94STATEMENT OF THE ISSUE

98The issue in this case is whether Respondents ' application

108to establish a dealership to sell motorcycles manufactured by

117Chongqing Astron au tical Bashan Motorcycle Manufacturer Co., Ltd.

126(BASH line - make), should be approved.

133PRELIMINARY STATEMENT

135On or about August 29, 2014, a notice was published in the

147Florida Administrative Register (FAR) indicating the desire of

155Respondent to establish a dealership to sell BASH line - make

166motorcycles in Volusia County, Florida. Petitioner filed a

174protest again st the proposed dealership dated August 21, 2014.

184The matter was referred to the Division of Administrative

193Hearings (DOAH) and assigned to the undersigned Administrative

201Law Judge. Pursuant to notice, a final hearing was scheduled for

212December 19, 2014. On December 16, 2014, Petitioner filed a

222motion seeking a continuance of the final hearing. The motion

232did not state the existence of an emergency and no good cause was

245shown for a continuance. See Fla. Admin Code R. 28 - 106.210. The

258motion was denied.

261At the final hearing, held as originally noticed, Petitioner

270did not make an appearance. Respondent did not call any

280witnesses but offered E xhibits 1 - 6 into evidence, each of which

293was admitted.

295The transcript of the final hearing was not ordered. B y

306rule, the parties are allowed up to ten days following the final

318hearing to submit a proposed recommended order. As of this date,

329neither Petitioner not Respondent has filed a proposed

337recommended order.

339FINDINGS OF FACT

3421. Petitioner filed an ÐOffi cial Notice of Protest Î

352Petition for DeterminationÑ dated August 21 , 2014, with the

361Florida Department of Highway Safety and Motor Vehicles (HSMV) .

371The protest/petition opposes RespondentÓs noticed intention to

378establish a dealership to be called Wild Ho gs Scooters and

389Motorsports, LLC , at 1431 South Woodland Boulevard, Deland

397(Volusia County), Florida. Notice of that intent was duly

406published in the Florida Administrative Register on August 29,

4152014. (There was no explanation provided as to why Petitio nerÓs

426protest/petition was filed before the publication of the notice.)

4352. PetitionerÓs protest/petition asserts that RespondentÓs

441proposed new dealership will be located Ðwithin our territory.Ñ

450Petitioner further asserts that Peace Industry Group is its

459Ðnumber two supplier of scooters, and represents 38% of our

469scooter sales.Ñ Petitioner did not appear at final hearing or

479present any competent evidence to support these allegations.

4873. Respondent provided evidence suggesting that Petitioner

494has only pu rchased seven motor - scooters from Peace Industry

505Group.

5064. Petitioner did not appear at final hearing and present

516evidence as to its Ðstanding to protestÑ as required by section

527320.642(3), Florida Statutes. (Unless specifically stated

533otherwise herein , all references to Florida Statutes will be to

543the 2014 version.)

5465. Conversely, Respondent presented evidence that

552PetitionerÓs dealership in Deland, Florida, has closed and gone

561out of business. This unrefuted evidence proves that Petitioner

570no longer has standing to protest RespondentÓs proposed new

579dealership in the area.

5836. The propriety of PetitionerÓs protest is the only issue

593in this proceeding. A petitioner without standing cannot pursue

602such a challenge.

605CONCLUSIONS OF LAW

6087. The Division of Administrative Hearings has jurisdiction

616over the parties to and the subject matter of this proceeding

627pursuant to s ections 120.569 and 120.57(1), Florida Statutes.

6368. This matter was transferred to DOAH from HSMV "for the

647sole purpose of determining the propriety of the protest by

657Petitioner regarding issues specifically within the purview of

665sections 320.642 and 320.699, Florida Statutes." ( See letter

674from Dealer License Section Administrator dated September 12,

6822014.)

6839. Section 320.699 addresses the process for obtaining an

692administrative hearing and states, in pertinent part:

699(1) A motor vehicle dealer, or person with

707entitlements to or in a motor vehicle dealer,

715who is directly and adversely affected by the

723action or conduct of an applicant or licensee

731which is alleged to be in violation of any

740provision of ss. 320.60 - 320.70, may seek a

749declaration and adjudication of its ri ghts

756with respect to the alleged action or conduct

764of the applicant or licensee by:

770(a) Filing with the department a request for

778a proceeding and an administrative hearing

784which conforms substantially with the

789requirements of ss. 120.569 and 120.57 ; or

796(b) Fi ling with the department a written

804objection or notice of protest pursuant to s.

812320.642.

81310. Section 320.642 sets forth the proc ess for establishing

823a new motor vehicle dealership. That section states in pertinent

833part:

834( 1) Any licensee who proposes to establish

842an additional motor vehicle dealership or

848permit the relocation of an existing dealer

855to a location within a community or territory

863where the same line - make vehicle is presently

872represented by a franchised motor vehicle

878dealer or dealers shall give written notice

885of its intention to the department. The

892notice must state:

895(a) The specific location at which the

902addition al or relocated motor vehicle

908dealership will be established.

912(b) The date on or after which the licensee

921intends to be engaged in business with the

929additional or relocated motor vehicle dealer

935at the proposed location.

939(c) The identity of all motor vehicle

946dealers who are franchised to sell the same

954line - make vehicle with licensed locations in

962the county and any contiguous county to the

970county where the additional or relocated

976motor vehicle dealer is proposed to be

983located.

984(d) The names and addre sses of the dealer -

994operator and principal investors in the

1000proposed additional or relocated motor

1005vehicle dealership.

1007Immediately upon receipt of the notice the

1014department shall cause a notice to be

1021published in the Florida Administrative

1026Weekly. The pu blished notice must state that

1034a petition or complaint by any dealer with

1042standing to protest pursuant to subsection

1048(3) must be filed within 30 days following

1056the date of publication of the notice in the

1065Florida Administrative Weekly. The published

1070notic e must describe and identify the

1077proposed dealership sought to be licensed,

1083and the department shall cause a copy of the

1092notice to be mailed to those dealers

1099identified in the licensee's notice under

1105paragraph (c). The licensee shall pay a fee

1113of $75 and a service charge of $2.50 for each

1123publication. Proceeds from the fee and

1129service charge shall be deposited into the

1136Highway Safety Operating Trust Fund.

114111. Florida Statutes clearly require a proposed licensee to

1150identify all currently franchised deale rs. Those dealers with

1159standing to protest are required to file a complaint within 30

1170days of the FAW notice. In this case, there is no evidence that

1183Petitioner was a licensed, franchised dealer at the time

1192RespondentÓs notice was filed in the FAR. Ther efore, Petitioner

1202has not established its standing to protest the proposed

1211dealership.

121212. The remainder of s ection 320.642, (specifically

1220subsection (2)(b)1 . - 11 . ) addresses the determination of whether

1232existing franchised dealers are providing adequat e representation

1240in the community for the line - make at issue. Inasmuch as

1252Petitioner has not proved its standing to file a protest , that

1263portion of the statute is not relevant to this case. Respondent

1274did not address the elements in s ubsection 320.642(2) (b)1 .

1285through 11. However, in light of PetitionerÓs lack of

1294jurisdiction to protest the proposed dealership, Respondent did

1302not have a burden to prove or address those elements.

1312RECOMMENDATION

1313Based on the foregoing Findings of Fact and Conclusions of

1323L aw, it is

1327RECOMMENDED that a final order be entered by the Department

1337of Highway Safety and Motor Vehicles denying Petitioner, Navitas

1346Financial Group, Inc. , d/b/a Pompano Pat s Deland 's protest of

1357Respondent's proposed new dealership.
