115STATEMENT OF THE CASE
119On September 4 , 201 4, Petitioner s , Ninsi Galindo and
129Wilfredo Morales , individually and on behalf of Elian O. Morales
139Galindo (Elian) , a minor, filed a Petition Under Protest Pursuant
149to Florida S tatute Section 766.301 et seq. (Petition) with the
160Division of Administrative Hearings (DOAH) for a determination of
169compensability under the Florida Birth - Related Neurological
177Injury Compensation Plan (Plan). The Petition named Amanpreet
185Bhullar, M.D., Y ocoima Plaza, M.D., and Diana Narvaez, M.D., as
196the physician s providing obstetrical services at the birth of
206Elian on October 27 , 20 12 , at Winnie Palmer Hospital for Women
218and Babies located in Orlando , Florida.
224DOAH served NICA with a copy of the Petitio n on
235September 12 , 201 4 . On October 14 , 201 4 , DOAH received a return
249receipt from the United States Postal Service showing that
258Dr. Bhullar had been served with a copy of the Petition. On
270October 24, 2014, DOAH received a return receipt from the United
281S tates Postal Service showing that Winnie Palmer Hospital had
291been served with the Petition. A copy of the Petition was mailed
303to Diana Narvaez, M.D., and Yocima Plaza, M.D., on September 11,
3142014.
315On October 9, 2014, Orlando Health, Inc., d/b/a Wi nn ie
326Pal mer Hospital for Women and Babies, Amanpreet S. Bhullar, M.D.,
337Yocoima Plaza, M.D., and Diana Narvaez, M.D., filed a Petition
347for Leave to Intervene which was granted by Order dated
357October 22, 2014.
360On October 30, 2014, Respondent filed a Motion to Dismi ss,
371which was granted with leave to amend, by Order dated November 7,
3832014. Petitioners filed an Amended Petition Under Protest on
392November 24, 2014.
395On January 15 , 201 5 , NICA filed a Motion for Summary Final
407Order, asserting that Elian did not sustain a "birth - related
418neurological injury" as that term is defined in section
427766.302(2), Florida Statutes. On January 26, 2015, Intervenors
435filed a Motion for Extension of Time in which to file a response
448to NICAÓs Motion for Summary Final Order, which was gran ted by
460Order dated January 27, 2015.
465On February 23, 2015, Respondent filed a Supplemental Motion
474for Summary Final Order. On March 12, 2015, Intervenors filed a
485Response to Supplemental Motion for Summary Final Order, in which
495Intervenors advised that they do not oppose the entry of a
506summary final order finding that this claim is not compensable
516under the Plan.
519FINDINGS OF FACT
5221. Elian O. Morales Galindo was born on October 27, 20 12 ,
534at Wi nn ie Palmer Hospital for Women and Babies located in
546Orland o , Florida. Elian weighed 3,849 grams at birth.
5562. Donald Willis, M.D. (Dr. Willis), was requested by NICA
566to review the medical records for Elian to determine whether an
577injury occurred in the course of labor, delivery, or
586resuscitation in the immediate post - delivery period in the
596hospital due to oxygen deprivation or mechanical injury.
604Dr. Willis described his findings as follows in an affidavit
614dated January 14, 2015 :
6195. It is my opinion, in summary, spontaneous
627vaginal delivery was complicated by nu chal
634cord x2 and avulsion of the cord during
642reduction for delivery. Despite a normal
648cord blood pH, the baby was depressed at
656birth and required bag and mask ventilation
663for six minutes. The baby recovered quickly
670and was on room air within 24 - hours aft er
681delivery. The initial blood gas after birth
688had a base excess of - 12, which is consistent
698with some degree of acidosis. Head
704ultrasound was normal. EEG, CT scan and MRI
712were not done during newborn hospital course.
719Avulsion of the umbilical cord ca n occur when
728a tight nuchal cord is being reduced to allow
737delivery. The only risk related to cord
744rupture is neonatal blood loss and resulting
751hypotension. The babyÓs blood counts were
757normal with a Hematocrit of 47% which would
765suggest th e baby did not have a significant
774blood loss at time [sic] or cord rupture.
782This does not appear to be a factor in the
792outcome.
793There was an apparent obstetrical event that
800resulted in some degree of oxygen loss during
808delivery and continuing into the immediate
814post - de livery period. This is based
822primarily on the low Apgar scores and an
830initial blood gas with a based excess of - 12.
840I am unable to comment about oxygen
847deprivation during labor without review [sic]
853the FHR monitor tracing. No imaging studies
860were done du ring the newborn hospital course
868to determine if this oxygen deprivation
874caused any brain injury.
8786. Thereafter, I reviewed the additional
884medical records, which include the motherÓs
890hospital course during labor and delivery,
896the fetal heart rate (FHR) tracing during
903labor and an emergency room visit for the
911mother at 7 weeks gestational age for nausea.
919The FHR tracing during labor was reviewed.
926The baseline FHR on admission was normal at
934130 bpm with normal heart rate variability.
941The FHR monitor trac ing does not suggest
949fetal distress during labor.
9537. Accordingly, it is my opinion that there
961was no obstetrical event that resulted in
968oxygen deprivation or brain injury to the
975baby during labor.
9783 . NICA retained Raymond J . Fernandez , M.D.
987(Dr. Fernan dez) , a pediatric neurologist, to examine Elian and to
998review h is medical records. Dr. Fernandez examined Elian on
1008February 11, 201 5. In the medical report attached to
1018RespondentÓs Supplemental Motion for Summary Final Order,
1025Dr. Fernandez opined as foll ows :
1032CONCLUSION: There is no evidence for
1038substantial motor or physical impairment.
1043Elian walked on time and gross and fine motor
1052skills are improving at a steady pace based
1060on history and this trend should continue.
1067Expressive speech and receptive langua ge
1073development is delayed, but improving and
1079this trend should continue. While speech and
1086language delay is a predictor of later
1093learning difficulty, he is improving and we
1100do not have convincing evidence, at this
1107time, for substantial mental impairment t hat
1114will be permanent.
1117There was transient physical depression
1122immediately after birth and there was
1128transient respiratory distress, but he
1133improved within a reasonable period of time.
1140There was no clear evidence for neonatal
1147encephalopathy or multi - organ involvement.
1153Therefore, there is no clear evidence in the
1161record for brain or spinal cord injury during
1169labor, delivery, or the immediate post
1175delivery period of resuscitation.
11794. While Dr. Willis and Dr. Fernandez are of the same
1190opinion that an obstet rical event causing oxygen deprivation did
1200not occur during labor, Dr. WillisÓ opinion is somewhat at odds
1211with Dr. FernandezÓs opinion regarding whether an obstetrical
1219event occurred that resulted in some degree of oxygen loss during
1230delivery and continui ng into the immediate post - delivery period.
1241However, there are no opinions filed contrary to Dr. Fernandez's
1251opinion that there is no evidence of substantial motor or
1261physical impairment or convincing evidence at this time of
1270substantial mental impairment that will be permanent.
1277Dr. Fernandez Ós opinion is credited.
1283CONCLUSIONS OF LAW
12865 . The Division of Administrative Hearings has jurisdiction
1295over the parties to and the subject matter of these proceedings.
1306§§ 766.301 - 766.316, Fla. Stat.
13126 . The Plan was established by the Legislature "for the
1323purpose of providing compensation, irrespective of fault, for
1331birth - related neurological injury claims" relating to births
1340occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
13517 . The injured infant, her or his personal representative,
1361parents, dependents, and next of kin may seek compensation under
1371the Plan by filing a claim for compensation with DOAH.
1381§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
1389which administers the Plan, ha s "45 days from the date of service
1402of a complete claim . . . in which to file a response to the
1417petition and to submit relevant written information relating to
1426the issue of whether the injury is a birth - related neurological
1438injury." § 766.305(4), Fla. St at.
14448 . If NICA determines that the injury alleged in a claim is
1457a compensable birth - related neurological injury, it may award
1467compensation to the claimant, provided that the award is approved
1477by the administrative law judge to whom the claim has been
1488ass igned. § 766.305(7), Fla. Stat. If, on the other hand, NICA
1500disputes the claim, as it has in the instant case, the dispute
1512must be resolved by the assigned administrative law judge in
1522accordance with the provisions of chapter 120, Florida Statutes.
1531§§ 7 66.304, 766.309, and 766.31, Fla. Stat.
15399 . In discharging this responsibility, the a dministrative
1548l aw j udge must make the following determination based upon the
1560available evidence:
1562(a) Whether the injury claimed is a birth -
1571related neurological injury. If the claimant
1577has demonstrated, to the satisfaction of the
1584administrative law judge, that the infant has
1591sustained a brain or spinal cord injury
1598caused by oxygen deprivation or mechanical
1604injury and that the infant was thereby
1611rendered permanently and su bstantially
1616mentally and physically impaired, a
1621rebuttable presumption shall arise that the
1627injury is a birth - related neurological injury
1635as defined in s. 766.303(2).
1640(b) Whether obstetrical services were
1645delivered by a participating physician in the
1652co urse of labor, delivery, or resuscitation
1659in the immediate postdelivery period in a
1666hospital; or by a certified nurse midwife in
1674a teaching hospital supervised by a
1680participating physician in the course of
1686labor, delivery, or resuscitation in the
1692immediate postdelivery period in a hospital.
1698§ 766.309(1), Fla. Stat. An award may be sustained only if the
1710administrative law judge concludes that the "infant has sustained
1719a birth - related neurological injury and that obstetrical services
1729were delivered by a pa rticipating physician at birth."
1738§ 766.31(1), Fla. Stat.
17421 0 . The term "birth - related neurological injury" is defined
1754in section 766.302(2) as follows:
"1759Birth - related neurological injury" means
1765injury to the brain or spinal cord of a live
1775infant weighin g at least 2,500 grams for a
1785single gestation or, in the case of a
1793multiple gestation, a live infant weighing at
1800least 2,000 grams at birth caused by oxygen
1809deprivation or mechanical injury occurring in
1815the course of labor, delivery, or
1821resuscitation in th e immediate postdelivery
1827period in a hospital, which renders the
1834infant permanently and substantially mentally
1839and physically impaired.
184211 . The evidence, which is not refuted, established that
1852Elian does not have a substantial motor or physical impairme nt
1863and does not have a substantial mental impairment that will be
1874permanent. It is noted that Petitioners stated in their Petition
1884Under Protest that they are not claimants. And, Intervenors do
1894not oppose the entry of a summary final order finding that t he
1907injury is not compensable under the Plan. Therefore, Elian is
1917not eligible for benefits under the Plan.
1924CONCLUSION
1925Based upon the foregoing Findings of Fact and Conclusions of
1935Law, it is ORDERED :
19401. T he Petition filed by Ninsi Galindo and Wilfredo
1950M o rales , individually and on behalf of Elian O. Morales Galindo ,
1962is dismissed with prejudice.
19662. The final hearing scheduled for June 17, 2015, is
1976canceled.
1977DONE AND ORDERED this 17th day of March , 2015 , in
