105PRE LIMINARY STATEMENT

108On April 10, 2014, Petitioner filed a Charge of

117Discrimination ("Complaint") with FCHR alleging: that the

126District School Board of Putnam County ("Respondent") refused to

137hire him because of his age; and that Respondent retal iat ed

149agai nst him after he objected to the discriminatory treatment.

159Following its investigation of the Complaint, FCHR notified the

168parties that there was "no reasonable cause to believe that an

179unlawful employment practice occurred."

183Petitioner elected to pursu e administrative remedies,

190timely filing a Petition for Relief with FCHR on or about

201October 1, 2014. Subsequently, on October 6, 2014, FCHR

210referred the matter to the Division of Administrative Hearings

219("DOAH") for further proceedings. The remainder of this case's

230procedural history is contained in the following Findings of

239Fact.

240FINDINGS OF FACT

2431. By Notice dated October 16, 2014, the final hearing was

254scheduled for December 15, 2014, at 9:30 a.m.

2622. Although the undersigned convened the final hea ring on

272the date and time indicated in the Notice, neither Petitioner

282nor counsel for Respondent was present.

2883. As of 10:00 a.m., Petitioner had not appeared or

298contacted DOAH. At that point, the undersigned announced that,

307in light of Petitioner's non appearance, the hearing would be

317adjourned and that a recommended orde r of dismissal would issue.

328CONCLUSIONS OF LAW

3314. DOAH has personal and subject matter jurisdiction in

340this proceedi ng pursuant to sections 120.569 and 120.57(1),

349Florida Statutes (201 4).

3535. The Florida Civil Rights Act of 1992 ("the FCRA"),

365chapter 760, Florida Statutes, prohibits discrimination in the

373workplace. In relevant part, the FCRA provides:

380(1) It is an unlawful employment practice

387for an employer:

390(a) To discharge or to fail or refuse to

399hire any individual, or otherwise to

405discriminate against any individual with

410respect to compensation, terms, conditions,

415or privileges of employment, because of such

422individual's race, color, religion, sex,

427national origin, age, handicap , or marital

433status.

434* * *

437(7) It is an unlawful employment practice

444for an employer, an employment agency, a

451joint labor - management committee, or a labor

459organization to discriminate against any

464person because that person has opposed any

471practice which is an unlawful employment

477practice under this section, or because that

484person has made a charge, testified,

490assisted, or participated in any manner in

497an investigation, proceeding, or hearing

502under this section.

505§ 760.10(1)(a) & (7), Fla. Stat.

5116. As noted previously, the Complaint alleges that

519Respondent violated the foregoing provisions by refusing to hire

528Petitioner because of his age, and by engaging in retaliation

538after Petitioner objected to the discriminatory treatment.

545Petitioner bears the bu rden of proof as to each issue. See Kidd

558v. Mando Am. Corp. , 731 F.3d 1196, 1202 (11th Cir. 2013);

569Ha ir ston v. Gainesville Sun Publ'g Co. , 9 F.3d 913, 919 (11th

582Cir. 1993).

5847. Petitioner failed to present direct or circumstantial

592evidence tending to p rove that Respondent committed the unlawful

602acts of discrimination alleged in the Complaint. Consequently,

610the Petition for Relief must be dismissed. See Dotson v. Dep't

621of Fin. Servs. , DOAH Case No. 09 - 2386 (Fla. DOAH Jan. 26, 2011;

635FCHR Apr. 13, 2011)( dismissing petition for relief where

644petitioner failed to appear at final hearing).

651RECOMMENDATION

652Based on the foregoing Findings of Fact and Conclusions of

662Law, it is RECOMMENDED that the Florida Commission on Human

672Relations enter a final order dismissi ng the Petition for

682Relief.
