48This cause came on for consideration upon a Motion for

58Summary Final Order filed by Respondent, Florida Birth - Related

68Neurological Injury Compensation Association (NICA), on

74September 23 , 201 4 .

79STATEMENT OF THE CASE

83On June 16, 2014 , Petitioner, Kikilia Snell , on behalf of

93and as parent and natural guardian of Ky'Mon Travis (Ky'Mon), a

104deceased minor, filed a Petition Under Protest Pursuant to

113Florida St atute Section 766.301 et seq. (Petition) with the

123Division of Administrative Hearings (DOAH) for a determination of

132compensability under the Florida Birth - Related Neurological

140Injury Compensation Plan (Plan).

144The Petition named Orlando Muniz, M.D., as th e physician

154providing obstetric services at the birth of Ky'Mon at Jackson

164Hospital in Marianna , Florida.

168DOAH served NICA with a copy of the Petition on June 20 ,

180201 4 . DOAH served Dr. Muniz and Jackson Hospital w ith a copy of

195the Petition on June 20, 201 4 . Neither Dr. Muniz nor Jackson

208Hospital has petitioned to intervene in this proceeding.

216On September 23 , 201 4 , NICA filed a Motion for Summary Final

228Order, asserting that Ky'Mon did not sustain a "birth - related

239neurological injury" as that term is defin ed in section

249766.302(2), Florida Statutes. The Motion was served by United

258States Mail on September 23, 2014.

264An Order to Show Cause was entered on October 7, 2014,

275advising Petitioner to show cause in writing why Respondent's

284Motion for Summary Final Or der should not be granted. To date,

296no response has been filed.

301FINDINGS OF FACT

3041. Ky'Mon Travis was delivered on July 12, 2012, at Jackson

315Hospital in Marianna, Florida. Ky'Mon weighed 4,735 grams at

325delivery.

3262. Donald Willis, M.D. (Dr. Willis), was requested by NICA

336to review the medical records for Ky'Mon. In an affidavit dated

347September 16, 2014, Dr. Willis opined in pertinent part:

3565. I have reviewed the medical records for

364the above individual. The mother, Kikilia

370Snell was a 35 year old G3 P 2002 with a

381history of Diabetes managed with diet.

387Maternal weight was > 300 lbs. Diabetes was

395poorly controlled. Her HbA 1C was

401significantly elevated at 8.7% at her initial

408prenatal visit. Normal would be < 6%.="" h="" b="">

413is a reflection of blood glucose levels over

421the past several weeks. I did not see any

430medical records concerning further management

435of the Diabetes during pregnancy.

4406. The mother presented to her physician at

44838 weeks gestational age with the complaint

455of not feeling the baby move fo r one day.

465She was sent to the hospital for delivery.

4737. Hydramnios was diagnosed at time of

480rupture of the membranes. The fetal heart

487rate (FHR) monitor during labor was reviewed.

494The FHR tracing was abnormal on admission to

502the hospital and progress ively worsened

508during labor. The initial FHR pattern showed

515a normal baseline heart rate, but markedly

522reduced variability. Variable FHR

526decelerations began about three hours after

532admission with FHR variability essentially

537absent. The abnormal FHR patt ern progressed

544to terminal bradycardia with a heart rate of

552about 40 bpm when the monitor was removed for

561delivery.

5628. Emergency Cesarean section was done for

569the abnormal FHR pattern. Birth weight was

5764,735 grams. There was no heart rate

584detected at b irth. Apgar scores were 0/0.

592Resuscitation was unsuccessful and death was

598pronounced. A heart rate was never obtained

605after birth or during resuscitation.

6109. Autopsy found a thin subdural hemorrhage

617and enlarged fetal organs.

62110. In summary, the mot her was a poorly

630controlled diabetic that presented at 38

636weeks with no fetal movement for one day.

644FHR monitoring during labor was consistent

650with severe fetal distress. Emergency

655Cesarean section delivery resulted in a still

662birth. There was no heart rate at delivery

670and no heart rate was obtained during

677resuscitation. Resuscitation was stopped and

682the baby pronounced dead shortly after birth.

68911. There was an apparent obstetrical [sic]

696even that resulted in loss of oxygen to the

705fetus during labor and delivery. The oxygen

712deprivation resulted in demise stillbirth.

717The baby could not be resuscitated and

724pronounced dead shortly after birth. This

730was not a live birth.

7353. A review of the file in this case reveals that there has

748been no expert opini on filed that is contrary to the opinion of

761Dr. Willis. The opinion of Dr. Willis that there was an apparent

773obstetrical event that resulted in loss of oxygen to the fetus

784during labor and delivery which resulted in demise stillbirth,

793that the baby could not be resuscitated and was pronounced dead

804shortly after birth, is credited.

809CONCLUSIONS OF LAW

8124. The Division of Administrative Hearings has jurisdiction

820over the parties to and the subject matter of these proceedings.

831§§ 766.301 - 766.316, Fla. Stat.

8375. The Plan was established by the Legislature "for the

847purpose of providing compensation, irrespective of fault, for

855birth - related neurological injury claims" relating to births

864occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8756. The inj ured infant, her or his personal representative,

885parents, dependents, and next of kin may seek compensation under

895the Plan by filing a claim for compensation with DOAH.

905§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA, which

914administers the Plan, has "45 days from the date of service of a

927complete claim . . . in which to file a response to the petition

941and to submit relevant written information relating to the issue

951of whether the injury is a birth - related neurological injury."

962§ 766.305 (4), Fla. Stat.

9677. If NICA determines that the injury alleged in a claim is

979a compensable birth - related neurological injury, it may award

989compensation to the claimant, provided that the award is approved

999by the administrative law judge to whom the claim has been

1010assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1021disputes the claim, as it has in the instant case, the dispute

1033must be resolved by the assigned administrative law judge in

1043accordance with the provisions of chapter 120, Florida Sta tutes.

1053§§ 766.304, 766.309, and 766.31, Fla. Stat.

10608. In discharging this responsibility, the administrative

1067law judge must make the following determination based upon the

1077available evidence:

1079(a) Whether the injury claimed is a birth -

1088related neurologic al injury. If the claimant

1095has demonstrated, to the satisfaction of the

1102administrative law judge, that the infant has

1109sustained a brain or spinal cord injury caused

1117by oxygen deprivation or mechanical injury and

1124that the infant was thereby rendered

1130perman ently and substantially mentally and

1136physically impaired, a rebuttable presumption

1141shall arise that the injury is a birth - related

1151neurological injury as defined in s.

1157766.303(2).

1158(b) Whether obstetrical services were

1163delivered by a participating physici an in the

1171course of labor, delivery, or resuscitation in

1178the immediate postdelivery period in a

1184hospital; or by a certified nurse midwife in a

1193teaching hospital supervised by a

1198participating physician in the course of

1204labor, delivery, or resuscitation in t he

1211immediate postdelivery period in a hospital.

1217§ 766.309(1), Fla. Stat. An award may be sustained only if the

1229administrative law judge concludes that the "infant has sustained

1238a birth - related neurological injury and that obstetrical services

1248were deliv ered by a participating physician at birth."

1257§ 766.31(1), Fla. Stat.

12619. The term "birth - related neurological injury" is defined

1271in section 766.302(2) as follows:

"1276Birth - related neurological injury" means

1282injury to the brain or spinal cord of a live

1292inf ant weighing at least 2,500 grams for a

1302single gestation or, in the case of a multiple

1311gestation, a live infant weighing at least

13182,000 grams at birth caused by oxygen

1326deprivation or mechanical injury occurring in

1332the course of labor, delivery, or

1338resuscit ation in the immediate postdelivery

1344period in a hospital, which renders the infant

1352permanently and substantially mentally and

1357physically impaired.

135910. The evidence, which is not refuted, established that the

1369birth of Ky'Mon was not a live birth. Theref ore, Petitioner is

1381not eligible for benefits under the Plan.

1388CONCLUSION

1389Based upon the foregoing Findings of Fact and Conclusions of

1399Law, it is ORDERED that the Petition filed by Kikilia Snell , a s

1412parent and natural guardian of Ky'Mon Travis , is dismissed with

1422prejudice.
