45This cause came on for consideration upon a Motion for

55Summary Final Order filed by Respondent, Florida Birth - Related

65Neurological Injury Compensation Association (NIC A), on April 2,

742015.

75STATEMENT OF THE CASE

79On August 21, 2014, Petitioner, Paula Dally, individually

87and on behalf of Michael Paul Dally (Michael), a minor, filed a

99Petition under Protest Pursuant to Florida Statute Section

107766.301 et seq. (Petition) wit h the Division of Administrative

117Hearings (DOAH) for a determination of compensability under the

126Florida Birth - Related Neurological Injury Compensation Plan

134(Plan). The Petition named Meredith Johnson Farrow, M.D., as the

144physician providing obstetrical s ervices at the birth of Michael

154on January 2, 2012, at Baptist Medical Center Beaches located in

165Jacksonville, Florida.

167DOAH served NICA with a copy of the Petition on August 28,

1792014. DOAH served Meredith Johnson Farrow, M.D., on September 2,

1892014. On S eptember 2, 2014, DOAH received a return receipt from

201the United States Postal Service showing that Baptist Medical

210Center Beaches had been served with a copy of the Petition.

221Neither Meredith Johnson Farrow, M.D., nor Baptist Medical

229Center Beaches ha s petitioned to intervene in this proceeding.

239On April 2, 2015, NICA filed a Motion for Summary Final

250Order, asserting that Michael did not sustain a "birth - related

261neurological injury" as that term is defined in section

270766.302(2), Florida Statutes. It is noted that the Petition was

280filed ÐUnder ProtestÑ and that Petitioner is described therein as

290Ðnot a claimant.Ñ Moreover, in a Joint Response to Order filed

301by the parties on February 26, 2015, NICA represented that

311Petitioner agreed that a hearing is not necessary in this matter.

322FINDINGS OF FACT

3251. Michael Paul Dally was born on January 2, 2012, at

336Baptist Medical Center Beaches located in Jacksonville, Florida.

344Michael weighed in excess of 2,500 grams at birth.

3542. Donald Willis, M.D. (Dr. Wil lis), was requested by NICA

365to review the medical records for Michael. In a medical report

376dated November 10, 2014, Dr. Willis described his findings as

386follows:

387Delivery was by spontaneous vaginal delivery.

393Birth weight was 3,657 grams. The baby was

402not depressed. Apgar scores were 9/9. The

409delivery was felt to be uncomplicated.

415The newborn hospital course was

420uncomplicated. The baby was discharged from

426the hospital on DOL 2.

431In summary, the mother presented in active

438labor and had an uncomplicated spontaneous

444vaginal delivery. The baby was not depressed

451at birth and had an uncomplicated newborn

458hospital course.

460There was no apparent obstetrical event that

467resulted in loss of oxygen or mechanical

474trauma to the babyÓs brain during labor,

481delivery or the immediate post delivery

487period.

4883. NICA retained Raymond J. Fernandez, M.D.

495(Dr. Fernandez), a pediatric neurologist, to examine Michael and

504to review his medical records. Dr. Fernandez examined Michael on

514January 21, 2015. In a medical report dated January 25, 2015,

525Dr. Fernandez opined as follows:

530IMPRESSION:

531There is no evidence in the medical record,

539nor is there evidence based on history for

547oxygen deprivation during labor, delivery,

552and the immediate post delivery period.

558There was no re suscitation necessary in the

566delivery room. MichaelÓs neurological

570development has been normal. His general

576physical examination and his

580neurodevelopmental examination are normal.

584There is no evidence whatsoever for any

591degree of brain injury, mental or motor

598disability, or oxygen deprivation during

603labor, delivery, or the post delivery period.

6104. A review of the file in this case reveals that there

622have been no opinions filed that are contrary to the opinion of

634Dr. Willis that there was no apparent obs tetrical event that

645resulted in loss of oxygen or mechanical trauma to the baby's

656brain during labor, delivery, or the immediate post - delivery

666period, and Petitioner has no objection to the issuance of a

677summary final order finding that the injury is not c ompensable

688under the plan. Dr. WillisÓ opinion is credited. There are no

699contrary opinions filed that are contrary to Dr. FernandezÓs

708opinion that there is no evidence of any degree of brain injury,

720mental or motor disability, or oxygen deprivation in th e course

731of labor, delivery, or the post - delivery period. Dr. FernandezÓs

742opinion is credited.

745CONCLUSIONS OF LAW

7485. The Division of Administrative Hearings has jurisdiction

756over the parties to and the subject matter of these proceedings.

767§§ 766.301 - 76 6.316, Fla. Stat.

7746. The Plan was established by the Legislature "for the

784purpose of providing compensation, irrespective of fault, for

792birth - related neurological injury claims" relating to births

801occurring on or after January 1, 1989. § 766.303(1), Fla . Stat.

8137. The injured infant, her or his personal representative,

822parents, dependents, and next of kin may seek compensation under

832the Plan by filing a claim for compensation with DOAH.

842§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

850which administers the Plan, has "45 days from the date of service

862of a complete claim . . . in which to file a response to the

877petition and to submit relevant written information relating to

886the issue of whether the injury is a birth - related neurological

898injury." § 766.305(4), Fla. Stat.

9038. If NICA determines that the injury alleged in a claim is

915a compensable birth - related neurological injury, it may award

925compensation to the claimant, provided that the award is approved

935by the administrative law judge to whom the claim has been

946assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

957disputes the claim, as it has in the instant case, the dispute

969must be resolved by the assigned administrative law judge in

979accordance with the provisions of chapt er 120, Florida Statutes.

989§§ 766.304, 766.309, and 766.31, Fla. Stat.

9969. In discharging this responsibility, the administrative

1003law judge must make the following determination based upon the

1013available evidence:

1015(a) Whether the injury claimed is a birth -

1024related neurological injury. If the claimant

1030has demonstrated, to the satisfaction of the

1037administrative law judge, that the infant has

1044sustained a brain or spinal cord injury

1051caused by oxygen deprivation or mechanical

1057injury and that the infant was ther eby

1065rendered permanently and substantially

1069mentally and physically impaired, a

1074rebuttable presumption shall arise that the

1080injury is a birth - related neurological injury

1088as defined in s. 766.303(2).

1093(b) Whether obstetrical services were

1098delivered by a pa rticipating physician in the

1106course of labor, delivery, or resuscitation

1112in the immediate postdelivery period in a

1119hospital; or by a certified nurse midwife in

1127a teaching hospital supervised by a

1133participating physician in the course of

1139labor, delivery, or resuscitation in the

1145immediate postdelivery period in a hospital.

1151§ 766.309(1), Fla. Stat. An award may be sustained only if the

1163administrative law judge concludes that the "infant has sustained

1172a birth - related neurological injury and that obstetrical services

1182were delivered by a participating physician at birth."

1190§ 766.31(1), Fla. Stat.

119410. The term "birth - related neurological injury" is defined

1204in section 766.302(2) as follows:

"1209Birth - related neurological injury" means

1215injury to the brain or spina l cord of a live

1226infant weighing at least 2,500 grams for a

1235single gestation or, in the case of a

1243multiple gestation, a live infant weighing at

1250least 2,000 grams at birth caused by oxygen

1259deprivation or mechanical injury occurring in

1265the course of labor, d elivery, or

1272resuscitation in the immediate postdelivery

1277period in a hospital, which renders the

1284infant permanently and substantially mentally

1289and physically impaired.

129211. The evidence, which is not refuted, established that

1301Michael did not sustain an in jury to the brain caused by oxygen

1314deprivation or mechanical injury in the course of labor,

1323delivery, or in the immediate post - delivery period. Therefore,

1333Michael is not eligible for benefits under the Plan.

1342CONCLUSION

1343Based upon the foregoing Findings o f Fact and Conclusions of

1354Law, it is ORDERED that the Petition filed by Paula Dally,

1365individually and on behalf of Michael Paul Dally, is dismissed

1375with prejudice.
