50This cause came on for consideration upon a Motion for

60Summary Final Order filed by Respondent, Florida Birth - Related

70Neurological Injury C ompensation Association (NICA), on June 15,

792015.

80STATEMENT OF THE CASE

84On May 12, 2014, Petitioners, Carla Lyle and Demetris

93Walker, on behalf of and as parents and natural guardians of

104Uzziah Walker (Uzziah), a minor, filed a Petition for Benefits

114Pursu ant to Florida Statute Section 766.301 et seq. (Petition)

124with the Division of Administrative Hearings (DOAH) for a

133determination of compensability under the Florida Birth - Related

142Neurological Injury Compensation Plan (Plan). The Petition named

150Tracy A. T homas - Doyle, M.D., as the physician providing

161obstetrical services at the birth of Uzziah on November 23, 2012,

172at Sacred Heart Hospital located in Pensacola, Florida.

180DOAH served NICA with a copy of the Petition on August 8,

1922014. DOAH served Tracy A. Th omas - Doyle, M.D., with a copy of

206the Petition on August 11, 2014. DOAH served Sacred Heart

216Hospital with a copy of the Petition on October 26, 2014.

227Neither Tracy A. Thomas - Doyle, M.D., nor Sacred Heart

237Hospital has petitioned to intervene in this p roceeding.

246On June 15, 2015, NICA filed a Motion for Summary Final

257Order, asserting that Uzziah did not sustain a "birth - related

268neurological injury" as that term is defined in section

277766.302(2), Florida Statutes.

280An Order to Show Cause was entered on June 30, 2015,

291advising Petitioners to show cause in writing no later than

301June 17, 2015, why RespondentÓs Motion for Summary Final Order

311should not be granted. To date, no response has been filed.

322FINDINGS OF FACT

3251. Uzziah Walker was born on Novem ber 23, 2012, at Sacred

337Heart Hospital located in Pensacola, Florida. Uzziah weighed in

346excess of 2,500 grams at birth.

3532. Donald Willis, M.D. (Dr. Willis), was requested by NICA

363to review the medical records for Uzziah. In an affidavit dated

374May 24, 20 15, Dr. Willis described his findings in pertinent part

386as follows:

38810. In summary, there was no apparent fetal

396distress during labor. Spontaneous vaginal

401delivery resulted in a large sub ga leal

409hemorrhage with blood loss and poor

415perfusion. The baby was not hypoxic at

422birth. Cord blood gas was normal (pH 7.25).

430However, blood loss from the scalp hemorrhage

437and poor perfusion resulted in

442intraventricular hemorrhage during the

446immediate post delivery period.

45011. There was an apparent obstetrical event

457t hat resulted in scalp hemorrhage and poor

465perfusion with loss of oxygen to the babyÓs

473brain during the immediate post delivery

479period. The poor perfusion resulted in brain

486injury. I am unable to comment about the

494severity of the brain injury.

4993. NICA r etained Michael Duchowny, M.D. (Dr. Duchowny), a

509pediatric neurologist, to examine Uzziah and to review his

518medical records. Dr. Duchowny examined Uzziah on March 11, 2015.

528In an affidavit dated May 29, 2015, Dr. Duchowny opined in

539pertinent part as foll ows:

54419. Review of medical records and imaging

551studies sent on February 4 and 6, 2015 was

560performed. They detail UzziahÓs birth at

566Baptist Hospital Health System in Pensacola

572with a forceps assisted delivery after a

579rapid decent. Uzziah evidenced tachyc ardia

585and some retractions at the time of delivery

593but his Apgar scores were 7 and 8. He was

603observed to have a subgaleal hematoma; a CT

611scan of the brain on November 23 revealed a

620large soft tissue hematoma and a small

627collection of subdural blood over t he right

635cerebellar tent with a small amount of right

643ventricular hemorrhage. Of note, there was

649no cerebral edema or ventricular compression.

655No skull fractures were noted despite

661bilateral subgaleal hematomas. The neonatal

666course was otherwise uncompl icated.

67120. In summary, UzziahÓs neurological

676examination today reveals normal findings.

681He does not exhibit either mental or physical

689impairment and his overall development has

695caught up and is proceeding in an age

703appropriate fashion. I believe that UzziahÓs

709perinatal hematomas were resorbed without

714residual brain injury and his future

720prognosis is excellent. I explained to his

727family that Uzziah is doing very well and

735that his fu t ure is favorable from a

744prognostic standpoint. Given UzziahÓs normal

749neurological status today, I am not

755recommending compensation with the NICA

760program.

7614. A review of the file in this case reveals that there

773have been no opinions filed that are contrary to the opinion of

785Dr. Willis that there was an apparent obstetrical event that

795resulted in scalp hemorrhage and poor perfusion with loss of

805oxygen to the baby's brain during the immediate post - delivery

816period , and that the poor perfusion resulted in brain injury .

827Dr. WillisÓ opinion is credited. There are no opinions fi led

838that are contrary to Dr. DuchownyÓs opinion that Uzziah Ós overall

849development is proceeding in an age appropriate fashion and does

859not exhibit either mental or physical impairment. Dr. DuchownyÓs

868opinion is credited.

871CONCLUSIONS OF LAW

8745. The Di vision of Administrative Hearings has jurisdiction

883over the parties to and the subject matter of these proceedings.

894§§ 766.301 - 766.316, Fla. Stat.

9006. The Plan was established by the Legislature "for the

910purpose of providing compensation, irrespective of fault, for

918birth - related neurological injury claims" relating to births

927occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

9387. The injured infant, her or his personal representative,

947parents, dependents, and next of kin may seek compensation under

957the Plan by filing a claim for compensation with DOAH.

967§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

975which administers the Plan, has "45 days from the date of service

987of a complete claim . . . in which to file a response to th e

1003petition and to submit relevant written information relating to

1012the issue of whether the injury is a birth - related neurological

1024injury." § 766.305(4), Fla. Stat.

10298. If NICA determines that the injury alleged in a claim is

1041a compensable birth - related n eurological injury, it may award

1052compensation to the claimant, provided that the award is approved

1062by the administrative law judge to whom the claim has been

1073assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1084disputes the claim, as it has in the instant case, the dispute

1096must be resolved by the assigned administrative law judge in

1106accordance with the provisions of chapter 120, Florida Statutes.

1115§§ 766.304, 766.309, and 766.31, Fla. Stat.

11229. In discharging this responsibility, the administra tive

1130law judge must make the following determination based upon the

1140available evidence:

1142(a) Whether the injury claimed is a birth -

1151related neurological injury. If the claimant

1157has demonstrated, to the satisfaction of the

1164administrative law judge, that the infant has

1171sustained a brain or spinal cord injury

1178caused by oxygen deprivation or mechanical

1184injury and that the infant was thereby

1191rendered permanently and substantially

1195mentally and physically impaired, a

1200rebuttable presumption shall arise that the

1206inj ury is a birth - related neurological injury

1215as defined in s. 766.303(2).

1220(b) Whether obstetrical services were

1225delivered by a participating physician in the

1232course of labor, delivery, or resuscitation

1238in the immediate postdelivery period in a

1245hospital; o r by a certified nurse midwife in

1254a teaching hospital supervised by a

1260participating physician in the course of

1266labor, delivery, or resuscitation in the

1272immediate postdelivery period in a hospital.

1278§ 766.309(1), Fla. Stat. An award may be sustained only if the

1290administrative law judge concludes that the "infant has sustained

1299a birth - related neurological injury and that obstetrical services

1309were delivered by a participating physician at birth."

1317§ 766.31(1), Fla. Stat.

132110. The term "birth - related neurolo gical injury" is defined

1332in section 766.302(2) as follows:

"1337Birth - related neurological injury" means

1343injury to the brain or spinal cord of a live

1353infant weighing at least 2,500 grams for a

1362single gestation or, in the case of a

1370multiple gestation, a live i nfant weighing at

1378least 2,000 grams at birth caused by oxygen

1387deprivation or mechanical injury occurring in

1393the course of labor, delivery, or

1399resuscitation in the immediate postdelivery

1404period in a hospital, which renders the

1411infant permanently and substan tially mentally

1417and physically impaired.

142011. The evidence, which is not refuted, established that

1429there was an apparent obstetrical event that resulted in scalp

1439hemorrhage and poor perfusion with loss of oxygen to the babyÓs

1450brain during the immediate p ost - delivery period , which resulted

1461in brain injury . However , the evidence established that Uzziah

1471is developing in an age appropriate fashion and does not exhibit

1482either mental or physical impairment. Because section 766.302(2)

1490requires that the brain i njury render the infant permanently and

1501substantially mentally and physically impaired, Uzziah is not

1509eligible for benefits under the Plan.

1515CONCLUSION

1516Based upon the foregoing Findings of Fact and Conclusions of

1526Law, it is ORDERED that the Petition filed by Clara Lyle and

1538Demetris Walker, on behalf of and as parents and natural

1548guardians of Uzziah Walker, is dismissed with prejudice, and the

1558final hearing scheduled for September 9, 2015, is canceled.
