117STATEMENT OF THE ISSUES
121Th e issues to be decided in this case are whether
132Respondents are liable for the violations charged in the NOV,
142whether Respondents should pay the penalties assessed in the NOV,
152and whether Respondents should be required to take the corrective
162actions demand ed in the NOV.
168PRELIMINARY STATEMENT
170On May 1, 2014, Petitioner Department of Environmental
178Protection (ÐDepartmentÑ) issued the NOV, charging Respondents
185with filling a wetland without a permit. On June 23, 2014,
196Respondents filed a petition for adm inistrative hearing. The
205Department then referred the matter to the Division of
214Administrative Hearings (ÐDOAHÑ).
217Respondents were generally recalcitrant in responding to
224discovery requests, making ordered filings, responding to
231motions, and making themse lves available for hearing. Consistent
240with this pattern, they did not file a response to the
251DepartmentÓs motion for summary final order.
257FINDINGS OF FACT
2601. The Department is the state agency with powers and
270duties related to the regulation of construc tion activities in
280wetlands and surface waters, including filling in wetlands.
2882. Respondents are individuals who own real property on
297Bayshore Road in North Fort Myers, Florida. Some confusion
306exists in the record about the street number for the propert y.
318It is alternately described as 11590, 11620, 11650, and 11850.
328This is partly due to the fact that the property consists of at
341least two recorded parcels. The actual location of the filled
351area is not disputed, nor is it disputed that Respondents own the
363property where the fill was placed.
3693. The property is adjacent to the Caloosahatchee River.
378It contains freshwater marsh wetlands dominated by Leather Fern.
3874. The Department conducted a site inspection of
395RespondentsÓ property and determined that Respondents had filled
4030.96 acres of wetlands.
4075. The Department produced evidence that it incurred costs
416of $1,824.50 in this case.
4226. The corrective actions ordered in the NOV, which are
432designed to restore the wetlands that were filled, are
441rea sonable.
443CONCLUSIONS OF LAW
4467. The Department may initiate an administrative proceeding
454to establish liability for violations of the laws the Department
464administers. § 403.121(2), Fla. Stat. (2014).
4708. Because the Department seeks to impose ad ministrative
479penalties, a final order is issued by the Administrative Law
489Judge. § 403.121(2)(d), Fla. Stat. (2014).
4959. The Department has the burden to prove by a
505preponderance of the evidence that Respondent s are liable for the
516violations charged in the NOV.
52110. A party may move for a summary final order when there
533is no genuine issue as to any material fact. § 120.57(1)(h),
544Fla. Stat. (2014). The Administrative Law Judge has determined
553from the pleadings and affidavits that there is no gen uine issue
565as to any material fact.
57011. Count I of the NOV charges Respondents with a violation
581of Florida Administrative Code Rule 62 - 330.020, which requires
591authorization from the Department to fill wetlands. Respondents
599are liable under Count I.
60412. Section 403.121(3)(c) provides that the Department
611shall assess an administrative penalty of $1,000 for unauthorized
621filling, plus $2,000 when the area filled is greater than one -
634half acre.
63613. In Count I, the Department also seeks an administr ative
647penalty of $420, which represents the cost of a permit to fill in
660wetlands. The Department is authorized to assess a penalty for
670failure to obtain a required permit of up to $3,000.
681§ 403.121(4)(c), Fla. Stat.
68514. RespondentsÓ total liability und er Count I is $3,420.
69615. In Count II of the NOV, the Department seeks to recover
708its costs. Section 403.121(2)(f) provides that the prevailing
716party shall recover all costs incurred in an administrative
725enforcement proceeding. Respondents are liable un der Count II
734for $1,824.50.
73716. The corrective actions ordered in the NOV are
746reasonable and should be imposed, except for the deadlines for
756compliance, which are unreasonably short.
761DISPOSITION
762Based on the foregoing Findings of Fact and Conclusions of
772Law, it is
775ORDERED that:
777Respondents shall comply with the Orders for Corrective
785Actions set forth in the NOV except that all deadlines are
796doubled in length, so that, for example, the deadline to remove
807all fill and restore the Ðwetland impact areaÑ s hall be 60 days,
820rather than 30, and payments shall be made in 20 days, rather
832than 10.
8342. The NOV terms are also modified to change the
844DepartmentÓs total cost recovery from $1,000.00 to $1,824.50.
8543. All deadlines shall be calculated from the date of t his
866Summary Final Order.
