56This cause came on for consideration upon a Motion for
66Summary Final Order filed by Respondent, Flo rida Birth - Related
77Neurological Injury Compensation Association (NICA), on
83December 29 , 2014.
86STATEMENT OF THE CASE
90On July 7, 2014, Petitioners, Carlos Barrientos - Martinez and
100Asuncion Gutierrez - Arreola, on behalf of and as parents and
111natural guardians of Carla Barrientos - Gutierrez (Carla), a minor,
121filed a Petition for Benefits Pursuant to Florida Statute Section
131766.301 et seq. (Petition) with the Division of Administrative
140Hearings (DOAH) for a determination of compensability under the
149Florida Birth - R elated Neurological Injury Compensation Plan
158(Plan). The Petition named Wilfredo Rivera - Ortiz, M.D., as the
169physician providing obstetrical services at the birth of Carla on
179April 12, 2013, at Manatee Memorial Hospital located in Braden
189River, Florida.
191DO AH served NICA with a copy of the Petition on Ju ly 10,
2052014. On July 22, 2014, DOAH received a return receipt from the
217United States Postal Service showing that Dr. Rivera - Ortiz had
228been served with a copy of the Petition. On October 15, 2014,
240DOAH recei ved a return receipt from the United States Postal
251Service showing that Manatee Memorial Hospital had been served
260with a copy of the Petition.
266Neither Wilfredo Rivera - Ortiz, M.D., nor Manatee Memorial
275Hospital has petitioned to intervene in this proceedi ng.
284On December 29, 2014, NICA filed a Motion for Summary Final
295Order, asserting that Carla did not sustain a "birth - related
306neurological injury" as that term is defined in section
315766.302(2), Florida Statutes. NICA represented in its motion
323that Petitio ners had no objection to the granting of the motion.
335FINDINGS OF FACT
3381. Carla Barrientos - Gutierrez was born on April 12, 2013,
349at Manatee Memorial Hospital located in Braden River, Florida.
358Carla weighed 3,610 grams at birth.
3652. Donald Willis, M.D . (Dr. Willis), was requested by NICA
376to review the medical records for Carla. In an affidavit dated
387December 17, 2014, Dr. Willis described his findings as follows:
397In summary, vacuum assisted delivery resulted
403in a scalp hemorrhage with significant bloo d
411loss and resulting anemia, hypovolemia,
416hypotension and coagulation defects.
420Hypovolemia resulted in poor perfusion and
426multisystem organ failure. E. coli sepsis
432compounded the complications related to the
438scalp hemorrhage. The baby suffered brain
444inju ry due to these complications . However,
452the brain injury did not occur during labor
460delivery or the immediate post - delivery
467period.
468There was no apparent obstetrical event that
475resulted in loss of oxygen or mechanical
482trauma to the babyÓs brain during lab or,
490delivery or the immediate post delivery
496period.
4973. NICA retained Michael S. Duchowny, M.D. (Dr. Duchowny) ,
506a pediatric neurologist, to examine Carla and to review her
516medical records. Dr. Duchowny examined Carla on October 15,
5252014. In an affidavi t dated December 17, 2014, Dr. Duchowny
536opined as follows:
539In summary, CarlaÓs neurological examination
544reveals evidence of a mild to moderate motor
552disability and language development which is
558behind age level. There is no focal or
566lateralizing findings and I was unable to
573confirm the familyÓs impression of diminished
579left - sided motor activity.
584The medical record review indicates that
590CarlaÓs neurological impairments are the
595result of E - coli, sepsis and
602meningoencephalitis. She likely had diffuse
607CNS va sculitis as well. However, there is no
616indication that CarlaÓs brain damage resulted
622from either mechanical injury or oxygen
628deprivation in the course of labor and
635delivery. The timing of acquisition of her
642infection is open [sic] a question as she
650only became symptomatic at 24 hours of age.
658Should this issue need further examination,
664input from a pediatric infectious disease
670consult would be useful. It would be
677important to review her MRI scans of the
685brain. However, pending any need for further
692review , I am not recommending Carla for
699inclusion in the NICA program.
7044. A review of the file in this case reveals that there
716have been no opinions filed that are contrary to the opinion of
728Dr. Willis that there was no apparent obstetrical event that
738resulted in loss of oxygen or mechanical trauma to the baby's
749brain during labor, delivery, or the immediate post - delivery
759period, and Petitioners have no objection to the issuance of a
770summary final order finding that the injury is not compensable
780under the plan. Dr. WillisÓ opinion is credited. There are no
791contrary opinions filed that are contrary to Dr. DuchownyÓs
800opinion that there is no indication that Carla's neu rological
810injury resulted from either mechanical injury or oxygen
818deprivation in the course of labor and delivery. Dr. DuchownyÓs
828opinion is credited.
831CONCLUSIONS OF LAW
8345. The Division of Administrative Hearings has jurisdiction
842over the parties to and the subject matter of these proceedings.
853§§ 766.301 - 766.316, Fla. Stat.
8596. The Plan w as established by the Legislature "for the
870purpose of providing compensation, irrespective of fault, for
878birth - related neurological injury claims" relating to births
887occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
8987. The injured infant, h er or his personal representative,
908parents, dependents, and next of kin may seek compensation under
918the Plan by filing a claim for compensation with DOAH.
928§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
936which administers the Plan, has "45 days from the date of service
948of a complete claim . . . in which to file a response to the
963petition and to submit relevant written information relating to
972the issue of whether the injury is a birth - related neurological
984injury." § 766.305(4), Fla. Stat .
9908. If NICA determines that the injury alleged in a claim is
1002a compensable birth - related neurological injury, it may award
1012compensation to the claimant, provided that the award is approved
1022by the administrative law judge to whom the claim has been
1033assig ned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1045disputes the claim, as it has in the instant case, the dispute
1057must be resolved by the assigned administrative law judge in
1067accordance with the provisions of chapter 120, Florida Statutes.
1076§§ 766 .304, 766.309, and 766.31, Fla. Stat.
10849. In discharging this responsibility, the administrative
1091law judge must make the following determination based upon the
1101available evidence:
1103(a) Whether the injury claimed is a birth -
1112related neurological injury. If the claimant
1118has demonstrated, to the satisfaction of the
1125administrative law judge, that the infant has
1132sustained a brain or spinal cord injury
1139caused by oxygen deprivation or mechanical
1145injury and that the infant was thereby
1152rendered permanently and subs tantially
1157mentally and physically impaired, a
1162rebuttable presumption shall arise that the
1168injury is a birth - related neurological injury
1176as defined in s. 766.303(2).
1181(b) Whether obstetrical services were
1186delivered by a participating physician in the
1193cour se of labor, delivery, or resuscitation
1200in the immediate postdelivery period in a
1207hospital; or by a certified nurse midwife in
1215a teaching hospital supervised by a
1221participating physician in the course of
1227labor, delivery, or resuscitation in the
1233immediate p ostdelivery period in a hospital.
1240§ 766.309(1), Fla. Stat. An award may be sustained only if the
1252administrative law judge concludes that the "infant has sustained
1261a birth - related neurological injury and that obstetrical services
1271were delivered by a part icipating physician at birth."
1280§ 766.31(1), Fla. Stat.
128410. The term "birth - related neurological injury" is defined
1294in section 766.302(2) as follows:
"1299Birth - related neurological injury" means
1305injury to the brain or spinal cord of a live
1315infant weighing at least 2,500 grams for a
1324single gestation or, in the case of a
1332multiple gestation, a live infant weighing at
1339least 2,000 grams at birth caused by oxygen
1348deprivation or mechanical injury occurring in
1354the course of labor, delivery, or
1360resuscitation in the immediate postdelivery
1365period in a hospital, which renders the
1372infant permanently and substantially mentally
1377and physically impaired.
138011. The evidence, which is not refuted, established that
1389Carla did not sustain an injury to the brain caused by oxygen
1401deprivation or mechanical injury in the course of labor,
1410delivery, or resuscitation in the immediate post - delivery period.
1420Therefore, Carla is not eligible for benefits under the Plan.
1430CONCLUSION
1431Based upon the foregoing Findings of Fact and Conclusions of
1441Law, it is ORDERED that the Petition filed by Carlos Barrientos -
1453Martinez and Asuncion Gutierrez - Arreola, on behalf of and as
1464parents and natural guardians of Carla Barrientos - Gutierrez, is
1474dismissed with prejudice, and the final hearing scheduled for
1483Ja nuary 27, 2015, is canceled.
