54This cause came on for consideration upon a Motion for
64Summary Final Order filed by Respondent, Flo rida Birth - Related

86STATEMENT OF THE CASE
90On November 10 , 201 4 , Petitioners, Betty D. Jernigan and
100Carlos Santiago , i ndividually and on behalf of Kelia Santiago
110( Kelia ), a minor, filed a Petition Under Protest Pursuant to
122Florida Statutes Section 766.301 et seq. (Petition) with the
131Division of Administrative Hearings (DOAH) for a determination of
140compensability under the Florida Birth - Related Neurological
148Injury Compensation Plan (Plan) . The Petition named
156Erich Wyckoff , M.D., as the physician who provided obstetric
165services for the birth of Kelia . The Petition stated that Kelia
177was born at Tampa General Hospital in Tampa , Florida.
186DOAH served NICA with a copy of the Petition on Novemb er 1 4 ,
200201 4 . DOAH received a return receipt from the United States
212Postal Service on November 19, 2014, showing that Tampa General
222Hospital had been served with a copy of the Petition. DOAH
233served a cop y of the Petition on Dr. Wyckoff on November 20,
246201 4.
248On December 11, 2014, Dr. Erich Wyckoff filed a Motion to
259Intervene, which was granted by Order dated December 19, 2014.
269As of the date of the Summary Final Order of Dismissal , Tampa
281General Hospital has not petitioned to intervene in this
290proceeding .
292On January 8 , 201 5 , NICA filed a Motion for Summary Final
304Order, requesting that a s ummary f inal o rder be entered finding
317that the claim was not compensable because Kelia did not meet the
329requisite minimum statutory birth weight as required by section
33876 6.302(2), Florida Statutes . As of the date of this Summary
350Final Order of Dismissal, no response to the Motion for Summary
361Final Order has been filed . On January 20, 2015, Respondent
372filed a Response to Order of January 8, 2015, and represented
383that Peti tioners and Intervenor agreed with NICA that there is no
395need for a hearing in this matter. It is noted that the Petition
408Under Protest requests a determination that KeliaÓs injuries be
417determined to be non - compensable under the Plan.
426FINDINGS OF FACT
4291. Kelia Santiago was born on October 25 , 2 011 , at Tampa
441General Hospital in Tampa , Florida. Sh e was a single gestation.
4522. Donald Willis, M.D. (Dr. Willis), was requested by NICA
462to review the medical records for Ke l i a. In a report dated
476December 11 , 2014, Dr. Willis described his findings in pertinent
486part as follows:
489Birth weight was reported as 2210 grams and
4972201 grams in different sites in the motherÓs
505medical records. Apgar scores were not
511given. Cord blood pH was normal at 7.29.
519No records we re available from the NICU for
528review.
529* * *
532In summary, there was no fetal distress
539during labor. Delivery was by repeat
545Cesarean section with normal blood gas.
551Birth weight was <2,500 grams.="" nicu="">2,500>
554were not available for review.
559This baby w as born prematurely due to
567premature rupture of the membranes. Birth
573weight appears to be less than 2,500 grams.
582There was no apparent obstetrical event that
589resulted in loss of oxygen or mechanical
596trauma to the babyÓs brain during labor or
604delivery. N ICU records were not available,
611so I have no comment about oxygen deprivation
619in the post delivery period. Birth weight
626was <2,500>2,500>
6273. In an affidavit dated January 7, 2015, Dr. Willis
637reaffirmed his opinion that t here was no apparent obstetrical
647event that resulted in loss of oxygen or mechanical trauma to the
659babyÓs brain during labor or delivery , and his review of the
670medical records revealed that the birth weight was less than
6802,500 grams.
6834. A review of the file reveals that no contrary evide nce
695was presented to dispute Dr. WillisÓ finding that KeliaÓs birth
705weight was less than 2,500 grams, or his opinion that there was
718no apparent obstetrical event that resulted in loss of oxygen or
729mechanical trauma to the brain during labor or delivery.
738D r. WillisÓ opinion is credited.
744CONCLUSIONS OF LAW
7475 . The Division of Administrative Hearings has jurisdiction
756over the parties to and the subject matter of these proceedings.
767§§ 766.301 - 766.316, Fla. Stat.
7736 . The Plan was established by the Legislatu re "for the
785purpose of providing compensation, irrespective of fault, for
793birth - related neurological injury claims" relating to births
802occurring on or after January 1, 1989. § 766.303(1), Fla. Stat.
8137 . The injured infant, her or his personal representati ve,
824parents, dependents, and next of kin may seek compensation under
834the Plan by filing a claim for compensation with DOAH.
844§§ 766.302(3), 766.303(2), and 766.305(1), Fla. Stat. NICA,
852which administers the Plan, has "45 days from the date of servi ce
865of a complete claim . . . in which to file a response to the
880petition and to submit relevant written information relating to
889the issue of whether the injury is a birth - related neurological
901injury." § 766.305(4), Fla. Stat.
9068 . NICA has determined tha t Petitioners do not have a claim
919that is compensable under the Plan and has filed a Motion for
931Summary Final Order, requesting that an order be entered finding
941that the claim is not compensable.
9479 . In ruling on the motion, the Administrative Law Judge
958mu st make the following determination based upon the available
968evidence:
969(a) Whether the injury claimed is a birth -
978related neurological injury. If the claimant
984has demonstrated, to the satisfaction of the
991administrative law judge, that the infant has
998susta ined a brain or spinal cord injury
1006caused by oxygen deprivation or mechanical
1012injury and that the infant was thereby
1019rendered permanently and substantially
1023mentally and physically impaired, a
1028rebuttable presumption shall arise that the
1034injury is a birth - re lated neurological injury
1043as defined in s. 766.303(2).
1048§ 766.309(1), Fla. Stat.
105210 . The term "birth - related neurological injury" is defined
1063in section 766.302(2) as follows:
"1068Birth - related neurological injury" means
1074injury to the brain or spinal cord of a live
1084infant weighing at least 2,500 grams for a
1093single gestation or, in the case of a
1101multiple gestation, a live infant weighing at
1108least 2,000 grams at birth caused by oxygen
1117deprivation or mechanical injury occurring in
1123the course of labor, deliver y, or
1130resuscitation in the immediate postdelivery
1135period in a hospital, which renders the
1142infant permanently and substantially mentally
1147and physically impaired.
115011 . The evidence, which is not refuted, established that
1160Kelia was a single gestation and di d not weigh at least 2,500
1174grams at birth. Thus, Kelia did not sustain a birth - related
1186neurological injury because s he did not meet the minimum
1196statutory weight as set forth in the definition of "birth - related
1208neurological injury," in section 766.302(2).
1213CONCLUSION
1214Based upon the foregoing Findings of Fact and Conclusions of
1224Law, it is ORDERED that the Petition filed by Betty D. Jernigan
1236and Carlos Santiago , individually and on behalf of
1244Kelia Santiago , a minor, is dismissed with prejudice.
