198The issue in this case is whether Intervenor s provided

208notice as required by section 766.316, Florida Statutes, on

217behalf of both the hospital , and the physicians and nurse

227midwives , rendering ob stetrical services to Petitioner,

234Miranda E. Price.

237PRELIMINARY STATEMENT

239On October 24, 2014, Petitioners, John Garrett Price and

248Miranda E. Price, on behalf of and as parents and natural

259guardians of Aurora Price (Aurora), a minor, filed a Petition

269Under Protest Pursuant to Florida Statute Section 766.301 et

278seq. (Petition) with DOAH.

282The Petition provided that Shireen Madani Sims, M.D. was

291the physician providing obstetric services at the birth of

300Aurora, who was born at the University of Florida Healt h Shands

312Hospital (Shands). DOAH served the Florida Birth - Related

321Neurological Injury Compensation Association (Association or

327NICA ) with a copy of the Petition on October 31, 2014. DOAH

340served copies of the Petition on Dr. Sims on November 3, 2014 ,

352and on Shands on November 19, 2014.

359On November 24, 2014, Petitions to Intervene were filed by

369the University of Florida Board of Trustees and by Shands

379Teaching Hospital and Clinics, Inc., d/b/a University of Florida

388Health Shands Hospital. Those Petitions to Intervene were

396granted by Order dated December 9, 2014.

403On August 27, 2015, Respondent filed a Motion for Summary

413Final Order, alleging that Aurora sustained a birth - related

423neurological injury as defined in section 766.302(2) , Florida

431Statutes . On October 28, 2015, an Amended Partial Summary Final

442Order was entered, finding that Aurora sustained a birth - related

453neurological injury, which is compensable under the Florida

461Birth - Related Neurological Injury Compensation Plan (Plan).

469Jurisdiction was re tained on the issues of notice and award.

480The final hearing, which was scheduled for January 13,

4892016, was continued and rescheduled for February 26, 2016.

498On February 23, 2016, the parties filed a Pre - h earing

510Stipulation and on February 24, 2016, filed an Amended Pre -

521h earing Stipulation.

524The f inal h earing was held on February 26, 2016. At the

537final hearing, the Ðadmitted factsÑ in paragraph (e) of the

547Amended Pre - h earing Stipulation were admitted into evidence.

557Joint Exhibits A through I were offered in to evidence.

567Petitioners objected, asserting lack of authenticity of the

575documents in the Joint Exhibits that purportedly bore the

584signature of Petitioner, Miranda E. Price ( Ms. Price or

594patient) . The undersigned considered the Certificates of

602Authenticit y (IntervenorsÓ Composite Hearing Exhibits 1 and 2,

611also found in Joint Exhibits A052 and I001) and the testimony of

623Marianne McGuinness - Gargano, the medical records custodian.

631PetitionersÓ objection was overruled, and Joint Exhibits A

639through I, includin g all of the documents bearing Ms. PriceÓs

650signature, were admitted into ev idence. IntervenorsÓ Exhibit

658D - 49 was also received in evidence.

666In addition to Ms. McGuinness - Gargano, the following

675witnesses were called at the f inal h earing: Ms. Price ; her

687husband, John Garrett Price (Mr. Price) ; Shayla Campbell,

695(Ms. Campbell) ; and Beverly Watson Littles, LPN (Nurse Littles).

704The deposition testimony of Robin E. Cunningham, RN was offered

714in lieu of her live testimony.

720The Transcript of the final hearing w as filed by the court

732reporter, as instructed, on March 16, 2016. The parties agreed

742to file their proposed final orders within 30 days of the filing

754of the transcript. Intervenors filed their Proposed Final Order

763on April 14, 2016, and on April 15, 2016 , Respondent filed a

775Notice of Joinder in IntervenorsÓ Proposed Final Order.

783On May 13, 2016 , Petitioners filed a Motion for Extension

793of Time to File Proposed Order and Recommendation, stating that

803the attorneys of the firm representing Petition ers had been in

814Ohio for a five - week trial, and had just returned to Florida on

828May 12, 2016. The motion represented that counsel for

837Petitioners had conferred with counsel for both Respondent and

846Intervenors, and that neither party objected to the requested

855exte nsion. The same day the motion for extension of time was

867filed, the undersigned entered an O rder granting the extension

877to May 20, 2016.

881Petitioners filed a Joint Proposed Order and Recommendation

889on May 23, 2016. Although PetitionersÓ P roposed O rder was

900untimely filed, it has nonetheless been considered by the

909undersigned in the preparation of this Final Order. On June 1,

9202016, Intervenors filed a Joint Response and Exceptions to

929PetitionersÓ Joint Proposed Order and Recommendation. Inasmuch

936as this fi ling was neither authorized by rule, or by order of

949the undersigned, it has not been considered in the preparation

959of this Final Order.

963FINDINGS OF FACT

9661 . From approximately April 2008 through the delivery of

976Aurora Price in May 2012, Ms. Price was emp loyed by the

988University of Florida (U.F.) College of Pharmacy as an editor

998and writer in the medicinal chemistry section where she wrote

1008and edited papers and grants, including academic scholarly

1016articles.

10172 . By virtue of her education, training, and exp erience in

1029linguistics, editing, and grant writing and editing for

1037professional publications, her custom and habit was to pay close

1047attention to the written word and to read documents prior to

1058signing them.

10603 . When Ms. Price believed that she may have be en

1072pregnant, she chose to have her prenatal care and delivery

1082performed by U.F. physicians and desired to have her infant born

1093at Shands, motivated by her having graduated from U.F. and by

1104her employment with U.F.

11084 . During the course of her pregnancy, M s. Price received

1120her prenatal care at the U.F. Magnolia Park OB/GYN clinic

1130(prenatal clinic) in Gainesville.

11345 . From her initial visit at the prenatal clinic on

1145September 21, 2011 , through the delivery of her daughter,

1154Aurora, Ms. Price knew that her pre natal care would be provided

1166by U.F. physicians and that her infant would be delivered by

1177U.F. physicians at Shands.

11816 . The prenatal clinic changed its name, subsequent to the

1192prenatal care Ms. Price received , to U.F. Health WomenÓs

1201Clinic -- Springhill , and also changed its location.

12097 . Ms. PriceÓs first visit to the prenatal clinic occurred

1220on September 21, 2011. During that visit , Ms. Price physically

1230received from the prenatal clinic check - in staff (unit clerk)

1241two NICA ÐPeace of MindÑ brochures (N ICA brochures) stapled to a

1253Notice to Obstetrics Patient form (NICA acknowledgment form).

12618 . The NICA acknowledgment form contained a ÐUniversity of

1271Florida PhysiciansÑ identifier at the top left corner and in

1281pertinent part, relevant to the NICA notice issue , contained the

1291words:

1292PHYSICIAN NOTICE TO OBSTETRIC PATIENT

1297(See section 766.316, Florida Statutes)

1302I have been furnished information on behalf

1309of all University of Florida College of

1316Medicine Physicians and certified midwives

1321who practice obstetri cs or perform

1327obstetrics services, which has been prepared

1333by the Florida Birth - Related Neurological

1340Injury Compensation Association (NICA). I

1345have also been advised that the University

1352of Florida College of Medicine physicians

1358and certified midwives who practice

1363obstetrics or perform obstetric services are

1369participating physicians in that program,

1374wherein certain limited compensation is

1379available in the event certain neurological

1385injury may occur during labor, deliver, or

1392resuscitation. For specifics on the

1397program, I understand I may contact the

1445HOSPITAL NOTICE TO OBSTETRIC PATIENT

1450(See section 766.316, Florida Statutes)

1455I have been furnished information prepared

1461by the Florida Birth - Related Neurological

1468Injury Compensation Association (NICA) on

1473behalf of Shands Teach ing Hospital and

1480Clinics, Inc., d/b/a Shands at the

1486University of Florida. For specifics on the

1493program, I understand I may contact the

1500Florida Birth - Related Neurological Injury

1506Compensation Association (NICA), Post Office

1511Box 14567, Tallahassee, Florida 32317 - 4567,

15181 - 800 - 398 - 2129. I specifically acknowledge

1528that I have received a copy of the brochure

1537prepared by NICA.

15409 . Additionally, Ms. Price physically received from the

1549unit clerk a genetic screening form, a U . F . Health Cystic

1562Fibrosis Screening for m, and a Healthy Start form.

157110 . On this initial prenatal visit of September 21, 2011,

1582after Ms. Price finished her business with the unit clerk and

1593financial staff member, Mr. and Ms. Price met with Nurse Littles

1604between 20 and 45 minutes. Nurse Little s had worked at the

1616prenatal clinic in the same position since 2005.

162411 . While at hearing , Nurse Littles did not have an

1635independent recollection of seeing the patient . S he did make

1646charting entries regarding the patientÓs visit.

165212 . During the Price sÓ vis it of September 21, 2011,

1664Nurse Littles followed her customary and habitual routine that

1673was required by the prenatal clinic. In order to ensure that

1684the required routine was followed, Nurse Littles used a

1693checklist which has a section for circling ÐNICAÑ after Nurse

1703Littles confirmed that patients received the NICA brochure and

1712signed the NICA acknowledgment form.

171713 . A summary of Nurse LittlesÓ customary and habitual

1727routine , required by the prenatal clinic , that she followed

1736(approximately 15 tim es per week since 2005) on Ms. PriceÓs

1747initial prenatal visit on September 21, 2011, included the

1756following steps which are relevant to the NICA notice issue:

1766• The patient gives to Nurse Littles the two NICA

1776Brochures stapled to the NICA acknowledgment form ,

1783as well as the Healthy Start, genetic testing, and

1792cystic fibrosis forms that the unit clerk provided

1800to the patient.

1803• Nurse Littles takes the patientÓs blood pressure,

1811height and weight, talks to the patient and takes

1820down the patientÓs health informati on, updates the

1828patientÓs records, and ensures that the patientÓs

1835records are in order and that the patient is

1844prepared for the first visit with the U.F. physician

1853or physicians who will be providing the patientÓs

1861obstetrical care.

1863• If the NICA acknowledg ment form was signed prior to

1874Nurse Littles having met the patient, Nurse Littles

1882will witness the patientÓs signatures in the section

1890pertaining to U.F. physicians and in the section

1898pertaining to Shands, after she explains the form.

1906She then affixes her signature in the two witness

1915places indicated under the notice provisions for

1922U.F. (physicians) and for Shands (Hospital). If the

1930NICA acknowledgment form was not signed prior to

1938Nurse Littles meeting with the patient, Nurse

1945Littles, after explaining the form, witnesses the

1952patientÓs signing the form and then signs her name

1961as witness in the sections for both the U.F.

1970(physicians) and Shands (Hospital).

1974• Nurse Littles advises the patient that the NICA

1983brochures attached to the NICA acknowledgment form

1990are given on behalf of the U.F. physicians who will

2000be providing obstetrical care for the patient, and

2008are also given on behalf of Shands.

2015• After witnessing the patientÓs signature, Nurse

2022Littles detaches the NICA brochures from the NICA

2030a c knowledgment form and gives the two brochures back

2040to the patient.

2043• Nurse Littles gives the patient a general

2051explanation that the NICA brochures contain

2057information that explain where the patient can go

2065for help if something unexpected happen s during the

2074birth of the child . She does not go into detail

2085regarding rights and limitations of the NICA plan.

2093She does not go into the legalities of the NICA

2103program .

2105• Nurse Littles advises all patients to read the NICA

2115brochure and tells the patient that if the patient

2124ha s more que stions to let her know.

2133• Nurse Littles advises the patient that the prenatal

2142clinic provides care for patients only if the

2150patient is to deliver her child at Shands.

2158• After completing the review of the documents and

2167conversation with the patient, Nurse Lit tles enters

2175an electronic note into the electronic medical

2182record concerning the intake visit. She also takes

2190several documents, including the NICA acknowledgment

2196form to the chart room in the clinic and places them

2207in a box designated for them to be scan ned into the

2219electronic record.

222114 . Nurse LittlesÓ testimony regarding her customary and

2230habitual routine at the clinic is credible. Accordingly, the

2239undersigned finds that during Ms. PriceÓs visit to the prenatal

2249clinic on September 21, 2011, Nurse Litt les followed her

2259customary and habitual routine, required by the prenatal clinic.

226815 . Pertinent to the NICA notice issue, the undersigned

2278finds that Nurse Littles, in accordance with her customary,

2287habitual, and routine practice, and as required by the pr enatal

2298clinic process, took from Ms. Price the NICA brochures attached

2308to the NICA acknowledgment form and witnessed Ms. PriceÓs

2317signature on the NICA acknowledgment form in the two places on

2328the form on behalf of U.F. physicians and Shands.

233716 . The unde rsigned also finds that Nurse Littles advised

2348Ms. Price to read the NICA acknowledgment form prior to her

2359witnessing Ms. PriceÓs signature, and then removed the NICA

2368brochures from the form and returned them to Ms. Price.

237817 . Nurse Littles credibly testi fied that she placed the

2389signed NICA acknowledgment form , along with the genetics forms ,

2398in the scanning box at the prenatal clinic for them to be

2410scanned. Inexplicably, the NICA acknowledgment form and genetic

2418form were not scanned into the e lectronic me dical record of

2430Ms. Price, and their whereabouts are unknown.

243718 . Nurse Littles Ó testimony regarding the NICA

2446acknowledgement form is corroborated in her Progress Notes

2454relating to Ms. PriceÓs visit of September 21, 2011. Her

2464Progress Notes specifically reflect ÐHer NICA and

2471Genetics forms are scanned , Ñ indicating that Nurse Littles had

2481placed the forms in the scanning box to be scanned by other

2493employees. Again, it is unknown why these forms were not

2503electronically scanned.

250519 . At the September 21, 2 011 , prenatal visit, Ms. Price

2517was also advised by Nurse Littles that she was being assigned to

2529Sharon Young Byun, M.D. (Dr. Byun) , for prenatal care. Nurse

2539Littles advised Ms. Price that the prenatal clinic only cared

2549for patients who se child would be de livered by the U.F. clinic

2562physicians at Shands.

256520 . Ms. Price first met with Dr. Byun on September 29,

25772011 , for a prenatal visit at the prenatal clinic. Dr. Byun at

2589all material times was a U . F . physician and a NICA participating

2603physician.

260421 . On No vember 4, 2011, M s. Price presented to the

2617Parke Avenue Imaging Center, a Shands radiology facility, but

2626not on the Shands hospital grounds. She was there solely for

2637breast imaging because of an abnormality identified earlier.

2645She was not there for pregn ancy - related diagnostics, care, or

2657treatment. At this radiology appointment, Ms. Price was not

2666provided NICA brochures and did not sign a NICA acknowledgment

2676form. She did sign a Consent and Authorization form.

268522 . On April 18, 2012, Ms. Price believed that her

2696membranes were leaking and presented to Shands for obstetrical

2705care.

270623 . Ms. Campbell served as a unit clerk in the Labor and

2719Delivery department at Shands from approximately April or

2727May 2011 through April or May 2013. Ms. Campbell was on dut y

2740April 18, 2012 , when Ms. Price came to Shands for obstetrical

2751care.

275224 . By virtue of her training and ShandsÓ required

2762practice, Ms. Campbell had a customary and habitual routine that

2772included the following steps to check in a labor and delivery

2783patient at Shands:

2786• Ms. Campbell signs in the patient and creates a

2796patient account by taking personal identification

2802and demographic information and verifies the

2808patientÓs identity with the patientÓs identification

2814document.

2815• Ms. Campbell assembles three documen ts on a

2824clipboard: the NICA brochure which is on top, the

2833C onsent and Authorization form beneath the brochure,

2841and finally the NICA acknowledgment form.

2847• Ms. Campbell goes over the NICA brochure with the

2857patient and advises the patient that the patient

2865w ill be asked to sign the NICA acknowledgment form

2875for the brochure . She advises that the NICA

2884brochure has information that explains what NICA

2891does if the baby suffers injury during the delivery.

2900She advises the patients of the telephone number on

2909the NI CA brochure which the patient can call if the

2920patient has questions. During this process, she

2927further advises and urges the patient to read the

2936brochure.

2937• Aft er discussing the brochure, Ms. Campbell goes

2946over the NICA acknowledgment form and again advises

2954and urges the patient to read the form. When the

2964patient indicates that they read the form, the

2972patient signs the form and Ms. Campbell witnesses

2980their signature in two places Î - one place for the

2991hospital notice and one place for the physician

2999notice. Sh e places her signature in the witness

3008spaces on the form. She advises the patient the

3017NICA acknowledgment form contains information

3022regarding the protections for the hospital and for

3030the physicians, if something happens to the infant

3038during its birth. Ms . Campbell next has the patient

3048read and sign the Consent and Authorization form,

3056which is a document with duplicate pages.

3063Ms. Campbell witnesses the signature by affixing her

3071signature or initial on the Consent and

3078Authorization form.

3080• The patient keeps the NICA brochure and a copy of

3091the Consent and Authorization form, but Ms. Campbell

3099retains the NICA acknowledgment form which is placed

3107into a folder and is given to the labor and delivery

3118nurse assigned to the patient.

312325 . Ms. CampbellÓs testimony at h earing credibly

3132established that she followed her customary, habitual, and

3140routine practice when she provided documents, including a single

3149NICA brochure, a NICA acknowledgment form, and a Consent and

3159Authorization form to Ms. Price when she checked into the labor

3170and delivery area (referred to as the triage area) on April 18,

31822012.

318326 . Ms. Campbell urged and otherwise encouraged Ms. Price

3193to read the NICA brochure, NICA acknowledgment form, and Consent

3203and Authorization forms.

320627 . The evidence establi s hed that on April 18, 2012,

3218Ms. Price signed the NICA ac knowledgment form in two places Î - the

3232hospital notice section and the physician notice section.

324028 . Ms. Campbell witnessed both the NICA acknowledgment

3249form of April 18, 2012 , and the Consent and Aut horization form

3261of April 18, 2012, by affixing her signature in two places on

3273the NICA acknowledgment form (the Hospital and U.F. sections)

3282and by affixing her initials ÐSCÑ on the Consent and

3292Authorization form.

329429 . The NICA acknowledgment form , which is signed by

3304Ms. Campbell in two places (Joint Exhibit D049) - Î one under the

3317hospital notice and one under the U . F . physician notice ,

3329contained the following language:

3495program, and that limited compensation is

3501available in the event certain neurological

3507injury may occur during labor, delivery or

356730 . On April 18, 2012, after Ms. Campbell completed her

3578business with Ms. Price, she gave the labor and delivery

3588departmen t nurse, Robin Cunningham, RN (Nurse Cunningham), the

3597NICA acknowledgment form executed by Ms. Price and witnessed by

3607Ms. Campbell.

360931 . Nurse Cunningham reviewed the NICA acknowledgment form

3618and checked off an entry into Ms. PriceÓs medical record that

3629r eads, ÐNICA Signature Obtained/On File,Ñ meaning that she

3639personally viewed the NICA acknowledgment form that was executed

3648by Ms. Price and witnessed by Ms. Campbell on April 18, 2012,

3660prior to checking off on the medical record entry.

366932 . Nurse Cunningh am w as the nurse who discharged

3680Ms. Price from labor and delivery triage on April 18, 2012.

3691Nurse Cunningham witnessed Ms. PriceÓs signing the Outpatient

3699Obstetrical Information and Instruction sheet on April 18, 2012.

370833 . On May 4, 2012, Ms. Price prese nted to Shands l abor

3722and d elivery triage for admission for delivery. At that time

3733Ms. Price signed a NICA acknowledgment form given to her by the

3745unit clerk. She signed it in two places - Î one under the hospital

3759notice on the form and one under the U.F. ph ysician notice on

3772the form. The language on the May 4, 2012 , NICA acknowledgment

3783form was the same as the language on the form signed by Ms.

3796Price on April 18, 2012.

380134 . Ms. Price delivered h er infant, Aurora Price, on

3812May 5, 2012. The attending ph ysic ian at the delivery was

3824Dr. Sims, who is, and was at the time of AuroraÓs delivery, a

3837University of Florida NICA participating physician.

384335 . The greater weight of the evidence established that on

3854September 21, 2011 ; April 18, 2012 ; and May 4, 2012, Inter venors

3866provided the notice required by section 7 66.316 on behalf of

3877Dr. Sims and Shands.

3881CONCLUSIONS OF LAW

388436 . The Division of Administrative Hearings has

3892jurisdiction over the parties to and the subject matter of this

3903proceeding. §§ 766.301 - 766.316, Fl a. Stat. (2016).

391237 . The only issue that was to be determined in the final

3925hearing is whether notice was provided pursuant to section

3934766.316, which provides:

3937Each hospital with a participating physician

3943on its staff and each participating

3949physician, othe r than residents, assistant

3955residents, and interns deemed to be

3961participating physicians under

3971Related Neurological Injury Compensation

3975Plan shall provide notice to the obstetrical

3982patients as to the limited no - fau lt

3991alternative for birth - related neurological

3997injuries. Such notice shall be provided on

4004forms furnished by the association and shall

4011include a clear and concise explanation of a

4019patientÓs rights and limitations under the

4025plan. The hospital or the partic ipating

4032physician may elect to have the patient sign

4040a form acknowledging receipt of the notice

4047form. Signature of the patient

4052acknowledging receipt of the notice form

4058raises a rebuttable presumption that the

4064notice requirements of this section have

4070been met. Notice need not be given to a

4079patient when the patient has an emergency

4086med ical condition as defined in

4092s. 395.002(8)(b) or when notice is not

4099practicable.

410038 . Section 395.002(8)(b) defines "emergency medical

4107condition" as follows:

4110(8) "Emergency medical condition" means:

4115* * *

4118(b) With respect to a pregnant woman:

41251. That there is inadequate time to effect

4133safe transfer to another hospital prior to

4140delivery;

41412. That a transfer may pose a threat to the

4151health and safety of the patien t or fetus;

4160or

41613. There is evidence of the onset and

4169persistence of uterine contractions or

4174rupture of the membranes.

417839 . Section 766.309(1)(d) provides:

4183(1) The administrative law judge shall make

4190the following determination based upon all

4196available evidence:

4198* * *

4201(d) Whether if raised by the claimant or

4209other party, the factual determinations

4214regarding the notice requirements in

4219s. 766.316 are satisfied. The

4224administrative law judge has the exclusive

4230jurisdiction to make these factual

4235d eterminations.

423740 . Petitioners contend that Dr. Sims and Shands did not

4248give sufficient notice pursuant to section 766.316. Intervenors

4256contend that sufficient notice w as provided pursuant to

4265section 766.316. As the proponent of the proposition that

4274ap propriate notice was given or that notice was not required,

4285the burden on the issue of notice is upon the Intervenors. Tabb

4297v. Fla. Birth - Related Neurological Injury Comp. Ass'n. , 880 So.

43082d 1253, 1257 (Fla. 1st DCA 2004).

431541 . Although Nurse Littles doe s not independently remember

4325her encounter with Ms. Price on September 21, 2011, she follows

4336her normal routine and practice when registering obstetrical

4344patients, which includes giving the brochure to the patient and

4354having the patient sign the acknowledg ment form. "Evidence of

4364the routine practice of an organization, whether corroborated or

4373not and regardless of the presence of eyewitnesses, is

4382admissible to prove the conduct of the organization on a

4392particular occasion was in confor mity with routine pra ctice."

4402§ 90.406, Fla. Stat. (2016); see also Tabb , 880 So. 2d at 1259.

4415Nurse LittlesÓ Progress Notes of September 21, 2011 further

4424corroborate the fact that Ms. Price was provided a NICA brochure

4435during that visit and that Ms. Price signed the acknowl edgment

4446form.

444742 . Although Ms. Price denies or otherwise has no current

4458recollection of having been given a NICA brochure at any time

4469during her visits to Shands l abor and d elivery t riage on both

4483April 18, 2012, and May 4, 2012, her signatures on the NICA

4495acknowledgment forms dated April 18, 2012 , and May 4, 2012 ,

4505raise the statutory rebuttable presumption provided by s ection

4514766.316 that she not only received the NICA brochure provided to

4525her on those dates on behalf of both U.F. (physicians) and

4536Shands, but also that the notice requirements of s ection 766.316

4547were met by U.F. (physicians) and Shands. Based upon the

4557totality of the evidence admitted, the undersigned finds by a

4567preponderance of the evidence that the Petitioners have not

4576rebutted the statuto ry presumption.

458143 . In Weeks v. Florida Birth - Related Neurological Injury

4592Compensation Association , 977 So. 2d 616, 618 - 619 (Fla. 5th DCA

46042008), the court stated:

4608[T]he formation of the provider - obstetrical

4615patient relationship is what triggers the

4621obliga tion to furnish the notice. The

4628determination of when this relationship

4633commences is a question of fact. Once the

4641relationship commences, because [section

4645766.316] is silent on the time period within

4653which notice must be furnished, under well -

4661established principles of statutory

4665construction, the law implies that notice

4671must be given within a reasonable time.

4678Burnsed v. Seaboard Coastline R. Co. , 290 So

46862d 13, 19 (Fla. 1974); Concerned Citizens of

4694Putnam County v. St. Johns River Water Mgmt.

4702Dist. , 622 So . 2d 520, 523 (Fla. 5th DCA

47121993). The determination depends on the

4718circumstances, but a central consideration

4723should be whether the patient received the

4730notice in sufficient time to make a

4737meaningful choice of whether to select

4743another provider prior to delivery, which is

4750the primary purpose of the notice

4756requirement.

475744 . Petitioners assert that if NICA brochures were not

4767provided to Ms. Price on the very first instance when she saw

4779Dr. Byun (September 29, 2011), U.F. (physicians) and Shands

4788would not b e in compliance with the NICA notice provisions i n

4801s ection 766.316. The undersigned finds that PetitionersÓ

4809position is unfounded. Although Florida courts use the

4817e stablishment of the physician - patient relationship as an

4827important consideration to determ ine compliance with the

4835statutory NICA notice provision, the date that the relationship

4844is formed merely triggers the starting point upon which to

4854determine if the NICA notice is given within a reasonable time

4865to conform to the NICA notice requirements. T he formation of

4876the physician - patient relationship does not establish a date

4886after which any NICA notice would be unreasonable per se.

4896Although the Fifth District Court of Appeal advised providers in

4906dicta to Ðfurnish the notice at the first opportunity a nd err on

4919the side of caution,Ñ the court did not establish a bright line

4932rule that the NICA notice must be given when the patient first

4944encounters her OB/GYN physician or first encounters the hospital

4953where the delivery takes place. Weeks v. Fla. Birth - R elated

4965Neuro. Injury Comp. AssÓn. , 977 So. 2d 616, 620 (Fla. 5th DCA

49772008). The Fifth District Court of Appeal concluded: ÐIn

4986summary, we hold that the NICA n otice must be given within a

4999reasonable time after the provider - obstetrical relationship

5007begins . . . . Ñ (emphasis added), Id . at 619; see also Galen of

5023Florida v. Braniff , 696 So. 2d 308, 311 (Fla. 1997).

5033Additionally, the court went on to state that Ð[W]hen the

5043patient first becomes an Òobstetrical patient Ó of the provider

5053and what constitutes a Òr easonable timeÓ are issues of fact.Ñ

5064Weeks , 977 So. 2d at 620. The Weeks court noted that the

5076central consideration is whether the timing of the notice

5085provides the patient with a reasonable opportunity to make a

5095meaningful choice of selecting the NICA p articipating provider

5104or a provider who is not a NICA participant.

511345 . The undersigned has found that the NICA brochures on

5124behalf of U . F . (physicians) and Shands were provided to Ms.

5137Price at her first prenatal intake visit at the prenatal clinic,

5148in adv ance of her seeing Dr. Byun for the first time. As reason

5162would dictate, even though Ms. Price did not first see a UF

5174physician until September 29, 2011, and did not present to

5184Shands for obstetrical care until April 18, 2012, it is not

5195unreasonable for t he NICA brochures to have been provided to her

5207on September 21, 2011, in advance of those events. Accordingly,

5217this Court finds that the NICA brochures provided to Ms. Price

5228on September 21, 2011 , on behalf of both U . F . (physicians) and

5242Shands , satisfied the requirements of s ection 766.316 .

525146 . The undersigned further finds that had the NICA

5261brochure not been provided to Ms. Price on behalf of UF

5272(physicians) and Shands on September 21, 2011, the NICA n otice

5283provided to Ms. Price on behalf of U . F . (physic ians) and Shands

5298on April 18, 2012 , was also provided within a reasonable time

5309prior to the delivery of Ms. PriceÓs infant in light of all the

5322circumstances of this case, and thus satisfied the purpose of

5332the NICA notice requirements for U . F . (physicians) and Shands on

5345that date.

534747 . Finally, PetitionersÓ contend that even if the NICA

5357brochures were given to Ms. Price during the September 21, 2011 ,

5368prenatal visit and during her p resentations at Shands on

5378April 18, 2012 , and May 4, 2012, the notice was defi cient

5390because the verbal explanations by Nurse Littles and Ms.

5399Campbell constituted an insufficient verbal explanation of

5406benefits and limitations on liability regarding the NICA p lan.

5416The undersigned finds that there is no requirement in

5425section 766.316 that the health care provider, the hospital, or

5435someone on their behalf verbally explain and counsel patients

5444about such matters regarding the NICA p lan. The Fifth District

5455Court of Appeal has held that the NICA brochure in and of itself

5468satisfies the sta tutory requirement of a "clear and concise

5478explanation of a patient's rights under the plan." Dianderas v.

5488Fla. Birth - Related Neurological , 973 So. 2d 523, 527 (Fla. 5th

5500DCA 2007), see also Jackson v. Florida Birth - Related

5510Neurological , 932 So. 2d 1125, 1 128 (Fla 5th DCA 2006). Any

5522other explanation from the healthcare providers, or from someone

5531on behalf of the healthcare providers, is unnecessary because

5540the NICA brochure provides an adequate explanation of the NICA

5550p lan benefits and limitations.

5555CONCL USION

5557Based on the foregoing Findings of Fact and Conclusions of

5567Law, it is

5570ORDERED:

55711. The claim for compensation filed by Petitioners, under

5580protest, as parents and natural guardians of Aurora Price, a

5590minor , is compensable and is APPROVED. 1/

55972. Inte rvenors complied with the statutory Notice

5605requirements of the NICA p lan pursuant to s ection 766.316.

56163. The p arties are accorded 45 days from the date of this

5629Order to resolve, subject to approval by the Administrative Law

5639Judge, the amount and manner o f payment of an award to the

5652parents, reasonable expenses incurred with the filing of the

5661claim, including reasonable attorneysÓ fees, and the amount

5669owing for expenses previously incurred and future expenses to be

5679incurred. If not resolved within such pe riod, the parties shall

5690advise the Administrative Law Judge, and a hearing will be

5700scheduled to address these remaining issues.
