94STATEMENT OF THE CASE

98On September 25, 2014, Petitioners, Raymond D. and Jessica

107Light, individually and on behalf of Owen Light (Owen), a minor,

118filed a Petition Under Protest Pursuant to Florida Statute

127Section 766.301 et seq. (Petition) with the Division of

136Administrative Hearings (DOAH) for a determination of

143compensability under t he Florida Birth - Related Neurological

152Injury Compensation Plan (Plan). The Petition named Thomas

160Enyart, M.D., as the physician providing obstetrical services at

169the birth of Owen on November 26, 2013, at Florida Hospital

180Altamonte in Altamonte Springs, F lorida.

186DOAH served NICA and Florida Hospital Altamonte with a copy

196of the Petition on October 7, 2014. DOAH served a copy of the

209Petition on Thomas Enyart, M.D., on October 6, 2014.

218On October 16, 2014, Adventist Health Systems/Sunbelt Inc.,

226d/b/a Florida Hospital Altamonte and Thomas Enyart, M.D. , filed a

236Petition to Intervene which was granted by Order dated

245October 24, 2014.

248On January 21, 2015, NICA filed a Motion for Summary Final

259Order, asserting that Owen did not sustain a "birth - related

270neu rological injury" as that term is defined in section

280766.302(2), Florida Statutes. Intervenors filed a Response in

288opposition. The Motion for Summary Final Order was denied without

298prejudice by Order dated February 6, 2015.

305On August 3, 2015, NICA filed a Renewed Motion for Summary

316Final Order. On August 12, 2015, Intervenors filed a Notice of

327Non - opposition to NICAÓs Renewed Motion for Summary Final Order.

338No response to the Motion was filed by Petitioners.

347FINDINGS OF FACT

3501. Owen Light was born on November 26, 2013, at Florida

361Hospital Altamonte located in Altamonte Springs, Florida. Owen

369weighed 3,980 grams at birth.

3752. Donald Willis, M.D. (Dr. Willis), was requested by NICA

385to review the medical records for Owen, to determine whether an

396injur y occurred in a hospital due to oxygen deprivation or

407mechanical injury occurring in the course of labor, delivery, or

417resuscitation in the immediate post - delivery period.

4253. Dr. Willis described his findings in pertinent part as

435follows in a medical re port dated November 3, 2014:

445In summary, there was no obvious distress

452during labor or delivery. The newborn was not

460depressed. Apgar scores were 9/9. The

466initial exam in the nursery noted some

473decreased muscle tone, but no acute distress.

480The baby was a pparently doing well until

488about 12 - hours after birth, when seizure

496activity was noted. Imaging studies showed

502venous thrombosis in the dural sinus.

508There was no apparent obstetrical event that

515resulted in loss of oxygen or mechanical

522trauma to the babyÓ s brain during labor,

530delivery or the immediate post - delivery

537period. The baby suffered brain injury, as

544indicated by the abnormal EEG and imaging

551studies of a venous thrombosis in the dural

559sinus. However, the brain injury does not

566appear to be related to either mechanical

573trauma or hypoxic injury during labor,

579delivery or the immediate post - delivery

586period.

5874. Dr. Willis reaffirmed his opinion in an affidavit dated

597January 20, 2015, that there was no apparent obstetrical event

607that resulted in loss of oxygen or mechanical trauma to the

618babyÓs brain during labor, delivery or the immediate post

627delivery period.

6295. NICA retained Laufey Y. Sigurdardottir, M.D.

636(Dr. Sigurdardottir), a pediatric neurologist, to examine Owen

644and to review h is medical recor ds. Dr. Sigurdardottir examined

655Owen on July 22, 2015, and opined in pertinent part as follows in

668an affidavit dated August 3, 2015:

6745. The opinions expressed in my Report are

682accurate and my opinions are as follows:

689A. The patient is found to have a p ermanent

699substantial mental and physical impairment

704and is overall functioning at approximately a

7117 - 9 month level at the biologic age of 19 - 20

724months. He is noted to have hypotonia,

731d elayed gross and fine motor skills, a past

740history of epilepsy, delayed visual

745maturation, although no periods of stagnation

751or developmental regression have been noted.

757B. There is little evidence from the records

765that we have reviewed to suggest a perinatal

773ischemic or mechanical injury as the cause

780for his delays. Prenat al care was complete

788and documentation during the vaginal delivery

794was continuous revealing only 2 brief periods

801of mild fetal heart rate deceleration. Upon

808delivery, there was no indication of an acute

816ischemic event with normal Apgar scores of 9

824after 1 minute and 9 after 5 minutes. There

833is documentation from a consulting genetic i st

841that mom described possible prenatal seizure -

848like events, alth ough a clear description was

856not given. The patient certainly had an

863abnormal immature EEG and seizure activi ty

870that continued for a few weeks. MRI findings

878have not been consistent with a profound

885ischemic event, in fact been completely

891normal. At this time, it is more likely that

900Owen has delays in his gross and fine motor

909skills as well as delayed cognitive

915development due to a congenital disorder that

922seems non - progressive in nature. He seems to

931be receiving excellent care provided to him

938by his parents and caretakers.

943C. At this time, it is difficult to measure

952OwenÓs global cognition but based on acquir ed

960skills he functions at a 7 - 8 month level at

971the age of 19 months. This would be

979considered a developmental quotient of 40 - 45.

987His life expectancy is not felt to be limited

996if he shows ongoing developmental progress.

1002He is likely to need lifelong care.

10096. I therefore am not recommending Owen to

1017be included into the NICA program.

10236. A review of the file in this case reveals that there

1035have been no expert opinions filed that are contrary to the

1046opinion of Dr. Willis that there was no apparent obstetric al

1057event that resulted in loss of oxygen or mechanical trauma to the

1069babyÓs brain during labor, delivery or the immediate post -

1079delivery period. Dr. WillisÓ opinion is credited. There are no

1089expert opinions filed that are contrary to Dr. SigurdardottirÓs

1098opinion that although Owen has both a substantial mental and

1108physical impairment, it is more likely that his neurological

1117impairments are due to a congenital disorder and not due to

1128either mechanical injury or oxygen deprivation during labor,

1136delivery or t he immediate post - delivery period.

1145Dr. SigurdardottirÓs opinion is credited.

1150CONCLUSIONS OF LAW

11537. The Division of Administrative Hearings has jurisdiction

1161over the parties to and the subject matter of these proceedings.

1172§§ 766.301 - 766.316, Fla. Stat.

11788. The Plan was established by the Legislature "for the

1188purpose of providing compensation, irrespective of fault, for

1196birth - related neurological injury claims" relating to births

1205occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.

12169. The in jured infant, her or his personal representative,

1226parents, dependents, and next of kin may seek compensation under

1236the Plan by filing a claim for compensation with DOAH.

1246§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,

1254which administers the Plan, has "45 days from the date of service

1266of a complete claim . . . in which to file a response to the

1281petition and to submit relevant written information relating to

1290the issue of whether the injury is a birth - related neurological

1302injury." § 766.30 5(4), Fla. Stat.

130810. If NICA determines that the injury alleged in a claim

1319is a compensable birth - related neurological injury, it may award

1330compensation to the claimant, provided that the award is approved

1340by the administrative law judge to whom the clai m has been

1352assigned. § 766.305(7), Fla. Stat. If, on the other hand, NICA

1363disputes the claim, as it has in the instant case, the dispute

1375must be resolved by the assigned administrative law judge in

1385accordance with the provisions of chapter 120, Florida S tatutes.

1395§§ 766.304, 766.309, and 766.31, Fla. Stat.

140211. In discharging this responsibility, the administrative

1409law judge must make the following determination based upon the

1419available evidence:

1421(a) Whether the injury claimed is a birth -

1430related neurolo gical injury. If the claimant

1437has demonstrated, to the satisfaction of the

1444administrative law judge, that the infant has

1451sustained a brain or spinal cord injury

1458caused by oxygen deprivation or mechanical

1464injury and that the infant was thereby

1471rendered per manently and substantially

1476mentally and physically impaired, a

1481rebuttable presumption shall arise that the

1487injury is a birth - related neurological injury

1495as defined in s. 766.303(2).

1500(b) Whether obstetrical services were

1505delivered by a participating phys ician in the

1513course of labor, delivery, or resuscitation

1519in the immediate postdelivery period in a

1526hospital; or by a certified nurse midwife in

1534a teaching hospital supervised by a

1540participating physician in the course of

1546labor, delivery, or resuscitation i n the

1553immediate postdelivery period in a hospital.

1559§ 766.309(1), Fla. Stat. An award may be sustained only if the

1571administrative law judge concludes that the "infant has sustained

1580a birth - related neurological injury and that obstetrical services

1590were de livered by a participating physician at birth."

1599§ 766.31(1), Fla. Stat.

160312. The term "birth - related neurological injury" is defined

1613in section 766.302(2) as follows:

"1618Birth - related neurological injury" means

1624injury to the brain or spinal cord of a live

1634infant weighing at least 2,500 grams for a

1643single gestation or, in the case of a

1651multiple gestation, a live infant weighing at

1658least 2,000 grams at birth caused by oxygen

1667deprivation or mechanical injury occurring in

1673the course of labor, delivery, or

1679resu scitation in the immediate postdelivery

1685period in a hospital, which renders the

1692infant permanently and substantially mentally

1697and physically impaired.

170013. The evidence, which is not refuted, established that

1709Owen did not sustain an injury to the brain o r spinal cord caused

1723by oxygen deprivation occurring during labor, delivery, or the

1732immediate post - delivery period. Therefore, Owen is not eligible

1742for benefits under the Plan.

1747CONCLUSION

1748Based upon the foregoing Findings of Fact and Conclusions of

1758Law, it is ORDERED that

17631. The Petition Under Protest filed by Raymond D . and

1774Jessica Light, individually and on behalf of Owen Light, is

1784dismissed with prejudice.

17872. The final hearing scheduled for September 29, 2015, is

1797cancelled.
