by Cesarean section for failure to
451progress was uncompli cated. The newborn was
458not depressed. Apgar scores were 9/9.
464Newborn hospital course was uneventful. The
470baby apparently did well after hospital
476discharge until about two years of age when
484evaluation for speech and developmental delay
490was initiated. M RI showed brain injury.
497Based on the medical records, the brain
504injury does not appear to be birth related.
512There was no apparent obstetrical event that
519resulted in loss of oxygen or mechanical
526trauma to the baby's brain during labor,
533delivery, or the im mediate post - delivery
541period .
5433. Dr. Willis reaffirmed the above findings and opinion in
553an affidavit dated October 7, 2014 , which reads in pertinent
563part:
564As such, it is my opinion that there was not
574an injury to the brain or spinal cord caused
583by oxyg en deprivation or mechanical injury
590occurring in the course of labor, delivery,
597or resuscitation in the immediate
602postdelivery period in a hospital as required
609by Section 766.302(2), Florida Statutes, for
615a claim to qualify for compensation under
622Sections 766.301 through 766.316, Florida
627Statutes.
6284. NICA retained Michael S. Duchowny, M.D. (Dr. Duchowny) ,
637a pediatric neurologist, to examine A lex and to review the
648medical records for both Alex and his mother, Melissa D'Angelo .
659Dr. Duchowny examined A lex o n October 22 , 2014. In a report of
673his examination of Alex, Dr. Duchowny described his findings and
683opined as follows:
686In summary, Alex's neurological examination
691is significant for bilateral pyramidal tract
697involvement primarily in the lower
702extremities and hyperreflexia consistent with
707a diagnosis of mild spastic diplegia. In
714contrast, his mental function is appropriate
720for age and he has above - average speech
729development. He does however have
734significant behavioral and emotional issues
739and is also over active by history although I
748did not observe symptoms today.
753A review of Alex's medical records shows that
761his mother presented to Seven Rivers Medical
768Center for induction of labor at 41 weeks
776gestation. Alex was born by cesarean section
783with a birth we ight of 8 pounds. The
792membranes were ruptured and productive of
798clear fluid. His mother has reported that
805Alex was "accidently poked in his head on 2
814occasions when membranes were ruptured." The
820subsequent postnatal course was uncomplicated
825and Alex was discharged at 3 days of age.
834Two MRI scans of the brain were performed on
843May 1 and November 25, 2013. Both studies
851revealed extensive abnormal signal in the
857subcortical white matter of cerebral
862hemispheres in the T2 and FLAIR sequences. I
870have not per sonally reviewed either imaging
877study.
878Based on today's evaluation and review of the
886medical records, I am not recommending Alex
893for inclusion within the NICA program. He
900does not evidence a substantial mental
906impairment and his motor impairement is
912judge d to be mild. Furthermore, there is no
921history of either a significant mechanical
927injury or oxygen deprivation in the course of
935labor or delivery. I therefore am not
942recommending Alex to be considered for
948compensation within the NICA program.
9535. Dr. Du chowny reaffirmed his findings and opinion in an
964affidavit dated November 11, 2014, in which he opined that "Alex
975is not permanently and substantially mentally and physically
983impaired due to oxygen deprivation or mechanical injury as
992required by section 76 6.302(2), Florida Statutes, for a claim to
1003qualify for compensation under sections 766.301 through 766.16,
1011Florida Statutes."
10136. A review of the file in this case reveals that there
1025have been no expert opinions filed that are contrary to the
1036opinion of Dr . Willis that there was no apparent obstetrical
1047event that resulted in loss of oxygen or mechanical trauma to the
1059baby's brain during labor or delivery. Dr. WillisÓ opinion is
1069credited. There are no expert opinions filed that are contrary
1079to Dr. Duchowny Ós opinion that Al ex does not evidence a
1091sub stantial mental impairment and his motor impairment is judged
1101to be mild ; and , that there is no history of either a significant
1114mechanical injury or oxygen deprivation in the course of labor
1124and delivery. Dr. Du chownyÓs opinion is credited.
1132CONCLUSIONS OF LAW
11357 . The Division of Administrative Hearings has jurisdiction
1144over the parties to and the subject matter of these proceedings.
1155§§ 766.301 - 766.316, Fla. Stat.
11618 . The Plan was established by the Legislature "for the
1172purpose of providing compensation, irrespective of fault, for
1180birth - related neurological injury claims" relating to births
1189occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
12009 . The injured infant, her or his personal representative ,
1210parents, dependents, and next of kin may seek compensation under
1220the Plan by filing a claim for compensation with DOAH.
1230§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1238which administers the Plan, has "45 days from the date of service
1250of a complete claim . . . in which to file a response to the
1265petition and to submit relevant written information relating to
1274the issue of whether the injury is a birth - related neurological
1286injury." § 766.305(4), Fla. Stat.
129110 . If NICA determines that t he injury alleged in a claim
1304is a compensable birth - related neurological injury, it may award
1315compensation to the claimant, provided that the award is approved
1325by the administrative law judge to whom the claim has been
1336assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1347disputes the claim, as it has in the instant case, the dispute
1359must be resolved by the assigned administrative law judge in
1369accordance with the provisions of chapter 120, Florida Statutes.
1378§§ 766.304, 766.309, and 766.31, Fla. Stat.
13851 1 . In discharging this responsibility, the administrative
1394law judge must make the following determination based upon the
1404available evidence:
1406(a) Whether the injury claimed is a birth -
1415related neurological injury. If the claimant
1421has demonstrated, to the satisfaction of the
1428administrative law judge, that the infant has
1435sustained a brain or spinal cord injury
1442caused by oxygen deprivation or mechanical
1448injury and that the infant was thereby
1455rendered permanently and substantially
1459mentally and physical ly impaired, a
1465rebuttable presumption shall arise that the
1471injury is a birth - related neurological injury
1479as defined in s. 766.303(2).
1484(b) Whether obstetrical services were
1489delivered by a participating physician in the
1496course of labor, delivery, or resus citation
1503in the immediate postdelivery period in a
1510hospital; or by a certified nurse midwife in
1518a teaching hospital supervised by a
1524participating physician in the course of
1530labor, delivery, or resuscitation in the
1536immediate postdelivery period in a hospita l.
1543§ 766.309(1), Fla. Stat. An award may be sustained only if the
1555administrative law judge concludes that the "infant has sustained
1564a birth - related neurological injury and that obstetrical services
1574were delivered by a participating physician at birth."
1582§ 766.31(1), Fla. Stat.
15861 2 . The term "birth - related neurological injury" is defined
1598in section 766.302(2) as follows:
"1603Birth - related neurological injury" means
1609injury to the brain or spinal cord of a live
1619infant weighing at least 2,500 grams for a
1628sing le gestation or, in the case of a
1637multiple gestation, a live infant weighing at
1644least 2,000 grams at birth caused by oxygen
1653deprivation or mechanical injury occurring in
1659the course of labor, delivery, or
1665resuscitation in the immediate postdelivery
1670period i n a hospital, which renders the
1678infant permanently and substantially mentally
1683and physically impaired.
16861 3 . The evidence, which is not refuted, established that
1697Alex did not sustain an injury to the brain or spinal cord caused
1710by oxygen deprivation or me chanical injury in the course of
1721labor , delivery, or resuscitation in the immediate post - delivery
1731period in a hospital. Therefore, Alex is not eligible for
1741benefits under the Plan.
1745CONCLUSION
1746Based upon the foregoing Findings of Fact and Conclusions of
1756L aw, it is ORDERED that the Petition filed by Melissa D' Angelo,
1769individually and as natural parent of Alex DeBlasio, is dismissed
1779with prejudice.
