101On A ugust 11 , 2014, Petitioner, Jennifer de la Rosa ,

111indiv idually and as Personal Representative of the Estate of

121Sophia Grant (Sophia), deceased, filed a Petition Under Protest

130Pursuant to Florida Statute Section 766.301 et seq. (Petition) ,

139with the Division of Administrative Hearings (DOAH) for a

148determination of compensability under the Florida Birth - Related

157Neurological Injury Compensation Plan (Plan). The Petition named

165Areej Salem , M.D., as the physician who provided obstetric

174services at the birth of Sophia on Ma y 20 , 2012, at St. Joseph's

188Hospital in Lutz , Florida.

192DOAH served the Florida Birth - Related Neurological Injury

201Compensation Association ( NICA ) and St. Joseph's Hospital with a

238On September 1 1, 2014, St. JosephÓs Hospital filed a

286On June 1 , 201 5 , NICA filed a n Unopposed Motion for Partial

299Summary Final Order on the issue of birth - related neurological

310injury. On June 5 , 201 5 , a Partial Summary Final Order on

322c ompensability was entered, finding that Sophia su stained a

332birth - related neurological injury, which is compensable under the

342P lan. Jurisdiction was retained on the issues of notice and

353award.

354A Notice of Hearing by Video Teleconference was issued on

364June 15, 2015, scheduling the final hearing for Augus t 25, 2015.

376On July 20, 2015, Intervenor, Dr. Salem , filed a Renewed Motion

387for Summary Final Order. On July 24, 2015, Intervenor,

396St. JosephÓs Hospital, Inc., filed a Motion for Summary Final

406Order. 1/ On August 10, 2015, Petitioner filed a Combined

514The final hearing was convened as scheduled on August 25,

5242015. However, at the commencement of the hearing, the parties

534concurred that it was the partiesÓ preference that the Motions

544for Summary Final Or der be considered and ruled upon before any

556final hearing t ook place. Petitioner made an ore tenus Motion to

568supplement her Combined Objection and Response to Motion for

577Summary Final Order, which was denied. The hearing was adjourned

598Order. On August 28, 2015, Petitioner filed a Motion for

626September 1, 2015, Interven or S t. JosephÓs Hospital filed a

665FINDINGS OF FACT

6681. S ophia Grant was born alive on May 20, 2012 , at

680St. JosephÓs Hospital (St. JosephÓs) located in Lutz, Florida.

689Sophia was a single gestation weighing 3,020 grams at birth. At

701all times material to this proceeding, St. Joseph Ós was, and is,

713a NICA particip ant.

7172. Sophia w as delivered by Areej Salem, M.D. At all times

729material to this proceeding, Dr. Salem was, and is, a NICA

740participating physician.

7423. SophiaÓs mother, Jennifer de la Rosa, presented to Labor

752of Love Birth Center (Labor of Love) the eveni ng of May 19, 2012,

766for the delivery of her daughter. According to the records of

777Labor of Love, she had pushed through some of the night and much

790of the morning. Berenice Rowell, a certified midwife and owner

800of Labor of Love, was called in for assessme nt and support the

813following afternoon. Ms. Rowell arrived at Labor of Love around

8231:00 p.m., and performed a vaginal examination of Ms. d e la Rosa

836shortly after her arrival. During that examination, Ms. Rowell

845confirmed that PetitionerÓs water had broke n and her membranes

855had ruptured. Labor of Love decided to transfer Petitioner to a

866hospital. Accordingly, Ms. Rowell offered to have an ambulance

875perform the transfer, but that offer was refused , and Petitioner

885rode in a car with her family to St. Josep hÓs. Ms. Rowell

898followed Petitioner to St. JosephÓs and accompanied her to the

908labor and delivery department.

9124. Petitioner presented to the labor and delivery

920department of St. JosephÓs at approximately 4:00 p.m., in the

930afternoon on May 20, 2012.

9355. Teresa Hampton is a licensed obstetrical r egistered

944n urse , who is employed by St. JosephÓs. Nurse Hampton was

955working at St. JosephÓs labor and delivery department at the time

966Ms. d e la Rosa transferred from Labor of Love on the afternoon of

980May 20, 2012. Upon admission, Ms. Hampton provided Ms. de la

991Rosa with the informational brochure furnished by NICA and

1000explained the rights and limitations under the NICA compensation

1009plan to her.

10126. Ms. Hampton also provided a form furnished by

1021St. JosephÓs entitled ÐNotice to Obstetric Patient - Receipt of

1031NICA InformationÑ (the acknowledgment form), which reads as

1039follows:

1040RECEIPT OF NICA INFORMATION

1044I have be e n furnished the brochure furnished

1053by the Florida Birth - Related Neurological

1060Compensation Associa tion (NICA), pursuant to

1066Section 766.316, Florida Statutes, by

1071St. JosephÓs Hospitals, wherein certain

1076limited compensation is available in the

1082event certain types of qualifying

1087neurological injuries may occur during labor,

1093delivery or resuscitation in a h ospital. For

1101specifics on the program, I understand I can

1109contact the Florida Birth - Related

1115Neurological Injury Compensation Association,

1119Post Office Box 14567, Tallahassee, Florida

112532317 - 4567, (800) 398 - 2129. I further

1134acknowledge that I have received a copy of

1142the brochure prepared by NICA.

1147M s. Hampton printed Ms. de la RosaÓs name on the line immediately

1160above the line for ÐPatient/GuardianÓs signatureÑ and observed

1168Ms. de la Rosa sign the form. The date appearing below her

1180signature is May 20, 2012. In her affidavit, Ms. Hampton attests

1191that Petitioner appeared alert and capable of receiving her

1200explanation of the P lan and that there was no indication that

1212Petitioner did not understand this explanation.

12187. In her Responses to St. JosephÓs First Req uest for

1229Admissions, Petitioner admits to signing the acknowledgment , but

1237despite her signature on the acknowledgement form, denies

1245receiving the NICA brochure.

12498. Helen Ross, M.D., 2/ is an obstetrician/gynecologist

1257employed by OB Hospitalist Group. Sh e was providing obstetrical

1267services at St. JosephÓs at the time Petitioner arrived at labor

1278and delivery. That is, OB Hospitalist Group was providing

1287obstetric care to patients who did not have an obstetrician or

1298who presented to the hospital under emerg ency conditions.

1307Dr. Ross obtained PetitionerÓs medical history from Labor of

1316LoveÓs records that accompanied the patient , from the midwife,

1325Ms. Rowell, and from the patientÓs family. The prenatal records

1335were not in St. JosephÓs system. After obtaining a history and

1346after performing a medical exam of Petitioner, Dr. Ross

1355determined that Petitioner had prolonged ruptured membranes, was

1363in danger of infection, and that she was experiencing persistent

1373labor contractions. It was clear to Dr. Ross that Peti tionerÓs

1384membranes had ruptured prior to her arrival at St. JosephÓs and

1395that she had been in persistent contractions for a prolonged

1405period of time.

14089. Dr. RossÓs 24 - hour shift was ending , and she had a face -

1423to - face turnover with Dr. Salem sometime betwe en 7:00 p.m., and

14368:00 p.m. , on the evening of May 20, 2012. Dr. Salem was also

1449providing obstetrical services through OB Hospitalist Group and

1457took over obstetrical duties from Dr. Ross that evening.

146610. Dr. Salem first met with Ms. de la Rosa at 7:49 p.m. ,

1479on May 20, 2012. When she first saw Ms. de la Rosa and evaluated

1493her fetal monitoring strips, she determined that the baby needed

1503to be emergently delivered , and she strongly recommended an

1512immediate Caesarean section to Petitioner. Dr. Salem furth er

1521determined that PetitionerÓs membranes were ruptured and that

1529there was evidence of persistent uterine contractions.

153611. Although Petitioner initially did not consent to have a

1546Caesarean section, she ultimately did. Dr. Salem performed a

1555Caesarean se ction procedure on Petitioner, and delivered Sophia.

15641 2. As has been determined in the Partial Summary Final

1575Order issued on June 5, 2015, Sophia sustained a birth - related

1587neurological injury.

158913. Dr. Salem did not provide NICA notice to Ms. de la Rosa .

1603CONCLUSIONS OF LAW

160614 . The Division of Administrative Hearings has

1614jurisdiction over the parties to and the subject matter of this

1625proceeding. §§ 766.301 - 766.316, Fla. Stat. (201 5 ).

163515 . The only remaining issue to be determined is whether

1646notice was p rovided pursuant to section 766.316, which provides:

1656Each hospital with a participating physician

1662on its staff and each participating

1668physician, other than residents, assistant

1673residents, and interns deemed to be

1679participating physicians under

1682s. 766.314(4 )(c), under the Florida Birth -

1690Related Neurological Injury Compensation Plan

1695shall provide notice to the obstetrical

1701patients as to the limited no - fault

1709alternative for birth - related neurological

1715injuries. Such notice shall be provided on

1722forms furnished b y the association and shall

1730include a clear and concise explanation of a

1738patientÓs rights and limitations under the

1744plan. The hospital or the participating

1750physician may elect to have the patient sign

1758a form acknowledging receipt of the notice

1765form. Sign ature of the patient acknowledging

1772receipt of the notice form raises a

1779rebuttable presumption that the notice

1784requirements of this section have been met.

1791Notice need not be given to a patient when

1800the patient has an emergency medical

1806condition as defined in s. 395.002(8)(b) or

1813when notice is not practicable.

1818(emphasis added) .

182116 . Section 395.002(8)(b) , Florida Statutes, defines

"1828emergency medical condition" as follows:

1833(8) "Emergency medical condition" means:

1838* * *

1841(b) With respect to a pregn ant woman:

18491. That there is inadequate time to effect

1857safe transfer to another hospital prior to

1864delivery;

18652. That a transfer may pose a threat to the

1875health and safety of the patient or fetus; or

18843. There is evidence of the onset and

1892persistence of uterine contractions or

1897rupture of the membranes.

190117 . Section 766.309(1)(d) provides:

1906(1) The administrative law judge shall make

1913the following determination based upon all

1919available evidence:

1921* * *

1924(d) Whether if raised by the claimant or

1932o ther party, the factual determinations

1938regarding the notice requirements in

1943s. 766.316 are satisfied. The administrative

1949law judge has the exclusive jurisdiction to

1956make these factual determinations.

19601 8 . Ms. d e la Rosa signed an acknowledgement form st ating

1974that she received a NICA brochure from St. JosephÓs. Her

1984signature on this form raises a rebuttable presumption that the

1994notice requirements of section 766.316 have been met by the

2004hospital. In her response to a Request for Admissions,

2013Petitioner d enies that she received the NICA brochure from

2023St. JosephÓs pursuant to section 766.316. Intervenor,

2030St. JosephÓs, contend s that notice was pr ovided pursuant to

2041section 766.3 16 , and that, in any event, notice was not required

2053to be given due to Petitioner Ós emergency medical condition upon

2064arrival .

20661 9 . Intervenor Dr. Salem, contends that she was not

2077required to give notice because Petitioner had an emergency

2086medical condition as defined in section 395.002(8)(b), when she

2095first encountered the patient. As the proponent s of the

2105proposition that appropriate notice was given or that notice was

2115not required, the burden on the issue of notice is upon the

2127Intervenors. Tabb v. Fla. Birth - Related Neurological Injury

2136Comp. Ass'n. , 880 So. 2d 1253, 1257 (Fla. 1st DCA 2004).

214720 . Intervenors have met this burden. The evidence

2156establishes that when Petitioner presented to St. JosephÓs and

2165when Dr. Salem first encountered Petitioner the evening of

2174May 20, 2012, PetitionerÓs membranes had broken and she was

2184experien cing persistent uterine contractions. The testimony of

2192Ms. Rowell, the certified midwife from Labor of Love; Dr. Ross,

2203who initially examined Petitioner upon admission; and Dr. Salem,

2212who took over PetitionerÓs obstetrical care when Dr. RossÓs shift

2222was o ver, are consistent in this regard.

22302 1 . Thus, it is concluded that when Petitioner presented to

2242St. JosephÓs labor and delivery department and when she first

2252encountered Dr. Salem, she had an emergency medical condition as

2262defined in section 395.002(8)( b). As such, neither St. JosephÓs

2272nor Dr. Salem was required to provide NICA notice pursuant to

2283section 766.316.

22852 2 . In Weeks v. Florida Birth - Related Neurological Injury

2297Compensation Association , 977 So. 2d 616, 618 - 619 (Fla. 5th DCA

23092008), the court stated:

2313[T]he NICA notice must be given within a

2321reasonable time after the provider -

2327obstetrical relationship begins, unless the

2332occasion of the commencement of the

2338relationship involves a patient who presents

2344in an "emergency medical condition," as

2350defined by the statute, or unless the

2357provision of notice is otherwise "not

2363practicable." When the patient first becomes

2369an "obstetrical patient" of the provider and

2376what constitutes a "reasonable time" are

2382issues of fact. As a result, conclusions

2389might vary, e ven where similar situations are

2397presented. For this reason, a prudent

2403provider should furnish the notice at the

2410first opportunity and err on the side of

2418caution.

2419Id. at 619 - 620.

24242 3 . The provider - patient relationship between M s . d e la

2439Rosa and St. Jo sephÓs began when she presented to the labor and

2452delivery department on May 20, 2012. The physician - patient

2462relationship between Ms. de la Rosa and Dr. Salem also began on

2474May 20, 2012. At the time these provider - patient relationships

2485commenced, Ms. de l a Rosa was in an emergency medical condition ,

2497as defined in section 395.002(8)(b). Therefore, the providers

2505were excused from giving such notice.

2511CONCLUSION

2512Based on the foregoing Findings of Fact and Conclusions of

2522Law, it is

2525ORDERED:

25261. St. JosephÓs Hospital provide d NICA notice in compliance

2536with section 766.316 , although they were not obligated to do so

2547because Petitioner presented to the hospital in an emergency

2556medical condition as defined in section 395.002( 8 )(b).

25652. Dr. Areej Salem was not req uired to give NICA notice to

2578Petitioner because Petitioner was in an emergency medical

2586condition , as defined in section 395.002(8)(b), when Dr. Salem

2595first encountered Petitioner.

2598It is further ORDERED that the parties are accorded 30 days

2609from the date of this Order to resolve, subject to approval of

2621the Administrative Law Judge, the amount and manne r of payment of

2633an award to Petitioner ; the reasonable expenses incurred in

2642connection with the filing of the claim, including reasonable

2651attorney's fees and c osts; and the amount owing for expenses

2662previously incurred. If not resolved within such period, the

2671parties shall so advise the Administrative Law Judge, and a

2681hearing will be scheduled to resolve such issues. Once resolved,

2691an award will be made consis tent with section 766.31.

2701It is further ORDERED that in the event Petitioner files an

2712election of remedies declining or rejecting NICA benefits, this

2721case will be dismissed with prejudice and the file of DOAH will

2733be closed.
