27P etitioner filed a motion for summary final order based on

38its contention that there is no genuine issue as to any material

50fact regarding the Notice of Violation, Orders for Corrective

59Action and Administrative Penalty Assessment (ÐNOVÑ) issued

66against Res pondent. No response to the motion was filed by

77Respondent. An Order to Show Cause was then issued. In its

88response to the Order to Show Cause, Respondent states that it is

100financially incapable of defending against PetitionerÓs

106enforcement action and w ill be submitting a re - designed

117stormwater system for review by Petitioner .

163STATEMENT OF THE ISSUES

167The issues to be decided in this case are whether Respondent

178is liable for the violations charged in the NOV, whether

188R espondent should pay the penalties assessed in the NOV, and

199whether Respondent should be re quired to take the corrective

209actions demanded in the NOV.

214FINDINGS OF FACT

2171. On August 7, 2014, Petitioner issued the NOV, charging

227Respondent with failure to maintain its stormwater facility in

236compliance with its permit and state law. Respondent filed an

246answer and request for a hearing. The matter was referred to the

258Division of Administrative Hearings.

2622. Petitioner Department of Environmental Protection

268(ÐDepartmentÑ) is the state agency having powers and duties

277related to the regulation of stormwater facilities.

2843. Respondent Classic Homebuilders Incorporated is a

291Florida corporation and holds a General Stormwater Permit issued

300by the Department for the construction and operation of a

310stormwater facility at 5100 Terra Lake Circle, Pensacola ,

318Florida.

3194. On April 9, 2013, Department staff inspected

327RespondentÓs stormwater facility and determined that the ponds do

336not percolate within 72 hours as required by the permit.

3465. On July 23, 2014, Department staff inspected the

355facility a gain and determined that the percolation problem had

365not been corrected. Debris and silt were observed in the

375stormwater facility.

3776. Respondent has not submitted an Ðas - builtÑ

386certification.

3877. The Department incurred $500 in expenses assoc iated with

397its investigation of this matter. That is a reasonable amount.

407CONCLUSIONS OF LAW

4108. The Department may initiate an administrative proceeding

418to establish liability for violations of the laws the Department

428administers. § 403.121(2), Fl a. Stat. (2014).

4359. Because the Department seeks to impose administrative

443penalties, a final order is issued by the Administrative Law

453Judge. § 403.121(2)(d), Fla. Stat. (2014).

45910. The Department has the burden to prove by a

469preponderance of the evidence that Respondent is liable for the

479violations charged in the NOV.

48411. A party may move for a summary final order when there

496is no genuine issue as to any material fact.

505§ 120.57(1)(h), Fla. Stat. (2014). The Administrative Law Judge

514has determined from the pleadings and affidavits that there is no

525genuine issue as to any material fact.

53212. Count I of the NOV charges Respondent with failure to

543properly maintain and operate a permitted stormwater facility as

552required by Florida Admini strative Code Rules 62 - 4.160(6) and

56362 - 4.540(12). Respondent is liable under Count I.

57213. Section 403.121(4)(b), Florida Statutes, provides that

579the Department shall assess an administrative penalty of $4,000

589for failure to install, maintain, or u se a required pollution

600control system.

60214. Count II of the NOV charges Respondent with failure to

613timely file an as - built certification as required by r ule

62562 - 25.801(2)(e). Respondent is liable under Count II.

63415. Section 403.121(4)(f) provi des that the Department

642shall assess an administrative penalty of $500 for failure to

652submit required reports.

65516. Count III of the NOV seeks reimbursement of the

665DepartmentÓs expenses of $500 for investigating this matter.

67317. Section 403.141(1) provide s that the Department may

682recover its reasonable costs and expenses in controlling sources

691of pollution.

69318. The corrective actions demanded in the NOV are

702reasonable.

703DISPOSITION

704Based on the foregoing Findings of Fact and Conclusions of

714Law, it is

717ORDERED that:

7191. Respondent shall pay $4,500 in penalties and reimburse

729the Department $500 for investigative expenses , in the manner

738described in t he NOV. The deadline for payment shall be

749calculated from the date of this Summary Final Order.

7582. Respon dent shall comply with the Orders for Corrective

768Actions set forth in the NOV. The deadlines for actions shall be

780calculated from the date of this Summary Final Order.
