50THIS CAUSE came on for consideration before the Agency for Health Care Administration

63("the Agency"), which finds and concludes as follows:

731. The Agency issued the Petitioner a letter denying his application for exemption from

87disqualification from employment. (Exhibit A).

922. The Petitioner requested a formal administrative hearing, and his petition was sent to the

107Division of Administrative Hearings (DOAH).

1123. The Petitioner subsequently filed a Motion to Rescind Petition for Formal Hearing with

126DOAH (Exhibit B), and DOAH closed its file and relinquished jurisdiction to the Agency (Exhibit C).

1424. The denial of the Petitioner's application for exemption from disqualification from

154employment is UPHELD.

1575. This Final Order is entered without prejudice to Petitioner reapplying for an exemption

171from disqualification from employment in the future.
