79STATEMENT OF THE CASE

83On September 16, 2014, Petitioner s , Donta and Kenia Wilson ,

93on behalf of and as parents and natural guardians of Dondraya

104Wilson ( Dondraya ), a minor, filed a Petition for Benefits

115Pursuant t o Florida Statute Section 766.301 et seq. (Petition)

125with the Division of Administrative Hearings (DOAH) for a

134determination of compensability under the Florida Birth - Related

143Neurological Injury Compensation Plan (Plan). On September 30,

1512014, Petitioners filed a letter with the ClerkÓs Office of DOAH

162referencing Dr. William Peters o n as the physician providing

172obstetrical services at the birth of Dondraya on December 11 ,

182201 1 , at Broward Health Medical Cent er (Broward Health) in Fort

194Lauderdale , Florida.

196DOAH served NICA with a copy of the Petition on October 7 ,

208201 4 . DOAH served a copy of the Petition on William Peterson,

221M.D., and Broward Health on November 17, 2014.

229A s of the date of this Summary Final Order of Dismissal,

241neither Broward H ealth no r Dr. Peterson filed a petition to

253intervene into this proceeding.

257On June 15 , 201 5 , NICA filed a Motion for Summary Final

269Order, asserting that Dondraya did not sustain a "birth - related

280neurological injury" as that term is defined in section

289766.302(2), F lorida Statutes. The motion was served by United

299States mail on June 15 , 201 5 .

307An Order to Show Cause was entered on June 30, 2015,

318advising Petitioners to show cause in writing no later than

328Ju ly 17, 2015, why RespondentÓs Motion for Summary Final Orde r

340should not be granted. To date, no response has been filed.

351FINDINGS OF FACT

3541. Dondraya Wilson was born on December 11, 201 1 , at

365Broward Health Medical Center located in Ft. Lauderdale , Florida.

374Dondraya weighed 3, 350 grams at birth.

3812. Donald Willis, M.D. (Dr. Willis), was requested by NICA

391to review the medical records for Dondraya, to determine whether

401an injury occurred in a hospital due to oxygen deprivation or

412mechanical injury occurring in the course of labor, delivery, or

422resuscitation i n the immediate post - delivery period. Dr. Willis

433described his findings in pertinent part as follows in an

443affidavit dated June 2, 2015 :

4494. I have reviewed the medical records for

457the above individual, pages 1 through 5357.

464The mother, Kenia Wilson, was a 29 year old

473G7 P3 with a history of macrosomia and

481shoulder dystocia with her prior pregnancy.

4875. The mother was admitted at 41 weeks for

496delivery due to post - dates and suspected

504fetal macrosomia. Ultrasound on the day of

511delivery gave an estimated f etal weight of 8

520lbs. 6 ozs. Her cervix was long and closed.

529She was not in labor. The decision was made

538to delivery (sic) by Cesarean section rather

545than induction of labor due to prior history

553of shoulder dystocia.

5566. Primary Cesarean section deliver y was

563done with a birth weight of 3,350 grams or 7

574lbs 6 ozs. Meconium stained amniotic fluid

581was present at time of delivery. The baby

589was not depressed at birth. Apgar scores

596were 8/9. U m bilical cord blood gas was

605normal with a pH of 7.29 and a base excess of

616only - 4.

6197. The baby was taken to the newborn nursery

628without apparent problems. Within 24 - hours

635of birth, temperature instability and poor

641feeding were noted and Neonatology

646consultation requested. The baby was

651subsequently transferred to Br oward General

657Hospital on DOL 2.

6618. The baby had a complicated and very long

670newborn hospital course. The initial

675problems were respiratory distress, poor

680muscle tone and poor feeding. Respiratory

686distress was managed with hood and nasal

693oxygen. Poo r muscle tone was a prominent

701feature. Spinal fluid was obtained for

707culture. Cultures were no - growth. Feeding

714tube was surgically placed at about 3 months

722of age due to poor oral feeding.

7299. Seizure activity developed at almost

735three months of age. EEG was abnormal. Two

743MRIÓs of the brain were done and both were

752normal.

75310. Genetic and metabolic evaluation was

759done. Chromosome analysis was normal, but

765microarray identified a deletion in

770chromosome 16.

77211 . In summary, the mother was not in labor

782prior to delivery. Delivery was by Primary

789Cesarean section. The newborn was not

795depressed at birth. Apgar scores were 8/9.

802Umbilical cord blood gas was normal with a pH

811of 7.29. The baby went from delivery room to

820the normal nursery. There were no f indings

828to suggest birth hypoxia. Within the first

835day of life, neurologic problems were

841suspected. MRIÓs of the brain were normal.

848Genetic evaluation identified a deletion of

854chromosome 16.

8561 2 . There was no apparent obstetrical event

865that resulted in loss of oxygen or mechanical

873trauma to the babyÓs brain during labor,

880delivery or the immediate post delivery

886period. The child was identified with a

893chromosome abnormality, which most likely

898explains the neurologic problems.

9023. NICA retained Michael S . Duchowny , M.D. (Dr. Duchowny) ,

912a pediatric neurologist, to examine Dondraya and to review h er

923medical records. Dr. Duchowny examined Dondraya on March 18 ,

9322015 , and opined in pertinent part as follows in his affidavit

943dated June 4, 2015:

94720. In summary , DondrayaÓs neurological

952examination is consistent with severe global

958neurodevelopment delay with a maturation

963level of approximating ages 1 - 2 month s .

973Dondraya evidences hypotonic quadriparesis

977with microcephaly and a cortical visual

983impairment. She addi tionally has a

989longstanding history of medically resistant

994seizures, oromotor dysfunction, pseudobulbar

998palsy and a chronic indwelling gastrotomy

1004tube. There is incidental reactive airway

1010disease. Dondraya therefore has both a

1016substantial mental and moto r impairment.

102221. Review of medical records reveals that

1029DondrayaÓs neurological problems are related

1034to her chromosome disorder and not due to

1042either mechanical injury or oxygen

1047deprivation during labor, delivery or the

1053immediate postnatal period. Dond raya was

1059born at 41 weeks gestation with a birth

1067weight of 7 pounds and had a 1 & 5 minute

1078Apgar scores of 8 & 9.

108422. She did not require intubation at birth

1092and there was no evidence of multiorgan

1099impairment. Furthermore, two MRI scans of

1105the brain per formed at ages 5 days and 2

1115months are within normal limits.

112023. I therefore believe that DondrayaÓs

1126neurological impairment was acquired

1130prenatally and therefore do not recommend her

1137for compensation within the NICA program.

11434 . A review of the file in this case reveals that there

1156have been no expert opinions filed t hat are contrary to the

1168opinion of Dr. Willis that there was no apparent obstetrical

1178event that resulted in loss of oxygen or mechanical trauma to the

1190babyÓs brain during labor, delivery or the immediate post -

1200delivery period. Dr. WillisÓ opinion is credited. There are no

1210expert opinions filed that are contrary to Dr. Duchowny Ós opinion

1221that although Dondraya has both a substantial mental and motor

1231impairment, her neurological impairments ar e related to her

1240chromosome disorder and not due to either mechanical injury or

1250oxygen deprivation during labor, delivery or the immediate

1258postnatal period, but were acquired prenatally. Dr. Duchowny Ós

1267opinion is credited.

1270CONCLUSIONS OF LAW

12735 . The Divi sion of Administrative Hearings has jurisdiction

1283over the parties to and the subject matter of these proceedings.

1294§§ 766.301 - 766.316, Fla. Stat.

13006 . The Plan was established by the Legislature "for the

1311purpose of providing compensation, irrespective of f ault, for

1320birth - related neurological injury claims" relating to births

1329occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

13407 . The injured infant, her or his personal representative,

1350parents, dependents, and next of kin may seek compensation u nder

1361the Plan by filing a claim for compensation with DOAH.

1371§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1379which administers the Plan, has "45 days from the date of service

1391of a complete claim . . . in which to file a response to the

1406petition and to submit relevant written information relating to

1415the issue of whether the injury is a birth - related neurological

1427injury." § 766.305(4), Fla. Stat.

14328 . If NICA determines that the injury alleged in a claim is

1445a compensable birth - related neu rological injury, it may award

1456compensation to the claimant, provided that the award is approved

1466by the administrative law judge to whom the claim has been

1477assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1488disputes the claim, as it has in th e instant case, the dispute

1501must be resolved by the assigned administrative law judge in

1511accordance with the provisions of chapter 120, Florida Statutes.

1520§§ 766.304, 766.309, and 766.31, Fla. Stat.

15279 . In discharging this responsibility, the a dministrati ve

1537l aw j udge must make the following determination based upon the

1549available evidence:

1551(a) Whether the injury claimed is a birth -

1560related neurological injury. If the claimant

1566has demonstrated, to the satisfaction of the

1573administrative law judge, that the i nfant has

1581sustained a brain or spinal cord injury

1588caused by oxygen deprivation or mechanical

1594injury and that the infant was thereby

1601rendered permanently and substantially

1605mentally and physically impaired, a

1610rebuttable presumption shall arise that the

1616injur y is a birth - related neurological injury

1625as defined in s. 766.303(2).

1630(b) Whether obstetrical services were

1635delivered by a participating physician in the

1642course of labor, delivery, or resuscitation

1648in the immediate postdelivery period in a

1655hospital; or by a certified nurse midwife in

1663a teaching hospital supervised by a

1669participating physician in the course of

1675labor, delivery, or resuscitation in the

1681immediate postdelivery period in a hospital.

1687§ 766.309(1), Fla. Stat. An award may be sustained only if the

1699administrative law judge concludes that the "infant has sustained

1708a birth - related neurological injury and that obstetrical services

1718were delivered by a participating physician at birth."

1726§ 766.31(1), Fla. Stat.

17301 0 . The term "birth - related neurologi cal injury" is defined

1743in section 766.302(2) as follows:

"1748Birth - related neurological injury" means

1754injury to the brain or spinal cord of a live

1764infant weighing at least 2,500 grams for a

1773single gestation or, in the case of a

1781multiple gestation, a live inf ant weighing at

1789least 2,000 grams at birth caused by oxygen

1798deprivation or mechanical injury occurring in

1804the course of labor, delivery, or

1810resuscitation in the immediate postdelivery

1815period in a hospital, which renders the

1822infant permanently and substanti ally mentally

1828and physically impaired.

183111 . The evidence, which is not refuted, established that

1841Dondraya did not sustain an injury to the brain or spinal cord

1853caused by oxygen deprivation occurring during labor, delivery, or

1862the immediate post - delivery period. Therefore, Dondraya is not

1872eligible for benefits under the Plan.

1878CONCLUSION

1879Based upon the foregoing Findings of Fact and Conclusions of

1889Law, it is ORDERED that

18941. T he Petition filed by Donta and Kenia W i lson , on behalf

1908of and as parents and n atural guardians of Dondraya W i lson , is

1922dismissed with prejudice.

19252. The final hearing scheduled for August 26, 2015, is

1935cancelled.
