47This cause came on for consideration upon a Motion for

57Summary Final Order filed by Respondent, Florida Birth - Related

67Neurological Injury Compensation Associa tion (NICA), on March 26,

77STATEMENT OF THE CASE

81On September 12, 2014, Petitioner, Octavia Pierson, on

89behalf of and as parent and natural guardian of Kaleah Turner

100(Kaleah), a minor, filed a Petition for Benefits Pursuant to

110Florida Statute Section 766.301 et seq. (Petition) with the

119Division of Administrative Hearings (DOAH) for a determination of

128compensability under the Florida Birth - Related Neurological

136Injury Compensation Plan (Plan). The Petition named Johanne

144Compas - Baril, M.D., as the physi cian providing obstetrical

154services at the birth of Kaleah on September 14, 2009, at Jackson

166North Medical Center located in North Miami Beach, Florida.

175DOAH served NICA with a copy of the Petition on

185September 19, 2014. DOAH served Johanne Yves Compas - Ba ril, M.D.,

197and Jackson North Medical Center on September 22, 2014.

206Neither Johanne Compas - Baril, M.D., nor Jackson North

215Medical Center has petitioned to intervene in this proceeding.

224On March 26, 2015, NICA filed a Motion for Summary Final

235Order, a sserting that Kaleah did not sustain a "birth - related

247neurological injury" as that term is defined in section

256766.302(2), Florida Statutes. On April 1, 2015, Petitioner filed

265an Objection and Response to Motion for Summary Final Order. A

276telephonic motio n hearing was held on April 1 3 , 2015. On May 27,

2902015, Petitioner filed an Amended Response to RespondentÓs Motion

299for Summary Final Order stating that Petitioner does not oppose

309the motion.

311FINDINGS OF FACT

3141. Kaleah Turner was born on September 14 , 2009, at Jackson

325North Medical Center located in North Miami Beach, Florida.

334Kaleah weighed in excess of 2,500 grams at birth.

3442. Donald Willis, M.D. (Dr. Willis), was requested by NICA

354to review the medical records for Kaleah . In a medical report

366dat ed February 26, 2015, Dr. Willis described his findings as

377follows:

378In summary, the mother presented at 36 weeks

386with rupture of the membranes and in labor.

394Although there were some variable FHR

400decelerations during labor, the baby was not

407depressed at bir th. Apgar scores were 9/9.

415Mild respiratory distress was present a few

422hours after birth, and did not require

429intubation. MRI showed subtle abnormalities

434in the white matter adjacent to the lateral

442ventricles.

443I am unsure about the significance of the M RI

453findings. However, the baby was not

459depressed at birth and went to the normal

467nursery, consistent with no significant birth

473related hypoxic event.

476There was no apparent obstetrical event that

483resulted in loss of oxygen or mechanical

490trauma to the bab yÓs brain during labor,

498delivery or the immediate post delivery

504period.

5053. In an affidavit dated March 23, 2015, Dr. Willis

515reaffirmed his opinion that there was no apparent obstetrical

524event that resulted in loss of oxygen or mechanical trauma to the

536b abyÓs brain during labor, delivery or the immediate post -

547delivery period.

5494. NICA retained Michael Duchowny, M.D. (Dr. Duchowny), a

558pediatric neurologist, to examine Kaleah and to review her

567medical records. Dr. Duchowny examined Kaleah on February 25,

5762 015. In an affidavit dated March 18, 2015, Dr. Duchowny opined

588as follows:

590It is my opinion that KALEAH TURNERÓs

597neurological examination reveals no abnormal

602findings. She is developing at age level and

610shows no associated problems with either

616mental or physical abilities.

620A review of her medical records likewise

627discloses no significant findings to suggest

633that a mechanical injury or that a period of

642oxygen deprivation occurred during either

647labor or delivery.

650Based [on] my evaluation and record review , I

658am not recommending KALEAH for inclusion

664within the NICA program.

6685. A review of the file in this case reveals that there

680have been no opinions filed that are contrary to the opinion of

692Dr. Willis that there was no apparent obstetrical event that

702res ulted in loss of oxygen or mechanical trauma to the baby's

714brain during labor, delivery, or the immediate post - delivery

724period, and Petitioner does not oppose NICAÓs Motion for Summary

734Final Order finding that the injury is not compensable under the

745plan. Dr. WillisÓ opinion is credited. There are no contrary

755opinions filed that are contrary to Dr. DuchownyÓs opinion that

765Kaleah is developing at age level and shows no associated

775problems with either mental or physical abilities, and that the

785medical recor ds disclose no significant findings to suggest that

795a mechanical injury or that a period of oxygen deprivation

805occurred during either labor or delivery. Dr. DuchownyÓs opinion

814is credited.

816CONCLUSIONS OF LAW

8196. The Division of Administrative Hearings h as jurisdiction

828over the parties to and the subject matter of these proceedings.

839§§ 766.301 - 766.316, Fla. Stat.

8457. The Plan was established by the Legislature "for the

855purpose of providing compensation, irrespective of fault, for

863birth - related neurologi cal injury claims" relating to births

873occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

8848. The injured infant, her or his personal representative,

893parents, dependents, and next of kin may seek compensation under

903the Plan by filing a claim f or compensation with DOAH.

914§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

922which administers the Plan, has "45 days from the date of service

934of a complete claim . . . in which to file a response to the

949petition and to submit relevant w ritten information relating to

959the issue of whether the injury is a birth - related neurological

971injury." § 766.305(4), Fla. Stat.

9769. If NICA determines that the injury alleged in a claim is

988a compensable birth - related neurological injury, it may award

998co mpensation to the claimant, provided that the award is approved

1009by the administrative law judge to whom the claim has been

1020assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1031disputes the claim, as it has in the instant case, the dispute

1043must be resolved by the assigned administrative law judge in

1053accordance with the provisions of chapter 120, Florida Statutes.

1062§§ 766.304, 766.309, and 766.31, Fla. Stat.

106910. In discharging this responsibility, the administrative

1076law judge must make the follo wing determination based upon the

1087available evidence:

1089(a) Whether the injury claimed is a birth -

1098related neurological injury. If the claimant

1104has demonstrated, to the satisfaction of the

1111administrative law judge, that the infant has

1118sustained a brain or s pinal cord injury

1126caused by oxygen deprivation or mechanical

1132injury and that the infant was thereby

1139rendered permanently and substantially

1143mentally and physically impaired, a

1148rebuttable presumption shall arise that the

1154injury is a birth - related neurologica l injury

1163as defined in s. 766.303(2).

1168(b) Whether obstetrical services were

1173delivered by a participating physician in the

1180course of labor, delivery, or resuscitation

1186in the immediate postdelivery period in a

1193hospital; or by a certified nurse midwife in

1201a teaching hospital supervised by a

1207participating physician in the course of

1213labor, delivery, or resuscitation in the

1219immediate postdelivery period in a hospital.

1225§ 766.309(1), Fla. Stat. An award may be sustained only if the

1237administrative law judge co ncludes that the "infant has sustained

1247a birth - related neurological injury and that obstetrical services

1257were delivered by a participating physician at birth."

1265§ 766.31(1), Fla. Stat.

126911. The term "birth - related neurological injury" is defined

1279in sectio n 766.302(2) as follows:

"1285Birth - related neurological injury" means

1291injury to the brain or spinal cord of a live

1301infant weighing at least 2,500 grams for a

1310single gestation or, in the case of a

1318multiple gestation, a live infant weighing at

1325least 2,000 gram s at birth caused by oxygen

1335deprivation or mechanical injury occurring in

1341the course of labor, delivery, or

1347resuscitation in the immediate postdelivery

1352period in a hospital, which renders the

1359infant permanently and substantially mentally

1364and physically imp aired.

136812. The evidence, which is not refuted, established that

1377there was no apparent obstetrical event that resulted in oxygen

1387deprivation or mechanical trauma to the babyÓs brain in the

1397course of labor, delivery, or in the immediate post - delivery

1408peri od. Further, the evidence established that Ka leah is

1418developing at age level and shows no associated problems with

1428either mental or physical abilities. Therefore, Kaleah is not

1437eligible for benefits under the Plan.

1443CONCLUSION

1444Based upon the foregoing Fi ndings of Fact and Conclusions of

1455Law, it is ORDERED that the Petition filed by Octavia Pierson, on

1467behalf of and as parent and natural guardian of Kaleah Turner, is

1479dismissed with prejudice, and the final hearing scheduled for

1488August 4, 2015, is canceled.
