76STATEMENT OF THE CASE
80On June 20, 2014, Petitioner, Megan Exantus, on behalf of
90and as parent and natural guardian of Kaidyn Hancock (Kaidyn), a
101minor, filed a Petition for Benefits Pursuant to Florida Statute
111Section 766.301 e t seq. (Petition) with the Division of
121Administrative Hearings (DOAH) for a determination of
128compensability under the Florida Birth - Related Neurological
136Injury Compensation Plan (Plan). The Petition named Glenda A.
145Phillips, ARNP, CNM, as the nurse/midwif e providing obstetrical
154services at the birth of Kaidyn on January 30, 2012, at Memorial
166Hospital Jacksonville located in Jacksonville, Florida.
172DOAH served NICA and Memorial Hospital Jacksonville with a
181copy of the Petition on July 1, 2014. DOAH served G lenda A.
194Phillips, ARNP, CNM, with a copy of the Petition on July 2, 2014.
207As of the date of this Summary Final Order of Dismissal, no
219petition to intervene has been filed by Memorial Hospital
228Jacksonville or Glenda A. Phillips, ARNP, CNM.
235On July 8, 2015, NICA filed a Motion for Summary Final
246Order, asserting that Kaidyn did not sustain a "birth - related
257neurological injury" as that term is defined in section
266766.302(2), Florida Statutes. On July 8, 2015, Petitioner filed
275a Response to the Motion for Summary Final Order serving notice
286that Petitioner will not be filing any substantive response to
296NICAÓs Motion for Summary Final Order.
302FINDINGS OF FACT
3051. Kaidyn was born on January 30, 2012, at Memorial
315Hospital Jacksonville located in Jacksonville, Florida. Kaidyn
322weighed in excess of 2,500 grams at birth.
3312. Donald Willis, M.D. (Dr. Willis), was requested by NICA
341to review the medical records for Kaidyn. In a medical report
352dated August 20, 2014, Dr. Willis opined as follows:
361In summary, pregnanc y, labor and delivery
368were essentially uncomplicated. There was no
374fetal distress during labor. Spontaneous
379vaginal delivery was uncomplicated.
383There was no apparent obstetrical event that
390resulted in loss of oxygen or mechanical
397trauma to the babyÓs br ain during labor,
405delivery or the immediate post delivery
411period.
4123. NICA retained Michael S. Duchowny, M.D. (Dr. Duchowny),
421a pediatric neurologist, to examine Kaidyn and to review her
431medical records. Dr. Duchowny examined Kaidyn on September 24,
44020 14. In a medical report dated September 30, 2014, regarding
451his independent medical examination of Kaidyn, Dr. Duchowny
459opined as follows:
462In summary, KaidynÓs neurologic examination
467reveals findings consistent with a
472substantial mental and physical impai rment.
478She has spastic quadriparesis, microcephaly,
483and absence of both expressive and receptive
490language ability. She additionally evidences
495mid - facial dysmorphism. There is no
502significant lateralization to her findings.
507I reviewed records sent from y our office
515which were sent on May 21, 2014 and confirm
524the familyÓs impression of a relatively
530normal prenatal course and labor and delivery
537with the single exception of meconium - stained
545amniotic fluid ingestion. KaidynÓs Apgar
550scores were 6 and 9 at 1 & 5 minutes and she
562did not require intubation or ventilatory
568support. There is no evidence of multi - organ
577system involvement or neurologic dysfunction
582and both mother and child were discharged
589from the hospital at the usual time.
596In view of these finding s together with a
605normal MRI scan of the brain obtained on
613November 6, 2012, I consider it unlikely that
621KaidynÓs neurologic impairments were acquired
626in the course of labor or delivery. Rather,
634KaidynÓs present disabilities are more likely
640to result from unknown prenatal factors,
646possibly genetic in origin. I therefore do
653not recommend that Kaidyn be considered for
660compensation within the NICA program.
6654. A review of the file in this case reveals that there
677have been no expert opinions filed that are contrary to the
688opinion of Dr. Willis that there was no apparent obstetrical
698event that resulted in loss of oxygen or mechanical trauma to the
710baby's brain during labor, delivery, or the immediate post -
720delivery period. Dr. WillisÓ opinion is credited. Th ere are no
731expert opinions filed that are contrary to Dr. DuchownyÓs opinion
741that although KaidynÓs examination reveals findings consistent
748with a substantial mental and physical impairment, her
756impairments did not result from either oxygen deprivation or
765mechanical injury acquired in the course of labor or delivery.
775Dr. DuchownyÓs opinion is credited.
780CONCLUSIONS OF LAW
7835. The Division of Administrative Hearings has jurisdiction
791over the parties to and the subject matter of these proceedings.
802§§ 766.30 1 - 766.316, Fla. Stat.
8096. The Plan was established by the Legislature "for the
819purpose of providing compensation, irrespective of fault, for
827birth - related neurological injury claims" relating to births
836occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
8477. The injured infant, her or his personal representative,
856parents, dependents, and next of kin may seek compensation under
866the Plan by filing a claim for compensation with DOAH.
876§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. N ICA,
885which administers the Plan, has "45 days from the date of service
897of a complete claim . . . in which to file a response to the
912petition and to submit relevant written information relating to
921the issue of whether the injury is a birth - related neurologi cal
934injury." § 766.305(4), Fla. Stat.
9398. If NICA determines that the injury alleged in a claim is
951a compensable birth - related neurological injury, it may award
961compensation to the claimant, provided that the award is approved
971by the administrative law j udge to whom the claim has been
983assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
994disputes the claim, as it has in the instant case, the dispute
1006must be resolved by the assigned administrative law judge in
1016accordance with the provisions of c hapter 120, Florida Statutes.
1026§§ 766.304, 766.309, and 766.31, Fla. Stat.
10339. In discharging this responsibility, the administrative
1040law judge must make the following determination based upon the
1050available evidence:
1052(a) Whether the injury claimed is a b irth -
1062related neurological injury. If the claimant
1068has demonstrated, to the satisfaction of the
1075administrative law judge, that the infant has
1082sustained a brain or spinal cord injury
1089caused by oxygen deprivation or mechanical
1095injury and that the infant was thereby
1102rendered permanently and substantially
1106mentally and physically impaired, a
1111rebuttable presumption shall arise that the
1117injury is a birth - related neurological injury
1125as defined in s. 766.303(2).
1130(b) Whether obstetrical services were
1135delivered by a participating physician in the
1142course of labor, delivery, or resuscitation
1148in the immediate postdelivery period in a
1155hospital; or by a certified nurse midwife in
1163a teaching hospital supervised by a
1169participating physician in the course of
1175labor, delivery , or resuscitation in the
1181immediate postdelivery period in a hospital.
1187§ 766.309(1), Fla. Stat. An award may be sustained only if the
1199administrative law judge concludes that the "infant has sustained
1208a birth - related neurological injury and that obstetri cal services
1219were delivered by a participating physician at birth."
1227§ 766.31(1), Fla. Stat.
123110. The term "birth - related neurological injury" is defined
1241in section 766.302(2) as follows:
"1246Birth - related neurological injury" means
1252injury to the brain or s pinal cord of a live
1263infant weighing at least 2,500 grams for a
1272single gestation or, in the case of a
1280multiple gestation, a live infant weighing at
1287least 2,000 grams at birth caused by oxygen
1296deprivation or mechanical injury occurring in
1302the course of labo r, delivery, or
1309resuscitation in the immediate postdelivery
1314period in a hospital, which renders the
1321infant permanently and substantially mentally
1326and physically impaired.
132911. The evidence, which is not refuted, established that
1338Kaidyn did not sustain an injury to the brain or spinal cord
1350caused by oxygen deprivation or mechanical injury in the course
1360of labor, delivery, or resuscitation in the immediate post -
1370delivery period in a hospital. Therefore, Kaidyn is not eligible
1380for benefits under the Plan.
1385CONCLUSION
1386Based upon the foregoing Findings of Fact and Conclusions of
1396Law, it is ORDERED that:
14011. The Petition filed by Megan Exantus, on behalf of Kaidyn
1412Hancock, is dismissed with prejudice.
14172. The final hearing scheduled for July 28, 2015, is
1427cance lled.
