81STATEMENT OF THE CASE

85On August 11 , 201 4 , Petitioners, Ana M. Maya and Carlos F.

97Maya , on behalf of and as parents and natural guardians of

108Sebastian Maya ( Sebastian ), a minor, filed a Petition Under

119Protest Pursuant to Florida Statutes Section 766.301 et seq.

128(Petition) with the Division of Administrative Hearings (DOAH)

136for a determination of compensability under the Florida Birth -

146Related Neurological Injury Compensation Plan (Plan). The

153Petition named Jane Matos - Fraebel , M.D. , as the physician who

164provided obstetric services for the birth of Sebastian . The

174Petition stated that Sebastian was born at Plantation General

183Hospital in Plantation , Florida.

187DOAH served NICA with a copy of the Petition on August 1 8 ,

200201 4 . DOAH served Plantation General Hospital with a copy of the

213Petition on Plantation General Hospital on August 18, 2014. DOAH

223served copies of the Petition on Dr. Matos - Fraebel on August 28,

2362014. As of the date of the Summary Final Order of Dismissal,

248neither Dr. Ma tos - Fraebel nor Plantation General Hospital has

259petitioned to intervene in this proceeding.

265On Octo ber 3 1, 201 4 , NICA filed a Motion for Summary Final

279Order, requesting that a s ummary f inal o rder be entered finding

292that the claim was not compensable becaus e Sebastian did not meet

304the requisite minimum statutory birth weight as required by

313section 766.302(2), Florida Statutes , and that the five - year

323statute of limitations had run under the Plan . As of the date of

337this Summary Final Order of Dismissal, Petit ioners have not filed

348a response to the Motion for Summary Final Order. It is noted

360that the Petition Under Protest requests a determination that

369SebastianÓs injuries be determined to be non - compensable under

379the Plan.

381FINDINGS OF FACT

3841. Sebastian Maya was born on October 11 , 20 06 , at

395Plantation General Hospital in Pla ntation , Florida. He was a

405single gestation.

4072. Based on the NICU discharge summary , Sebastian weighed

4161,740 grams at birth. There is no dispute that Sebastian did not

429weigh at lea st 2,500 grams at birth.

4383. The Petition Under Protest was filed on August 11, 2014,

449which is more than five years after SebastianÓs birth.

458CONCLUSIONS OF LAW

4614 . The Division of Administrative Hearings has jurisdiction

470over the parties to and the subjec t matter of these proceedings.

482§§ 766.301 - 766.316, Fla. Stat.

4885 . The Plan was established by the Legislature "for the

499purpose of providing compensation, irrespective of fault, for

507birth - related neurological injury claims" relating to births

516occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

5276 . The injured infant, her or his personal representative,

537parents, dependents, and next of kin may seek compensation under

547the Plan by filing a claim for compensation with DOAH.

557§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

565which administers the Plan, has "45 days from the date of service

577of a complete claim . . . in which to file a response to the

592petition and to submit relevant written information relating to

601the issue of whethe r the injury is a birth - related neurological

614injury." § 766.305(4), Fla. Stat.

6197 . NICA has determined that Petitioners do not have a claim

631that is compensable under the Plan and has filed a Motion for

643Summary Final Order, requesting that an order be en tered finding

654that the claim is not compensable.

6608 . In ruling on the motion, the Administrative Law Judge

671must make the following determination based upon the available

680evidence:

681(a) Whether the injury claimed is a birth -

690related neurological injury. If the claimant

696has demonstrated, to the satisfaction of the

703administrative law judge, that the infant has

710sustained a brain or spinal cord injury

717caused by oxygen deprivation or mechanical

723injury and that the infant was thereby

730rendered permanently and subst antially

735mentally and physically impaired, a

740rebuttable presumption shall arise that the

746injury is a birth - related neurological injury

754as defined in s. 766.303(2).

759§ 766.309(1), Fla. Stat.

7639 . The term "birth - related neurological injury" is defined

774in section 766.302(2) as follows:

"779Birth - related neurological injury" means

785injury to the brain or spinal cord of a live

795infant weighing at least 2,500 grams for a

804single gestation or, in the case of a

812multiple gestation, a live infant weighing at

819least 2,00 0 grams at birth caused by oxygen

829deprivation or mechanical injury occurring in

835the course of labor, delivery, or

841resuscitation in the immediate postdelivery

846period in a hospital, which renders the

853infant permanently and substantially mentally

858and physical ly impaired.

86210 . The evidence, which is not refuted, established that

872Sebastian was a single gestation and did not weigh at least 2,500

885grams at birth. Thus, Sebastian did not sustain a birth - related

897neurological injury because he did not meet the mini mum statutory

908weight as set forth in the definition of "birth - related

919neurological injury," in section 766.302(2).

92411. Moreover, the Petition Under Protest was filed more

933than five years after the birth of Sebastian. This is beyond the

945five - year statute of limitations set forth in section 766.313,

956and is, therefore, barred.

960CONCLUSION

961Based upon the foregoing Findings of Fact and Conclusions of

971Law, it is ORDERED that the Petition filed by Ana M. Maya and

984Carlos F. Maya , on behalf of and as parents and natural guardians

996of Sebastian Maya , a minor, is dismissed with prejudice.
